1 ..1 INTERNATIONAL REGULATORY NEWS UPDATE - No. 2: 2015 ENVIRONMENT HEALTH & SAFETY SOCIAL INFRASTRUCTURE CLIMATE CHANGE SUSTAINABILITY Envirotrends the regulatory news & documentation services I N T E R N A T I O N A L INTERNATIONAL ORGANIZATION FOR STANDARDIZATION (ISO) TO PUBLISH ITIRST EVER STANDARD ON OCCUPATIONAL HEALTH AND SAFETY- ISO 45001:2016 Introduction: An organization is responsible for ensuring the Health and Safety (H&S) of the people working for it and minimizing the risk of harm of its activities to the people (e.g. its workers, its managers, contractors, or visitors), particularly if they are engaged by the organization to perform those activities as part of their Occupation. An organization s activities can pose a risk of injury or ill-health, and can result in a serious impairment of health, or leading to even fatality, to those working on its behalf. Consequently it is important for the organization to eliminate or minimize its Occupational Health and Safety (OH&S) Risks by taking appropriate preventive measures. OH&S Management System of an organization can therefore translate its intentions to prevent incidents into a systematic and ongoing set of processes (supported by the use of appropriate methods and tools) and can reinforce the organization s commitment to proactively improve its OH&S Performance. It is logical that those working closest to an OH&S Risk will be knowledgeable about it. As such, the participation of workers in the establishment, implementation and maintenance of an OH&S Management System can play an important role in ensuring that the risks are managed effectively. In view of the above, International Organization for Standardization (ISO) is developing an OH&S Management System Standard: ISO 45001, which is expected to be published by October , is intended to enable organizations to manage their OH&S Risks and improve their OH&S Performance. The implementation of an OH&S Management System will be a strategic decision for an organization that can be used to support its sustainability initiatives - ensuring people are safer and healthier and increase profitability at the same time. 1. BS OHSAS Before 1999, organizations had to choose from a range of National Health and Safety Standards and proprietary Certification Schemes. This led to confusion and fragmentation in the market, due to a number of individual schemes that create potential trade barriers undermining their credibility. Drawing on the best of these existing Standards and Schemes, the OHSAS Project Group (with British Standards Institution (BSI) as the Secretariat) published the Occupational Health and Safety Assessment Series (OHSAS Series) in The Series had two (2) Specifications: OHSAS focuses on the requirements for an effective OH&S Management System and OHSAS offers Practical Implementation Guidelines. By 2005, around 16,000 organizations in more than 80 countries were certified to OHSAS Please follow the link for more information: OCTOBER

2 In July 2007, the OHSAS specification was updated and more closely aligned with the Framework of other Management System Standards (MSS) such as ISO This helped organizations to bring their existing Management Systems more easily in line with the Standard. The United Kingdom (U.K.) then decided to adopt OHSAS as a British Standard (BS) and created BS OHSAS Framework of OSHAS An efficient OH&S Management System promotes a safer and healthier working environment for everyone involved. Thus, BS OHSAS is designed to help organizations implement a framework that identifies and controls H&S Risks, reduces potential accidents, aids in legislative compliance to improve their overall performance. It lays out all the elements that can be integrated with other Management Systems to boost a company s OH&S Performance. The Standard also demonstrates how to develop and implement a Policy with the right objectives for organizations of all types and sizes, covering diverse geographical, cultural and social conditions. After its publication, despite not being an ISO Standard, BS OHSAS quickly gained popularity, with a recent OHSAS Standards and Certificates Survey showing that organizations in over 127 countries are currently using the Standard. 