2 Nursing Law Update PLEASE NOTE: We are not here to interpret the law Questions regarding the law should be directed to the Board of Nursing

3 Nursing Law Update Highlights Clinical simulation will become acceptable for up to 50% of clinical training. Clinical training is limited to the United States, Washington, D.C., or a possession or territory of the U.S. NOTE: Pending interpretation by Board of Nursing Any graduate of an approved program who fails to take the licensure examination within 6 months after graduation must take and pass a BON approved examination preparatory course prior to taking the exam Nursing programs on probation must establish a remediation plan including specific benchmarks to identify progress toward a graduate pass rate goal

4 Nursing Law Update Highlights (Continued) During the 2 calendar years following placement on probationary status a program that does not achieve the required passage rate for any 1 calendar year may have its probation extended for an additional year if the program can demonstrate adequate progress towards the passage rate standard during the probationary period Approved programs that are terminated, and that have students with at least 12 credits who transfer to other programs licensed by the Commission for Independent Education (CIE), will not have their licensure examination scores counted in the program passage rate for the new program

5 Nursing Law Update Highlights (Continued) All existing approved professional nursing programs must be accredited in accordance with s , F.S. by July 1, Any professional nursing program approved after July 1, 2014 must be accredited in accordance with s , F.S. within 5 years of enrolling students. NOTE: Section , F.S. currently defines Accredited program as a program for the prelicensure education of professional or practical nurses that is conducted in the United States at an educational institution, whether in this state, another state, or the District of Columbia, and that is accredited by a specialized nursing accrediting agency that is nationally recognized by the United States Secretary of Education to accredit nursing education programs

6 Clinicals Clinicals must cover all competencies Professional nursing (Associates or Bachelors) medical, surgical, obstetric, pediatric, geriatric, and psychiatric Practical Nursing (Diploma) medical, surgical, obstetric, pediatric, and geriatric No more than 50% of clinical training consists of simulation Clearly indicate which site and competency consists of simulation Settings acute care, long-term care, and community 6

7 Clinicals Adequate clinicals are extremely important to the Commission Information needed on each clinical site to properly evaluate adequacy: Distance from institution Name and address of the site If a healthcare facility, indicate the setting (i.e., acute, long-term, community) Competency covered at the site Site contact name, phone number and 7

8 Clinicals Information needed on each clinical site to properly evaluate adequacy (continued): Number of students the facility can accommodate Agreement status (i.e., begin and end dates, auto renewal, or no expiration date) Ratio of site supervisor to students 8

9 Clinicals Exhibits needed: If multiple institution locations use the same site, attach a schedule for each location If over 50 miles from the school, attach an explanation of how the students will be accommodated for the travel Must be disclosed in student catalog Complete copies of executed clinical agreements Must include programs included and all signatures 9

10 Clinicals Common issues with clinicals Distance from school location Who pays for the travel cost? Is a passport required? Dependent upon Board of Nursing interpretation Are immunizations required? Proper competencies not covered Improper disclosure to students Expired or dated agreements 10

11 Licensure Pass Rates Monitored by CIE staff Probation will result in finding of substantive change and issuance of provisional license Substantive change fee is $1,000 Program termination will result in rescission of CIE approval Nursing assistant programs - approval will be rescinded even if approval is received for another program Since the program is issued a new code by the BON, the institution must reapply for a new program with CIE Considered 2 separate programs

12 Licensure Pass Rates Summary reports provided to Commissioners Reports are attached to any institutional action on a Commission agenda Report includes: Disclosure of probationary status Pass rates for previous 2 years Current year s quarterly pass rates Attachments such as clinical agreements, documentation regarding programmatic accreditation, and any documents related to probationary status

13 Licensure Pass Rates CIE action taken when pass rates are low and not on probation Require a remediation plan to address low rates Submission of an update regarding programmatic accreditation Quarterly reporting to Commission on effectiveness of the plan Efforts to address poor passage rates must be handled carefully (e.g., practice tests) Negative impact can result

14 Programmatic Accreditation Professional nursing programs only, not practical nursing May require prior institutional accreditation CIE will ask for updates any time institution is before the Commission

15 Programmatic Accreditation All existing approved professional nursing programs must be accredited in accordance with s , F.S. by July 1, 2019 Any professional nursing program approved after July 1, 2014 must be accredited in accordance with s , F.S. within 5 years of enrolling students

16 Programmatic Accreditation Must be a specialized nursing accrediting agency that is nationally recognized by the United States Secretary of Education to accredit nursing education programs CIE will monitor progress Will need to start the process right away If adequate progress is not made by year 4 then Commission action may occur Will be required to start training out students

17 On-site Visits Conducted by CIE staff prior to initial approval and upon annual review of licensure (including LBMA) Possibly clinical sites Verify adequacy of equipment and facilities Talk to students and faculty 17

18 Financial Financial must demonstrate sufficient resources for operations and discharge of obligations to students Failure to demonstrate sufficient resources may result in finding of substantive change and issuance of provisional license For new institutions/programs, institution must also demonstrate sufficient resources to fully fund the start of the program 18

19 Remediation Plan Be specific, include details Remediation plans must include specific benchmarks to identify progress toward a graduate passage rate goal CIE will monitor effectiveness of plan 19

20 Commission Action Rescind approval for terminated programs Find a substantive change and issue a provisional when placed on probation Monitor passage rates and require remediation plans when pass rates are low, even if not on probation Track progress towards obtaining programmatic accreditation for professional nursing programs 20

21 Faculty Qualified faculty Adequate number of faculty to accommodate students PN s can now teach CNA programs.

22 Communication Keep the Commission/Executive Director informed Major changes or issues should be communicated immediately Failure to communicate certain changes may result in issuance of a citation Change in location Minor program modification Substantive change Accreditation Status 22
