2 Policy Summary Excess Protection Insurance Some important facts about your Insurance Cover are summarised below. This summary does not form part of the contract and does not describe all the terms and conditions of your Policy, so please take time to read the Policy document to make sure you understand the cover it provides. WHAT MAKES UP THIS POLICY? This policy summary and the Policy document must be read together as they form your Insurance Contract. COOLING OFF PERIOD You may cancel this Policy at any time. You will receive a full refund if You cancel this Policy within 14 days of the date You received Your Policy documentation. You will not receive a refund if You cancel this Policy once that 14 day period has expired. JURISDICTION AND LAW This insurance shall be governed by the laws of England, whose courts alone shall have jurisdiction in any dispute arising from this insurance. WHO IS ELIGIBLE TO PURCHASE THIS POLICY? Any person: - 1. Permanently resident in the United Kingdom (England, Wales, Scotland, Northern Ireland, Channel Islands and the Isle of Man). 2. Any person who have a current and valid UK/EU driving licence, or holds a full internationally recognised licence. COVER PROVIDED 1. Cover is provided for the Excess that you would have been responsible for following the successful settlement of any physical damage claim for Your vehicle by Your Motor Vehicle Insurer in respect of claims arising as a result of accidental damage, fire, theft, or vandalism, provided the settled claim exceeds the stated Excess amount under Your Motor Insurance Policy. 2. Subject to the appropriate premium having been paid to the Insurer, t he maximum amount payable under this policy is dependent upon the Cover Level chosen: 3. Please refer to your Schedule for details of Your Cover level. GENERAL CONDITIONS APPLICABLE You must comply with the following conditions to have the full protection of Your P olicy. Cover is provided under the following Uses: a) Social Domestic & Pleasure b) Personal Business Use By Policyholder Page 1 of 9

3 c) Personal Use by a Named Driver(s). d) Personal Business Use by Policy Holder & Named Driver(s) e) Business use by Policy Holder / Named Driver (excluding Commercial Travel) 1. The Excess Protect policy will continue to respond for the period of the insurance or until your chosen Claims Limit is exhausted; whichever comes first. 2. Motor Insurance - You must maintain at all times during the period of this Policy a current and valid Motor Insurance Policy issued by an FSA authorised and regulated UK Motor Insurer to You in respect of Your Motor vehicle. 3. The Policyholder as stated on the Confirmation of Coverage document must be the lead name of the individual on the Motor Insurance Policy and to which this Policy will respond to the amount of the excess. 4. In the event that any misrepresentation or concealment is made by You or on Your behalf in obtaining this Insurance or in support of any claim under this Insurance, the Policy will be considered voided and no refund of premium will be given. 5. In the event that Your Motor Insurance Policy is cancelled for any reason whatever, this Policy will be cancelled automatically. 6. We may at Our discretion take any steps in Your name against any person/third party including but not limited to their Motor Insurance Policy Insurer to recover any money We pay in settlement of Your claim. You must give Us all assistance necessary. 7. All claims must be notified in the first instance to the Excess Protect Helpline on xxx WHAT IS NOT COVERED (EXCLUSIONS) a) Any claim not successfully paid by your Motor Insurance Policy to or to which the Excess is not exceeded. b) Any claim on the Motor Insurance Policy which occurred prior to the sold date of this Insurance as shown on your Confirmation of Cover document. c) Any claim not notified immediately to Us via the Excess Protect Claims Helpline. d) Any contribution or deduction from the settlement of Your claim against Your Motor Insurance Policy other than the stated Policy Excess, for which you have been made liable. e) Where a third party has waived or reimbursed You and made good the Excess which is the first amount of any claim, shown in/ the schedule under own damage of Your Motor Insurance Policy. f) Any liability You accept by agreement or contract, unless You would have been liable anyway g) Any claim that is refused by Your Motor Insurer to whom you are claiming. h) Any claim where the Motor vehicle is used for hire and reward. i) Any excess claim arising from glass repair or replacement, personal effects, satellite navigation systems, cd, cassette player, radio etc. j) Any motor claim arising out of the use of the vehicle by the Insured for racing, rallies, trials, off road driving or competitions of any kind. k) Any theft or malicious damage claim which has not been reported to the Police and has not been given a crime incident number. l) Any claim that arisies out of Your unlawful use of drink or drugs m) Any property, damages or expenses more specifically insured or any claim which but for the existence of this Insurance should be recoverable under any other Insurance or that of a third party. Claims Process for Making a Claim: Composite Legal Expenses Ltd (Claims Administrator) handles all claims under this Policy on behalf of the Insurer. 1. If you wish to claim under this Policy You must notify the Excess Protect Claims Helpline immediately on You will need your Policy Number, Name, Address, Vehicle Information, Motor Vehicle Insurance Policy, circumstances of the incident and details of any Third Party involved. 3. The Claims Administrator will complete a claims form with You over the phone. 4. The completed claim form will be sent to You in the Post for you to check and confirm the details you gave over the phone. Page 2 of 9

