3 ADVERTISEMENT FOR BIDS GENERAL CONTRACTOR Cheboygan County Animal Shelter Building 1536 East Hackleburg Road is accepting material and labor proposals for the General Contractor at the Storage building Addition. The County can reject all or any portion of the bids. General Contractors must notify The Architect Forum by 5:00 P.M. the Friday prior to bid opening of intent to submit bid. If Contractor fails to notify The Architect Forum of intent than the contractors bid may be rejected. Bids are due 2:00 p.m. local time, August 30th, 2016 at the office of: The Cheboygan County Administrator Office 870 South Main Street In a sealed envelope marked Animal Shelter Kennels General Contractor. The bids will be opened at the office of the Cheboygan County Administrator, at 2:10 P.M. August 30th, Contract will be awarded after bid qualification is complete. Cashier s Check for the sum of 5% of the bid. Will be returned upon execution of AIA A101 Agreement between Owner and Contractor. A Performance, and Payment bond will be required for this contract. The County reserves the right to reject any or all bids, to waive irregularities in the bid, or to select other than the low bid, as may be in the best interest of the County. Copies of the plans and specifications will be available at the office of the Architect, Call ahead for prints. Plans are $75.00 per set nonrefundable with a $10.00 mailing fee

4 GENERAL CONTRACTOR SCOPE OF WORK Work shall consist of furnishing all material & labor, to perform the following, but is not limited to he following bid components: 1. New Kennel wing Demolition and construction. 2. Demolition of interior walls and floor. 3. Rebuild and remodel of existing space. Demolition of existing kennels including removal of footings, foundations, slab, plumbing, electrical, walls, and roof. Additional demolition of existing slab and gabled end wall on existing main building as noted in plans. Furnish materials and labor for the addition of the new kennels wing and remodel of a portion of the existing main building. Demolition of concrete slab and drains, interior doors, electrical, plumbing and mechanical in old garage area. Furnish material and labor to construct connection structure with door between Lost and Found Kennel building and new Isolation Kennel Area. Concrete slab and foundation to include all floor drainage systems including piping and connection to existing waste sanitary system. WORK SCHEDULE HOURS of work are as determined by the General Contractor to ensure timely completion of this project. START AND COMPLETION DATES & LATE FEES BID AWARD: September 13 th, Commissioners Meeting START DATE: To be identified by contractor. SUBSTANTIAL COMPLETION: Contractor to provide schedule. FINAL COMPLETION: By May 31, INSURANCE GENERAL LIABILITY INSURANCE: $1,000, WORKMAN S COMPENSATION: Current State of Michigan Requirements. BID SECURITY: Cashier s Check for the sum of 5% of the bid. Will be returned upon execution of AIA A101 Agreement between Owner and Contractor. PERFORMANCE AND PAYMENT BOND: IS Required. All pay requests will have 10% retainage until Final Pay Request. DESIGNATED SUBCONTRACTORS - 4 -

5 WORK SEQUENCE Coordinate construction schedule and operations with the Construction Manager, The Architect Forum PENALTY Penalty fee of $ per day, will be assessed for each day the project extends beyond the agreed upon final completion date, unless the delay is caused by conditions beyond the contractor s control, or an agreed time extension by Owner, Contractor, and Architect. RETAINAGE A retainage of 10% of material and labor will be withheld until final completion. PROJECT COORDINATION The project coordinator is THE ARCHITECT FORUM. The Contractor shall cooperate with the Project Coordinator in allocation of mobilization areas of the site; filed offices and sheds, for continued use of the existing building, traffic and parking areas. The Contractor shall coordinate field engineering and layout work with the Project Coordinator. The Contractor shall make the following submittals to THE ARCHITECT FORUM: 1. Request for interpretation. 2. Requests for substitutions. 3. Shop Drawings, product data, and samples. 4. Test and Inspections. 5. Manufacturer s instructions and field reports. 6. Applications for Payments. And change order requests. 7. Coordination drawings. 8. Closeout submittals. SUBMITTALS Submit to the OWNER one set of maintenance information and operating instructions for all equipment, systems, lights, doors and other hardware and major building elements that will require maintenance and/or replacement. Provide a list of Subcontractors with address and telephone numbers. ARTICLE 7 - CIVIL RIGHT ACTS COVENANT The contractor must comply with the requirements of 1976 PA 453 (Elliott-Larsen Civil Rights Act) and 1976 PA 220 (Persons with Disabilities Civil Rights Act), as amended. Contractor and his sub-contractors agree not to discriminate against an employee or applicant for employment with respect to hire, tenure, terms, conditions, or privileges of employment, or a matter directly or indirectly related to employment, because of race, color, religion, natural origin, age, sex, height, weight, marital status or a disability that is unrelated to the individual s ability to perform the duties of a particular job or position. A breach of this covenant will be considered as a material breach of the contract

