1 WTO TBT NOTIFICATIONS Issue No. 3 March Cadangan Peraturan Kerajaan Asing (Proposed Foreign Government Regulations) Maklumat mengenai cadangan keperluan peraturan dan persijilan negara asing telah diterima oleh WTO TBT Enquiry Point (Malaysia), Jabatan Pengurusan Standard, SIRIM Berhad. Notifikasi-notifikasi ini dikeluarkan oleh negara-negara ahli yang menandatangani perjanjian GATT mengenai halangan teknikal kepada perdagangan. Sebagai negara ahli, pengeksport Malaysia perlu mengkaji cadangan peraturan berkenaan dan menghantar sebarang ulasan untuk dipertimbangkan oleh negara tersebut sekiranya keperluan baru itu menghalang perdagangan secara tidak berpatutan. Ulasan yang lewat diterima masih boleh dipertimbangkan sekiranya diterima tidak lama selepas tarikh akhir untuk ulasan. 3 BELGIUM 1. Gaming Machines Operated In Class I This draft Royal Decree establishes the technical operating procedures for games of chance which may be operated in Class I gaming establishments, as defined by the Belgian Law of 7 May 1999 on games of chance, gaming establishments and protection of gamblers, i.e., casinos. It is modelled on the draft Royal Decree on Class II and III establishments, which has already been submitted to the European Commission. G/TBT/N/BEL/19 Proposed date of entry into force : 60 days 2. Vehicles For The Transport Of Valuables Vehicles for the transport of valuables must be approved by the Minister of the Interior, based on the opinion of the Commission on the transport of valuables. This Decree establishes the procedure to follow to be granted approval. For security reasons, vehicles for the transport of valuables must possess certain technical characteristics. On the basis of a reasoned decision by the Commission on protected transport, the Minister of the Interior will decide whether or not to grant a certificate of approval. Particular attention should be paid to Article 11.2 of this draft Decree which deals with the principle of the mutual recognition of equivalent foreign approval. This draft Royal Decree incorporates the provisions of the Royal Decree of 28 February 1997 on the technical characteristics and approval of vehicles for the transport of valuables used by security firms and internal security services. However, a number of the provisions of the previous Royal Decree have been refined. These changes mainly concern standards relating to the armour plating of vehicles, their technical characteristics and external markings and the authority accorded to the Ministry of the Interior to ensure that vehicles for the transport of valuables comply with the provisions of the Royal Decree. Construction Products This draft Royal Decree amends Royal Decree of 7 July 1994 corresponding to Notification 97/0511/B (Notification 92/0032/B for the first amendment). An Equivalence and Derogation Committee has been established and its role defined. G/TBT/N/BEL/30 Proposed date of entry into force : 60 days 4. Royal Decree On Identity Cards On 19 July 2001, the Belgian Cabinet approved the concepts of the new digital identity card. This card, of bank-card (ID1) format, will possess an electronic microprocessor and present information visible to the naked eye as well as holding electronic data. It will also, unless citizens object, incorporate a certificate of identity and a signature certificate. In addition to performing the same functions as the present identity card, it will make digital authentication and a digital signature available to all citizens. The project will be implemnted in two phases: the first phase, a six-month pilot project in which eleven municipalities will take part and which will be assessed upon its conclusion, is scheduled for the beginning of the second half of The aim of this pilot phase is to obtain the necessary guarantees in terms of both quality of production and the management system and the authentication and signature functions. At the end of this period, and in the event of a favourable assessment, the project should be extended to the other 578 Belgian municipalities. 