4 5. Once you are happy with the completed claim form, having made any necessary changes you should return the form and include the following documentation: A copy of the Confirmation of Cover. A copy of the acknowledgement letter received from the claims administrator. A full breakdown of the claim and repairs from Your Motor Insurer. A copy of Your Motor Vehicle Insurance Policy. Either a) a copy of the receipt You received on payment of Your Excess or b) a copy of Your settlement letter from Your Motor Insurance Company, both of which must state the amount settled and the Excess deducted in respect of Your Settled Motor Claim Please send all the information to the Claims Administrator at the following address: Excess Protection Claims Composite Legal Expenses Suffolk House Trade Street Cardiff CF10 5DTShould You need to call the claims administrator Composite Legal Expenses Ltd please call , or enquiries@composite-legal.com. PLEASE NOTE: FAILURE TO FOLLOW THESE STEPS MAY DELAY AND / OR JEOPARDISE THE PAYMENT OF YOUR CLAIM. Cancellation Right This policy has a cooling off period of 14 days from the time you receive this information. If You do not wish to continue with this insurance, the policy will be regarded as not taken up and cancelled from inception, and You will be refunded any monies paid to Us in respect of premium provided no claims have been made. Please refer to your Schedule for details of Your Cover level. DEFINITIONS Any word or expression to which a specific meaning has been attached will bear the same meaning throughout this policy. You/Your/Insured Person - means the person whose name appears at the top of Your Confirmation of Coverage document. We/Us/Our - means AmTrust Europe Limited. Excess - means the amount You must pay under the terms of Your Motor Insurance Policy in respect to the first amount payable of the Motor Insurance claim. Period of Insurance - means the period for which We have accepted the premium, being the same Page 5 of 9

7 Period as applies to Your Motor Insurance Policy.. Motor Insurance Policy means the Insurance Policy issued by an authorised UK Motor Insurer to you in respect of your Motor vehicle. Event - means each claim occurrence during the Period of Insurance. Motor Insurer means a FSA authorised and regulated UK Motor Insurer. Named Driver(s) means Drivers in addition to You who are permitted to drive under the terms of your Motor Insurance Policy. Certificate of Insurance or Confirmation of Coverage - this forms part of this Policy Document and contains the name of the Policy Holder and gives summary details of the Cover Level provided by this Policy. Motor Vehicle - a vehicle (not being an invalid carriage), which is constructed for the carriage of passengers and their effects and is adapted to carry not more than seven passengers and does not exceed 3.5 tonnes, of which You are the owner or which You are authorised to drive. Annual Aggregate Limit (Cover Level) means the total aggregate amount that the Insurer will pay to You under this Insurance Policy during the Period of Insurance, as shown on Your Confirmation of Cover. Commercial Travel - means commercial use by company directors and sales representatives. CONDITIONS APPLICABLE 1. Right of Recovery - We can take proceedings in Your name but at Our expense to recover for Our benefit the amount of any payment made under this Policy. 2. Other Insurance - If You were covered by any other Insurance for the Excess payable following the incident, which resulted in a valid claim under this Policy, We will only pay Our share of the claim. 3. Reasonable Precautions - You must take reasonable steps to safeguard against loss or additional exposure to loss. 4. Keeping to the terms of this Policy - We will only give You the cover that is described in this Policy if any person claiming cover has met with all its terms and the terms of the Excess Protect Insurance Policy, as far as they apply. 5. Fraudulent Claims - If You make a claim under this Policy that is false or fraudulent in any way, the Policy is void and any claim will not be paid. All communication is to be conducted in English. a. CANCELLATION PROVISIONS a) This policy has a cooling off period of 14 days from the time you receive this information. If You do not wish to continue with this insurance, the policy will be regarded as not taken up and cancelled from inception, and You will be refunded any monies paid to Us in respect of premium provided no claims have been made. b) If the policy is cancelled after the cooling off period, there will be no refund of premium c) We may cancel this policy at any time by giving thirty days notice to the Agent. We may also exclude an individual Insured Person from cover at any time by sending fourteen days notice to the Agent. In the event of cancellation the Insured shall be entitled to a return of a proportionate part of the premium corresponding to the unexpired Period of Insurance. Such cancellation shall not prejudice the rights of the Insured Person in respect of any claim notified prior to the date of cancellation.
