3 COMMERCIAL AUTOMOBILE GENERAL RULES AND OVERVIEW INTRODUCTION Germantown Mutual s commercial automobile program is primarily based on the ISO Commercial Lines Division One Automobile Manual. The rules are primarily those of that program and the rates are primarily based on ISO s Loss Costs, and are independently filed. DEFINITION Commercial Automobiles include trucks, pickup, panel and van types, truck tractors, trailers and semi trailers. Private passenger types are four wheel autos of the private passenger or station wagon types. A pickup, panel truck or van not used for business is rated as a private passenger auto. POLICY TERM All policies will be written for a term of one year. BINDING AUTHORITY This program is intended to support those property and liability risks the company currently insures. All risks must be submitted for approval. INELIGIBLE OPERATORS Those in need of a financial responsibility filing. Any operator who has had his/her license suspended or revoked within the past five years. Any operator without a valid Wisconsin driver s license. Any operator who has had two or more at fault accidents, more than two minor traffic violations, or a combination of one traffic violation and one at fault accident in the last three years. Any operator who is under the age of 26 or over the age of 69, and has had more than one minor violation in the last three years. Any operator who has been convicted of any of the following violations in the past five years: Accident-Conviction-Fatal Altering driver license Attempting to elude officer Falsified accident report Failure to report accident Failure to stop after accident Great bodily harm Habitual traffic offender Implied consent Implied consent underage Intoxicant in vehicle carrying underage person Injury due to negligent use of vehicle Imprudent speed Intoxicant in vehicle-operator Intoxicant in vehicle-passenger Juvenile alcohol Non-compliance w/driver Safety Plan Negligent homicide JAN 2012 GERMANTOWN MUTUAL INSURANCE COMPANY WISCONSIN 18.3

5 GMIC EXPENSE COST RATING FACTOR PREMIUM DEVELOPMENT 1. Under the Trucks, Tractors and Trailers section (p 18.6), and under the Private Passengers Types section (p ); the premium is determined for Liability, Comprehensive, and Collision Coverages. For these coverages only, the following factor will be multiplied by those premiums. 2. The GMIC Expense Cost Rating Factor is This factor will not be multiplied by the Underinsured Motorists Premiums, Uninsured Motorists Premiums, Medical Payments Premiums, or any of the Optional Coverages Premiums GMIC SCHEDULED CREDITS OR DEBITS PREMIUM DEVELOPMENT 1. 6 TRUCKS, TRACTORS AND TRAILERS CLASSIFICATION GUIDELINES 1. Fleet/Non-Fleet Classifications A. Classify as fleet the autos of any risk that have five or more self-propelled autos of any type that are under one ownership. Do not include autos owned by allied or subsidiary interests unless the insured holds a majority financial interest. B. Do not include mobile equipment insured on a general liability policy in determining if the risk is a fleet. C. Do not include trailers in determining if the risk is a fleet, but apply the fleet classification to the trailers if the risk otherwise is classified as a fleet. D. Classify the autos of any other risk as non-fleet. E. Do not change the fleet or non-fleet classification because of midterm changes. The fleet/non-fleet classification can only be changed when the policy is written new or at renewal. 2. Primary Classifications A. Vehicle Weight Gross vehicle weight (GVW) and gross combination weight (GCW) mean: (1) Gross Vehicle Weight The maximum loaded weight for which a single auto is designed, as specified by the manufacturer. (2) Gross Combination Weight The maximum loaded weight for a combination truck-tractor and semi trailer or trailer for which the truck-tractor is designed, as specified by the manufacturer. B. Size Class (1) Light Trucks Trucks that have a gross vehicle weight (GVW) of 10,000 pounds or less. (2) Medium Trucks Trucks that have a gross vehicle weight (GVW) of 10,001 20,000 pounds. Include crawler type trucks in this class. (3) Heavy Trucks Trucks that have a gross vehicle weight (GVW) of 20,001 45,000 pounds GERMANTOWN MUTUAL INSURANCE COMPANY WISCONSIN JAN 2012

