1 Dear friends, Traditionally, the Soros Foundation Kyrgyzstan prepares an annual report at the end of the year in accordance with principles of openness and transparency it follows in its operations year was uneasy for Kyrgyzstan. It was marked by a series of political events that brought the country to a new stage in its development. Efforts of the state and public organizations in stabilization of the situation and further promotion of democracy principles and development of civil society institutions have become one of the main areas of democratic transformations. That uneasy time, the Soros Foundation Kyrgyzstan remained loyal to its mission supporting initiatives targeted at improvement of life of citizens of Kyrgyzstan and realization of their civic rights and freedoms. The past year was the year of development of a new strategy for the Soros Foundation Kyrgyzstan with development of public policy formats and policy, civil society principles, observance of human rights as top priorities. At the same time, support of initiatives of the civil communities across the country is of crucial importance for the Foundation. A number of successful and significant projects were implemented with support of the Soros Foundation Kyrgyzstan in partnership with all interested stakeholders. Those projects might be considered a positive example that characterizes the level of maturity of our society and preparedness to further follow principles built upon right of every individual to decent life in the surrounding world. Accomplishments of the Soros Foundation Kyrgyzstan would be impossible without support and cooperation of all partners, donors and grantees of the Foundation whom I would like to thank on behalf of the Foundation. 3 The past year was not that easy for Kyrgyzstan. The spring events made us not only reflect over the country future but start resolving problems encountered by Kyrgyzstan. The Soros Foundation Kyrgyzstan was not an exception. The first days followed after March 24, the Foundation tried to respond to emerging crisis situations in the soonest possible way. The Foundation supported initiatives of NGOs and activists in bringing the country back to peace. Thus, the information center operated at the municipal council of Bishkek that provided timely information on the recent developments in the capital city. A free legal aid was provided to businessmen and entrepreneurs affected by looting. The public service announcements advocating tolerance and peace within the country were broadcast by TV channels. The Foundation supported production of immediate news reports on situation in the southern parts of Kyrgyzstan and in Bishkek for TV channels across the country. Eleven project proposals of NGOs to stabilize situation in the regions of the country were supported. Over 46 million US dollars were received by the country on a gratuitous basis for 12 years of the Foundation operation March events required to reflect on the situation. It was necessary to understand and to realize what had happened so that to move further. A series of forums held for representatives of NGOs, media, education and ethnic spheres pursued that goal. The socio-political processes that took place in the country demanded a wide involvement of the civil society. This is why the Foundation facilitated public discussions of the constitutional reform, mid-term developmental strategy of Kyrgyzstan, economic growth strategy and the need for governmental media reform. Besides, the Foundation supported development of short-term stabilization programs that are posted on the web-site of the Open Kyrgyzstan project To ensure transparent presidential elections, the Foundation supported initiatives aimed at involvement of the civil society into operations of the election commissions at polling stations. Besides, migrant laborers in Russia were provided the chance to take part in the poll.

Through its programs the Foundation was active in development of economic policy, human rights advocacy, enhancing transparency of the national budget, development of modern approaches to multicultural ethnic development and gender policy, agreeing interests in ICT sector, harm reduction from drug abuse, upgrading teachers professionalism, establishing social partnership between schools and local communities, effective media management, etc. Budget by Programs (USD)

Mamaev, The program mission is to shape civic-mindedness and to develop the civil society as the main factor necessary for building an open society. The non-governmental sector plays a crucial role in all spheres of social development in Kyrgyzstan. Development programs in education, law, health care, culture, art, business, information are the main aspects in operation of various public organizations that mobilize the local community, strengthen the internal capacity of the country and attract resources of donor agencies into various social spheres and thus contribute to the overall development of the country. Since the beginning of its work in Kyrgyzstan the Soros Foundation Kyrgyzstan supports nongovernmental organizations through training programs that aim to build the capacity of NGOs in institutional and organizational management, fostering inter-sectoral interaction, and providing grants necessary for implementation of the projects in the sphere of social development of the country. The program promotes institutional sustainability of NGOs; supports initiatives to resolve issues in socioeconomic, socio-cultural, and legal spheres; facilitates interaction between NGOs, state agencies and commercial organizations for the sake of building an open democratic society. CIVIC INITIATIVES ON STABILIZATION AND DEVELOPMENT OF REGIONS OF KYRGYZSTAN The goal: to support initiatives from institutes of the civil society that are targeted at stabilization and development of the regions of Kyrgyzstan. The project Involvement of the Rural Population into the Constitutional Reform. The goal: to involve the population in 16 remote villages of Chui oblast into discussion of the new draft of the Constitution and development of proposals on introduction of amendments and additions to the Constitution by organizing two round table discussions and 16 extended seminars (for 30 participants for every seminar) with engagement of local activists: members of village councils, local government officials, teachers, health care professionals, elderly people s courts, NGOs, self-help groups and other interested stakeholders. The goal: to propose mechanisms for establishing partnership between energy producers and users and other stakeholders in the sphere of regulation of energy tariffs. INDEPENDENT APPRAISAL OF QUALITY OF GOVERNMENTAL SERVICES IN ISSUANCE OF LICENSES Winners The goal: to strengthen the capacity and encourage efforts of NGOs in monitoring the state agencies operations in the sphere that were not analyzed and appraised by the civil society and that are of critical importance for the further development of democracy in the country.

