3 Consultation Process Districts must conduct timely and meaningful consultation with private school representatives and representatives of parents of parentally-placed private school students (PPPSS) during the design and development of special education and related services. 3
4 Consultation Process How, where, and by whom special education and related services will be provided, including a discussion of the types of services, how such services will be apportioned if funds are not sufficient to serve all students, and how and when these decisions will be made. If the school district disagrees with the views of the private school officials on the provision of services, the school district shall provide a written explanation of the reasons why the school district chose not to provide those services. 4
5 DCPS Consultation Process Opportunities for DCPS to consult with parents and schools has occurred regularly throughout the school year Parentally Placed Private School staff have facilitated approximately 150 Child Find meetings and 700+ Service Plan meetings with families and school staff DCPS has collected input from parents and schools regarding the types of services and supplemental instructional material Informational/Professional development monthly meetings were conducted for the 2015 school year 5
6 Parentally-Placed Private School Students with Disabilities Although there is no individual entitlement to Free and Appropriate Public Education (FAPE) for students with disabilities enrolled by their parents in private schools, school districts have an obligation to ensure that such private school students enrolled in nonprofit private schools have an opportunity to participate in services. DCPS serves all eligible students in non-profit private schools in the county; to the extent a parent desires services offered by DCPS on an annual basis, and even if the student actually resides in another county. 6
7 Child Find - Obligations Each school district must locate, identify, and evaluate all students with disabilities who are enrolled by their parents in private, including religious, elementary and secondary schools located in the school district s jurisdiction. 6A FAC 7
8 Child Find - Students Suspected of Having a Disability Referral Process: A student is referred to the Multi-disciplinary Referral Team to discuss the concerns of the parent and private school, in order to determine if a formal evaluation is needed. If evaluation is recommended by the referral team, the evaluation(s) will be conducted following receipt of written parental consent for evaluation. *Release of Information must be obtained or on file. 8
9 Child Find - Students Suspected of Having a Disability Evaluation: For students initially suspected of having a disability, evaluations must be completed within sixty (60) school days in which the student is in attendance. Per State Board Rule, additional elements may be required as a part of the evaluation process for specific Exceptional Education programs*: Functional Behavioral Assessment/Positive Behavior Intervention Plan, Medical form completed by FL licensed physician, Audiological, etc. *DCPS team members will discuss the required documentation at the referral meeting and assist the private school and parent. 9
10 Child Find - Students Suspected of Having a Disability Prior to determining eligibility, the private school must document the following: Evidence-based interventions addressing the identified area of concern with progress monitoring data [Response to Intervention (RtI), Parent involvement in general education interventions, Review of existing data, Observations in the educational environment, and Vision & Hearing screenings 6A FAC Note: Forms are provided in the RtI User Guide to assist in data gathering of the requirements above. 10
11 Child Find - Students Suspected of Having a Disability Eligibility: The Eligibility Determination Team (EDT) will convene to determine eligibility once all required elements are gathered. The EDT, which includes the parent, will review and discuss all information and evaluative data in order to determine eligibility 11
12 FAPE and Services If the student is determined eligible: The team will offer FAPE through an IEP for the student to receive services within the school district. OR If the parent decides to continue the student s enrollment in the private school: Nonprofit If parent elects for the student to receive services offered by DCPS, a Services Plan will be developed For Profit Services will not be offered 12
13 Child Find - Students Previously Determined Eligible Parent requests services through an IEP or a Services Plan: Contact the DCPS Parentally Placed Private School Services Office for verification of eligibility and to schedule an IEP or Service Plan meeting, as appropriate. A Release of Information must be obtained or on file. Note: If the student was determined eligible in another district, additional documentation will be requested. 13
14 Services Plan (Nonprofit only) Students with disabilities in nonprofit parentally-placed private schools, receiving direct services under IDEA, must have a Service Plan developed by appropriate members of the multidisciplinary team. The Service Plan describes the specific direct special education and related services DCPS will provide. A Services Plan is NOT: required for technology, software, and/or other instructional materials. an IEP required to address all the needs of the student that result from the disability required to represent FAPE 14
15 Service Plan (Nonprofit only) The school district must initiate and conduct meetings to develop, review, and revise a Services Plan for a student determined eligible to receive services. The school district must ensure that a representative of the religious or other private school attends the meeting, or use other methods to ensure participation. 15
16 Re-evaluation Re-evaluation must occur every three years. A re-evaluation may consist of the review of existing data and may not involve formal assessments. To request a re-evaluation, parents may complete the form provided at the following link: 16
17 Annual Count DCPS is required to identify the number of parentally-placed private school students with disabilities attending nonprofit private schools located in the district every year. For the past four school years the number of students accessing the PPPSS services has continued to stay consistant = 1007 students = 1169 students = 1226 students = 1080 students 17
18 Annual Count for Proportionate Which students are eligible? Share Calculation Students who have been evaluated and found eligible under the IDEIA 2004 and who are enrolled by their parents in nonprofit private schools as a result of parental choice. Includes students participating in the McKay Scholarship Program. Does not include gifted or Section 504. For students never enrolled in DCPS, in order to determine eligibility, each nonprofit school must provide: Eligibility Determination Form and Parent Consent for Placement Form OR Most current IEP 18
19 Proportionate Share State and local funds may supplement, and in no case supplant, the proportionate share of federal funds to be expended. 19
20 Proportionate Share Dollars in school year used for: Instructional assistance for Reading/Language Arts and/or Math Speech Therapy Technology and web based products Professional Development Collaborative conferencing with parents and schools Technology Support Instructional Materials 20
21 Proportionate Share Services and/or instructional materials will be provided until such time that: The proportionate share funds have been expended, The student withdraws from the private school, The parent no longer wants the student to receive services, or The student is no longer a student with a disability. DCPS is in the process of calculating the Proportionate Share for the school year. 21
22 Private Schools Rights A private school official has the right to submit a complaint to the state Department of Education (DOE) if the LEA did not engage in consultation that was meaningful and timely, or did not give due consideration to the views of the private school official. If the private school official is not satisfied with the decision of the state DOE, a complaint may be submitted to the USDOE. Procedural Safeguards Due process rights for parents apply to Child Find Due process rights for parents do not apply to Services Plans State complaint procedures exist to resolve issues 22
23 Services and Supplemental Instructional Material DCPS is in the process of developing the possible options for services and supplemental instructional materials for the next school year. To the extent the private schools have any additional suggestions or ideas they can provide them at that time. In order to receive any services and/or supplemental instructional materials a school will be required to submit an Affirmation of Consultation form, which will be furnished with the options list. **Please fill out the brief survey located on your table** 23
