Surface locations shall be marked using flag type markers with different colors representing main line and for sewer services. 3 2.0 Mandatory Pre-Bid Meeting June 2, 2015 at 10: am 151 S Banner Street 3.0 Proposal Submittal All Proposals must be received by to mgibbs@ci.elizabeth.co.us by 5:00 p.m. MDT, Friday, June 12, MDT. Proposals must be submitted electronically as an attachment to E- Mail message. The subject of the message shall read: PROPOSAL 2015 Camera and locate of In-Situ Sewer Line Proposing firm s name and address shall also appear on the attachment containing the Proposal. Late Proposals will not be accepted under any circumstance. Proposing firms will be expected to allow adequate time for electronic delivery of their Proposals. The 5:00 p.m. MDT deadline will be based on the time is recorded as received in Public Works Director, Michael Gibbs account. The Town reserves the right to reject any and all Bids, to waive all informalities and to negotiate contract terms with the Most Responsible Successful Bidder, to disregard all nonconforming, nonresponsive or conditional Bids, and to postpone the award of the Contract for a period of time which, however, shall not extend beyond 60 days from the proposal opening date unless a different period is set forth in the Agreement. 3.1 Conditions of Proposal Submittal 1. All proposing firms shall comply with all conditions, requirements, and specifications contained herein, with any departure constituting sufficient cause for rejection of the Proposal; 2. The Proposal must be signed by a duly authorized official of the proposing firm submitting the Proposal; 3. The Proposal shall include a completed Bidding Schedule (Section 16.0); 4. No Proposal will be accepted from any person, firm, or corporation that is in arrears for any obligation to the Town or that otherwise may be deemed irresponsible or unresponsive by Town staff or Town Board of Trustees; 5. Only one (1) Proposal will be accepted from any person, firm, or corporation; 6. All rates and fees quoted must be firm for a period of ninety (90) Calendar Days from the Proposal submittal date; 7. The Town reserves the right to reject any and all Proposals or any part thereof. The right is reserved to waive any formalities or informalities contained in any Proposal, and to award 2015 Camera and Locate of In-Situ Sewer Line Page 3

4 the Project to the most responsive and responsible proposing firm as deemed in the best interest of the Town; 8. All Proposals shall be prepared in a comprehensive manner as to content, but no necessity exists for expensive binders or promotional material; and 9. All costs, including travel and expenses, incurred in the preparation of this Proposal shall be borne solely by the proposing firm. 4.0 Evaluation Criteria Proposals shall be evaluated on the basis of the following criteria: 1. Responsiveness to the needs of the Town, both in the time to complete the Project and in the proposed means and Scope of Services offered; 2. Experience of the proposing firm in Projects of similar size, scope, and nature; 3. The proposing firm's engagement team, including the experience of key personnel assigned to the Project; 4. The degree to which the Proposal meets or exceeds the terms of the Request for Proposal (RFP); 5. Results of reference checks and past performance for other clients; 6. The proposing firm s quoted fee based on the services to be provided; 7. The proposing firm s insurance coverage limits; and 8. The proposing firm s proposed methods. 5.0 References Proposers are encouraged to provide references from entities who have purchased similar services from the proposer in the past; however, the Town reserves the right to request references as deemed necessary. 6.0 Regulatory Compliance All of the work performed by the Contractor shall comply with all applicable laws, rules, regulations, and codes of the United States and the State of Colorado and with the ordinances, and rules and regulations of the Town as well as those items described in Section 12.0 of this Document. Regulatory agencies include, but are not limited to, the following: 2015 Camera and Locate of In-Situ Sewer Line Page 4

5 1. Occupational Safety and Health Agency OSHA 2. United States Environmental Protection Agency USEPA 3. Colorado Department of Public Health and Environment CDPHE 4. Colorado Department of Public Health and Environment, Water Quality Division WQD 5. Elbert County 6. Elizabeth Fire Protection District 7. Town of Elizabeth 7.0 Permits Contractor shall be responsible for obtaining any and all permits required for this project, and paying all transportation and disposal fees. The Town Public Works Department will work with the selected contractor to schedule with impacted resident(s)/business(s). 8.0 Site Safety and Security Contractor will be responsible for providing a Site Specific Health and Safety Plan (SSHASP). It will be the responsibility of the Contractor to secure all work areas from unauthorized access. This may include, but is not limited to installation of temporary work-site fencing, signage, and controlled access points. 9.0 Clean-Up Removal and off-site disposal for typical industry standard trash items will be done in coordination with the Town of Elizabeth. Upon completion, the work area shall be left clean of debris and trash associated with the work. There shall be no additional charges for removal and/or disposal of materials Storm Water and Erosion Control The selected contractor will install when applicable erosion BMP protection for each project location as outlined in this document Scheduling and Sequence of Project The Contractor should provide a proposed project schedule, including required lead time from contract award, and anticipated job duration Utility Location 2015 Camera and Locate of In-Situ Sewer Line Page 5

