3 1 Introducing PTS Post- och telestyrelsen, PTS, The Swedish National Post and Telecom Agency, is the governmental authority that monitors the electronic communications and postal sectors. The concept 'electronic communications' includes telecommunications, IT and radio. PTS works in four main areas: consumer issues; competition issues; efficient utilisation of resources and secure communications. It is PTS's vision that everyone in Sweden should have access to efficient, affordable and secure communication services. One of our key tasks is to ensure the development of functioning postal and telecom markets. We actively promote healthy competition, supervise price trends and have the consumer's interests at heart. PTS also issues regulations and ensures that existing legislation is followed. Operators wishing to start or conduct postal and telecom operations must apply to PTS for a licence. PTS is also in charge of the Swedish numbering plan and allocates number resources to telecom operators. Radio spectrum is a limited resource that can get very crowded at times, and frequencies must be allocated in a fair way among interested parties. PTS is responsible for allocating frequencies in Sweden, as well as coordinating its operations with other countries. Those who own or want to use radio transmitters must apply to PTS for a licence. The authority also investigates cases of radio interference. The National Post & Telecom Agency has approximately 250 employees, of which the majority work at the head office, located in central Stockholm. More general information about PTS is available at 2 Aim of the Procurement The aim of the project is to rationalise radio spectrum monitoring operations, lower the costs and improve the quality and service level by acquiring a new IT System for Radio Spectrum Monitoring ( the IT System ) at PTS to replace the existing IT system. Note that tenders must include all parts of this procurement including options. Radio-engineering measuring instruments, radio-engineering equipment, computer hardware and operating systems shall not be included in procurement of the new IT system. 3 Economic Ability and Certificates 3.1 Registration Certificate A current registration certificate from the Swedish Companies Registration Office (Bolagsverket) for the company must be attached to the tender. Foreign tenderers must submit a similar registration certificate from the corresponding authority in the tenderer s home country. The National Post and Telecom Agency 3

4 3.2 Tax Verification The tenderer must not have any debts for taxes and social security charges. Swedish tenderers must certify this by attaching a completed Tax Authority standard form 4820 Begäran om upplysningar offentlig upphandling [ Request for information - public procurement ], see Appendix 6. Foreign tenderers must satisfy corresponding conditions in their home country, which must be verified by a certificate from the relevant authority in the tenderer s home country. The certificate may not be older than three months on the last date for tenders. 3.3 Affirmation The tenderer must sign and attach an affirmation, see Appendix 4, in original. 3.4 Credit Rating Information An extract from a credit information undertaking (e.g. from Swedish Upplysningscentralen [UC], Dun & Bradstreet [D&B], or the corresponding in the tenderer s home country), indicating the tenderer s financial and economic stability, must be attached to the tender. The credit worthiness rating must be at least 2 in accordance with the UC scale (see or corresponding (as shown by the tenderer), unless an explanation has been provided that is accepted by PTS. The credit information certificate may not be older than three months on the final date of tender. 4 Technical and Professional Ability 4.1 Description of the Company A description of the firm, its operations, resources and capacity for the delivery must be attached to the tender. 4.2 Description of Principal Contracts In the tender the supplier must include descriptions of the principal deliveries similar to that in this enquiry document effected in the last three years. Name, company and contact information to the buyer must be included. 4.3 Subcontractor If the supplier intends to use subcontractors they must be listed in the tender. 5 Requirements For the Delivery The requirement specification, see Appendix 1, includes Must and Should requirements. The tenderer will only be given the opportunity to participate in the evaluation of tenders if all must requirements are met. A requirement can constitute an option that entails a possibility for PTS to order the option as a supplement. All options must be included in the tender. 6 Additional Requirements 6.1 Tenders Must Fulfil All Requirements The tender must satisfy the requirements and instructions imposed in this Enquiry Document. Tenders may be accepted without prior negotiation and the opportunities for supplementing or The National Post and Telecom Agency 4

