1 MINISTRY OF THE INTERIOR Pursuant to Article 65 of the Act on Amendments to the Aliens Act (Official Gazette 36/09), the Minister of the Interior, hereby issues the ORDINANCE ON AMENDMENTS TO THE ORDINANCE ON TRAVEL DOCUMENTS FOR FOREIGN NATIONALS, VISAS AND TREATMENT OF FOREIGN NATIONALS Article 1 In Article 1 of the Act on Amendments to the Aliens Act (Official Gazette 36/08), the words»the procedure of expulsion and prohibition of entry and stay of foreign nationals«shall be inserted after the words»the manner of setting the deadline for leaving the Republic of Croatia«, and a comma and the words»the manner of conducting official verifications«shall be inserted after the words»border crossings at which a visa can be issued«. Article 11 shall be amended as follows: Article 2»Article 11 When submitting the visa application in the event referred to in Article 21(5) of the Aliens Act, proofs shall be presented to justify humanitarian, serious professional or personal reasons, and in the event referred to in Article 24(2) of the Aliens Act (extension of visa), documents shall be presented to justify force majeure, humanitarian, serious professional or personal reasons, and the proof of payment of the visa application fee. The visa referred to in paragraph 1 of this Article shall not be issued if it has been established that the applicant could have submitted the application on time at a diplomatic mission or consular post of the Republic of Croatia. A colour photograph of size 35 x 45 mm shall be attached to the visa application form referred to in paragraph 1. The photograph of the person shall be taken en face, with the forehead uncovered, without a head cover and in such a manner that 70 to 80 % of the photograph displays the head of the person from the chin to the scalp. The photograph must not be retouched nor made with personal photographic equipment. The photo must be developed on white, glossy, thin photo paper. 667
2 The data on issued visas referred to in paragraph 1 of this Article shall be entered into the Croatian Visa Database in compliance with the implementing regulation governing the Croatian Visa Database.«. Article 13 shall be amended as follows: Article 3»Article 13 The humanitarian, serious professional or personal reasons referred to in Article 21(5) and Article 24(2) of the Aliens Act are considered to be the following: 1. urgent medical assistance, 2. natural and other disasters, 3. unpredicted events concerning immediate family members (serious illness, death and similar), 4. urgent business visit at the request of a competent authority, 5. arrival upon a written invitation of competent authorities of the Republic of Croatia (delegation visits, sports or cultural events, etc.), 6. participation in procedures before state authorities, 7. entry into the Republic of Croatia of a ship s crew in order to board a vessel that is in a port in Croatia or to set ashore and return to their country of origin, 8. change of the state delegation member on a working or official visit to the Republic of Croatia, of participants at seminars, congresses or similar events, 9. changes in air and other types of traffic, which are a result of objective technical difficulties or other force majeure, at the request of the competent ministry.«. Article 15 shall be amended as follows: Article 4»Article 15 The validity period of a visa shall be shortened by affixing a stamp stating»shortened«to the visa sticker, a line shall be drawn across the optically variable element by using a sharp object, and a new sticker shall be affixed to the travel document.«article 5 Article 15a shall be inserted after Article 15 as follows:»article 15a If during border check it has been established that the data relating to the validity period in a previously obtained visa were incorrectly entered by obvious mistake, and the foreign national
3 fulfils all the stipulated conditions for entry into the Republic of Croatia, the police officer may correct such data by hand and verify them by affixing a stamp and signature. The ministry in charge of foreign affairs shall be notified through the Ministry on the data corrected in the visa.«. Article 17 shall be amended as follows: Article 6»Article 17 The data on the shortening of the validity period or annulment of a visa issued by a diplomatic mission/consular post of the Republic of Croatia shall be entered into the Croatian Visa Database in accordance with the implementing regulation governing the Croatian Visa Database.«. Article 7 Item 7 of Article 23 shall be amended as follows:»7. health or travel health insurance«. Article 25 shall be deleted. Article 26 shall be deleted. Paragraph 1 of Article 29 shall be deleted. Article 8 Article 9 Article 10 In the existing paragraph 2 that shall become paragraph 1, the words»or the operator«shall be deleted. The existing paragraphs 3, 4, 5 and 6 shall become paragraphs 2, 3, 4 and 5. Article 11 In Article 36 paragraph 1, the words»article 21(2)«shall be replaced by the words»article 19(2)«. Article 40 shall be amended as follows: Article 12»Article 40
4 The prohibition of entry and stay imposed by a decision on expulsion on the grounds of illegal crossing or attempt to cross the state border and for illegal stay shall be imposed for a period of: 3 months if the foreign national has exceeded the period of stay laid down by the law, but for not more than 30 days, from 3 months to 2 years if the prohibition of entry and stay is imposed in the event referred to in Article 89 paragraph 3 of the Aliens Act from 3 months to 3 years if the foreign national did not leave the Republic of Croatia within the deadline set in the order of leaving the Republic of Croatia of if the foreign national has illegally crossed or attempted to cross the state border, from 3 months to 5 years if the foreign national has been caught staying illegally more than twice over the past two years, or if it has been established that he has illegally crossed or attempted to cross the state border more than twice, from 3 months to 2 years in other cases.