2 Chapter 8 TRANSPORTATION OF HAZARDOUS MATERIALS
3 APPLICABILITY Each officer or employee of the motor carrier who performs duties related to the transportation of hazardous materials. Each person who operates or is in charge of a motor vehicle containing hazardous materials.
4 STATE AND LOCAL LAWS Every Commercial Motor Vehicle (CMV) containing hazardous materials must be driven and parked in compliance with the laws, ordinances and regulations of the jurisdiction in which it is being operated.
5 ATTENDANCE OF MOTOR VEHICLES A motor vehicle carrying 50 Lbs. or more, must be attended at all times unless all of the following conditions apply: Vehicle is located: on the property of a motor carrier the property of a shipper or consignee of the explosives or hazardous materials in a safe haven on a construction or survey site
6 ATTENDANCE OF MOTOR VEHICLES The driver or Bailee of the vehicle is aware of the nature of the explosives and has been instructed in emergency procedures The vehicle is within the driver or Bailee's unobstructed field of view or is located in a safe haven
7 VEHICLE SURVEILLANCE A motor vehicle containing hazardous materials and located on a public street, highway or the shoulder of a public highway, must be attended by its driver.
8 ATTENDANCE A motor vehicle is attended when the person in charge of the vehicle is on the vehicle, awake and not in a sleeper berth, or is within 100 feet of the vehicle and has it within his/her unobstructed field of view.
9 PARKING A motor vehicle containing hazardous materials must not be parked : On or within 5 feet of the traveled portion of a public street or highway On private property without the consent of the person who is in charge of the property and who is aware of the hazardous materials
10 PARKING Within 300 feet of a bridge, tunnel, dwelling or place where people work, congregate or assemble, except when the necessities of operation make it impracticable to park in any other place
11 FIRES A motor vehicle containing hazardous materials must not be operated near an open fire unless the driver has taken precautions to ensure that the vehicle can safely pass A motor vehicle containing hazardous materials must not be parked within 300 feet of an open fire
12 SMOKING No person may smoke or carry a lighted cigarette, cigar or pipe on or within 25 feet of: A motor vehicle which contains hazardous or flammable materials An empty tank motor vehicle which has been used to transport flammable materials or gases
13 FUELING When a motor vehicle which contains hazardous materials is being fueled: Its engine must not be operating A person must be in control of the fueling process at the point where the fuel tank is filled
14 TIRES If a tire is flat, leaking or improperly inflated, the driver must have the tire repaired, replaced or properly inflated before the vehicle is driven (the vehicle may be driven to the nearest safe place to perform the required action)
15 TIRES If a tire is overheated, the driver shall immediately remove it and place it at a safe distance from the vehicle The driver shall not operate the vehicle until the cause of the overheating is corrected
16 INSTRUCTIONS AND DOCUMENTS A motor carrier that transports Division 1.1, 1.2 or 1.3 materials must furnish the driver of each motor vehicle in which the explosives are transported with the following documents: A copy of the rules A document containing instructions on procedures to be followed in the event of accident or delay
17 INSTRUCTIONS AND DOCUMENTS A driver who receives documents must sign a receipt for them. The motor carrier shall maintain the receipt for one year from the date of signature.
18 RESPONSIBILITY FOR ROUTING A vehicle carrying hazardous materials shall operate over routes which do not go through or near heavily populated areas, places where crowds are assembled, tunnels, narrow streets or alleys, except where the motor carrier determines that:
19 RESPONSIBILITY FOR ROUTING There is no practicable alternative A reasonable deviation is necessary to reach terminals, points of loading and unloading, facilities for food, fuel, repairs, rest or a safe haven A reasonable deviation is required by emergency conditions
20 REQUIREMENTS FOR TRANSPORTING RADIOACTIVE MATERIALS A carrier or any person operating a motor vehicle that contains a radioactive material shall ensure that the vehicle is operated on routes that minimize radiological risk.
21 REQUIREMENTS FOR TRANSPORTING RADIOACTIVE MATERIALS A carrier or any person operating a motor vehicle containing radioactive materials shall operate the vehicle only over preferred routes: Interstate System highway A State-designated route selected by a State routing agency Both of the above
22 ROUTING REQUIREMENTS A motor vehicle may be operated over a route other than a preferred route only under the following conditions: Deviation from the preferred route is necessary to pick up or deliver radioactive materials To make necessary rest, fuel or motor vehicle repair stops
23 ROUTING REQUIREMENTS Emergency conditions make use of the preferred route unsafe or impossible The route selected must be the shortest-distance route from the pickup location to the nearest preferred route entry location, and the shortestdistance route to the delivery location from the nearest preferred route exit location.
24 ROUTING REQUIREMENTS A carrier who operates a motor vehicle containing radioactive materials shall prepare a written route plan and supply a copy before departure to the driver and the shipper Any change between the route plan and routes used, and the reason for it, shall be reported in an amendment to the route plan delivered to the shipper within 30 days following the deviation
25 ROUTE PLAN The route plan shall contain: A statement of the origin and destination points, a route selected in compliance with this section, all planned stops and estimated departure and arrival times Telephone numbers which will access emergency assistance in each State to be entered
26 REQUIREMENTS No person may transport radioactive materials on a public highway unless the driver has received within the two preceding years, written training on: Requirements pertaining to Class 7 (radioactive) materials transported The properties and hazards of the materials being transported Procedures to be followed in case of an accident or other emergency.
27 CERTIFICATE OF TRAINING The driver must have a certificate of training and a copy must be placed in his or her qualification file showing: The driver's name and operator's license number The dates training was provided The name and address of the person providing the training
28 CERTIFICATE OF TRAINING That the driver has been trained in the hazards and characteristics of radioactive materials A statement by the person providing the training that information on the certificate is accurate
