2 RV Rental Agreement/Contract PLEASE READ THIS AGREEMENT and BE AWARE OF ALL THIS BEFORE YOU RENT! Please keep a copy of this Rental Agreement with you while travelling. When renting The Mobile Cabin RV, a $1, Security Deposit is collected in Check form at the time of pick up. In order to hold the specific date, we collect the full amount of the rental plus a $100 refundable cleaning deposit, and delivery fees. Once payment is collected, your agreement to all Cancellation penalties will apply. We inspect the unit before and after the rental. If the RV returns with damage inside or out, you will forfeit the entire security deposit and be subject to additional charges to restore to original condition. We strive to maintain that all renters will have an enjoyable experience. Our goal is to make sure your Mobile Cabin experience is a good one. Please treat this vehicle with respect, please drive carefully, and take care of it! Have a great trip!!! Thank you, The Mobile Cabin Owners The Mobile Cabin RV Agreement of Terms and Conditions 1. Definitions: "Agreement" means all terms and conditions found in this form, and all additional materials we provide at the time of rental. "You" or "your" means the person identified as the renter on this form, each person signing this Agreement, each Authorized Driver and each person or organization to whom charges are billed by us at its or the renter's direction. All persons referred to as "you" or "your" are jointly and severally bound by this Agreement. "We", "our" or "us" means the recreational vehicle dealer names elsewhere in this Agreement Authorized Driver" means the renter and each driver permit to drive the towing vehicle with the Vehicle in tow. Every Authorized Driver must have a valid driver s license and be at least age 25. "Vehicle" means the non-motorized towed recreational vehicle identified in this Agreement and each vehicle we substitute for it, all the Vehicle s equipment, awnings, keys and Vehicle documents. "Loss of Use" means the loss of our ability to use the Vehicle for any purpose due to damage to it or loss of it during this rental, including uses other than for rental, such as display for rent, display for sale, opportunity to upgrade, or opportunity to sell the Vehicle. Damages for Loss of Use are often difficult to determine with precision. Therefore, you and we agree that Loss of Use will be calculated by multiplying the number of days from the date the Vehicle is damaged until it is replaced or repaired, times 80% of the daily rental rate, which you and we agree represents a reasonable estimate of actual damages and not a penalty. Diminished Value means the actual cash value of the Vehicle just prior to damage or loss less the value of the Vehicle after repair or replacement. 2. Rental, Indemnity and Warranties: This is a contract for rental of the Vehicle. We may repossess the Vehicle at your expense without notice to you, if the Vehicle is abandoned or used in violation of law or this Agreement. You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from, or arising out of, this rental and your use of the Vehicle. We make no warranties, express, implied or apparent, regarding the Vehicle, no warranty of merchantability and no warranty that the Vehicle is fit for a particular purpose. 3. Age Restrictions: You must be of Age 25 years or older to operate vehicle. The Primary renter must be the driver at all times and must be properly insured and licensed and a Credit Card will be put on file. You must also provide a photo copy of your Driver s License for our records. Page 2 of 7
3 4. Charges. You agree to pay us on or before the Vehicle is returned or on demand all charges due is under this Agreement, including, but not limited to: (a) time for the period during which you keep the Vehicle; (b) charges for optional services; (c) applicable taxes; (d) all traffic, or parking violations, fines, penalties, citations, forfeitures, court costs, towing charges and other expenses involving the Vehicle assessed against us or the Vehicle; if you fail to pay a traffic or parking charge to the charging authority, you will pay us all fees owed to the charging authority plus our administrative fee of $50 for each such charge; (e) all costs we incur recovering the Vehicle if you fail to return it to the renting location; (f) all costs, including pre- and post judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this Agreement; (g) a 5% per month late payment fee on all amounts paid after the Vehicle is returned; (h) $50 or the maximum amount permitted by law, whichever is greater, if you pay us with a check returned unpaid for any reason; (i) a reasonable fee not to exceed $450 to clean the Vehicle, if returned substantially less clean than when rented; (j) a dumping fee of $50 if the Vehicle s waste tanks; (k) Any cost of repairs needed to repair trailer to its original condition. 