You wi need to provide your poicy number and brief detais of the incident. Report a accidents and osses except for gass damage on this number. Any further information to hep you make the caim wi be provided on this number. A accidents and osses shoud be notified to us within 24 hours of the occurrence. By notifying us as soon as possibe about an incident, your insurer can sette your caim quicker and if your car is repairabe, arrange for one of their nominated repairers to be notified as soon as possibe. Furthermore quicky notifying us of the incident means that the detais are fresh in your mind and can hep your insurer essen the cost invoved in deaing with your caim, heping them to keep their prices as ow as possibe. What to do in the event of a caim for gass damage If the ony damage is to the windscreen or windows in your car, pease ca the gassine shown on your Certificate of Motor Insurance and on your Schedue. This ine is open 24 hours a day, every day of the year. If you are covered for gass damage under your poicy and you use this number to arrange repacement, a you pay is the excess (shown on your Schedue). Traveing abroad? Your current poicy cover is automaticay extended to incude trave in the EU and the countries specified in Section 5 for up to 90 days per trip. Pease read Section 5 for fu detais. If you intend to trave for more than 90 days per trip or visit countries not specified, your poicy cover may be extended for the trip or for these countries. Pease ca our Customer Service Department on at east 7 days before the date of your departure. You wi have to pay an additiona premium for this. Important notice You wi enter into two separate contracts when you take out an insurance poicy through us. The first contract is with us for arranging and administering your insurance poicy, on your behaf, and we sha charge you an arrangement and administration fee for providing our services. Our terms and conditions are set out in this document. The second contract is with the insurer noted on the certificate of motor insurance and the poicy schedue, for providing your insurance and they sha charge you a separate premium incusive of insurance premium tax. Their terms and conditions are set out in this document (pages 14-end) the statement of motor insurance, poicy key facts and the certificate and schedue, a of which are in your wecome pack. The combined arrangement and administration fee and premium wi form the tota cost of the insurance and the amounts paid in respect of the cover you hod are found in the covering etter in the wecome pack. Pease note that when we are arranging your insurance on your behaf or making any adjustments to it we are acting on your behaf as your agent. When deaing with caims for Advantage Insurance Company Limited we are acting as the agent for the insurer. A other insurer caims wi be deat with by the insurer concerned. 6 Materia facts Duty of discosure A materia fact is one that is ikey to infuence an insurer in the acceptance and assessment of the proposa. For exampe your or inexperienced driver, or any offence, ( incuding non motor reated offences such as drug, fraud, robbery, theft, handing stoen good, actua bodiy harm or grievous bodiy harm.) or prosecutions pending, or infirmities of any driver. It is an offence under the Road Traffic Acts to make any fase statement or withhod any materia information for the purpose of obtaining a certificate of motor insurance. A materia facts must be discosed faiure to do so coud invaidate your poicy. If you are in any doubt as to whether a fact is materia then it shoud be discosed to Hastings Insurance Services Limited or your insurer. Keeping your poicy up to date The terms of your poicy and premium are based on the information you have given us. If any of this changes or if any materia facts ater (see definitions), you shoud te us by caing our Customer Service Department. Beow are some exampes of what you shoud te us. Pease note this ist is not exhaustive and you shoud contact us if you are unsure about whether you need to inform us of a change. Any changes to your poicy wi be subject to your insurers agreement and may not be acceptabe, therefore pease contact us for guidance on changes you wish to make. If a change to your poicy is acceptabe it may resut in revised terms and/or a change in the premium. Pease te us immediatey if: You or any insured drivers are invoved in an accident, no matter how trivia and regardess of faut; or You change your address or you or any insured drivers change occupations; or Your or any insured driver s driving icence is revoked either temporariy or permanenty, or the status of the driving icence has changed, e.g. if you or any insured driver has passed their driving test. Hastings Insurance Services Limited is authorised and reguated by the Financia Services Authority (FSA). Ownerships and Cose inks Hastings Insurance Services Limited is whoy owned by Hastings (UK) Limited (registered in Engand and Waes number ) which, in turn, is whoy owned by Hastings (Hodings) Limited (registered in Engand and Waes number ) which, in turn, is whoy owned by Hastings Insurance Group Limited (registered in Jersey number ) ("HIG"). If we have arranged your insurance with Advantage Insurance