4 1. GENERAL INFORMATION This document regarding market and trade fair sales places includes conditions of the city of Joensuu for organising sales activities at the market square of Joensuu. The applicable parts of this instruction are followed also at other market places of Joensuu. These conditions and the fees of Joensuu market square and trade fair sales places are yearly determined by the Recreational board. The Event services of the Leisure time department of the city of Joensuu is in practise responsible for the lease of the market and trade fair sales places and the following of the conditions and principles in accordance with this document. The entrepreneur leasing a market and trade fair sales point at the Joensuu market square or other market places, the sales person working for him/her or the organiser of a market square event has to follow, in addition to the laws regulating the trade activities and good manners, these conditions and regulations as well as the possible additional regulations or instructions given by the market place supervisor or Event services personnel. If necessary the Event services of Joensuu have the right to decide about opening hours deviating from the ones mentioned in these conditions and also about the changes and complements to these conditions. 1.1 Market square opening hours The market square is open for market vendors and clients during period from Monday till Friday at 7:00-20:00 and on Saturdays at 7:00-18:00. The market square is open for market vendors and clients during period from Monday till Saturday at 7:00-18:00. On Sundays and public holidays the market square is closed. The lessees of market place and trade fair sales point have the right for sales activities within the opening hours according to these conditions. The Event services have the right to change the opening hours of the market square and if necessary, to take the market square to their own disposal and prohibit the sales activities completely. The lessees shall be informed about the possible changes. 4

5 1.2 Market place personnel The market place supervisor and the event manager and event coordinators of the Event services are responsible for the administration and supervision of the Joensuu market square and other market places of the Joensuu region. Market place supervisor is responsible for the daily market place supervision. 2. SQUARING OF SALES PLACES The market square of Joensuu is divided into sales places and walkway areas according to sales place squaring. The sales place squaring shows the size, number and location of sales points and also the different kinds of sales areas. The sales place squaring is indicative and the market square personnel can change the sales place division and squaring case by case. The sales place squaring can be seen in the office of the market square personnel, in Leisure time department in the office of Event services and in the office of market square supervisor. 3. LEASING OF THE MARKET SALES PLACES The lessee of market sales place has to have business ID and the lessee must be registered in trade register, or the lessee has to have a certificate proving him/her being a primary producer, i.e. selling the products of his/her farm or household. Exceptions to this are the daily sales places of household vendors and flea market places. The market sales places are leased on yearly ( ), seasonal ( ), monthly, weekly and daily basis. The location of sales place is determined by the sales place squaring at the discretion of the market place personnel. The market place personnel is responsible for leasing the sales places. Leasing of a market sales place gives the right for sales during the normal opening hours of the market square as mentioned in chapter 1.1. A lease contract is signed for the market sales places. The contract can deviate from the conditions of this document. The number of the sales places, which are leased on yearly basis, is approximately 88. The lessee of yearly market sales place has to inform in writing the Event services prior two (2) months before the expiration of the valid lease contract about the prolongation of the lease time. The Event services lease the remaining yearly sales places by public application process. 5

6 The number of leased seasonal sales places is approximately per year. The seasonal sales places are to be reserved from the Event services and a written contract will be signed about the leasing of a seasonal sales place. The Event services determine the sales place in accordance with the sales place squaring and at their own discretion. The monthly, weekly and daily sales places are leased directly from the market place supervisor, who will determine the sale place in accordance with the sales place squaring and at his/her own discretion. The Event services charge from the lessee of the sales place the price of yearly, seasonal and, if necessary, monthly sales places in accordance with the contract or permission. For weekly and daily sales places the payment is carried out in cash to the market place supervisor. Other possible payment methods can be agreed upon between the Event services and lessee separately. The lease right for a market square sales place can be cancelled completely or for a fixed period of time in case: - the lessee of the sales place or his/her employee does not follow the conditions of this document - the lessee of the of the sales place or his/her employee does not follow the instructions of the Event services or the market square personnel - the lessee of the sales place or his/her employee acts in violation of the food and health safety law - the lessee of the sales place or his/her employee behaves inappropriately in the market square - the lessee of the sales place or his/her employee operates his/her sales place while intoxicated. In case the lessee of the sales place has not carried out the payments within agreed deadlines and in accordance with the instructions of the Event services, he/she will lose the lease right. 6