5. SECURITY DEPOSIT/ REFUNDS: We may use your deposit to pay all monies owed to us under this Agreement. A $1, check written out to: The Mobile Cabin will be collected at the time of pick up. (We will not cash the check) This deposit is used as security against damage, theft, late fees, and violation of any renter s agreement contained in this Agreement of terms and conditions. You are responsible for all damages or theft to the unit while it is in your possession; whether it occurs from someone in or out of your party or nature. The following are examples of what may be deducted out of the security deposit upon your return. All damages to unit costing $ per hour of repair plus additional parts/materials, late pick up, late fees, sewer tank clean up, and additional cleaning. We reserve the right to utilize the entire check on file upon return of the unit. If charges are in excess of the Security Deposit all other damages will be reported as an insurance claim. Charges may also apply for missing items, broken items, and vandalism. Any portion of security deposit and refunds will be sent up to 7-14 days from the date returned of vehicle and it is in satisfactory condition, i.e. cleaned with no damages, and all terms of agreement are met. Refunds will be mailed via check to your mailing address listed on the application or on your Security deposit check. 6. Prohibited Uses: The following acts or uses of the Vehicle are prohibited: a) towing/driving the Vehicle: (i) by anyone who is not an Authorized Driver, or by anyone whose driving license is suspended in any jurisdiction; (ii) by anyone under the influence of drugs or alcohol; (iii) by anyone who obtained the Vehicle or extended the rental period by giving us false, fraudulent or misleading information; (iv) in furtherance of an illegal purpose or under circumstance that would constitute a violation of law other than a minor traffic citation; (v) to carry persons or property for hire; (vi) to carry dangerous or hazardous items or illegal materiel; (vii) outside the United States; (viii) when loaded beyond its capacity, as determined by the manufacturer of the Vehicle; (ix) when driven through or under an underpass or other structure without sufficient overhead or side clearance; (x) when it is reasonable to expect you to know that further operation would damage the Vehicle; (xi) in a manner that causes damage to the Vehicle due to inadequately secured cargo; (xii) with your vehicle when your vehicle has insufficient towing capacity as determined by the manufacturer of your vehicle; or, (b) failing to summon the police to an accident involving the Vehicle; (c) damaging the Vehicle by your intentional, want or, willful or reckless conduct; (d) transporting an animal in the Vehicle; (e) sitting, standing or lying on the roof of the Vehicle; (f) by placing signs or lettering on the outside of the Vehicle; (g) placing loudspeakers or other sound equipment on the exterior of the Vehicle; and, (h) if the Vehicle is equipped with an outside fuel station, using fuel with an octane rating higher than 87. 4 7. Rental Departure: At the time of pick-up we will provide an orientation to show you the safe and proper use of the trailer. Please arrange minutes for this detail orientation. You must pick up from 1948 Republic Ave. San Leandro, CA and schedule a pick up time between the hours of 9:00am - 1:30pm based on availability only. If you must pick up your rental earlier BEFORE 9:00AM, you must call at least 24 hours prior to schedule time, and must only arrive no earlier than 8:00AM. *Early Check out (Day before) are available at no additional charge only with a 3-day rental, with written approval (via ) if these changes need to be made. For late departures you must call or to receive approval for this special request. If you are going to be late and must arrive after 1:30PM you must call and arrange, you and the vehicle must exit the gate no later than 6:00PM. A full Cancellation of rental if no show. 8. Insurance: You are responsible for all damage or loss you cause to others. You agree to provide auto liability, collision and comprehensive insurance covering you, us, and the Vehicle. Where State law requires us to provide auto liability insurance, or if you have no auto liability insurance, we provide auto liability insurance (the "Policy") that is secondary to any other valid and collectible insurance whether primary, secondary, excess or contingent. The Policy provides bodily injury and property damage liability coverage with limits no higher than minimum levels prescribed by the financial responsibility laws of the State whose laws apply to the loss. You and we reject PIP, medical payments, no-fault and uninsured and under-insured motorist coverage, where permitted by law. Coverage is void if you violate the terms of this Agreement or if you fail to cooperate in any loss investigation conducted by us, or our insurer. The Policy does not cover losses caused by drivers of the Vehicle who are not Authorized Drivers. 