Company Limited, which is whoy owned by Advantage Goba Hodings Limited ("AGH"), we shoud advise that AGH is aso whoy owned by HIG. Wherever we arrange a poicy underwritten by Advantage Insurance Company Limited we wi advise you of this connection before you commit to buy. What is the insurance intermediary service we provide you with? We wi provide you with sufficient information to enabe you to make an informed decision on your purchase. As We wi not make a forma recomendation pease consider a information carefuy to ensure the product(s) meet your requirements before you decide to proceed. Our service incudes: arranging your insurance cover on your behaf with insurers to meet your requirements; and heping you with any ongoing changes you have to make, such as amendments to the cover, use and property insured. We wi aso arrange the canceation of your poicy and arrange cover with an aternative insurer if your requirement to amend your poicy is not acceptabe to your origina insurers. Additionay we wi arrange optiona additiona covers such as ega protection and breakdown where these meet your needs. We wi aso arrange the renewa of your insurance. 7
8 What you have to pay for our services The figures beow are the fees for our services ony. Your insurer may aso appy a premium for any amendment to your poicy. 9 Cient Money and Instaments A money received by us in respect of insurance premiums is hed on behaf of the reevant insurer so that you have no risk in the event of our insovency. The tota price of your insurance is shown in your documents incuding insurance premium tax where appicabe. For ega purposes, we are required to inform you of the possibiity that other taxes or costs may exist that are not paid through or imposed by us, however, we are not aware of the existence of any other taxes or costs currenty payabe. When deaing with any amendments or aterations to your poicy, we wi not coect or refund any amounts under 1. Pease note that any interest earned by us and any investment returns on any segregated designated investments wi be retained by us. If you fai to pay us any money you owe us on the due date and we instruct any third party to coect this money from you, you agree that you wi pay the reasonabe costs of the third party for coecting the money for us. We use a third party to coect and store card detais in accordance with industry standards. We wi use the card detais stored on our behaf to coect payment for mid-term changes, defauted instaments incuding the associated fee, baances foowing canceation and for the renewa of your poicy. We wi inform you in advance of doing so. In the event of you receiving an overpayment, we wi attempt to recover our funds using the credit/debit card stored on our behaf. If payment is initiay made by debit/credit card any refund wi be made to the same card in accordance with the Terms and Conditions of the card issuer. A other refunds wi be made by cheque. We are unabe to give cash refunds. If you do not pay for your insurance you shoud show these detais to the person who paid on your behaf. If you pay using our Direct Debit faciity for any adjustments to your premium over the term of your oan, we hod the right to ask for part or fu payment of any additiona amount. Any return of premium wi be used to reduce your oan amount. If you fai to pay us any money you owe to us on the date due and we instruct a third party to coect this amount you agree to pay our reasonabe costs in the form of fees and reated interest charges and the reated fees and costs of the third party coecting this amount on our behaf. Introducer arrangements A third party may have introduced you to us and for this the introducer may be paid a fee by us. If, as a resut of an accident that was not your faut, you require ega representation, Hastings Insurance Services wi arrange for their recommended soicitors to act for you. The soicitors recommended by Hastings Insurance Services have been chosen as experts in this particuar fied. A fee is paid by the soicitors for being members of our ega services pane. We compy with the Soicitors Introduction and Referra Code as set down by the Soicitors Reguation Authority, and any soicitors to whom we may refer you are independent professionas from whom you wi receive impartia and confidentia advice. 9
10 Your right to cance This section contains important notes about your rights of canceation. You must read these notes carefuy. You can cance your poicy at any time by sending written notice to the address given beow, we can cance your poicy by sending you a seven-day notice in writing to your ast known address. If your poicy is canceed, we wi refund your premium as foows: If you or we cance the poicy within the 14-day withdrawa period, whether cover has commenced or not, we wi refund the part of the premium you have not used subject to our canceation fee of 25 and any charge made by the insurer. If you or we cance the poicy at any other time, we wi refund the part of the premium you have not used subject to our canceation fee of 55 and any charge made by the insurer. You may not receive a refund of premium if you have made a caim, or if one has been made against you, during the period of insurance. If you are paying by instaments and a caim