6 The Town does not have tracer wire or is able to accurately locate the water line/sewer line main. The selected contractor is required to contact applicable utility locates for all other utilities Hazardous Materials N/A 14.0 Agreement Terms An agreement is attached to this RFP. The successful bidder will be required to accept the terms of the agreement. Proposers are responsible for understanding the contract terms, and by means of providing a Bid, acknowledge that the example agreement document has been received Times and Methods of Payment Progress payments shall be made in proportion to services rendered and shall be due and owing within thirty (30) days of Contractor s submittal of his monthly invoice. Contractor shall submit invoices prior to the twenty-fourth (24th) day of each month for payment the following month. Payment of any invoice that is received after the twenty-fourth (24th) day of each month may be delayed up to a period of sixty (60) days. If the Town objects to any invoices submitted by Contractor, the Town will so advise Contractor in writing giving the reason within fourteen (14) days of receipt of such invoice. If the Town fails to make payments due Contractor within sixty (60) days after receipt and acceptance of Contractor s bill, Contractor may, after giving seven (7) days written notice to the Town, suspend services under this Agreement until Contractor s outstanding bills have been paid in full Bidding Schedule Bids will be considered on the attached schedule; no bid will be considered for only part of the schedule. Bidders are instructed to complete all items in the Bidding. The following unit prices shall be applicable for the specific items listed. Price shall be complete, in place including materials and installation, e.g., fittings, etc., and anything incidental to the proper installation or removal as specified. Unit prices shall be basis for payment for quantities of work complete and in place. 1 The Contractor agrees that for requested and/or required changes in the scope of work, the contract sum shall be adjusted in accordance with the following unit prices, where the Town elects to use this method of determining cost Camera and Locate of In-Situ Sewer Line Page 6

7 2 Contractor is advised that the unit prices will enter into the determination of the successful bidder. Unreasonable prices may result in rejection of the entire bid proposal. Unit prices listed below refer to all items installed and completely in place. 3 The unit prices quoted by the Contractor shall be those unit prices that will be charged or credited for labor and materials to be provided regardless of the total number units and/or amount of labor required for added or deleted items of work. 4 Payment for all work including labor, equipment, materials, tools, and services necessary for the project for the Town shall be included in the unit prices listed below. This shall include all cleaning and repairs and other work incidental to the cleaning and repairs. 8 Bidders Person to contact for additional information on this Proposal: Name: Michael Gibbs, Public Works Director Phone: (303) BIDDERS DECLARATION AND UNDERSTANDING The undersigned, hereinafter called the Bidder, declares that the only persons or parties interested in this Proposal are those named herein, that this Proposal is, in all respects, fair and without fraud, that it is made without collusion with any official of the Town, and that the Proposal is made without any connection or collusion with any person submitting another Proposal on this Contract. The Bidder further declares that Bidder: a) has carefully examined the Contract Documents for the completion of the services, b) is satisfied as to the quantities involved, including materials and equipment, and conditions of work involved, including the fact that the description of the quantities of work and materials, as included herein, is brief and is intended only to indicate the general nature of the work and to identify the said quantities upon inspection, and c) that this Proposal is made according to the provisions and under the terms of the Professional Services Agreement, which are hereby made a part of this Proposal. The Bidder further acknowledges the exercise of whatever judgment deemed necessary regarding the interpretation of internal RFP information and has utilized all pertinent data received from the Town, and other sources in submitting this Proposal. CONTRACTOR By: Name: Title: License No.: 18.0 Award of Contract Within 60 calendar days after the opening of Proposals, unless otherwise stated in the INVITATION TO BID, the Town will accept one of the Proposals and will act in accordance with BASIS OF AWARD, below. The acceptance of the Proposal will be by written NOTICE OF AWARD, ed or delivered to the office designated in the Proposal. In the event of failure of the selected Bidder to sign and return the Agreement, the Town may award the Contract to the next lowest responsible Bidder or reject all bids and negotiate an agreement with any Bidder Basis of Award of Contract The award will be made by the Town on the basis of the Proposal from the Bidder which, in the Town's sole and absolute judgment, will best serve the interest of the Town. The Town reserves the right to reject any and all bids, to postpone the award of the contract for a period not to exceed Camera and Locate of In-Situ Sewer Line Page 8

9 days after the bid opening, to waive any informalities or irregularities in the Proposals received, and to accept the Proposal deemed most advantageous to the best interests of the Town Execution of Contract The successful Bidder shall, within 5 business days after receiving NOTICE OF AWARD, sign and deliver to the Town the executed Agreement. After receiving the signed Agreement from the successful Bidder, the Town's authorized agent will sign the Agreement. Signature by both parties constitutes execution of the Agreement. Key agreement terms are included in Section 14, and an example agreement is included as an attachment to this RFP Notice to Proceed After execution of the Agreement, the Town will issue a NOTICE TO PROCEED to the Contractor, which will state the date the work is to commence. The Contractor will acknowledge receipt of the Notice to Proceed prior to beginning work Time of Completion The time of completion of the work to be performed under this Contract is the essence of the Contract.