7 4. SALES AREA The sales activities of the lessee of the market sales place have to fit in the given sales square and the square boundaries are not to be exceeded. In case the sales is carried out from a sales van, the van is to fit into the given sales square and area. 5. MARKET TRADE RESTRICTIONS 5.1 Events at the market square When the city of Joensuu organises a trade fair or other own event, or rents out the market square or its part to a private event organiser, the lease contracts of the market sales places are not valid in the rented area and the sales activities are not allowed in these cases. The Event services arrange, if possible, alternative market sales places for the time in question. 5.2 Other possible cases On Sundays, when the market square is closed, different kinds of events, happenings and, for example, flea markets can be organised at the market square. The possible Sunday or holiday opportunities for market place sales are to be agreed separately between the sales place lessees and the Event services. 6. OTHER POSSIBLE REGULATIONS REGARDING MARKET TRADE The lessee of the market sales place does not have a right to transfer the sales place contract or to hand over the place or its part to a third party. The Event services of Joensuu do not answer for vandalism, petty theft, theft or other possible damages connected with the sales point of the lessee of the market sales place. The daily market sales place has to be claimed within the working hours of the market place supervisor. 7

8 In case the vendor does not take the sales place into the use by 7:30, the Event services have the right to lease the place to a third party. The lessee of the market sales place is obliged to ensure that his/her facilities (for example frames, wires and similar structures) do not hamper the general maintenance or sanitation services or cause danger to the people moving in the area. The lessee of the market sales place is responsible for the damages caused by the appliances, wires and structures at his disposal. The Event services have the right to arrange to the market square of Joensuu a client parking area during winter season from November to March, in which case the lessees of a yearly sales place will receive an alternative sales place in market square area free of charge. The market sales place is not leased to a person who him/herself, his/her spouse, other family member living in the same household or whose business partner participating in the market trade has unpaid payments to the city of Joensuu or tax authorities, unless he/she has an approved and valid payment plan. In case the lessee of market sales place has been repeatedly notified about the actions violating this condition or about neglecting the payments, the Event services have a right to refuse to lease the market sales place. 7. PERMISSIONS REQUIRED FOR MARKET TRADE The market trade is stipulated and limited by various laws, regulations and conditions. The person engaged in market trade is to follow these laws, conditions and regulations, as well as good manners. If required the lessee of the market sales place and the salesperson have to present to the market square personnel or other possible authorities the permissions and documents required by present valid laws, such as certificates of origin of the food products. If required a certificate of origin or other reliable clarification about the origin of the other sales articles have to be presented. The lessee of sales place has to inform the Department of environmental health of North Karelia about the sales or other handling of food products in a movable food product facility in accordance with the food safety regulations 8

9 7.1 Name sign and package markings The name, domicile and other possible information required by authorities are to be presented clearly by a sign in the market sales place. The required information can also be presented in a form of an advertisement. The price and package markings are to be presented in a way required by the authorities. 8. FEES FOR MARKET SQUARE SALES PLACES The fees for the market sales places of the Joensuu market square are defined by the tariffs, which are yearly determined by the Recreational board of the city of Joensuu. The tariffs and the lease fee list are shown in the websites of the city of Joensuu and the Event services, as well as in the offices of the Event services and market place supervisor. 9. PARKING AND MOVING OF THE VENDORS Unnecessary car driving in square market area is prohibited. Driving into square market area of a vehicle used for goods transportation is allowed only for unloading and loading during sales starting time and after the sales time is finished. Setting up of the sales place and all the vehicle transportation connected to it are to be carried out by 9:00. For sales place dismantling, the vehicle driving in the market square is allowed at the earliest after 15:00. The Event services show a place for unloading and loading for supplementary goods deliveries and service traffic, through which all service traffic is carried out during opening hours of the market square. During period it is allowed for the lessee of market sales place to park a vehicle in immediate vicinity of the sales place for warming up purposes. Vehicle idling is prohibited, so the heating of the vehicle interior must be carried out by a separate interior heater. The Event services will charge a fee of the electricity in case the lessee needs electricity from the Event services. Free parking spaces are reserved for the entrepreneurs of market sales places in the parking area of the Joensuu Sports hall, the market supervisor provides for the necessary parking ID. 9

SANITATION OF MARKET SQUARE SALES PLACE The lessee of the sales place is responsible for the cleanliness of his/her own sales place and its immediate surroundings during the sales hours and the lessee takes care of the cleaning after the sales hours. The vendor obliges to follow the instructions of the market square personnel and authorities concerning the maintenance on the environment cleanliness 11. WASTE MANAGEMENT AND WASHING POINT The vendor must ensure that the waste induced by his/her activities is removed from the sales place and its immediate surroundings after the sales hours. The waste materials are to be sorted to the corresponding waste collection points (mixed waste material, cardboard, biowaste) and they must not be left by the walls of the market hall, outside the waste containers or in other inappropriate areas. The waste collection points of the market square are meant only for the waste induced from the market trade and events organised in the market square area, and it is prohibited to bring waste to the market square waste collection points from elsewhere. It is prohibited to pour grill grease/oil and waste water to the rain water drainage of the market square. The vendor must him/herself transport the grease material and pallets away from the market square area. In case the sanitation and waste regulations are violated the Event services can terminate the lease contract of the market sales place. The Event services have the right to collect the costs caused by the irresponsible maintenance and cleaning of the place from the lessee of the sales place. 12. CLIENT AND PERSONNEL TOILETS Toilet facilities for vendors clients and personnel are arranged in the trade hall of Joensuu. 10

