1 AIP New Zealand GEN GEN 1.3 ENTRY, TRANSIT AND DEPARTURE OF PASSENGERS AND CREW 1 INTRODUCTION 1.1 General With exceptions noted later in this chapter, all passengers entering New Zealand are required to present an acceptable passport or certificate of identity, and complete a New Zealand Passenger Arrival Card. A copy of the New Zealand Passenger Arrival Card is provided on the New Zealand Customs Service website The information sought on the Arrival Card is for Customs, immigration and quarantine purposes. 2 CUSTOMS REQUIREMENTS 2.1 General Information on customs requirements is available on the New Zealand Customs Service website. 3 IMMIGRATION REQUIREMENTS 3.1 General Information on immigration requirements is available on the Immigration New Zealand website Obligations on Carriers and Persons in Charge of Aircraft The Immigration Act 2009 and associated Regulations imposes obligations on carriers and persons in charge of an aircraft carrying passengers arriving in or departing from New Zealand. Effective: 30 MAY 13
2 GEN AIP New Zealand Arrival Section 101 of the Immigration Act sets out the obligations on carriers which include: (a) (b) (c) (d) ensuring that all persons on board an aircraft arriving in New Zealand have the correct documentation for immigration purposes; producing such documents or information about passengers as may be required under the law by an immigration officer; ensuring that passengers disembark only at the appropriate part of an airport (when, in an emergency, the craft must land elsewhere than at a Customs place, appropriate arrangements are required to be made for passengers to report to an immigration officer at a Customs place within 72 hours after arriving in New Zealand); and reporting the presence of any stowaway to an immigration officer as soon as practicable. Departure When leaving New Zealand, the obligations include: (a) reporting to an immigration officer details of any crew member or passenger who was exempted from the requirement to hold a permit while stopping over in New Zealand and who should be, but is not, on board the aircraft as it departs; and (b) subject always to the safety of the craft and other passengers, allowing on board any person in respect of whom a removal warrant or deportation order is in force and ensuring that such a person is detained on board until the craft has left the territorial limits of New Zealand Carriers have further obligations to provide passage, or bear the cost of passage on board some other aircraft, of any person who was on board any aircraft operated by the carrier when it arrived if that person did not hold a visa and was not granted a permit or was not exempt from the requirement to hold a permit Carriers are also required to provide passage for any crew member that remained in New Zealand without the necessary permit. There is provision for carriers to pay all costs incurred by the Crown in detaining and maintaining the passenger refused a permit or the crew member without a permit pending that person s departure from New Zealand Because it is an important condition of temporary permits that holders retain the means of departing from New Zealand, carriers and their agents are urged not to issue refunds of tickets in New Zealand without ensuring that the person concerned has either been granted a residence permit or become a New Zealand citizen. 3 AIP New Zealand GEN Obligations on Persons Arriving in New Zealand Every person arriving in New Zealand is required to report to an immigration officer and present a duly completed arrival card. Exceptions to the requirement to present an arrival card are made from time to time by way of regulations. Current exemptions are for members of the armed forces arriving on board military aircraft and for the crew of those aircraft, and members of the crew of any commercial aircraft who are temporarily exempt under the Act from the requirement to hold a permit. Travel documents Every person arriving in New Zealand is required to produce an acceptable passport or certificate of identity. The following documents are also accepted: (a) Carte de Service issued to officials of the South Pacific Commission; (b) Certificate or document of identity, provided the holder is entitled to readmission to the country which issued the document; (c) International refugee travel document; (d) Laissez-Passer issued by the United Nations; and (e) Republic of Kosovo passports The only exception to this rule is for holders of military identity cards or crew of their aircraft who are travelling to New Zealand in the course of duty. All travel documents of visitors are required to be valid for at least 3 months beyond the intended stay in New Zealand Unless otherwise specified, any travel document issued by the countries or sources listed on the following website are unacceptable. Visas and/or permits will not be endorsed in these travel documents,
4 GEN AIP New Zealand Visas A visitors visa is an endorsement in a passport that allows the passport bearer to travel to New Zealand for the purpose of visiting. A visitors permit may be granted on arrival, as explained on the Immigration New Zealand website, Visas are required except for: (a) Citizens of New Zealand. (b) Australian citizens. (c) Holders of current Australian Resident Return Visas. (d) Any person for the time being entitled to any immunity under the Diplomatic Privileges and Immunities Act 1968 or the Consular Privileges and Immunities Act 1971 (special exemption endorsements are placed in the travel documents of these passengers to enable them to be readily identified). (e) Members of the Armed Forces of any country travelling on duty (including their crew members) at the request or with the consent of the Government of New Zealand. (f) Crew members of any commercial aircraft provided they will depart within 7 days of the date of arrival. (g) Visits up to six months by British citizens, provided they hold passports that give them the right of permanent residence in the United Kingdom. (h) Visits up to three months by citizens of countries listed on the Immigration New Zealand website, Visas for New Zealand issued by the Ghanaian Immigration Authorities are not acceptable.