Box 548 Mackinaw City, MI Phone (231) Fax (508) archforum@sbcglobal.net PROPOSAL FROM: (hereinafter called the bidder) The Bidder, in compliance with the Invitation to Bids for: Cheboygan County Animal Shelter Phase II-Part 2 Having familiarized themselves with the conditions affecting the cost of the work and with all requirements of the contract documents as prepared by the Architect, and all addenda to said documents, hereby proposes to furnish all labor, materials, and supplies unless otherwise specifically stated, and to construct the project in accordance with the Contract Documents, within the time set forth therein, and at the price stated below. These prices are to cover all expenses incurred in performing the work required under the Contract Documents, of which this proposal is a part. COMPONENT PRICING FOR LABOR AND MATERIALS AS DESCRIBED IN SCOPE OF WORK: (include all applicable sales tax) Component 1 pricing for new kennel wing demolition and rebuild $ DOLLARS $ Component 2 pricing for demolition of interior walls, concrete slab, plumbing, mechanical and electrical systems of existing kennels. $ DOLLARS $ Component 3 pricing for rebuild floor, plumbing and interior walls and finishes of exiting space. $ DOLLARS $ - 6 -

THE COUNTY RESERVES THE RIGHT TO DISQUALIFY ANY SUBCONTRACTOR. The subcontractors designated on an attached sheet marked as SUBCONTRACTORS, will be employed by the Contractor. 9 SECTION GENERAL CONDITIONS LIABILITY The CONTRACTOR and SUB-CONTRACTORS shall provide and maintain during the term of this project public liability, property damage, and workers compensation insurance insuring, as they may appear, the interests of the parties during the construction against any and all claims which may arise. WAIVER OF LIEN The CONTRACTOR shall supply to the OWNER partial conditional waiver of liens from all parties supplying labor and/or materials for the construction of this project prior to request of second payment, and partial unconditional waivers prior to subsequent payments, waivers shall be for prior payment, and shall supply full unconditional waiver of liens prior to request of final payment. PERMITS It shall be the responsibility of the CONTRACTOR to pay for and secure all construction permits. The CONTRACTOR shall schedule all necessary inspections. HOLD HARMLESS The OWNER shall not be liable for any loss, damage, or injury resulting from actions taken during the construction of this project. LIQUIDATED DAMAGES Liquidated damages of $ per day will be assessed for each day the project extends beyond the agreed upon final completion date, unless the delay is caused by conditions beyond the contractor s control. ACCEPTANCE OF PROCEEDING WORK Before starting any operation, the CONTRACTOR shall examine work performed by others to which his work adjoins or is applied and shall report to the ARCHITECT any conditions that will prevent satisfactory accomplishment of his work. Failure to notify the ARCHITECT of deficiencies or faults in proceeding work will constitute acceptance thereof and waiver any claims of its unsuitability. ALTERNATES Whenever in the construction drawings materials are indicated by trade name or catalogue number of certain manufactures, it is done for the express purpose of establishing a standard of quality and design, and not to limit the competition. All materials and equipment furnished shall be equal in quality and capacity to that specified and harmonious in design. All alternates must be preapproved in the bidding process. WARRANTIES Submit all written guarantees, bonds, affidavits required to the OWNER prior to final payment. Guarantee shall extend full period of the required guarantee period. USE OF SITE The contractors use of the site shall be limited to those areas indicated on the drawings. The site usage shall allow for the use of Cheboygan County s normal activities. WORK SEQUENCE Coordinate construction schedule and operations with the Owner and The Architect Forum. RETAINAGE A retainage of 10% of the completed labor and purchased material will be withheld until final completion

