4 NAVY CHILD AND YOUTH PROGRAMS Child Development Homes (CDH) Liability Insurance Requirements PURPOSE: This information is required to be provided to all potential and currently certified Navy CDH Providers for the purpose of notifying them about CDH liability insurance requirements. CDH Providers are independent private contractors certified by the Navy to provide home-based child care service for eligible patrons in their government or nongovernment owned or leased residence, which may be located on or off the installation. As independent private contractors, CDH Providers may be held personally liable for claims in the absence of any insurance. CDH CERTIFICATION LIABILITY REQUIREMENTS: CDH Providers are not government employees and are not covered by the Navy under any Navy insurance program or plan. CDH Providers are required to maintain personal liability insurance to protect themselves and the Navy as additional primary insured against potential liability claims for negligence that might arise from their operations as a CDH Provider. CDH Providers must purchase insurance coverage immediately following completion of certification requirements and before accepting children in care. Proof of insurance coverage is required prior to the issuance of the Navy CDH Provider Certificate. Additionally, CDH Providers must maintain appropriate insurance throughout the certification period. Failure to do so will result in suspension and/or revocation of certification. CDH Providers are encouraged to thoroughly read their insurance policies to ensure they understand the terms of their coverage and to make sure their policies provide coverage at least to the extent set forth below. CDH Providers must provide a certificate of proof of insurance to the CDH program office prior to issuance of the Navy CDH Provider Certificate. This proof of insurance certificate must show that the CDH Provider has coverage that includes, at a minimum, the following: The DON is listed on the insurance policy as additional primary insured against potential liability claims for negligence. General liability insurance, which includes products and completed operations, personal and professional liability loss exposures, is a minimum of $500,000 for each claim and policy aggregate. Sexual abuse and molestation liability coverage is a minimum of $100,000 for each claim and policy aggregate. Encl (1)
5 NAVY CHILD AND YOUTH PROGRAMS Child Development Homes (CDH) Liability Insurance Requirements Fire liability for the damage to non-owned property, which is in the provider s care, custody and control, is insured for a minimum of $50,000 per claim and policy aggregate. Automobile insurance coverage that includes transporting children for business purposes if the CDH provider plans to transport children in his/her privately owned vehicles. ADDITIONAL NOTIFICATIONS: As independent private contractors, CDH Providers may be held personally liable for any negligent damage claims or awards for damages which exceed their insurance policy limits and for any personal acts and omissions that are specifically excluded by their liability insurance policy. The Government will not furnish independent contractors, including CDH Providers, legal representation in court, nor will the Government pay any claims arising from any CDH Provider s actions or omissions. **The Department of Navy does not provide, endorse or recommend insurance carriers to independent contractors, including CDH Providers. Employees of Navy Child and Youth Programs are not authorized to provide information regarding insurance companies. 2