«. Article 13 Article 40a shall be inserted after Article 40 as follows:»article 40a The prohibition of entry and stay imposed by a decision on expulsion on grounds other than the grounds laid down in Article 40 of this Ordinance shall be issued for a period of: from 3 months to 1 year if the foreign national has been imposed a fine for a misdemeanour offence, from 3 months to 5 years if the foreign national has been imposed an unconditional sentence of imprisonment for a period of at least one year, or if the foreign national has been imposed several unconditional sentences of imprisonment for a total period of at least one year within the past three years, or if the foreign national has been imposed a sentence for a misdemeanour offence with elements of violence, from 3 months to 8 years if the foreign national has been imposed an unconditional sentence of imprisonment for a period of at least 2 years or if the foreign national has been imposed several unconditional sentences of imprisonment for a total period of at least 3 years within the past 5 years, from 3 months to 10 years if the foreign national has been imposed an unconditional sentence of imprisonment for a period of at least 2 years or if the foreign national has been expelled for national security reasons, from 3 months to 3 years in other cases.
5 The prohibition of entry and stay shall be imposed for full-year and half-year periods, and if set for a period shorter than a year, it shall be imposed for three, six and nine month periods.«. Article 41 shall be amended as follows: Article 14»Article 41 The prohibition of entry and stay imposed by a decision on expulsion shall be counted from the day: the foreign national leaves the Republic of Croatia within the deadline set in the order of leaving the Republic of Croatia, the foreign national is forcefully removed, the decision on expulsion is served to a proxy authorised for the receipt of writs if appointed by the foreign national, the decision on expulsion is served abroad if the foreign national reported leaving the Republic of Croatia before the rendering of the decision on expulsion, and did not appoint a proxy authorised for the receipt of writs, of refusal of entry if the foreign national fails to report at the border crossing on leaving the Republic of Croatia and if the foreign national can not provide proof that he left the Republic of Croatia in compliance with item 1 of this paragraph, of expiry of the prohibition of entry and stay imposed by the decision on expulsion the counting of which started earlier. The counting of the prohibition of entry and stay imposed by a decision on expulsion served by affixing it to the notice board may commence once the conditions for the counting of the prohibition of entry and stay referred to in paragraph 1 of this Article have been met, until the commencement of the statute of limitations. In the event referred to in paragraph 1 item 5 and paragraph 2 of this Article, the police administration or police station that issued the decision on expulsion shall be informed thereof. The prohibition of entry and stay imposed on a foreign national expelled pursuant to a court decision with the protective measure of expulsion of the foreign national shall be counted in an appropriate manner in accordance with paragraph 1 and 2 of this Article. By way of derogation from paragraph 1, 2 and 3 of this Article, the prohibition of entry and stay imposed on a foreign national expelled pursuant to a court decision with the protective measure of expulsion of the foreign national shall be counted from the day the court decision becomes enforceable, or from the service of a sentence of imprisonment is completed. Article 15
6 Paragraph 2 of Article 44 shall be amended as follows:»if it is not possible to establish the day of leaving the Republic of Croatia, the time referred to in paragraph 1 of this Article shall be counted from the day the decision on revocation of stay is served to the proxy, the day of refusal of entry or the day the conditions referred to in paragraph 1 of this Article have been fulfilled, until the commencement of the statute of limitations.«. Article 46 shall be amended as follows: Article 16»Article 46 A deadline for leaving the Republic of Croatia shall be imposed on a foreign national: whose application for visa extension has been refused, and the application was submitted prior to the expiry of the visa, whose application for approval or extension of temporary residence has been refused or rejected, or the procedure has been stayed, and the application was submitted prior to the expiry of the short-term or temporary stay, whose application for asylum or subsidiary, or temporary protection, has been refused or rejected, or the procedure has been stayed, and there are no circumstances referred to in Article 102 paragraph 1 item 2 of the Aliens Act, whose asylum, subsidiary or temporary protection, Croatian citizenship, temporary of permanent residence has expired, whose short-term stay in the Republic of Croatia has been revoked. The deadline referred to in paragraph 1 of this Article shall be counted from the day the decision referred to in paragraph 1 of this Article has become enforceable. Article 47 shall be amended as follows: Article 17»Article 47 The deadline for leaving the Republic of Croatia shall be set for a foreign national who has been expelled from the Republic of Croatia if circumstances indicate that the foreign national will comply with the obligation to leave the Republic of Croatia. The deadline referred to in paragraph 1 of this Article shall not be set: if the foreign national poses a threat to national security,
