3 Public Hearing Summary and Analysis FM 3380 (Manuel F. Aguilera Highway) I. INTRODUCTION On Tuesday, July 29, 2014 the Texas Department of Transportation (TxDOT), the County of El Paso, and the Camino Real Regional Mobility Authority conducted a public hearing for the proposed FM 3380 (Manuel F. Aguilera Highway Phase II) from 0.35 Mile South of SH 20 (Alameda Avenue) to IH 10 in eastern El Paso County, Texas. The Public Hearing was held at the Rogelio Sanchez Road and Bridge Building located at 1331 North Fabens Road, Fabens, Texas The hearing included an Open House followed by a formal presentation and public comment period. The purpose of the hearing was to: Provide an opportunity for the public to view exhibits showing the proposed build alternative and to discuss comments/concerns in a face to face dialogue; Provide technical information regarding the proposed project; and Officially record comments/concerns from the public. II. NOTICES AND PRESS RELEASES The hearing was published in English and Spanish in the El Paso Times and El Diario, respectively. Publication dates were as follows: Newspaper Language Publish Dates El Paso Times English Sunday, June 29, 2014 Sunday, July 20, 2014 El Diario Spanish Sunday, June 29, 2014 Sunday, July 20, 2014 In addition, the County of El Paso published official press releases on Monday, July 28, 2014 and on July 29, TxDOT also posted a web page with public hearing information for this project. These above notices, affidavits, and press releases are included as Appendix A. Prior to and during the hearing, the local public was informed of the event by use of a county vehicle with a digital marquee parked at the entrance to the venue. Two additional TxDOT message boards were placed along Fabens Road, visible to traffic in each direction. 1

Aguilera Highway) Letters were mailed on June 26, 2014 to 60 public officials, providing them with information regarding the planned public hearing date. An example of a public official notification letter and the list of recipients is included in Appendix B. In addition, 21 owners of adjacent and nearby properties were provided the English and Spanish version of the newspaper hearing notice by mail. This list, also included in Appendix B, includes other area landowners who received notices in the past and/or attended a prior meeting. III. LOGISTICS A table with sign in sheets (Appendix C), speaker cards and comment forms 1 (Appendix D) were set up at the venue s entrance. Comment forms were provided that included instructions for submitting comments. Instructions were verbally reiterated before and after the formal presentation. A bilingual English/Spanish interpreter was on site to provide live Spanish translation during the hearing. Individuals were able to listen to the translation through the use of individual wireless headsets. A court reporter was on hand to record the hearing minutes. A transcript of the hearing is included in Appendix E. Multiple informational and graphic boards were displayed at the venue s entrance, as well as within the hearing room. See Appendix F. 1 Comment forms provided during the public hearing included an incorrect project description. The County of El Paso corrected this error by adding to their website a statement regarding the error, and a new comment form was made available on the website for formal written comments. The website notice and corrected forms are included in Appendix D. 2

5 Public Hearing Summary and Analysis FM 3380 (Manuel F. Aguilera Highway) IV. ATTENDANCE Twenty (20) citizens, three public officials, and one member of the media were present at the hearing. Public officials included Arlina Palacios, House District 75 District Director; Jose Landeros, Policy Advisor (El Paso County Commissioners Court, Precinct #3), and Vince Perez, Commissioner (El Paso County Commissioners Court, Precinct #3). In addition, project representatives from TxDOT, Structural engineering Associates, the County of El Paso, Camino Real Regional Mobility Authority (CRRMA), and Dannenbaum Engineering were on site to provide information concerning the project. V. FORMAT AND PROCEDURE The open house began at 6:00 pm. The open house allowed attendees an opportunity to hold an open dialogue with project representatives. 3

Mr. Robert Bielek, District Engineer for the TxDOT El Paso District, opened the hearing. He discussed the need and purpose of the project, and summarized previous public meeting comments related to the Manuel F. Aguilera Highway project. He also discussed methods for providing comments on the proposed project. 4

(Structural Engineering Associates) then began the technical presentation, during which he discussed engineering and other aspects of the project, such as right of way requirements, proposed roadway/overpass dimensions and features, project funding, and a project timeline. Mr. Sam Blanco, AICP (Raba Kistner Environmental) then discussed environmental and cultural resources that were evaluated as part of the Environmental Assessment (EA). Mr. Blanco discussed the potential to encounter threatened species in the project area, as well as the status of archaeological studies and tribal consultation that were conducted as part of the project. The slideshow presentation is included in Appendix G. After the technical presentation, a 15 minute break was provided. After the break, the hearing resumed. Speaker cards were read aloud to call upon those wishing to speak their comments or concerns. Attendees were invited to continue viewing exhibits and to ask further questions at the end of the comment period. 5