7 (4) Extra Heavy Trucks Trucks that have a gross vehicle weight (GVW) over 45,000 pounds. (5) Truck Tractors A truck tractor is a motorized auto with or without body for carrying commodities or materials, equipped with fifth wheel coupling device for semi trailers. (a) A heavy truck tractor has a gross combination weight (GCW) of 45,000 pounds or less. (b) An extra heavy truck tractor has a gross combination weight (GCW) over 45,000 pounds. (6) Semi trailers A semi trailer is a trailer equipped with fifth wheel coupling device for use with a truck tractor, with load capacity over 2,000 pounds. This includes bogies used to convert containers into semi trailers. (7) Trailers Any trailer with load capacity over 2,000 pounds, other than a semi trailer. (8) Service Or Utility Trailer Any trailer or semitrailer with load capacity of 2,000 pounds or less. C. Business Use Class If a truck, tractor or trailer has more than one use, use the highest rated classification unless 80% of the use is in a lower rated activity. In that case, use the lower rated classification. (1) Service Use Autos used for transporting the insured s personnel, tools, equipment and incidental supplies to or from a job location. This classification is confined to autos principally parked at job locations for the majority of the working day or used to transport supervisory personnel between job locations. (2) Retail Use Autos used to pick up property from, or deliver property to individual households. 8 D. Radius Class Determine radius on a straight line from the street address of principal garaging. (1) Local (Up To 50 Miles) The auto is not regularly operated beyond a radius of 50 miles from the street address where such auto is principally garaged. (2) Intermediate (51 To 200 Miles) The auto is operated beyond a radius of 50 miles but not regularly beyond a radius of 200 miles from the street address where such auto is principally garaged. (3) Long Distance (Over 200 Miles) The auto is operated regularly beyond a 200 mile radius from the street address where such auto is principally garaged. GMIC is currently not a market for long distance operations. E. Classification Tables (1) See the Primary and Secondary Class Code Tables. PREMIUM DEVELOPMENT 1. Determination of Classification Rating Factor and Class Code Determine the classification rating factor and class code as follows: A. Determine whether the risk is classified as fleet or non-fleet. B. Determine the primary rating factor based on size class, business use class and radius class. (p 18.35) C. Determine the secondary rating factor, if any, based on the special industry classifications. (p 18.37) D. Determine the combined rating factor by adding the secondary rating factor to or subtracting it from the primary rating factor. 2. Premium Computation A. Liability (1) Determine the Territory Code by using the Wisconsin Territory Pages. (p 18.18) (2) Using the Territory Code, determine the State Loss Cost, found under the State Loss Cost Table. (p 18.26) (3) Mulitply the State Loss Cost by the Increased Liability Limits Factor, found under the Increased Liability Limits Table. (p 18.27) (4) If applying a liability deductible, multiply the State Loss Cost by the Liability Deductible factor, found under the Liability Deductible Factor Table. 9 (5) If this is a fleet, multiple the State Loss Cost by the Liability Fleet Factor, found under the Liability Fleet Factor Table. (p 18.27) (6) Multiply the State Loss Cost by the Combined Rating Factor (see Comments under Premium Development.1.D. listed on page 18.8). B. Physical Damage (Actual Cash Value Basis) (1) The following needs to be done separately for comprehensive and collision coverages: i. Determine the Territory Code by using the Wisconsin Territory Pages. (p 18.18) ii. Using the Territory Code, determine the State Loss Cost, found under the State Loss Cost Table. (p 18.26) iii. Multiply the State Loss Cost by the Age Group Factor, found under the Age Group Factor Table (p 18.28) iv. Multiply the above result by the following: 1. Find the Original Cost New Factor, found under the Original Cost New Factor Table. (p 18.29) 2. Find the Deductible Factor, found under the Deductible Factor Table. (p 18.29) 3. Subtract the Deductible Factor from the Original Cost New Factor, however the deductible factor does not apply if the deductible factor is greater than the Original Cost New Factor v. To further clarify B.(1)ii. B.