2. DEVELOPMENT OF A NEW INTERNATIONAL STANDARD 2.1 Need for an ISO Standard Every day, across the globe, shocking statistics for Health and Safety incidents, accidents and their related costs are recorded. The International Labour Organization (ILO) revealed in 2014 that every year, 2.34 million people throughout the world lose their lives due to accidents at the workplace 3. Such vital statistics for H&S incidents, accidents and their related costs recorded every day, and a pressing desire from business and interested parties, highlight a global need to synchronize H&S Management Systems using an internationally recognized Standard. Further, although Companies tend to use generic H&S Guidelines or National and Consortia Standards, none of these demonstrate global conformity. A recent OHSAS Standards and Certificates Survey has shown a rapid increase in the use of OHSAS and equivalent Standards over the last decade. With over 127 countries currently using these Standards, there is a worldwide need to harmonize H&S Management Systems using an International Standard and share best practices. Making a Global Difference The need for an International Standard in the field of OH&S can be seen at local, national, regional and global levels applying to both Developing and Developed Countries. With an International Standard to refer to, together with the right infrastructure and training, these organizations will be able to address their risks better in future. More and more Companies also want detailed information about their suppliers OH&S practices to protect their brands. 3 Third Party Certification helps to demonstrate that a business is meeting its requirements effectively whilst the process of achieving and maintaining Certification helps ensure that it is continually improving across all areas of the organization. Therefore, a New International Standard is required in the field of OH&S that will provide a basis for such Third Party Certifications, thus supporting new areas of Management Systems to ensure better compatibility and systems governance, making the implementation within an organization a lot smoother. 2.2 Development of ISO 45001: 2016 In 2013, ISO approved the creation of a New Project Committee (PC) to develop an International Standard for OH&S. The work is being overseen by ISO PC 283. The ISO PC has been tasked with transforming OHSAS into an ISO Standard, ISO The Secretariat of ISO/PC 283 has been assigned to BSI. There are currently 50 countries/organizations working on or involved in producing ISO 45001, including the ILO. Stages of Development 4 ISO/PC 283 was established in June The First Meeting of the Committee ISO/PC 283 was in October 2013, where the Committee decided that the new Standard would carry the number ISO 45001, because the number has already been assigned to a different Standard. The purpose of the Meeting was to review the comments received on the revised Draft and to produce the First Working Draft (WD1). Working Group 1 was established. PC held Open Forum session after the Opening Plenary Meeting to consider some key issues (such as risk, people, workplace and so on) in order to allow participants to contribute to the discussions. PC examined the timeline for the development of ISO 45001:2016 Standard and determined the target date for publication in October The First Working Draft (WD1) was produced in December In January 2014, the first face-to-face Meeting of the United States Technical Advisory Group (US TAG) was held in Washington DC to review WD1 of future ISO The comments on the First Working Draft were reviewed in March 31 April 4, In July 2014, the ISO/CD (Committee Draft 1) was published. IMPACT OF THE NEW STANDARD ON ORGANIZATIONS Even though various parties have expressed the need for an International H&S Standard for some time, many global organizations were concerned about how it would affect and work with their local Regulations. To address these challenges and protect workers around the world, the ILO is a key player in the development of ISO Once published, the Standard will apply to any organization wishing to: Establish and implement an internationally recognized OH&S Management System to reduce or minimize risks to personnel and other relevant parties. Maintain and constantly improve their H&S Performance. Keep all operations in line with their stated H&S Policies to an internationally recognized Standard. 3.1 Who are the Intended Users of the new Standard? It should not matter if an organization is a micro business, or a global conglomerate; if it is a nonprofit organization, a charity, an academic institution, or a government department. As long as the organization has people working on its behalf, or who may be affected by its activities, then using a systematic approach to managing health and safety will bring benefits to it. The Standard can be used by small low risk operations equally as well as by high risk and large complex organizations. While the Standard requires that OH&S Risks are addressed and controlled, it also takes a risk based approach to the OH&S Management System itself, to ensure that it is effective and is being improved to meet an organization s ever changing Context (explained in Section 5.3). 