In proposed prices for sample task table of Exhibit 2, what are the anticipated quantities of each task? The quantities will be established based on specific scopes of work that emerge during the contract period. 3. For Phase I ESAs, would MOER be responsible for providing access or would the consultants be required to obtain access? In some cases, OER may provide access agreements. Generally, OER would not require consultants to obtain access agreements on their own. However, in most cases, site access is readily available. 4. For the purpose of estimating unit costs for boring installation, what assumptions should be made in reference to drilling techniques and type of formation (consolidated or unconsolidated media)? Should we assume that the borings can be advanced using direct push technologies? Would concrete coring be required? Respondents should consider field conditions typical of New York City, including types of geological formations found in the five boroughs and field conditions typical for such work. Drilling technologies should be cost efficient and sufficient to achieve goals. 5. For estimating unit costs, what assumptions (e.g., size, volume, dimensions) should be made for the bid items listed below? For some of these items, should the unit cost include just design or design and construction/implementation? 1

The RFP states that one of the anticipated on-call Environmental Consulting Services is, Environmental Remediation Regulatory Oversight. Do you envision that providing this service to MOER would create a conflict that will exclude the consultant (during the 5-yr contract period) from providing investigation/remediation services to developers that have entered the NYC Voluntary Cleanup Program? We do not anticipate that potential conflicts of interest would exclude contractors from providing services under OER programs. It is reasonable to assume that contractors would not perform regulatory oversight over their own OER projects. 7. For the current contract period, could you please provide the names of the selected firms and Service Areas (i.e., categories) that they were awarded? The incumbent contractors are as follows: AKRF - Phase I, Phase II, Cleanup & Remediation. PB Americas - Phase I, Phase II. Tetra Tech - Heating Oil Tank, Remediation audits. Liro Engineers - Heating Oil Tank, Phase I, Phase II, Cleanup & Remediation. Gannett Fleming - IT, Grant Writing SoBRO - Real Estate Advisory services. Brownfield Redevelopment Solutions (BRS) - Grant Writing 8. During the pre-bid meeting, MOER mentioned a need for modeling and other services related to noise and/or air quality. In proposal responses, would these services be addressed under Allowable Additional Services? 2

3 We believe modeling or other services related to noise and/or air quality would be relevant under the stated contract tasks in this solicitation. 9. The RFP states that we must submit six copies of the proposal and must submit four separate envelopes (one for Proposal, one for Price, one for Doing Business Data Form and one for M/WBE Forms). Please confirm that six copies are only required for the first envelope containing the proposal and all other envelopes can contain one copy of said forms. Here is what is required: -Six copies of the price proposal. -Six copies of the technical proposal. -One copy of the Doing Business Data Form. -One copy of the MWDBE forms. 10. May the selected Consultant have the right to refuse to participate in certain Project Assignments? 11. Given that unanticipated events can occur, and new services can emerge, may the selected Consultant hire Subcontractors not mentioned in the original proposal? Please refer to Article 4 of the Draft Contract. The selected Consultant shall be authorized to enter into subcontracts for specialized professional services as required for performance of the Services subject to the prior written approval of the Director as to the Subcontractor, the scope of services, compensation, and theprincipal or other member(s) of the Consultant s staff responsible for supervising the performance of the Subcontractor s activities. 12. Please clarify if multiple contracts will be awarded. If so how many? Multiple contracts are anticipated. The exact quantity is not defined. 13. If multiple contracts are awarded, is there a mini RFP process for each assignment? Individual scopes of service would be provided for specific tasks. 14. If there is a mini RFP process for each assignment will the responses be judged based solely on price (i.e., awarded to the low bidder) or will the technical approach and qualifications be considered? All relevant factors will be considered in the award of assignments in response to a scope of service. 3

4 15. We understand the length of the contract is 5 years with two 1 year options. If your contract is extended past the initial 5 year award will there be an opportunity to negotiate rate changes? 16. Is a markup allowed on subcontractor costs? The contractor will be expected to perform work at costs submitted in response to the scope of services. Any markups would have to be included in a contract amendment or otherwise borne by the contractor. 17. Are three quotes required for all subcontractors? No. 18. If Railroad Liability Insurance is required will the consultant receive reimbursement for the cost of obtaining the insurance? Generally, contractors would be expected to incorporate all costs necessary to perform services in their scope of service proposals. 19. Do you want applicants to simply indicate if they could perform the various tasks listed in the RFP (Part I, page 2) but not specifically mentioned in the sample tasks (Exhibit 1-13)? Selected contractors should be capable of performing all tasks identified or otherwise indicated in the RFP. 20. Under Sample Tasks, 'Task D: Perform assistance to community based organizations...' the RFP provides some sample budget numbers. Should these number be used as a general guidance for the scope to be developed or should respondents develop a budget for this sample task using these specific number? If you want respondents to develop a budget please provide some clarification as to how the numbers should be used. Our current understanding is that $100k (or less) is available for one pre-development contract for three sites, with $10k to $15k allocated to identify the three strategic sites and $25k for each site for pre-development services (total contract pre-development budget of $75k). The per-site budget of $25k should generally be divided into pre-development planning services (i.e., generally up to $10k) and Phase Is and Phase IIs (i.e., the remainder of the per-site budget - $15k). Please clarify if the above assumptions are correct. Respondents should develop their responses on the basis of the content of the RFP. 4

5 Questions from pre-proposal meeting: 21. What are the noise/air services? Noise and air services may include noise monitoring, air quality monitoring, noise modeling, air quality modeling, and instruction of OER staff. 22. For Air Quality modeling, would you be looking to account for stationary and/or mobile sources? OER assessments would follow CEQR protocol(s). 23. Is there a specific M/WBE minimum requirement, or does it depend on the contract?. Please refer to Part I Section of the RFP. Respondents must submit an M/WBE Narrative Form detailing how they intend to achieve their self-set M/WBE participation goal within the goal range. 24. Are there funded projects in the pipeline you anticipate awarding? 25. If one firm can t handle all of the requirements, can we join forces and submit a unified proposal? Each respondent should be prepared to address all tasks in the RFP. It is unlikely that any one firm will be able to handle all of the tasks stated in this RFP. We expect that organizations will collaborate to respond for all of the services. 26. Do you expect every team to perform every service listed? Teams that perform all or almost all of the services listed will be more competitive than teams that perform fewer of those services. 5