The goal: to evaluate effectiveness of the regulative framework within operation of executive bodies and their offices related to issuance of licenses to the population. The goal: to evaluate the quality of the State Agency for Architecture and Construction under the Kyrgyz Government, municipal and rayon departments of architecture and construction in issuance of licenses for construction, design, reconstruction and restoration of objects. PUBLIC DISCUSSIONS OF CONSTITUTIONAL REFORM PROJECT SEMINARS The goal: to promote a wide public involvement into constitutional reform. The project supported comprehensive events aimed to involve a wide public into discussion of the constitutional reform. A series of round tables and meetings on constitutional reform related issues were organized in all parts of the country. The recommendations made by participants of the events were proposed to the Constitutional Consulting Board. The electronic digest of media materials on constitutional reform was distributed to ensure a wide information campaign of the constitutional reform progress. Besides, the technical assistance was provided to Secretariat of the Constitutional Consulting Board. A number of groups approached the Foundation with initiative to produce alternative amendments and additions to separate paragraphs of the Constitution, in particular, the paragraphs regulating human rights and judicial power. Objectives: to summarize outcomes of the project, to reinforce communication skills of the civil society support centers and partnership NGOs, to identify a role and place of project participants in further efforts on promotion of democracy at the grassroots level. $ 12,121* * Hand-outs, transportation, meals, accommodation, salaries to lecturers. 10 ETHNIC DEVELOPMENT PROGRAM Program Coordinator Nurgul Asylbekova, Program Assistant Mirlan Mulkubatov, The program mission is to build an open, democratic and multicultural society in the Kyrgyz Republic with harmonious inter-ethnic relations. Program Areas in 2005 Development of a strategic approach to ethnic sphere administration in Kyrgyzstan and facilitation in formation of ethnic development subjects (performing analysis prior to taking ethnic related decisions, expanding types of activities of various organizations, increasing responsibility and willingness to partnership, using strategic approach in their own activities, etc.). Partnership interaction and pooling of resources (interaction of all societal sectors aimed at ethnic development and attraction of new technologies and investments, expanding opportunities for general development through pooling and joint use of available resources, etc.). Shaping an environment to facilitate formation of subjects and expansion of ethnic development processes (expanding platforms of real and virtual nature aimed for communication between ethnic development subjects, enhancing opportunities and a range of participants in discussion of urgent problems; creation of conditions necessary for initiating and implementing joint projects, etc.). The following activities were implemented under the Program in 2005: 1. Operational projects that facilitated implementation of strategic approaches to ethnic sphere administration through shaping the ethnic development environment, formation of ethnic subjects and search of tools and mechanisms for promotion of principles of the Ethnic Development Conceptual Framework of the Kyrgyz Republic. 2. Information & communication activities that aimed to foster interaction between various societal sectors and ethnic groups along with monitoring of implemented projects and their outcomes (i.e. produced program documents) by civil society. 3. Grant support for projects of public associations, national & cultural centers, mass media and state agencies targeted at expanding opportunities of interethnic and intercultural relations and cooperation which facilitate implementation of the program strategy. 4. Support of the Ethnic Development web-site. 5. Monitoring & evaluation of the program and its integral parts. Accomplishments Two analytical documents on approaches to the ethnic policy development in Kyrgyzstan and instruments of consolidation of ethnic groups and local government bodies have been developed and discussed. A Draft Program on multilingual and multicultural education in Kyrgyzstan has been developed and discussed. Five project proposals of NGOs and state agencies on promotion of principles of ethnic development in multicultural environment of Kyrgyzstan were supported. A web-site was developed to accumulate information in the field of ethnic development. A range of partner organizations has been expanded; ideas and views on fundamentals, methods and principles of work in ethnic field and network interaction have been developed and agreed on. A community of humanities professors and researchers has been set up to promote critical thinking and analysis of different approaches to ethnicity and nationalism theories. Financial Information