7 if the foreign national has committed a criminal offence or a misdemeanour offence with elements of violence, if the foreign national has been imposed an unconditional sentence of imprisonment, if the foreign national has illegally crossed or attempted to cross the state border, By way of derogation from paragraph 2 of this Article the deadline for leaving the Republic of Croatia may be set: if the foreign national is escorted by nuclear family members who are staying legally, if the foreign national is a minor not escorted by a legal guardian, if the foreign national has been identified as a victim of trafficking in human beings, and does not have the status of a victim, if the foreign national is seriously ill, if the foreign national has essentially contributed to the identification of perpetrators of the misdemeanour offence referred to in Article 41, 114 and 127 paragraph 2 of the Aliens Act, or a criminal offence by giving a statement before an administrative or court authority, if the foreign national is in possession of an own vehicle or a return travel ticket. The deadline referred to in paragraph 1 of this Article may be reset if the foreign national was unable to leave the Republic of Croatia for justified reasons (illness, bodily injury, traffic accident and similar). The deadline referred to in paragraph 1 of this Article shall be counted from: the day the decision on expulsion of the foreign national issued by the Ministry, police administration or police station has become enforceable the day the order on leaving the Republic of Croatia is served if the foreign national has been deported by a court decision with the protective or security measure of expulsion.«. Article 18 Articles 47a and 47b shall be inserted after Article 47 as follows:»article 47a The deadline for leaving the Republic of Croatia referred to in Article 46 and 47 shall not be set: if the foreign national has reported to leave the Republic of Croatia prior to the rendering of the decision referred to in Article 46 of this Ordinance and of the decision on expulsion, if the expulsion procedure was conducted in absentia.
8 Article 47b The deadline for leaving the Republic of Croatia shall be set for a foreign national who has exceeded the period of stay in the Republic of Croatia laid down by law. The deadline referred to in paragraph 1 of this Article shall be counted from the day the order of leaving the Republic of Croatia is served. If the foreign national referred to in paragraph 1 of this Article has been expelled from the Republic of Croatia, the provisions on setting the deadline for leaving the Republic of Croatia referred to in Article 47 and 47a of this Ordinance shall apply. The deadline referred to in paragraph 1 of this Article may be reset if the foreign national was unable to leave the Republic of Croatia for justified reasons (illness, bodily injury, traffic accident and similar). Article 49 shall be amended as follows: Article 19»Article 49 A foreign national shall be forcefully removed when the decision from which the obligation referred to in Article 93 paragraph 1 of the Aliens Act derives has become enforceable, and the deadline for leaving the Republic of Croatia for the foreign national shall not be set pursuant to Articles 46, 47, 47a, 47b and 48 of this Ordinance. The forced removal shall be conducted with police escort. The forced removal shall be conducted by: the police administration, or police station in the area of responsibility of which the foreign national is located, the police administration, or police station in the area of responsibility of which the prison is located, if the foreign national is accommodated in the prison, the Centre, if the foreign national is located at the Centre. By way of derogation from paragraph 2 of this Article, forced removal shall be conducted by the police administration, or the police station, in whose area of responsibility the centre for social welfare is located that appointed a guardian and accommodated a minor foreign national at the reception station of the ministry in charge of social welfare. The authority referred to in paragraph 2 and 3 of this Article shall provide the necessary care for the foreign national being forcefully removed. The foreign national shall be notified on the destination state of forced removal.«. Article 20
9 Article 50 shall be deleted. Article 21 In Article 59(2) the words»written decision«shall be replaced by the words Conclusion on stricter police supervision.«. Article 23 In Article 69(1) the words»and on other circumstances of significance for deciding on the foreign national s application«shall be replaced by the words»the application for Croatian citizenship and collect other information of significance for deciding on the foreign national s application.«in paragraph 3 the words»the verification can be performed«shall be replaced by the words»the collection and verification of data and information can be performed«. Article 24 Articles 69a, 69b and 69c shall be inserted after Article 69 as follows:»article 69a Prior to the field check, the police officer conducting the official verification shall compare and verify the data contained in the request for official verification with the data contained in the data collections of the Ministry. Article 69b The field check shall be conducted in a discrete manner and, as a rule, in civilian clothing. In the field check, the data and information shall be collected from persons who are acquainted with or in a relationship with the foreign national who is the subject of the field check, as well as from other persons who might objectively present their knowledge that is required for deciding on the application referred to in Article 69 paragraph 1 of this Ordinance. If required, for the purpose of completion or clarification, data and information can be requested from the foreign national for whom the official check is being conducted, or from the applicant referred to in Article 69 paragraph 1 of this Ordinance. Article 69c The police officer shall compile an official record of the comparison and verification of data and information collected in the field check in which the data on the sources of the data and information collected shall not be mentioned.