10 CLEAN-UP AND SECURITY Each CONTRACTOR is responsible for keeping the premises free of surplus materials and rubbish resulting from daily operations. Provide a temporary construction fence around all work of this project, as required, to restrict access to the construction site to authorized parties only. PROJECT COORDINATION The project coordinator is THE ARCHITECT FORUM. The Contractor shall cooperate with the Project Coordinator in allocation of mobilization areas of the site; filed offices and sheds, for continued use of the existing building, traffic and parking areas. The Contractor shall coordinate field engineering and layout work with the Project Coordinator. The Contractor shall make the following submittals to THE ARCHITECT FORUM: 9. Applications for Payments. And change order requests. 15. Coordination drawings. 16. Closeout submittals. SUBMITTALS Submit to the OWNER one set of maintenance information and operating instructions for all systems, and major building elements that will require maintenance and/or replacement as part of this contract. Provide a list of Subcontractors with address and telephone numbers. PROCEDURE FOR SPECIFICATION CHANGE Plans and specification documents will be negotiated and specified at the time of contract signing. Any later changes must be in writing and be signed by both OWNER and CONTRACTOR, or their authorized agents, in accordance with the following procedure. Changes may be initiated by either the owner or the contractor by presenting the other with a PROPOSED CHANGE LETTER. That letter must specify in detail the exact change desired and the reason for the change and the date on which it is proposed. If initiated by the contractor, when presented to the owner, the letter shall indicate the project dollar cost adder or subcontractor, if any, as well as the effect upon the scheduled project completion date, if any, and be signed and dated by the contractor. If the owner approves the change, he will sign and date the letter and return a copy to the contractor, at which time it will become a CHANGE ORDER. If initiated by the owner, when presented to the contractor, without owner signature, the letter shall provide space for the contractor to indicate project dollar cost adder or sub tractor, if any, as well as the effect upon project completion date, if any. Contractor shall fill in those amounts, sign and date the letter and forward a copy back to the owner. If owner then signs and dates the letter and returns it to the contractor, it will become a CHANGE ORDER. The parties are cautioned, no PROPOSED CHANGE LETTER will become a CHANGE ORDER, a binding contract amendment document, unless and until signed and dated by BOTH owner and contractor. Nothing in this procedure shall bar the open and free discussion and/or negotiation of proposed changes between the parties. It merely stipulates the procedures for documenting such changes. In general, it is expected that the contractor will accept any changes proposed by the owner, but contractor may stipulate cost and schedule adjustments, acceptable to the contractor. The owner

11 may then find those factors acceptable and order the change or the owner may drop the proposed change. The owner may or may not accept any changes proposed by the contractor. If not accepted, the plans and specifications in effect at the time of contract award, as modified by subsequent CHANGE ORDERS, shall govern the project. Proposed changes affecting the structural or life safety features of the building shall require prior approval from the architect. PROPOSED SPECIFICATION CHANGE The contractor shall submit a Specification Change printed on AIA Form G701 Change Order, Contractor s standard form. Submit the Change Order to The Architect Forum for processing. The change does not take effect until all parties have signed and agreed to AIA Form G701- Change Order. SCHEDULE OF VALUES SECTION PRICE AND PAYMENT PROCEDURES The contractor shall submit a schedule of values printed on AIA Form G703 Application and Certificate for Payment Continuation Sheet, Contractor s standard form. Submit the Schedule of Values in duplicate within 15 days after date of Owner-Contractor Agreement. Include in each line item, amount of Allowances specified for payment. Revise schedule to list approved Change Orders with each Application for Payment. APPLICATIONS FOR PROGRESS PAYMENTS Payment period: Submit at intervals stipulated in the Agreement. The contractor shall present the required information in typewritten form. The contractor shall use AIA Form G702 Application and Certificate for Payment and AIA Form G703 Continuation Sheet including continuation sheets when required. The Certificates shall be executed by signature of authorized officer and submit three copies of each Application for Payment. RETAINAGE A retainage of 10% of material and labor will be withheld until final completion. SUBMITTALS CLOSEOUT SUBMITTALS The Contractor shall submit the following to THE ARCHITECT FORUM along with the application for final payment: 1. Project record documents including Drawings, Specifications, Addenda, Change Order Requests, Reviewed shop Drawings, Manufacturer s instructions for assembly, installation and adjusting. 2. Warranties. 3. Operation and Maintenance Date for Materials and Finishes. 4. Operation and Maintenance Data for Equipment and systems.