STAKEHOLDER COMMENTS During the course of the hearing and subsequent comment period, a total of two comments were received. Two speaker cards were completed during the hearing; however, only one of these speakers remained at the hearing for the comment period. He was able to provide his verbal comments at that time. In addition, one comment was received by mail after the hearing date. The following table summarizes these comments: Commenter Format Nature of Comment Reference James R. McDonald Jose L. Appendix E (Pages of transcript text) Appendix H In response to Mr. McDonald s name change request, it is within the purview of El Paso County Commissioners Court to change the name of the roadway. This can be done during any Commissioners Court Meeting with a properly posted agenda item. On September 11, 2014 Mr. McDonald s suggestions were forwarded for consideration to El Paso County Judge, Veronica Escobar, and to the Commissioner whose precinct includes the Port of Entry roads, Vincent Perez. In response to Mr. Marquez s comment regarding the project design, in March 2013 the Federal Highway Administration (FHWA) provided a comment regarding the Draft EA as it stood at that time. During that time, the Draft EA discussed an alternative similar to that suggested by Mr. Marque, which was dismissed from further study. Since the alternative was not considered viable, FHWA suggested that a memo be placed in the file regarding its dismissal and rationale. FHWA also recommended limiting the EA discussion to One Build (the preferred alternative) and the No Build. This suggestion was followed, and a memo dated July 24, 2014 was placed in the project file (Appendix I). VII. CLOSING In July of 2014, TxDOT, the County of El Paso, and the CRRMA conducted a public hearing for the proposed FM 3380 (Manuel F. Aguilera Highway). The hearing was publicized prior to the meeting through various outlets in English and Spanish, and was well attended. Two citizens provided comments. One requested a name change for the proposed roadway, and the other suggested a design modification. These comments and responses are discussed in the previous section. The potential for a name change appears to be the only viable request, and the appropriate individuals have been made aware of this request. 6