9. Responsibility for Damage or Loss of use; Reporting to Police. You are responsible for all damage to, or loss, theft of, the Vehicle, whether or not you are at fault. Your responsibility includes the cost of repair and damages with the $ insurance deductible and any difference over what is paid on each claim by the insurance. You will pay us for Loss of Use, Diminished Value and a reasonable charge to cover our administrative expenses connected with a damage claim. You must report all accidents involving the Vehicle to us and the police within 24 hours of occurrence. 10. ACCIDENTS / MECHANICAL BREAK DOWN /DAMAGE: Please report all accidents/incidents, damage to the vehicle within 24 hours of occurrence. Failure of reporting will suffice admittance of all cost of damages, and will result in the forfeiture of the entire Security Deposit plus additional repairs if loss of use. If mechanical breakdowns should become necessary, please call me on my cell at (510) during business hours. We strive to keep all of our equipment in excellent working condition, and will assist as necessary. Pre-approval from our office is required before making any off site repairs or out of pocket expenses. If authorized, please keep the receipt. There will be no compensation for appliances that stop working such as air conditioner/heater, stove, coffee maker, fridge, microwave, oven, TV, DVD player, radio, back up cameras, generator, awning, slide-outs or fire alarm. Any damage in need of immediate repair to the unit based on negligence/fault of the renter, fees will be applied to your security deposit plus any additional repairs fees in excess of deposit or $185 per hour of repair plus parts and material fees. 11. Roadside Assistance for Towing only: If the RV vehicle breaks down and in need of a tow, please contact David s cell phone at (510) for Roadside assistance information between hours of 8:00AM-10:00PM. Should towing be in need before or after hours, we ask you to please remain with vehicle at all times until Roadside assistance arrives. Failure to do so will result in penalty of loss towards your entire security deposit in access of charges to your mileage and accessed fees. 12. REPAIRS: You are not allowed to repair vehicle for any reason without proper authorization from us. Failure to comply with this rule will result in the forfeiture of the entire Security Deposit plus additional repairs if loss of use. (See Addendum 10.) Page 4 of 7
5 13. TRAFFIC VIOLATIONS/PARKING: You are responsible for reporting and payment of all parking/traffic violations at rental return. Non- reporting of parking/traffic violations breaches the Rental Contract and may result in administrative charges to your bill on file in addition to the fines. 14. WARNING! Prohibited Travel Areas/Camp areas: This vehicle must be driven only on paved roads only in the United States. The vehicle must not be driven through SAND, SNOW, and 4x4 Terrain. Please limit high gravel terrain. Do not enter desert areas during high temperature summer months (i.e. Death Valley) this vehicle will overheat, this will also cause tire damage, engine failure and other problems. You will be responsible to pay for any damage caused and any loss of revenue while the vehicle is being repaired. If you are traveling to an elevation of 2500 feet or more, you may encounter troubles with the operation of the generator. If this occurs, we suggest you hook up to 110 volts to operate the 110 volt appliances. If the generator malfunctions due to elevation, please do not use or try to adjust the generator. No compensation will be made for generator malfunction. This vehicle must not be driven through snow areas, use snow chains, or travel where the weather is below freezing. Tire chains can damage tires if not properly installed and the holding tanks may freeze and burst; you will be responsible to pay for any damages caused and any loss of revenue until the rental vehicle can be rented again. Canada and Mexico is prohibited travel areas. 