has been made, you may have to pay the baance of the fu annua premium. If we give a discount on our fees and/or the insurer's premium at the inception of your poicy, and the poicy is subsequenty canceed we sha be entited to reduce the amount of any refund to enabe us to recaim the unused portion of the discount. Car, Motorcyce, and Van poicies We wi ony cance a Motor Poicy at your request if you meet the ega requirement to return the certificate of motor insurance to us. If you have ost the certificate of motor insurance, you must send in a competed written decaration confirming that you wish to cance and no onger have the certificate of motor insurance in your possession. Optiona Additiona Products The poicies shown in bod beow can be canceed at any time. However, uness they are canceed within the 14-day withdrawa period, they wi be subject to no return in premium. Motor Lega Protection, Breakdown, Persona Accident, Windscreen, Keycover, Substitute Vehice, Motor Excess Protector. If you have purchased Hastings Direct Premier car insurance, breakdown cover and motor ega protection are incuded as standard and cannot be removed from the poicy. Notes The address to return your poicy document to is: Hastings Insurance Services Ltd, Conquest House, Coington Avenue, Bexhi-on-Sea, East Sussex, TN39 3LW. The withdrawa period of 14-days commences from the time the contract is concuded. The contract is concuded, when you receive the documents from us. We are entited to assume that documents have been received in accordance with accepted principes of aw. That is: provided the document is sent to the correct address, documents posted first cass on business day one are received on business day two. If you have a baance outstanding foowing the canceation of your poicy, the credit/debit card used to pay the first instament wi be charged with the outstanding baance, as this card wi be used to secure the premium payabe for your insurance. If you do not pay for your insurance, you shoud show these detais to the person who paid on your behaf. 10
11 Data Protection For the purpose of the Data Protection Act 1998 the Data Controer in reation to the persona data you suppy is Hastings Insurance Services Limited. Information you provide about yoursef and others wi be used by us for insurance and account administration, providing automatic renewas, to assist you with caims and enquiries, and for statistica and research purposes. We may check and/or share information with credit reference or fraud prevention agencies, and debt coection agencies where necessary. In order to assess the terms of the insurance contract or administer caims that arise, we or the insurer may need to coect data that the Data Protection Act defines as sensitive (such as medica conditions or crimina convictions). By proceeding to provide any sensitive information about a third party (e.g. another driver), you must obtain their prior agreement to this and we wi proceed on the basis that you have done so. We wi pass your information to other organisations (e.g. insurers, service providers) to enabe them to provide the cover/services you have requested, and they in turn may pass your information to their agent(s) in order to deiver the service or carry out reevant investigations. We wi discose your information if we have been egitimatey asked to provide it for ega or reguatory purposes or in connection with actua or prospective ega proceedings. Occasionay, insurers/organisations may transmit or store your data outside the European Economic Area (EEA) in countries that do not have the same standards of protection for persona data as the UK. Continuous Insurance Enforcement and the Motor Insurance Database Information reating to your insurance poicy wi be added to the Motor Insurance Database ("MID") managed by the Motor Insurers Bureau ("MIB"). The MID and the data stored on it may be used by certain statutory and/or authorised bodies incuding the Poice, the DVLA, the DVANI, the Insurance Fraud Bureau and other bodies permitted by aw for purposes not imited to but incuding: I. Eectronic Licensing. II. Continuous Insurance Enforcement. III. Law enforcement (prevention, detection, apprehension and or prosecution of offenders). IV. The provision of government services and or other services aimed at reducing the eve and incidence of uninsured driving. If you are invoved in a road traffic accident (either in the UK, the EEA or certain other territories), insurers and or the MIB may search the MID to obtain reevant information. Persons (incuding his or her appointed representatives) pursuing a caim in respect of a road traffic accident (incuding citizens of other countries) may aso obtain reevant information which is hed on the MID. It is vita that the MID hods your correct registration number. If it is incorrecty shown on the MID you are at risk of having your vehice seized by the Poice. You can check that your correct registration number detais are shown on the MID at 11