5 sets out the High Level Structure, Identical Core Text, common terms and core definitions that form the nucleus of the future and revised MSS such as ISO The New Structure helps to combine and integrate different Management Systems and is a unified Guideline used for development of all new ISO Standards 8. The reason behind this crucial change is that despite sharing common elements, all the ISO MSS have different structures. Thus, in order to bring some uniformity and to help make the implementation process smoother, the ISO has introduced the Annex SL- High Level Structure which describes the framework for a Generic Management System. All new ISO MSS will adhere to this framework in their next revision. 4.1 Details of Annex-SL Structure Annex-SL defines the proposal process for a MSS and the Rules for drafting a MSS using a common approach. It consists of nine (9) Clauses and three (3) Appendices. The impact of Appendix- 2 of Annex-SL will be felt by all users of MSS in the future. Appendix-2 comprises of following three (3) parts 9 : High Level Structure; Identical Core Text; and Common Terms and Core Definitions. 6 to fewer conflicts, duplication, confusion and the misunderstandings that generally took place as a result of different MSS Structures Plan-Do-Check-Act (PDCA) Cycle in the Structure of ISO 45001:2016 Just like the OHSAS 18001, the revised Standard is based upon the PDCA Cycle. However, this revised version of PDCA Cycle incorporates the internal and external issues, needs & expectations of the stakeholders, and recognizes the role of the Top Management during the course of the cycle. The following Figure shows the comparison of two (2) versions of the PDCA Cycle. PDCA Model as per OHSAS 18001: PDCA Model as per ISO 45001: Table 1: Comparison of PDCA Cycle of ISO 45001:2016 and BS OHSAS 18001: ANTICIPATED STRUCTURE OF ISO 45001: IN REFERENCE TO BS OHSAS 18001: Draft ISO includes Familiar Concepts and Requirements The purpose of the Draft ISO remains almost similar to that of OHSAS 18001, i.e., it retains many familiar concepts and requirements. The stated purpose of the Draft ISO is to enable an organization to proactively improve its OH&S Performance in preventing injury and illhealth ; whereas the purpose of OHSAS is given as to enable an organization to control its OH&S Risks and improve its OH&S Performance. Familiar concepts and requirements include application of the PDCA Model, setting Policy, setting Objectives, carrying out Internal Audit, and Management Review. In many cases, the current requirements have been carried over from OHSAS 18001, although with some minor changes of wording at times. 7 INTERNATIONAL REGULATORY NEWS UPDATE - No. 2: 2015 Management Systems may well already address the new requirements since they have largely only been re-arranged to fit in with the Annex SL structure. 5.2 Draft IS includes some New Terms and Definitions The Draft ISO has introduced some significant new definitions for fulfilling the newly defined and modified purposes of the document. Some of the newly added terms include Top Management, Documented Information, Process, Outsourcing, Worker, Contractor, Representative and Legal Requirements. Definitions of few terms, such as, OH&S Performance and Continual Improvement have been modified in the Draft ISO Draft ISO includes some New Clauses and Replacements a) New Clauses i) Context of the Organization (Clause 4) 4.1 Understanding the Organization and its Context 4.2 Understanding the Needs and Expectations of Interested Parties 4.3 Determining the Scope of the EMS 4.4 OHS There is a stronger focus on the Context of organizations in the Draft ISO The concept of Context requires organizations to look beyond H&S within their own facilities and to take into account the working conditions along the supply chain. The intent of this new Clause is to provide a High-Level, Conceptual Understanding of important issues that can affect, either positively or negatively, the way the organization manages its responsibilities in relation to the OH&S Management System for persons working under its control. The issues of interest are those that affect the organization s ability to achieve the intended outcome, including the objectives it sets for its OH&S Management System, which include meeting its OH&S Policy commitments. Examples of the Issues are: a) External Issues such as the Cultural, Social, Political, Legal, Financial, Technological, Economic and Natural Surroundings and Market Competition, whether International, National, Regional or Local. b) Internal Issues of the organization such as Governance, Structure, Roles and Accountabilities and the Organization