1 Oil Spill Prevention & Countermeasure Annual SPCC Plan Oil Discharge Prevention Briefing Farm Operations Mott Equity North Exchange Dakota

2 Course Objective To prevent, control and provide countermeasures to prohibit oil spills from our facilities from contaminating the environment Focus on preventing discharges to navigable waters (stormwater drains, creeks, rivers, etc) To increase understanding of this facilities oil spill prevention, control and countermeasure (SPCC) plan To meet requirements of an annual oil discharge briefing required by 40 CFR (d)

3 Who is Must Be Trained? 40 CFR 112.7(f) at a minimum, must train oil-handling personnel. Oil-handling personnel is to be interpreted according to industry standards, but includes employees engaged in the operation and maintenance of oil storage containers or the operation of equipment related to storage containers and emergency response personnel. We (EPA) do not interpret the term to include secretaries, clerks, and other personnel who are never involved in operation or maintenance activities related to oil storage or equipment, oil transfer operations, emergency response, countermeasure functions, or similar activities. conduct discharge prevention briefings for oil-handling personnel at least once a year to assure adequate understanding of the SPCC Plan for that facility

6 Rules & Regulations North Dakota State ND Oil & Gas Commission Applies to petroleum producers & drill rig operators Equipment must be devoid of leaks and in good condition Report discharges of 25 gallons or more or if the discharge flows off of the facility property NDDH Environmental Health Section Regulates only above-ground hazardous waste tanks Must report discharges excess of reportable quantity of hazardous substance or if oil sheen produced ND State Fire Marshal North Dakota Department of Health Incorporates by reference all National Fire Prevention Association codes & standards

7 Other Federal Regulations Resource Conservation and Recovery Act (RCRA) Typically referred to as hazardous waste regulations Emergency Planning and Community Right to Know Act (EPCRA) Additionally, releases must be reported to appropriate local emergency planning commissions (LEPC) and state emergency response commissions (SERC) Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Typically referred to as Superfund regulations While petroleum products such as gasoline and oil are excluded from this rule but are covered under the Clean Water Act and UST/AST regulations

8 Rules & Regulations 40 CFR 112 US EPA Oil Pollution Prevention Regulation Typically referred to as the oil SPCC plan regulations Promulgated in 1974 under the authority of the Clean Water Act. Last major revision was in July 2002 with minor amendments in December 2006 and December Sites with >1320 gallons (including containers such as drums) of capacity must prepare a SPCC plan Requires specific design and equipment to prevent spills, or oil discharging to water Secondary Containment To Control Any Spilled Volume Security Provisions Prevent Vandalism Routine and Periodic Storage Container Inspections Oil handing employees to receive an annual oil discharge briefing i.e. training

9 Definitions 40 CFR Bulk Storage Container any container used to store oil. These containers are used for purposes including but not limited to the storage of oil prior to use, while being used, or prior to further distribution in commerce. A tank is a bulk storage container Containers smaller than 55 gallon are not regulated

10 Oil Filled Equipment Oil-filled electrical, operating, or manufacturing equipment is not a bulk storage container. Oil-filled equipment does not require secondary containment nor inspections like containers do

11 Definitions 40 CFR Permanently Closed means a container or facility for which: All liquid and sludge has been removed from each container and connecting line; and All connecting lines and piping have been disconnected from the container and blanked off, all valves (except for ventilation valves) have been closed and locked, and conspicuous signs have been posted on each container stating that it is a permanently closed container and noting the date of closure.

18 Spill Countermeasures Spill Countermeasures are actions that must be taken whenever a discharge or threat of a discharge in harmful quantities is discovered. Spill response procedures will be reviewed later in this briefing

19 Facility Specifics Facility Transfer Operations Schedule and conduct piping visual leak inspection Conduct periodic integrity testing with consideration of industry standards and procedures subject to the approval of the professional engineer Facility Bulk Storage Containers Material of construction compatible with oil and conditions Secondary requirement including precipitation freeboard Drainage from undiked areas in catchment basin or holding pond Inspect each container including foundation periodically Log inspections

20 Site Specific Warnings Aboveground piping exists at this facility Piping within and at the loading and unloading areas WARNING ABOVEGROUND PIPING EXISTS AT THIS SITE Clear vehicle access is provided for your use. All are clearly visible from vehicle drivers seat, but may be concealed by snow drifts in winter time. However, if you are new to the facility, please ask for assistance to point out these potential hazards.