Aguilera Highway) from 0.35 Mile South of State Highway 20 (Alameda Avenue) to IH-10 El Paso County, Texas CSJ: The Texas Department of Transportation (TxDOT), the County of El Paso, and the Camino Real Regional Mobility Authority will conduct a public hearing on Tuesday, July 29, 2014 for the proposed FM 3380 (Manuel F. Aguilera Highway) from 0.35 Mile South of SH 20 (Alameda Avenue) to IH-10 in eastern El Paso County, Texas. The Public Hearing will be held at the Rogelio Sanchez Road and Bridge Building located at 1331 North Fabens Road, Fabens, Texas The hearing will consist of an Open House followed by a formal presentation. The Open House will begin at 6:00 pm. to allow for questions and review of project exhibits. The formal presentation will begin at 7:00 p.m., followed by a public comment period. During the formal comment period no questions will be answered. The purpose of the hearing is to provide information about the proposed improvements. The County of El Paso recently completed construction of a county-funded portion of Manuel F. Aguilera Highway (referred to as Phase I), which extends from the new Tornillo-Guadalupe Port-of-Entry (POE) to SH 20 (Alameda Avenue), southwest of Tornillo, El Paso County, Texas. The Current Project consists of a new 3.88-mile section of Manuel F. Aguilera Highway from 0.35 mile south of SH 20 to I- 10. Phase II will build a two-lane roadway providing a direct connection from Manuel F. Aguilera Highway Phase I to I-10. This phase would construct an overpass over the SH 20 and adjacent Union Pacific Railroad (UPRR) rights-of-way. The Horizon 2040 Metropolitan Transportation Plan (MTP) lists the Year of Expenditure for Phase II as A total of acres of land is needed for the project. Maps showing the project location and design, the environmental document, tentative construction schedule, and other information relative to the project file are on-file and available for review at the El Paso County Road and Bridge Office located at 800 East Overland Avenue - Suite 407, El Paso, Completed: Int l Bridge & POE Facilities (County Project) Current Project: M.F. However, residents reached bytelephone Saturday evening said militants were still in control oftikrit, apredominantly Sunni city of more than 200,000, and patrolling the city s streets. They confirmed the clashes around the university, and reported fighting between the Islamic State and Iraqi forces to the southeast of the city as well. Some residents described black smoke rising from a presidential palace complex located along the edge of the Tigris River after armyhelicopters opened fire onthe compound. They spoke oncondition of anonymity out of concern for their safety. Many locals had already fled the city in anticipation of agovernment assault, said another Tikrit resident, Muhanad Saif al-din. Tikrit has become a ghost town because alot of people left over the past 72 hours, fearing random aerial bombardment and possible clashes as the army advances toward the city, Saif al-din said. SouthofBaghdad,heavy clashes between security forces and Sunni insurgents inthe town of Jurf al-sakhar killed at least 21 troops and dozens ofmilitants, police and hospital officials said oncondition of anonymity because they were authorized to brief the media. Jurf al-sakhar, located some 30miles outside the capital, ispart of a predominantly Sunniribbon that runs just south of Baghdad. The Islamic State, which already has seized control of vast swaths in northern and easternsyria,aimstocreate astate straddling Syria and Iraq governed byislamic law. In Iraq, the group has formed an alliance of sorts with fellow Islamic militants as well as former members of Saddam s Baath party to fight al-maliki s Shiite-led government. The militants have tapped into deep-seated discontent among Iraq s Sunni community with al-maliki, who has been widely accused ofmonopolizing power and alienatingsunnis. Theprime minister s failure topromote national reconciliation has been blamed for fueling Sunni anger. The United States and other world powers have pressed al-maliki to reach out tothe country s Sunni and Kurdish minorities and have called for amore inclusive government that can address long-standing grievances. A 2011 study by MGT of America found that El Paso police were spending too much time booking prisoners and recommended that the department contract out prisoner services to save time and money. During a City Council presentation in July 2012, Police Chief Greg Allen said that a pilot program would save the equivalent in time of 10 full-time employees at each of the two police regional commands, freeing officers from administrative duties to respond to calls for help. Officials did not provide the number of people on an average flight. If the planes are similar to the ones used to transport immigrants from South Texas to El Paso, they can carry up to 135 passengers. They include things such as the length of immigration proceedings or whether they have valid protection or asylum claims, among other factors, ICE officials said. The reasons for the sudden surge of Central American immigrants continues to be the focus of debate. Wong authored a statistical analysis earlier this month examining reasons for the surge. He said that while violence was a systematic reason for the immigration of some 57,000 unaccompanied minors to the U.S., misinformation about U.S. immigration policies cannot be cited as the exclusive reason for the influx. Last September, the council unanimously approved a $1.3 million one-year contract that expanded the program to all five regional Violence, Not U.S. Immigration Policies, is Behind the Surge of Unaccompanied Children Crossing the Border, was first published by progressive Washington, D.C. think tank, the Center for American Progress on July 8. The report was updated and released by the Center for Comparative Immigration Studies. Wong s analysis says: It s not U.S. policy but rather violence and the desire to find safety that is the impetus for these children s journeys. Wong clarified that while the title of his report might suggest otherwise, his statistical data points to a number of reasons for the influx of Central American immigrants. These include violence, misinformation and poverty. They are not mutually exclusive, Wong said. Wong is an assistant professor at UCSD s political science department. Leaked by Breibart News on July 7, the EPIC report says that erroneous information spread by smugglers and Spanish media and not necessarily violence is causing the spike of Central Americans trying to enter the country illegally. If the argument is that this information is the sole cause of unaccompanied minors coming to the United States, I totally disagree, Wong said about the report. Causality is a very technical concept that s being discussed much too loosely, in my opinion, Wong said. The report states that in 2012, El Salvador, Guatemala, Honduras and Mexico had 41,828 homicides, at a rate of 28 per 100,000. commands, documents stated. The citywide program was projected to save the time equivalent to 18 full-time officers. When a person is arrested, they are handed over to a G4S crew made up of two booking officers at each police station. Two G4S transport teams also travel around the city taking prisoners to be booked in the Downtown Jail or the jail annex on Montana Avenue. Policeofficials did not respond to a request for comment regarding the G4S contract. G4S is working with EPPD to identify opportunities to reduce cost while maintaining the operational effectiveness and integrity of the G4S services provided, company spokeswoman Monica Lewman- Garcia said in an . By using G4S Custom Protection Officers to perform supplementary duties, local law enforcement agencies like El Paso are able to make better use of their budgets and place sworn officers in more public-focused, critical law enforcement roles. In many cases, local police departments can save taxpayers millions of dollars per year by using G4S personnel and services in addition to increasing police presence in the community. The family of Saenz has filed a lawsuit in U.S. District Court against the city and G4S on allegations of excessive force, recklessness, negligence and violating Saenz s civil rights. The lawsuit also names as defendants Allen, Flores and the unnamed prison transport guard. The lawsuit does not specify an amount sought. The city has declined to comment on the lawsuit. G4S did not comment on the lawsuit but Lewman- Garcia said, G4S extends its sympathy to the family of Mr. Saenz. Wong s report states that if Mexico were excluded, leaving ElSalvador, Guatemala and Honduras the countries producing the mass exodus of unaccompanied children the homicide rate would to 54 per 100,000. By contrast, the report states, other countries in the region, such as Belize, Costa Rica, Nicaragua and Panama had a total of 1,881 homicides, at a rate of 13 per 100,000. Wong said that often times people interpret a set of numbers as data and make overreaching assumptions. His research, Wong said, is based on regression statistics, an approach that estimates relationships among different variables, such as how violence, poverty and misinformation led to the surge of Central American migration to the U.S.. Wong said the most important thing beyond any research was making sure that unaccompanied minors and families who crossed the border received due process. Brian Erickson, policy advocate for ACLU of New Mexico Regional Center for Border Rights, agreed. Erickson said, the AC- LU s main concern was making sure that those who have been deported from the detention center in Artesia,N.M., receive due process and a chance to make their case before an immigration judge. Erickson said Border Patrol officials may not be adequately trained to discern who is fleeing violence, human trafficking or any credible danger.