5 clarifying details in the tender are strictly limited. A tender that is not complete or includes reservations may be excluded. If information is omitted, this may be interpreted to mean that the requirements cannot be satisfied. The attached Contract, Appendix 2, including Avtal 90/Agreement 90 must apply. 6.2 Price The tender must state total fixed prices for the delivery including options in accordance with the Requirement Specification. 6.3 Time Limits A tender in writing must be submitted to PTS no later than 19 June 2008 at 5 p m and must be binding up to and including 19 November Languages Tenders must be submitted in Swedish or English. All documentation and correspondence in the matter must be in Swedish or English. 6.5 Signing, Authorised Signatories The tender must be signed by an authorised signatory. In the event that an authorised signatory s powers are not indicated by the extract from the Companies Registration Office in the tenderer s home country, the power must be verified by another appropriate document, for example a power of attorney. 7 Evaluation The most economically advantageous tender will be accepted. The following criteria, with the weighting factors stipulated, will be considered in the tender evaluation. Criteria Price Fulfillment of want-requirements Time of delivery Weighting factor 35 points 50 points 15 points 7.1 Price (35 points) 28 points will be allocated to the tender with the lowest price for the delivery without options. 7 points will be allocated to the tender with the lowest price for the options. Other tenders are allocated points on the basis of their inverted proportional relationship to the tender with the lowest price respectively. Example: A price that is 25% higher than the lowest price for the delivery without options receives 28/1.25 points=22.4 points. 7.2 Fulfilment of Want-Requirements (50 points) Fulfilment of the should-requirements will give points according to Appendix 7. 6 7.3 Delivery Time (15 points) Final delivery approval must take place by 29 April 2009 at the latest. Final delivery approval should take place between 30 Nov 2008 and 29 April Points will be given according to Appendix 7. So that delivery can be implemented and so as to achieve the targets established for the project, tenderers must provide a timetable in their tenders, stating the dates of the components stated in below Special System Requirements The supplier must notify PTS of special system requirements regarding the IT system as soon as possible after signing the contract, but at the latest 20 days after signing Delivery PTS must be in receipt of materials and products included in the delivery of the IT system sufficiently in advance of commencement of installation Installation training The staff from PTS's IT unit who are to carry out installation must be appropriately trained prior to installation. Structuring of the training shall be by consultation with PTS Installation Installation must be carried out by PTS staff supported by the supplier. The supplier must be responsible for the installation with the prerequisites stipulated. PTS shall ensure that hardware (computers and instruments) and system software with network connections are in operation before installation commences. PTS cannot guarantee that the installation can be started before 29 September User training User training must be carried out before commencement of the Preliminary Inspection of Delivery. Structuring of the training shall be by consultation with PTS Preliminary Inspection of Delivery Installation of the IT system must be completed before commencement of the Preliminary Inspection of Delivery. The Preliminary Inspection of Delivery covers a period of two weeks. The test must be in accordance with the Delivery Inspection Form drawn up by PTS Trial Operation The one-month Trial Operation period covers checking and testing of all parts and functions of the IT system under production circumstances, to verify that the IT system meets the Agreed Specification. The requirement for final approval is continuous rectification during the trial operation period of any defects that may arise, so that the agreed timetable can be adhered to Final Delivery Approval The entire delivery must meet the Agreed Specification. The Trial Operation period concludes with final approval of the entire delivery. If the final inspection is not satisfactory the supplier must rectify the defects obtaining, in accordance with the contract. The National Post and Telecom Agency 6

7 8 General Conditions for the Tender 8.1 Form of Procurement This procurement is an open procedure according to the Swedish Public Procurement Act (LOU). 8.2 Form and Number of the Tender In order for PTS to be able to evaluate the tender, it is of great importance that it contains all the information requested. PTS requests that the tender is drawn up in the same sequence and according to the same structure as the Enquiry Document, and refers to the items mentioned in it. Submit 3 printed copies of the tender in paper form, one original and two copies. For environmental reasons include only paper sheets in the tender. Do not include any folders, registers, binders, CD:s or other plastic material in the tender. 8.3 Questions Questions concerning this Enquiry Document and the procurement must be presented in writing or via to David Sundgren, david.sundgren@pts.se. The final date for presenting questions is 5 June We will publish all questions and answers on our web site no later than 12 June Checklist The tenderer confirms that the conditions contained in this Enquiry Document are accepted by completing and signing the enclosed Checklist (Appendix 5). Signature by an authorised signatory is not required. 8.5 Confidential Material Tenders are confidential until the final contract has been signed. After that all tenders may be made public.