s Culture. The results of the Context Review should be used to assist the organization in understanding and determining the scope of its OH&S Management System, determining its risks and Opportunities, developing or enhancing its OH&S Policy, setting its OH&S objectives and determining the effectiveness of its approach to maintaining compliance with applicable legal requirements and other requirements to which the organization subscribes. Also, as per Sub-clause 4.2, the organization has to understand the needs and expectations of Workers and other Interested Parties that are relevant to the OH&S Management System, and then the relevant requirements of those interested parties. However, there is no expectation that the organization shall comply with all those relevant requirements. The Interested Parties needs and expectations are not necessarily compliance requirements of the organization. It is important to distinguish between what these needs and expectations will lead to. These may include: OCTOBER

8 Mandatory Requirements, Laws, Regulations. Voluntary commitments to Interested Parties to which the organization voluntarily subscribes. Needs and expectations from Interested Parties only become obligatory requirements for an organization if that organization chooses to adopt them. Furthermore, as per the understanding of Sub-clause 4.3, Draft ISO states that the Scope shall include all the activities, products or services within the organization s control or influence that can impact on the organization s OH&S Performance. The guidance given in Annex A of the Draft in regard to the Scope advises that: Supply and Procurement Policies should address hazards and potential OH&S risks to persons in the organization and, as far as possible, impacts on persons, outsourced or subcontracted, carrying out activities or producing products or services for the organization. ii) Leadership (Clause 5) 5.1 Leadership and Commitment 5.2 Policy 5.3 Organizational Roles, Responsibilities, Accountabilities and Authorities. Although some Sub-clauses of Clause 5 in the Draft ISO may seem familiar to users of OHSAS 18001, there are significant new and enhanced requirements. The Top Management now has a stronger role to play in the organization s activities. H&S has become a central aspect of the overall Management System, requiring a firm commitment from Top Management. This Clause calls for the organization s Top Management to demonstrate their involvement and engagement with the OH&S Management System through direct participation in, for example: Taking OH&S Performance into account in Strategic Planning. Communicating the importance of effective OH&S Management and of conforming to the OH&S Management System requirements. Directing and supporting persons to contribute to the effectiveness of the OH&S Management System for all functions. Promoting and leading organizational culture with regard to the OH&S Management System. Top Management shall identify one (1) or more of its members to be accountable for the OH&S Policy and OH&S Management System. Note: These are the activities Top Management is required to carry out, and cannot delegate to others. Thus, the Top Management assumes an active role in the OH&S Management System. The leaders must also ensure integration of the OH&S Management System requirements into the organization s business processes. b) Revised Requirements Documented Information (Clause 7.5) OHSAS requirements for Documentation and Records are largely transferred to Sub-clause 7.5-Document Information in the Draft ISO 45001, with revisions. Sub-clause 7.5 is further divided into three (3) parts: OCTOBER

9 7.5.1 General; Creating and updating; and Control of Documented Information. INTERNATIONAL REGULATORY NEWS UPDATE - No. 2: 2015 The significant change is use of the term Documented Information not Documents and Records as is the case in OHSAS Documented Information includes processed information held for example on smartphones, tablets, etc. c) Introduction of Continual Improvement as a New Sub-clause (Sub-clause 10.2) Draft ISO has a specific Clause 10 for Improvement. Under this Clause, Continual Improvement is a separate Sub-clause in Draft ISO 45001, unlike OHSAS where it is shown in the OH&S Management System Model as coming from the interaction of Policy, Planning, Monitoring and Review, etc. However, familiar concepts include Incident, Nonconformity and Corrective Action (Sub-clause 10.1) as well as a specific requirement for Continual Improvement. d) Replacements in the New Standard Reference to Preventive Action is omitted from the Draft ISO The term Preventive Action, and any specific reference to it has been removed. This stems from the