21 Monthly Facility and Container Inspections Inspections Must be Documented & Forms Retained for 3 Years The site personnel is responsible for this inspection. One form is required for each oil tank. A separate form is required for the facility and drum storage areas.

22 Site Security 40 CFR 112.7(g) Non Production Facilities (1) Close and lock facilities fences and buildings when unattended (2) Ensure flow and drain valves on tanks (including portable tanks) have adequate security measured so that they remain in the closed position. (3) Turn off electrical power to the loading and unloading pumps, if applicable, when the site is unattended or when the facility will not be used for an extended period of time. (4) Securely cap or blank-flange the loading / unloading connections of facility piping when not in use. (5) Verify lighting systems are active. Repair damage or burnt out bulb elements as soon as possible.

23 Underground Piping Repair or Replacement As of August 16, 2002 all new underground piping at facilities must meet the following new requirement: Protect all piping appurtenant to the facility from corrosion, such as with protective coatings or cathodic protection. Double walled piping may be an acceptable alternative to coating and/or wrapping and/or providing cathodic protection to new underground piping.

24 Petroleum Oil Distribution Facility 40 CFR Facility Drainage Close and seal at all times drains of dikes or drains except when drawing uncontaminated rainwater NO SHEEN! Prior to drainage, inspect the diked area, remove accumulated oil and return it to storage or dispose of it in accordance with legally approved methods Inspect regularly for accumulation of oil that may have occurred Promptly remove any accumulation of oil Log discharges

25 Discharge Procedure Protocols (Spill Response)

26 Our Spill Procedures Your safety is our first concern. Unless additional training is obtained, you role is limited to on-scene observer Get assistance for injured personnel, if necessary If a safety hazard exists, remove yourself and others from the area Call for immediate assistance Notify owner Control vehicle and personnel access to spill site (personnel sentries, barrier tape, ropes, signs, etc.)

27 Protect Water Sources If you can do so safely Shutdown ignition sources (electrical service, vehicle ignitions, etc.) Shutdown source of oil (pump, valve, dispenser, etc.) Control flow of oil if beyond containment structures Cover or otherwise protect stormwater or other water system drains Divert oil flow to contain on-site Construct earthen berms at property edge if necessary Note: Do not clean up discharged materials unless you have received clean-up training and are current with OSHA HAZWOPER training.

28 Emergency Response Procedures Refer to the specific discharge response procedures in the SPCC plan (or on your duty card if appropriate). Site specific contact names and phone numbers are also listed there.

30 When to Report Oil Spills to EPA NOTE: this chart from the EPA website uses the word could not did (800)

31 Reporting Spills Information Required Spill of harmful quantities to surface water is to be reported: Violate applicable water quality standards; Cause a film or "sheen" upon, or discoloration of the surface of the water or adjoining shorelines; or Cause a sludge or emulsion to be deposited beneath the surface of the water or upon adjoining shorelines A form is provided to compile the necessary info before the call is made

32 Reporting Oil Spills The owner or their designate is responsible to report the spill to the regulatory agencies. EPA National Response Hotline (800) North Dakota Department of Health (701) Report the spill promptly. The regulation says immediately. It is, however, acknowledged that some time is necessary to assess the situation and compile the information to comply with the reporting requirements. Recommended reporting timeframes range from 2 hours to 4 hours from time of discovery.

33 Five-Year Spill History Any reportable spill which has occurred in the past 5 years and subsequent changes to the facility s SPCC Plan is to be discussed. A SPCC plan must be modified if such a release occurs. If two reportable spill occurs within a 5 year period, or one spill gallons in size occurs, an engineer must review and approve the plan.