15. Dry Camping/Non Hook Up Sites: We highly advise NOT to Dry camp with this vehicle. When the renter is Dry Camping (not connected to an external power source), problems will most likely arise due to a low battery or failure. It may help to start your engine and let it run for a minimum of 15 to 20 minutes several times a day or until the battery is charged. The battery will continue to become low until renter is connected to an external power source. We are not responsible for the battery being low or any appliance or vehicle malfunctions of the vehicle due to dry camping, NO reimbursements will be given for Dry Camping Malfunctions. 16. Delivery: When delivered there is a two-day minimum rental. We will not schedule deliveries or pick up on December 24 th, 25th or Thanksgiving Day. We will deliver and set up the Vehicle at any location for a $ set up fee and Fuel Surcharge fee (rates vary upon destination) PLUS $2 per mile to and from facility at San Leandro, CA to renter s destination (MUST not exceed over 200 miles each way). At the time of delivery, we will provide a minute orientation to show you the safe and proper use of the Vehicle. *Please note: Detailed information must be submitted prior to delivery (i.e. correct dates, detailed location, campground, as well as making sure correct width/length/height is suitable for vehicle storage/and parking), this applies to delivery to a residential area (House), you must make sure there is enough room for clearance of Vehicle reversal (trees, fences, parked cars, neighbors, roof etc. ). If arrived upon delivery and the information is not correctly provided or we cannot properly fit/park the cabin without damage to vehicle or surrounding area, the delivery mileage charge, fuel surcharge and a one-day rental will be deducted from your credit card and we will be forced to cancel your reservation 17. Water and Propane: Due to water shortage we cannot supply water for any of our rentals. Please be prepared that our tanks will not have water and it would be your responsibility to fill them up before your reach your camp destination (for non-hookup sites/dry camp). No compensation if you bring back the water tanks with any water in them. Propane tanks are full and a $50 flat fee will be charged from your Security Deposit if not returned full. We will allow you to bring your own propane tanks, so you do not have to use ours and avoid this charge. Please let us know within 24 hours PTD that you are bringing your own propane tanks prior to arrival, if you do not contact we will not be able to deduct the fee. * If we are delivering RV to your campsite we can fill the water tanks for you for an additional fee of $50 to fill tanks. 18. Fuel/Diesel: Your Rental price does not include fuel. The Vehicle will be full upon pickup. You must return tanks full or pay the penalty of $100 PLUS the cost of the fuel to fill if tanks are not full. Please make sure you fill the RV with the correct type of fuel. Some units are Diesel only. Page 5 of 7
6 19. NON USE OF AWNING: We reserve the right to not offer awning usage. Due to all damages to our awnings we feel that all awning is loss of use and unsafe for all rentals. Awnings are zip tied and cannot be used. Failure to comply will result in loss of entire security deposit. There will be no compensation, nor will we be able to cancel or refund due to non-awning usage. 20. Return of Rental/Extension: Please allow 30 minutes once you return to do a brief walk through with you. If you wish to extend the rental period, you must call to approve. If you do not vacate the Vehicle at the scheduled day/time and you have not called for approval you will be automatically charged additional days and any inconvenience fees incurred by the next renter, this also violates your terms in agreement and you will forgo your entire security deposit. There will be no refunds for early returns. Please schedule returns between the hours of 2:00pm 5:00pm PST. PLEASE RETURN RENTAL ON TIME! 21. Late Fees: There will be a late charge of $25.00 per every 15 minutes you are late over your scheduled return/pick time up to a daily usage fee if we are kept waiting (This includes Delivery). All Late returns, without prior approval will result in additional nightly charges, plus you forfeit your entire security deposit, in addition you will pay any inconvenience fees of the next renter, damage fees, cleaning fees, delivery/retrieval fee, that is in excess of your security deposit. Failure to contact us for approval that you are going to be late dropping off the rental, a GPS tracking device will be switched on and we will report this rental as stolen vehicle, appropriate legal action may result. 