4 Section 111 of the Motor Vehicle Safety Regulations (MVSR), entitled Mirrors, specifies the requirements governing the mirrors of all motor vehicles, including passenger cars, motorcycles, multipurpose passenger vehicles, trucks, and buses. This proposed amendment would make changes to the regulations governing mirrors fitted to school buses. The majority of the changes are designed to clarify the testing procedures by introducing more detailed guidelines under which current performance requirements are to be evaluated (pages , English and French). Agricultural Chemicals In accordance with the Article 14.3 of the Agricultural Chemical Regulation Law, Japanese Government establishes the standard levels of dioxins used in the inspections conducted under the said article for agricultural chemicals as impurities, taking account of the feasibility in detection and the toxicity of each dioxin. Bananas The document specifies marketing standards for the bananas to be supplied fresh to the consumer, after preparation and packaging. Consumer Protection (Safety Requirements) Regulations As on 1 April, the Consumer Protection (Safety Requirements) 1991 will be revoked and replaced by Consumer Protection (Safety Requirements) Regulations. Under the Regulations, the Singapore Consumer Protection (Safety Requirements) Registration Scheme or CPS Scheme will change from government to third party CABs certification. PSB will be registering the current thirty-one (31) categories of controlled goods based on Certificates of Conformity (COCs) issued by designated CABS located in Singapore and MRA partners. Also from 1 April, 8

6 prescribed articles under Part IV of the Public Utilities (Electricity) Regulations (Cap 261, Rg2) will be transferred to PSB as controlled goods making a total of thirty-nine (39) categories of controlled goods. These controlled goods are specified in the First Schedule of the Consumer Protection (Safety Requirements) Regulations (25 pages, in English). Regulations On Thermal Protection And Efficient Use of Energy In Buildings These regulations lay down technical specifications for thermal insulation and efficient use of energy in the heating of buildings designed for human dwelling and work. These regulations apply to new constructions and to the changes of utilization of individual rooms in existing buildings. They also apply to building reconstruction provided that their implementation is technically feasible and in accordance with cultural heritage conservation criteria (23 pages, in Slovenian, English). G/TBT/N/SVN/6 Final date for comments : 31 March Proposed date of entry into force: 31 December Products For Ventilation Systems In Buildings These regulations lay down technical requirements concerning building ventilation and air-conditioning and technical requirements concerning mechanical ventilation systems where installed in buildings. In the scope of laying down technical requirements mentioned in the above paragraph, these regulations deal with indoor ambient conditions as regards quality of air and thermal conditions, by laying down the lowest allowable quality of this aspect of inddoor ambnient (20 pages, in Slovenian, English). Containers For Compressed Or Liquefied Gas, Of Iron Or Steel The mandatory standard TIS (1997) which was notified as G/TBT/Notif on 19 December 1996 was amended by the Thai Industrial Standards Institute (TISI). The main amendments are as follows: 1. The standards number TIS (1997) is amended to TIS (2000); 2. The name or trademark of fuel traders according to the Fuel Act shall be displayed on the container; 3. The labelling statement shall be in Thai language except for the statement on the following which can be in foreign language: - Inspector s mark, month and year in which hydrostatic pressure test is performed; - Name or trademark of fuel traders according to the Fuel Act (1 page, in Thai language). 7 THE NETHERLANDS 1. Waste Substances In the National Waste Management Plan, the policy for waste management for the period is outlined, with an idea of what we can expect in The plan is the frame of reference for decisions regarding waste, such as licensing. Only motivated departures from the above are permitted. Section 1 of the plan is the policy framework which does not contain any technical regulations. However, the policy framework does indicate the difference between disposal and recovery. Section 2 of the plan (the sector plans) contains the general policy framework for specific (categories of) waste. The sector plans contain minimum standards for processing waste. The minimum standards constitute specific technical regulations. After all, the standard indicates the minimum high quality of treatment/processing of a certain waste or category of waste. The following aspects were taken into consideration when the minimum standards were laid down: environmental effects, expenses, viability, implementability, implications for import and export, the practicality and effectiveness when granting licences and the incentive it creates for the waste-processing sector to increase the environmental yield of waste processing and the development of new techniques. The environmental effects have, for a number of waste substances, been described in an environmental report. Chapter 10 of Section 1 of the plan includes an extensive explanatory note to the minimum standards.
