There, PS&B represented the family of Jose Vega who was killed on the 101 freeway by a wrong way driver employed by Verizon. The Verizon driver was a diabetic and was experiencing a hypoglycemic episode at the time of the collision. The $7 million settlement was achieved on the eve of trial, with PS&B poised to prove that Verizon was aware of the driver s medical condition and did nothing to protect the public from the safety issues it presented, especially when the employee was driving. 14 COVER Spotlight Shernoff Bidart Echeverria On The Ins and Outs of Insurance Law Think about the last time you purchased an insurance policy. Did you read it thoroughly and negotiate with the insurance company to get a policy that met your needs? No one does, says Michael J. Bidart, senior and managing partner of Shernoff Bidart Echeverria LLP. You get insurance because you have to. You fill out the paperwork, send in your money and then they send you a policy. You put it away and pray to God that you never have to use it. When most people purchase a product, they intend to consume it or obtain some benefit from it. But the opposite is true for insurance. Bidart believes that no industry exists where the playing field is more uneven for consumers than in the world of insurance. Insurance companies have all the resources, they draft the policies the way they want them and give them to consumers on a take-it-or-leave-it basis, he says. Insurance is supposed to give you peace of mind that you will be protected when things go wrong but sometimes the unthinkable happens. A mother was horrified to find out that her son, a Little League coach, abused a minor in her home when she was not present. As if the revelation of the allegations wasn t devastating enough, counsel for the plaintiff argued that the acts occurred as a result of woman s negligent supervision. The woman s homeowner s insurance included liability coverage to defend her for personal injury or property damages arising from occurrences at her home, but the company denied her coverage in relation to the case. Bidart represented the woman in court. Insurance companies have all the resources, they draft the policies the way they want them and give them to consumers on a take-it-or-leave-it basis. Michael J. Shernoff, the founding senior partner of Shernoff Bidart Echeverria is known as the pioneer of bad faith law. A bulk of his practice involves rescission cases in which insurers cancel policyholders coverage after they become injured, sick or hospitalized. One day after a woman underwent a gallbladder surgery, she had to return to the hospital due to a collapsed lung. The woman s insurance provider rescinded her policy and refused to pay her medical bills, saying that she did not provide complete and accurate information on her application. Shernoff represented the woman in her complaint against the insurance company. The court ruled that the insurance company failed to conduct a reasonable underwriting investigation and was still obligated to honor her policy. If they rescind the policy, the companies get out of paying not only those bills, but also ongoing treatment the policyholder may need, Shernoff says Amy Cantrell The court opined that the mother would have reasonably expected her insurance policy to cover her separately for her independent acts or omissions causing injury or damage. The insurance company had to honor the policy that the woman purchased. We prevailed for the mother who was the insured; she didn t have anything to do with the harming of the child, Bidart says. My generation was the first to understand you can be feminine and still command respect. What we also learned is that although we thought we could have it all, sacrifice is unavoidable, she said. 24 COVER Spotlight Brian Panish on How a Football Background Helped Him Prepare for his 18-Year Win Streak Amy Cantrell The last time prominent plaintiff s attorney Brian Panish lost a case, the Internet was something only the government had access to, Nirvana was topping the album charts, and the eldest George Bush was trying to force Iraq to disarm, just a year after the first Gulf War. One hundred-plus victories later what does Panish owe his 18-year consecutive win streak to? I think just having deserving clients is most important, in that when you have someone that s deserving, then no matter where you are, people generally get it right and follow the evidence, Panish says, knocking on wood as he speaks. Despite all of the attacks on the jury system, the jurors usually get it right. My dad always said that if a lawyer tells you they ve never lost, they haven t really tried a lot of cases. So I try to keep that in mind. The son of a successful trial lawyer, because of the the AV-rated Panish, who describes himself as a fierce competitor, grew competitiveness up in the Los Angeles area and played of it, because football, basketball and baseball in high school, where he still holds the trials are several single season records. Upon like games. graduation, Fresno State offered him a football scholarship; he played free Brian Panish safety for the school, and later, worked as a football coach for an all boys school while attending law school. I m a competitor and all of my life, I ve had to kind of dial it back and realize, you don t always have to win. In order to be successful, the weaker players have to become better players, and that makes the team better, Panish, a frequent lecturer on trial practice and a Master with the American Inns of Court, says. And at a law firm and in lawyers, it is the same thing. It is a team and the key is getting the talented people on the team and then developing them. That has been part of our strategy as a law firm; we have a lot of great young people who have grown with us, and gotten the opportunity to get the training and experience, which is hard to get in our field. Panish has secured several multimillion and multibillion-dollar awards for his clients. Only four times in California s legal history has a jury awarded more than $50 million in compensatory damages and compensatory damages alone; Panish was on the winning side of three of those cases. Despite everything, Panish, who rose through the ranks from associate to partner, and later started his own firm in 2005, is humble. The man doesn t brag about his successes, not even when implored to. I let my record speak for me, he says. We have passion for what we do. Just to get to the trial, you have to fight off all the motions, but once you get to the jury, you have to be able to take the most complex things and bring them down to a level where everyone can understand it and relate to the story of what really happened. Panish says the most rewarding aspect of this profession has to be the work he s done for his clients. Winning is nice too, but being able to do something for the clients, and when the clients, they realize everything that you have done for them, they re so appreciative and you know that you ve made their life better, he says. There are so many people out there that we ve made their life better and we ve made products safer. 