22. CLEANING: We emphasize that the unit be returned in the same general condition that you received it. You must wipe down and clean everything you used or touched, all counters, handles, switches, wipe inside/outside fridge and freezer, stove/oven, microwave, the entire toilet, the entire tub/shower, all sinks. Sweep the floors, wipe up spills. Remove all your trash, food, and all supplies you brought into the RV. Any items left by you will not be returned. If cleaning is required, the refundable cleaning deposit of $100 will not be refunded. Most cleaning inspections occur within hours after return of vehicle (we reserve the right to penalize and charge cleaning fees when customer is not present). A walk through after return of vehicle is not a cleaning inspection as details maybe over looked. We do not require you to wash the exterior portion of the vehicle. 23. Condition and Return of Vehicle: You must return the Vehicle to our San Leandro rental office or other location we specify, on the date and time specified in this Agreement, and in the same condition that you received it except for ordinary wear. If the Vehicle is returned after closing hours, you remain responsible for all damage to it until we inspect it upon our next opening for business. Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval. 24. CANCELLATIONS: If you decide to cancel your reservation up to 15 days prior to departure there will be a $250 handling fee. If the reservation is cancelled 14 days to 48 hrs. prior to departure a $500 penalty will apply. Cancellations less than 48 hrs. prior to arrival no refund. To avoid cancellation fees 100% of your payment can be held towards a future rental within 12 months of original rental date. 25. Cancellation from The Mobile Cabin: We have the right cancel your reservation should the vehicle be loss of use (inoperable) at time of your departure/reservation dates. We will advise as soon as we find out, if this should prevail. We are not liable or responsible to pay additional of any charges or inconvenience fees to you, other than the payment received. 7 26. Modifications: No term of this Agreement can be waived or modified except by a writing that we have signed. This Agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us regarding this rental are merged into this Agreement. 27. Lost Key: If any keys are lost or not returned there will be a $50.00 replacement fee per key. 28. *USE OF TOILET: It is very important when using the Toilet that only special RV Toilet Paper is allowed. Do not throw any trash, female sanitary napkins, regular TP or paper towels inside toilet, as it will result in damage, you will be held accountable for damages. 29. No Smoking: If evidence shows that smoking accrued in vehicle, this is a violation of the terms set forth in this agreement and will result in the forfeiture of the entire Security Deposit. Please make sure you close doors and windows if near camp fire and/or BBQ smoke. Smoke will saturate walls and will make the vehicle smell like smoke. 30. Pet Policy (Woof Friendly only): Only service dogs or domesticated dogs are allowed. An additional $20 per day per pet will be assessed. If evidence of a pet is found and was not disclosed at time of reservation this is a violation of the terms set forth in this agreement and will result in the forfeiture of the entire Security Deposit. 31. DISCLAIMER: You the Renter agrees not to hold The Mobile Cabin liable for any loss, damage or injury to person and/or personal property. Neither, do we accept liability for inconveniences, or delays resulting from negligence, all acts of nature (weather), mechanical break downs of rented vehicle or your vehicle, or other reasons beyond our/its control. Your Property: You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of another person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in our offices, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility. You cannot remit credit card payment once charges are in effect. 32. Miscellaneous: A waiver by us of a breach of this Agreement is not a waiver of an additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. You release us from all liability for consequential, special or punitive damages in connection with this rental or the reservation of a vehicle. You will indemnify, defend, and hold us harmless from and against all claims arising out of unsafe fueling practices committed by you. If a provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable. *Please Sign and initial this Agreement, fill out the application portion completely and print. Send signed copy via no less than 7 days prior to arrival to Rent@themobilecabin.com. Terms/conditions of agreement are subject to change without notice.