11 ACTIVITIES AIMED AT STABILIZATION OF THE SITUATION March 26 28, Round Table Discussions in Osh and Jalal-Abad oblasts. Goal: to analyze situation in ethnic field after the March events, to discuss efforts on stabilization of the situation and prevention of tension in interethnic relations. Attended by representatives of national & cultural centers, oblast affiliates of the Kyrgyzstan People s Assembly (KPA) and oblast administrations. $ 400* * Travel expenses, lodging and accommodation. March 30, The Civil Forum Kyrgyzstan is a Peace Territory. Goal: to analyze potential risks of impact of the current situation on interethnic relations and development of adequate measures on minimization (prevention) of those risks and their consequences on the part of civil sector. May 19, Kara-Balta. Round Table Discussion on Development of Mechanisms on Stabilization of the Ethnic Situation within Chui Oblast. The discussion was held jointly with the National Council Secretariat on Women s, Family s and Gender Development Affairs under the President of the Kyrgyz Republic and Network Women Can Do Everything. Goal: to analyze the situation in the field of interethnic relations in Chui oblast and development of stabilization measures. OPERATIONAL PROJECT «METHODOLOGICAL SUPPORT OF THE ETHNIC DVELOPMENT CONCEPTUAL FRAMEWORK OF THE KYRGYZ REPUBLIC» Problem The ethnic field of Kyrgyzstan lacks an effective approach that would consider the ethnic field not from the perspective of conflict but in terms of a joint development. That can be explained by shortage of views on concrete types and methods of work on-site, and absence of training programs and trained specialists. Currently, a part of these forms is developed spontaneously. Such sphere as development of academic discourse and promotion of new approaches to theoretic analysis and study of work of the higher school requires an active formative impact. Development of a multilingual education is another important vector. Therefore, there is a need in an operational project to accumulate, discuss and share positive experience, methods and types of work in the field of ethnic development. The experience can be accumulated and disseminated through several information & communication platforms specially designed for sharing ideas, opinions and concrete proposals. Project Goal Preparation and enhancement of methodological support of the program activities and its partners in promotion of new approaches to interethnic interaction and implementation of the Ethnic Development Conceptual Framework. Main Objectives of the Project Analysis and summary of an available experience on strengthening and expansion of standards and examples of interethnic relations aimed at expansion of ethnic development processes. Expansion of academic discourse on problems of ethnic development in summer schools for teachers and researchers; promotion of modern approaches to study of ethnic sphere in higher education institutions and national research structures.

12 Development, discussion and dissemination of new methodological materials for work in ethnic field at various levels (among local communities, in schools, higher education institutions, public ethnic associations, etc.). Preparation of ethnic development related training programs for various target groups. Goals: to project information & communication system of the KPA, training on methods of horizontal transfer of information and positive experience in ethnic field; to train KRA information managers to work with information flows; to develop the contents and organizational structure of the KPA Vestnik and to project other communication platforms of the KPA (information & analytical center, TV programs, press-club, library, etc.). May 11, Bishkek. Round Table Discussion on «Multilingual Education in Kyrgyzstan: Experience, Problems, Perspectives». The event was held jointly with the OSCE Academy. Goal: to discuss the situation in the field of development of multilingual education in Kyrgyzstan and to identify possible directions of work in the light of general education reform. July 2005, Issyk-Kul oblast. United Summer School Identity: Search, Production and Reproduction. The Project was implemented jointly with the Friedrich Ebert Foundation and OSCE Center in Bishkek. Goals: to promote modern theoretic concepts on nature of ethnicity and nationalism in Kyrgyz universities; to develop a wider context of professional activities for a new generation of humanities professors through interaction in the single educational space of specialists of different directions from various countries; to change approaches to organization of university courses and types of curricular and extracurricular classes. Attended by university professors, researcher, undergraduate and post-graduate students. November 23, Round Table Discussion on «Public and Religious Figures for Peace, Stability and Development of Kyrgyzstan». The event was held jointly with the Regional Studies Institute and US Embassy in the Kyrgyz Republic. Goal: to involve positive forces of the country including leaders of different confessions into shaping a general position in addressing problems of destabilization and