approach of Annex SL. Preventive Action of OHSAS has been replaced with: Sub-clause 4.1 (Determination of External and Internal Issues). Sub-clause 6.1 (Actions to address risks associated with Threats and Opportunities). Sub-clause 5.2 (Commitment to satisfy applicable legal and other requirements to which the organization subscribes). Sub-clause 8.6: Emergency Preparedness and Response (where Potential Emergency Situations are identified and planned for and the Emergency Procedures are tested). The hierarchy of control is a concept the OH&S Practitioners and Auditors are familiar with. The requirement in OHSAS to consider reducing risks according to a hierarchy of controls is strengthened in Draft ISO 45001, which requires a Policy Commitment to the control of OH&S risks through a hierarchy of control and mandates use of the hierarchy in Sub-clause 8.1- Operational Planning and Control. This is one (1) of the changes in the Draft where what may have seemed optional in OHSAS is mandatory in Draft ISO e) Enhanced Requirements in the New Standard Draft ISO places more emphasis on Risk Management and ongoing Assessment of Risks and Opportunities (Sub-clause 6.1) to prevent and reduce the undesired effects. Also, there is a strengthening of the requirement to demonstrate and understand compliance status at all times (with Legal and other requirements ). There are specific Sub-clauses and requirements for Procurement (Sub-clause 8.4) and Contractors (Sub-clause 8.5), clarifying and expanding requirements of OHSAS Also a specific requirement on outsourcing of operations The organization shall ensure that outsourced processes affecting its OH&S Management System are controlled. There are enhanced requirements for the use of Performance Indicators to monitor performance (Sub-clause 9.1- Monitoring, Measurement, Analysis and Evaluation) and track OH&S OCTOBER

10 Performance including status and trends in Monitoring and Measurement Results (9.3 Management review). 6. BENEFITS OF USING ISO 45001: A BRIEF SUMMARY An ISO based OH&S Management System will enable an organization to improve its OH&S Performance 14 by: Developing and implementing an OH&S Policy and OH&S objectives. Establishing systematic processes which consider its Context and which take into account its risks and opportunities, and its legal and other requirements. Determining the hazards and OH&S Risks associated with its activities; seeking to eliminate them, or putting in controls to minimize their potential effects. Establishing operational controls to manage its OH&S Risks and its legal and other requirements. Increasing awareness of its OH&S Risks. Evaluating its OH&S Performance and seeking to improve it, through taking appropriate actions. Ensuring that the workers take an active role in OH&S matters. In combination, these measures will ensure that an organization s reputation as a safe place to work will be promoted, and is likely to have more direct benefits, such as: Improving its ability to respond to regulatory compliance issues. Reducing the overall costs of incidents. Reducing interruption and the costs of disruption to operations. Reducing the cost of insurance premiums. 13 Recognition for having achieved an international benchmark (which may in turn influence customers who are concerned about their social responsibilities). 8. RECOMMENDATIONOR ORGANIZATIONS: THE WAY FORWARD Organizations are recommended to monitor the changes in the upcoming Drafts of ISO which shall ensure that the management is aware about the expected changes and the requisite resources are available once the New Standard is published. Those adopting the Standard, once it has been published, should find its requirements consistent with the other Standards and develop a transition plan. This will allow for a relatively easy migration from using an existing OH&S MSS to using ISO 45001, and will also allow for the alignment and integration with the requirements of other ISO MSS into their organization s overall management processes. It may be useful to carry out a Gap Analysis against the requirements of ISO 45001:2016 and training of Internal Auditors and other key personnel on the new Standard. The new requirements will certainly involve some additional time and effort- But in the end it will be worthwhile. The fact that ISO points towards the future is definitely a positive challenge for users when it comes to the economically successful and sustainable development of their organization. Also, the organizations operating Quality Management System, Environmental Management System and OH&S Management System will have a unique opportunity to align and integrate these three (3) Management Systems, if they choose to do so.