(1)iv. above, the formula should be: State Loss Cost x Age Group Factor x (Original Cost New Factor Deductible Factor) vi. For any trucks, trailers, and semitrailers capable of dumping their loads (determined by the secondary class code), and all trucktractors (determined by the primary class code), multiply the collision result by the factor found under the Trucks, Trailers, and Semitrailers capable of dumping their loads and all Truck-Tractors Table. (p 18.30) vii. If this is a fleet, multiple the result by the Physical Damage Fleet Factor found under the Physical Damage Fleet Factor Table. (p 18.30) viii. Multiple the result by the combined rating factor (see comments under 1.D. listed on page 18.8). D. Medical Payments (1) Trucks and Tractors i. 11 PRIVATE PASSENGER TYPES ELIGIBILITY 1. Definition A private passenger auto is a four-wheel auto of the private passenger or station wagon type. A pickup, panel truck or van not used for business is rated as a private passenger auto. 2. Application This subsection applies to all private passenger autos which are owned by corporations, partnerships, unincorporated associations, government agencies or rated as part of a fleet and which are insured on a Business Auto form. Multiply the State Loss Cost by the Increased Liability Limits Factor, found under the Increased Liability Limits Table. (p 18.27) 3. Physical Damage Premium Calculation a. Using the Territory Code, determine the State Loss Cost, found under the State Loss Cost Table. (p 18.26) b. Multiply the State Loss Cost by the Age Group Factor, found under the Age Group Factor Table. (p 18.28) c. Multiply the above result by the following: i. In all other circumstances, use form CA and charge as follows: a. Liability Premium Calculation i. The rating territory is 102 ii. Multiply the Private Passenger Loss Cost found under the State Loss Cost Table (p 18.26), by the DOC Factor, found under the DOC Factor Table. (p 18.31) iii. Multiply the above result by the Increased Liability Limits Factor, found under the Increased Liability Limits Table. (p 18.27) Use the factor listed under All Other Risks. iv. For liability deductibles, multiply the above result by the Liability Deductible Factor, found under the Liability Deductible Factor Table. (p 18.27) b. Physical Damage Premium Calculation i. The rating territory is 102 ii. The following needs to be done separately for both Comprehensive and Collision coverage 1. Find the Private Passenger Loss Cost found under the State Loss Cost Table. (p 18.26) 2. If using a deductible, find the Deductible Factor, found under the Deductible Factor Table (p 18.29) and subtract that number from 1. Multiple the result by the Private Passenger Loss Cost found under the State Loss Cost Table. (p 18.26) 3. Multiple the above result by the DOC Factor found under the DOC Factor Table. (p 18.31) c. Using the total number of employees (for all locations), determine the Liability Base Loss Cost, found under the Non-Ownership Liability Loss Cost Table. (p 18.31) 2. For Garage Service Operations a. Determine the total number of employees whose principal duty involves the operation of autos and multiple this amount by the Garage Service Operations, Non-Ownership Liability Coverage Factor, found under the Garage Service Operations, Non-Ownership Liability Coverage Factor Table. (p 18.31) b. Multiply the above result by the Liability Loss Cost for Private Passenger Type Vehicles, found under the State Loss Cost Table. (p 18.26) The Liability Loss Cost will be based on the territory where operations are principally conducted. EMPLOYEES AS INSUREDS COVERAGE CA Determine the Extended Non-Ownership Liability Employee Coverage Factor, found under the Extended Non-Ownership Liability Employee Coverage Factor Table. (p 18.31) 2. Multiply the above factor by the premium determined under the Non-Ownership Liability section above on page The above result is the additional premium that is added to the policy for this coverage. 15 HIRED AUTO LIABILITY 1. Estimate the annual cost of hire. 2. Divide the estimated annual cost of hire by Multiply the above result by the Cost of Hire Basis Liability Loss Cost Factor, found under the Cost of Hire Basis Liability Loss Cost Table (p 18.32). 4. For liability deductibles multiply the above result by the Liability Deductible Factor, found under the Liability Deductible Factor Table. (p 18.27) 5. For increased limits, multiply the above result by the Increased Liability Limits Factor found under the All Other Risks column of the Increased Liability Limits Table. (p 18.27) 6. The minimum premiums for hired auto liability are listed under the Hired Autos Liability Minimum Premium Table. (p 18.32) HIRED AUTO PHYSICAL DAMAGE COVERAGE 1. RENTAL REIMBURSEMENT CA The following needs to be done separately for comprehensive and collision coverage. 2. Take the agreed amount of rental reimbursement for each day ($25) 3. Multiply by the maximum number of days (30) 4. Divided the above result by Multiply the above result by the loss cost per $100 of insurance found under the Rental Reimbursement Physical Damage Loss Costs Table. (p 18.32) 6. An example of the above equation would be 25 x 30 = / 100 = x 0.80 = $6 premium.