10 In addition to the official record referred to in paragraph 1 of this Article, the police officer shall compile a field check report in which, in addition to the data contained in the official record, he/she will enter data on the persons from whom he/she requested and collected the data and information. The field check report shall be drafted in a single copy, marked as»classified«and filed in the field check file. The personal data on the persons from whom the data and information were requested and obtained contained in the official record, as well as the content of the data and information collected from them, shall be kept by the police officer as official information and shall not be disclosed to the foreign national, other persons involved in the check and other unauthorised persons.«. Article 25 In Article 71 item 5 shall be inserted as follows:»5. foreign nationals to whom a visa has been refused, shortened and annulled.«. Article 26 The words»in the Croatian Visa Database as well«in Article 72 paragraph 1 shall be deleted. Article 27 A new item 6 shall be inserted in Article 73 as follows:»6. personal identification number (OIB), if allocated,«. The existing items 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16 shall become items 7, 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17. Article 28 Subparagraph 1 of Article 74 shall be amended as follows:» for travel documents: 1. general data referred to in Article 73 of this Ordinance, 2. date of issue, type, number and validity period of the travel document issued to a foreign national, 3. name of competent authority.«item 7 of subparagraph 4 shall be deleted, and the existing item 8 shall become item 7. Subparagraph 5 shall be deleted, and the existing subparagraph 6 shall become subparagraph 5. Article 29
11 Article 81a shall be inserted after Article 81 as follows:»article 81a The data base on foreign nationals whose visas have been refused, shortened or annulled shall contain the following: for refused visas: 1. general data referred to in Article 73 of this Ordinance, 2. date of application, 3. date of refusal of the visa, 4. the grounds for refusal of the visa application, 5. name of the competent authority. for visas with shortened period of validity and annulled visas: 1. general data referred to in Article 73 of this Ordinance, 2. type and number of the visa with shortened term of validity or type and number of annulled visa, 3. the diplomatic mission/consular post of the Republic of Croatia that issued the visa, 4. the grounds for the shortening of the validity period or annulment, 5. name of the competent authority, 6. date of decision.«. Article 30 In Article 84, a full stop shall be inserted after the words»european Union«and the words»and the provisions of Article 11(2) and Article 70, 71 and 72 of this Ordinance in the part that relates to the Croatian Visa Database, that shall enter into force on the day of start of operations of the Croatian Visa Database.«shall be deleted. Article 31 Forms 4, 5 and 10 printed along with the Ordinance on travel documents for foreign nationals, visas and treatment of foreign nationals (Official Gazette 36/08) shall be replaced by new forms 4, 5 and 10 printed along with this Ordinance and shall form an integral part thereof. 12 The provision of Article 5 of this Ordinance shall cease to be in effect on the day of accession of the Republic of Croatia to the European Union. He/she has not paid a fine imposed in the Republic of Croatia. Uputa o pravnom lijeku: Protiv odbijanja ulaska stranac ima pravo žalbe u roku od 8 dana od dana odbijanja ulaska. Žalba se podnosi Ministarstvu unutarnjih poslova Republike Hrvatske putem nadležne diplomatske misije, odnosno konzularnog ureda Republike Hrvatske. Žalba ne odgađa izvršenje odbijanja ulaska. Legal remedy: A foreign national is entitled to appeal within 8 days following the refusal of entry. The appeal shall be lodged at the Ministry of the Interior of the Republic of Croatia through the competent diplomatic mission or consular post of the Republic of Croatia.