28 COVER Spotlight Thomas Girardi s Class Action Win Insurance Provider to Pay Class Action Members in Settlement About 13 million consumers nationwide will soon receive compensation for excessive fees paid to their insurance provider. Some have been waiting for more than a decade. In October, a major insurance company agreed to pay $455 million to settle a class action suit that claimed that the insurance management firm charged excessive management service fees to policyholders. While the company says that the claims are without basis, they agreed to settle in order to end the seven-year case. We had the leading chromium expert in the world come and evaluate the area, and he found unbelievable amounts of chromium in the community, Girardi says. A local tannery has provided the fertilizer free of charge to local farmers since Thomas V. Girardi of Los Angeles law firm Girardi Keese, helped negotiate the settlement, and says that qualifying class members are expected to receive around $35 each. The insurance company s corporate parent company is paying the settlement to The class action s lead plaintiff bought policies from three individual health insurance exchanges, which are cooperatives that contract with private insurers. The exchanges take a percentage of the premiums they receive, and use it to pay management fees to the insurance company. After the story hit the newsstands, the company s leadership instructed staff to destroy certain company documents, but one employee became nervous and notified the authorities, Girardi says. A document was discovered that showed that the company saved money by mixing chromium with fertilizer and giving it to the farmers rather than paying for it to be disposed of offsite, Girardi says. The Missouri case is still in progress. Girardi made headlines after securing a $333 million settlement for 650 California residents in a toxic tort case made famous by the film Erin Brokovich. Similar to the Missouri case, a company knowingly dumped millions of gallons of chromium 6 to save money. The chemical poisoned the groundwater and led to sickness and death among residents. Amy Cantrell In response to the case and settlement, the corporate parent company will be offering additional disclosures to exchange policyholder subscribers. Agents and employees will also receive subscription agreement and procedure training. One of the key reasons that a resolution was achieved is due to the mediation efforts of Judge Daniel Weinstein, a retired Superior Court judge, Girardi says. He was persuasive with both the higher-ups at the company, and persuasive with us, too, in terms of working with our expectations. Girardi calls his opposing counsel spectacular and says that that the case was complex and challenging. Girardi had no time to rest after this settlement. He was asked to assist in a case involving a small Missouri town that began seeing a rise in cancer and brain tumors among residents. The increase is believed to be related to fertilizer that is used on surrounding farms that contains significant levels of chromium 6, a known carcinogen. It was the second million-dollar verdict in California and the first million-dollar verdict in a malpractice case. Girardi says that s he is especially proud of the team he has built over the years. Our firm has a good reputation for decency. If the other side doesn t do something that they should be doing, such as providing documents, you can file a motion to get the documents and then you can also file a motion to give sanctions against the other side, Girardi says. Our law firm has never asked for monetary sanctions. There aren t too many law firms that can say that. Girardi must be doing something right because employee turn-over is next to nothing. He has only had two secretaries in 44-years of practice. Two of our secretaries started here when they were just 18, and now they re 42, he says. Once you join our firm, you re here for life. Grassini Grassini & Wrinkle Personal Injury Litigation The first time Lawrence Grassini was even in a court room was as a young lawyer, on the job for just over a week; he was sent by his boss to pick his first jury. Grassini has since gone on to secure a number of landmark, multimillion-dollar punitive damages awards for his clients over the course of his more than 40-year career. All this success, and Grassini never thought personal injury cases would end up being his life s work. My first boss literally said to me, Come on, let s go out for lunch, and I ll tell you how to pick a jury, Grassini, who was born in 1945 in Flushing, Queens, recalls, So I tried it for a week, and won, very surprisingly. He called Grassini into the office after his win, and greeted Grassini back at the office with a cupcake, stuck in the middle with a lit candle. After finishing his clerkship and getting some trial experience under his belt, the St. Bonaventure University graduate, who earned his JD from the Columbus School of Law at Catholic University of America in Washington, DC, joined forces with Roland Winkle in 1976 to launch his own practice. Today, Grassini s daughter Katie, one of his five children with his wife Sharon, works side-by-side with him. David Noonan graduated from Colby College where he was a linebacker for the school s football team in 1969 and earned his JD three years later from Syracuse University. As an undergrad, he became extremely interested in the development of common law, and followed some rather highprofile trials, including those of The Chicago Seven and Sirhan Sirhan.