13 division of Kyrgyzstan people on the basis of confessional signs. 16 LAW PROGRAM Program Coordinator Azamat Yusupov, Program Coordinator Ruslan Khakimov, Program Assistant Baglan Mamaev, The program mission: to support initiatives, reforms and institutes that enforce human rights and freedoms, rule of law and democratic values in the Kyrgyz Republic. The program priority: observance of human right and freedoms and administration of criminal justice. However, this does not exclude program activities in other law spheres that need reforms and have the necessary conditions for that. MAIN PROGRAM AREAS 1. Support of Human Rights Initiatives The goal: to enhance the public control after observance of human rights and freedoms via support of human rights initiatives. The program announced a call for proposals Protection of Civil and Political Human Rights in 2005 jointly with the Open Society Institute Budapest Human Rights and Good Governance program. The total grant fund of this program area made $ 165,123. Forty seven project proposals were submitted, while only 9 were selected. 2. Human Rights Advocacy International Facilities The goal: to enhance the practice of applying procedures of the International Pact on Civil and Political Human Rights and Optional Protocol. Currently, 6 claims have been filed at the UN Commission on Human Rights. Five of them were prepared by lawyers that underwent specialized training course in 2004 in application of the International Pact on Civil and Political Human Rights and Optional Protocol. This course was organized by the Soros Foundation Kyrgyzstan in partnership with the Youth Human Rights Group, OSCE Center in Kyrgyzstan, ODIHR/OSCE and International Lawyers Commission. 25 lawyers and human rights activists were trained in total. In 2005 the Soros Foundation Kyrgyzstan, OSCE Office for Democratic Institutions and Human Rights in Warsaw, OSCE Center in Bishkek, Office of UN High Commissioner for Human Rights, Youth Human Rights organized the similar training course for a group of 28 lawyers. 3. Reforming the Guaranteed Legal Aid System The goal: to reform the system of the legal aid guaranteed by the state to ensure a timely access to highly qualified legal aid to individuals that cannot afford paying lawyer s fee. In 2004 the inter-sector work group with support of the Open Society Institute Budapest Law program and Law Initiative developed the Concept Paper on improving the system of guaranteed legal aid that was approved by the Presidential Decree of October 12, The working group was recruited to develop bills on guaranteed legal aid and introduction of the respective amendments into regulative framework of the Kyrgyz Republic by the Presidential Decree of December 2, Penitentiary Reform The goal: to facilitate development of the penitentiary system, to ensure observance of the international standards with regard to rights and imprisonment conditions of the convicts. The program started working in this area in 2002 and achieved some progress in this regard. The Soros Foundation Kyrgyzstan facilitated in development of the Conceptual Framework on the Penitentiary Reform in the Kyrgyz Republic that was approved by the Government of the Kyrgyz Republic. Besides, the program assisted in preparation of amendments and additions to a number of regulations aimed at humanization of the criminal policy and introduction of alternatives to imprisonment. In 2003 the Foundation rendered assistance in creation of the In-Service Training Center for Criminal Justice System Specialists. The program continues supporting the Center to date. The program provided a grant to the Public Foundation Center for Legal Aid to Convicts to deliver free legal services to convicts in four correctional institutions for 2 years. The Atlantis 12-Step Recovery Program is run in two prisons for substance abusers. The Foundation is active in promoting public monitoring of the correctional services,

17 abolishment of death penalty, development of probation services and alternatives to imprisonment by organizing round table discussions and conferences on the above mentioned topics. 5. Freedom of Access to Information Legislation Reform The goal: to improve legal conditions for freedom of access to information. The Public Association Future Without Corruption Transparency International implemented the project Conceptual Framework and Mechanism of Realization of Citizens Right to Information with grant support provided by the Law program. The draft of the law On Access to Information Produced by the State Agencies and Local Government Bodies was prepared in the result of the project. The bill was prepared by the working group established by decree of the Head of President Administration in The group was comprised of government officials, members of public organizations, media, and businessmen. When preparing the draft of the law, the working group used experience of Estonia, Latvia, Russia and the model law on access to information developed by the international non-governmental organization Article XIX. The bill was discussed by the state agencies and public organizations. The bill reinforces guarantees of freedom of access to information by providing mechanism and procedures of access to information supervised by the state agencies and local government bodies. The bill stipulates responsibility for public servants for unjustified refusal to provide information, specifies restrictions in access to information, proposes mechanisms to appeal them and introduces procedures of public involvement into the decision making process.