11 13. ADVERTISING The lessee of market sales place is obliged to follow in advertising the instructions given by the Event services and market place personnel as well as good manners. 14. FLEA MARKETS Flea market sales is allowed within the opening hours of the market square or during other times determined by the Event services. Larger scale flea market events are being organised on Sundays. The market place supervisor sells the flea market places without prior reservation. The supervisor provides for the sales place according to sales place squaring and at his/her own discretion. A fee defined by the decision of the Recreational board of the city of Joensuu is charged from the flea market place. 15. TERMINATION OF MARKET SALES PLACE CONTRACT The yearly sales place contract is by nature a long-term contract and therefore the yearly contract can be terminated between the lessee and the Event services following a notice time of one (1) month. Seasonal, monthly, weekly and daily places are by nature timelimited and they cannot be terminated during the validation period. In cases of severe contract breach the yearly, seasonal, monthly, weekly and daily contracts can be terminated without notice. 16. SETTLEMENT OF POSSIBLE DISPUTES The possible disagreements and disputes are always tried to be agreed by negotiations between the parties. In case, despite the good intensions, the mutual understanding is not reached by negotiations the possible disputes are to be settled by the District Court of North Karelia. 11

OFFICIAL TRADE FAIR OF JOENSUU 17.1 General information and dates The Event services of Joensuu organises yearly four trade fair events, which are organised , , and If necessary, trade fairs and other sales events can be organised also during other times. The official trade fairs of Joensuu last two days. In trade fair arrangements this document is applied mutatis mutandis regarding the conditions and regulations, parking, sanitation, sales area of the sales place, restrictions, waste management, toilet services, advertising and dispute settlement. The Event services reserve the right for possible changes connected with the organisation and conditions of trade fairs Sales of the trade fair places The reservation of a sales place in the official trade fair of Joensuu is carried out by telephone or to the Event services of Joensuu. The Event services advertises the trade fair in media, its own website and possibly also by direct marketing to trade fair vendors. Information about the trade fair and an invoice for trade fair sales place are sent well in advance to the vendor who participate regularly in the trade fairs. By carrying out the invoice payment by the due date the vendor reserves him/herself the sales place in which he/she has been previously. In case the payment is not carried out by the due date and the vendor does not contact the Event services, the sales place can be given to another vendor Fees for trade fair places The fees for sales places in the official trade fairs of Joensuu are determined in accordance with the tariffs and lease price list, confirmed by the Recreational board of the city of Joensuu. Electricity and limited number of parking places for the vendor in question are included in the fee. 12

13 17.4 Opening hours of the trade fair The sales time of the official trade fair of Joensuu is on Thursday 7:00-19:00 and on Friday 7:00-17: Other regulations What it comes to the sales activities at the trade fair, the vendor obliges to follow food safety regulations and other Finnish laws regarding the trade fair sales and also general manners. The vendor obliges to carry out the necessary notifications to the authorities and to follow the instructions and regulations given by the authorities. The vendor obliges to follow the instructions given by the Event services and the market square personnel. The Event services of Joensuu do not answer for the vandalism connected with the sales places or for thefts of the sales goods Security The Event services of Joensuu organise at their own expense a night-time security for time 19:00-07: Parking and accommodation of trade fair vendors The Event services of Joensuu provide the trade fair vendors accommodation and parking places in Koivuniemi field. The fee for accommodation and parking is determined in accordance with the tariffs and lease price list, confirmed yearly by the Recreational board of the city of Joensuu. The Event services of Joensuu arrange, if possible, parking spaces for the vendors in parking area of Joensuu Sports hall. 13

14 17.8 Return of trade fair fees In case the lessee of a trade fair sales place is unable to claim the sales place because of sudden illness, the beforehand paid sales place fee can be reimbursed to the vendor in connection with future trade fair. The vendor must notify the market square personnel before the trade fair day about the cancellation and present an adequate explanation, for example, a medical certificate, in which case the fee for trade fair sales place will be reimbursed. 14
