5 Dispatching Services DISPATCH AGENT /CARRIER AGREEMENT THIS AGREEMENT made this day of, 20.USA Transportation Logistics LLC, Dispatching Service of, Jonesville, South Carolina (the Agent ) and (the Trucking Company ). The Purpose of this Agreement is to create a document whereby Named Carrier authorizes USA Transportation Logistics LLC, to act as dispatch and to secure and/or locate loads for Named Carrier from time to time. DISPATCHERS RESPONSIBILITY It shall be the dispatcher s responsibility to search for available loads for said trucking company as instructed by the owner of said company. It is the dispatcher s responsibility to obtain said load with the owner/operators full consent and authority, which shall be evidenced upon the execution of this contract. The dispatcher shall try to get the best possible prices for loads obtained for the trucking company. The dispatcher shall ensure that all possible loads dispatched through brokers and or shipper direct freight shall be investigated for credit worthiness prior to the acceptance of said load. Dispatcher shall also obtain verbal consent from the owner operator prior to accepting any available freight for hire. It is also the dispatcher s responsibility to provide and sign all carrier s packets and contracts on behalf of said trucking company, fax and/or copies of all executed documents on behalf of the trucking company. It is also guaranteed that while in transit from the pick- up point to the delivery point that the dispatcher shall begin obtaining the trucking company s next load as instructed by said trucking company to help facilitate quick turnarounds and or backhauls. It is also the dispatcher s responsibility to give daily check calls to the company/broker that has hired said company to provide transport services. The dispatch company agrees to use all means necessary to obtain freight for the trucking company, direct shippers and/or any brokered loads. TRUCKING COMPANY S RESPONSIBILITY It shall be the trucking company s responsibility to keep in contact with the dispatcher during the line haul and to keep the dispatcher informed of any problems that may occur. All check calls must be made as follows or there may be a $25.00 fine: At the time of dispatch to confirm arrival time at the pickup location. At the time of arrival at the pickup location. Upon departing the pickup location. Daily by 10:00 am while en-route to destination.
6 Upon arrival at destination to unload. When the truck is unloaded and to give notification when they are ready for another load. It is the responsibility of the Trucking Company to keep their dispatcher up to date on their status for taking loads. The trucking company must be licensed according to State and Federal Law and carry a valid and current Motor Carrier Permit and be fully insured. Minimum Liability of $750, and Minimum Cargo insurance of $100, and must provide an Insurance Certificate with USA Transportation Logistics LLC as a Certificate Holder. It is also the trucking company s responsibility to pay the dispatching service according to the plan the trucking company has chosen. If the Trucking Company has chosen to pay by load the payment per load must be paid for upon verbal acceptance and booking of said load. The Trucking Company agrees not to back-solicit any of USA Transportation Logistics LLC, shippers or brokers. If the Trucking Company back solicits any Customers there shall be a $ fine imposed for each. It is the responsibility of the trucking company to keep all Carrier Package documents up to date and provide USA Transportation Logistics LLC, with replacement documents when necessary. It is also the responsibility of the trucking company to keep USA Transportation Logistics LLC up to date on the equipment and drivers availability. Mutual Agreement It is understood that USA Transportation Logistics LLC had built a reputation with shippers and brokers in providing quality transport services and it is to be understood by the trucking company it is imperative to maintain said reputation and carrier agrees to abide by any special conditions that each shipper or broker requires when taking a load. It is understood that USA Transportation Logistics LLC, is not liable for any loss of equipment or load damage or injury to driver (s). In the event of an accident or damaged freight, it is between the trucking company, shipper and or consignee and Insurance Company. It is agreed and Understood by both parties that, as a result of failure to remit payment to provide USA Transportation Logistics LLC as per this Agreement, all activity on behalf of Named Carrier will cease and request for payment will be placed in collection. It is also agreed that if provide USA Transportation Logistics LLC must use collection procedure/agents, Named Carrier will bear all collection costs, including reasonable attorney fees. This Agreement is a continuing agreement until cancelled by either party upon written notification. This Agreement may not be assigned without written consent of other party, and shall be governed by the laws of the state of South Carolina. Accepted on this day of, 20.