5 AIP New Zealand GEN Visitor s Permits A visitors permit is an endorsement in a passport that allows the passport bearer to remain in New Zealand for the purpose of visiting. The expiry date of the permit will be stated. 3.4 Special Requirements Special requirements exist for visitors and those seeking permission to be in New Zealand temporarily for work or study. Passengers are required to be able to produce: (a) onward tickets to a country to which they can show they have right of entry on a one-way ticket; and (b) evidence that they have the means to maintain themselves while in New Zealand. The amount of funds is usually at least $1000 per month or $400 if accommodation has been prepaid. The evidence could be in the form of cash, travellers cheques, bank drafts, letters of credit, or the following credit cards Diner s Club, American Express, Bankcard, Mastercard, Visa. A visa that waives the funds requirement could also be accepted Passengers who are unable to satisfy the above requirements are likely to be refused permits to be in New Zealand. As well, there are a number of classes of people who are not eligible for exemptions from permit requirements or for permits to be in New Zealand. The categories are as follows: (a) Any person convicted and sentenced to imprisonment for a term capable of running for five years or more. (b) Any person convicted within the preceding 10 years and sentenced to imprisonment for a term capable of running for 12 months or more. (c) Any person against whom a removal order is still in force.
6 GEN AIP New Zealand (d) Any person who has been deported from New Zealand or any other country (there are some technical exceptions relating to seamen and people deported from New Zealand for certain immigration offences prior to the coming into effect of the Immigration Act 1987). (e) Any person who the Minister of Immigration has reason to believe has connections with terrorist or criminal activities, or is likely to commit an offence against the Crimes Act 1961 or the Misuse of Drugs Act (f) Any person who the Minister of Immigration has reason to believe, in the light of any international circumstances, is likely to constitute a danger to the safety or public order of New Zealand. (g) Any person who the Minister of Immigration has reason to believe is a member or adherent of any organisation or group having criminal objectives or which has engaged in criminal activities and whose presence in New Zealand would, in the opinion of the Minister, constitute a threat to the public interest or order People who fall into these categories may apply to the Minister of Immigration for a special direction allowing them to be in New Zealand and, where a special direction has been given, a visa will be issued showing that they may travel to New Zealand.
7 AIP New Zealand GEN Obligations on Persons Transiting Through New Zealand Under New Zealand legislation, transit passengers are those who: (a) arrive in New Zealand from another country while in transit to another overseas destination; and (b) throughout the whole period while they are in New Zealand remain on board the aircraft or in a boarding or examination station The aim of the transit visa policy is to provide a mechanism for closer scrutiny of a class of travellers. This includes those persons who, although they have stated the intention of passing through New Zealand in transit to some other country, have a relatively high incidence of failure to travel onwards from New Zealand after having boarded an aircraft A number of persons transiting New Zealand must obtain a transit visa prior to travelling, irrespective of how short the stopover. If the aircraft lands in New Zealand then relevant passengers must have a transit visa unless: (a) They are travelling on a passport from a country on Immigration New Zealand s list of visa-free countries (the list is online at or (b) They are a citizen of Australia; or (c) Their destination after New Zealand is Australia, and they hold a current visa allowing them to travel to Australia; or (d) They have a current visa allowing them to travel to New Zealand; or (e) They are citizens of one of the following countries: Bahamas Peru Bermuda Republic of Marshall Islands Colombia Samoa Federated States of Micronesia Solomon Islands Kiribati Tonga Nauru Tuvalu Palau Vanuatu Papua New Guinea Passengers wishing to leave the airport area are considered to be visitors and are required to comply with all normal visitor requirements. 8 GEN AIP New Zealand 3.6 Obligations on Persons Leaving New Zealand Every person leaving New Zealand is required to report to an immigration officer and present a duly completed departure card. Exceptions to this rule are made from time to time by way of regulations. Current exemptions are the same as those set out in relating to arrival cards Every person leaving New Zealand is required to produce a passport or certificate of identity When any permit holder leaves New Zealand, the permit expires. In order to return to New Zealand the passenger is required to have an appropriate visa where required. For residents, the appropriate visa is a returning residents visa. Most students and workers in New Zealand on a temporary basis will have been issued multiple journey visas enabling them to travel freely during the period for which their permit would otherwise remain current. Prospective passengers in New Zealand may apply for the appropriate visa at any office of Immigration New Zealand, preferably at least 3 weeks in advance of their proposed date of departure.
9 AIP New Zealand GEN PUBLIC HEALTH REQUIREMENTS 4.1 International Health Requirements Health quarantine procedures in New Zealand arise from the requirements of the International Health Regulations 1969, which has as its fundamental principle to ensure maximum security against the international spread of diseases with minimum interference with world traffic and trade. 4.2 New Zealand Health Legislation and Services While procedures in the Health Act 1956 and the Health (Quarantine) Regulations 1983 largely focus on quarantinable diseases (cholera, plague, and yellow fever), provision is also made for the management of other diseases and insanitary conditions that may be associated with international travel Health services are widely available in New Zealand, but are not free to ineligible persons. Information on local medical practitioners and hospitals is available at the front of any New Zealand telephone directory. 4.3 Notifiable Infectious Diseases Certain infectious diseases are notifiable to the Medical Officer of Health, who is responsible for the public health investigation and control of the disease. These infectious diseases include acute gastrointestinal illnesses, tuberculosis, and other infections of public health significance The implication for aircraft is that if a person identified with a notifiable disease has travelled on an aircraft within the period of communicability, the Medical Officer of Health may need to identify and trace passengers and crew members to prevent ongoing transmission, and quarantine provisions may be necessary. 4.4 Responsibilities of Pilot-in-Command To allow for sufficient notification to the Medical Officer of Health at the local Public Health Service, the pilot-in-command of an aircraft arriving in New Zealand must notify the airline agent at least 15 minutes before landing, if: (a) ill persons are on board suffering from diarrhoea, vomiting (not motion sickness), or abnormal temperature and a skin rash; or (b) there is any other condition that may lead to the spread of disease Illnesses not showing symptoms described in do not require notification and should be dealt with through the normal available medical services.