12 Fraud prevention and detection Frauduent insurance appications and caims increase insurance premiums for a poicyhoders. To prevent and detect insurance reated fraud we may check your detais with nationa fraud prevention agencies and databases incuding Insurance Hunter, Motor Insurance Anti-Fraud & Theft Register, Caims and Underwriting Exchange and the Motor Insurers Database. When we dea with your request for insurance, or hande your caim, we may search these registers. Under the conditions of your poicy, you must te us about any incident (such as accident or theft) which may, or may not, give rise to a caim. When you te us about an incident, we wi pass information reating to it to the registers. If fase or inaccurate information is provided and fraud is identified, detais wi be passed to fraud protection agencies. Law enforcement agencies may access and use this information. The insurer and other organisations may aso access and use this information to prevent fraud and money aundering, for exampe, when: Checking detais on appications for credit and credit reated or other faciities. Managing credit and credit reated accounts or faciities. Recovering debt. Checking detais on proposas and caims for a types of insurance. Checking detais of job appicants and empoyees. The insurer shown on your schedue can give you detais of the reevant agencies. The insurer and other organisations may access and use from other countries the information recorded by fraud prevention agencies. It is an offence under the Road Traffic Act to make a fase statement or to withhod information to obtain the issue of a Motor Insurance Certificate. Faiure to discose a reevant facts coud invaidate your poicy. If you are in any doubt as to whether certain facts are reevant or not, pease ask us. In particuar, you shoud discose any facts which woud infuence an insurer in the assessment and acceptance of the risk. If you give us any additiona information in writing you shoud keep a copy for your records. If requested a copy of this competed form wi be suppied to you within a period of three months after its competion. 12

14 Information about your poicy documents Your insurance contract is made up of: This poicy; Your Schedue which has detais of you, your Insurer, your car and the cover provided; Your current Certificate of Motor Insurance which gives detais of who may drive your car and what your car can be used for; and The Proposa/Statement of Fact/Statement of Insurance which shows a the information you have provided on which the cover has been based. Your Schedue wi show you which sections and endorsements in this poicy appy to you. You shoud keep a record (incuding copies of etters) of a the information you suppy us with in reation to this insurance. Contract of insurance This poicy is a contract soey between you and the Insurer (as shown on your current Certificate of Motor Insurance). It is not intended that the Contracts (Rights of Third Parties) Act 1999 shoud confer any additiona rights under this poicy in favour of any third party. The information provided by you, to us as stated on your Proposa /Statement of Fact /Statement of Insurance forms part of this contract. If you have paid or agreed to pay the appropriate premium, and arrangement and administration fee the Insurer wi provide insurance, under the terms set out in this poicy, for injury, oss or damage occurring during the period of cover. Under European aw, you and we may choose which aw wi appy to the contract. Uness you and we have agreed otherwise, Engish aw wi appy. Certificate of Motor Insurance The proof of the motor insurance you need by aw. The Certificate of Motor Insurance shows what car is covered, who is aowed to drive the car and what the car can be used for. Endorsement A cause which changes the terms of the poicy. Any endorsements which appy wi be shown on your Schedue. Excess The part of the caim that you must pay. Insurer The insurance company or Loyd's syndicate Insurer whose name is shown on your Certificate of Motor Insurance and Schedue. Materia Facts Facts ikey to infuence our decision to insure you such as occupation(s) of a insured drivers or any driving convictions or accidents you or any insured driver may have. Market Vaue The cost of repacing your vehice in the United Kingdom at the time the oss or damage occurred with one of a simiar make, mode, age and condition. Pubications may be used which refer to vehice vaues such as Gass's Guide to assess the market vaue, with an aowance being made for the mieage, condition and circumstances of purchase by you. Nominated Repairer A repairer from your insurer approved network, whom your insurer wi authorise to repair your car foowing a caim under Section 1 or Section 2 of this poicy. Period Of Cover The period you are insured for, as shown on your Certificate of Motor Insurance. If the equipment is part of the car's origina specification, fitted by the manufacturer/deaer from first registration, cover wi be unimited. 6 Loss of or damage to your car where possession of it is gained by deception by someone who caims to be a buyer or agent. 6 Your car being repossessed by its rightfu owner or having to pay compensation to the owner. 6 Loss or damage if your car is being driven by anyone who is not keeping to the terms of their driving icence. 6 Any amount greater than the manufacturer s ast ist price for repacing any part or accessory ost or damaged. 6 Repairs or repacements which improve the condition of your car. 6 Loss of or damage to your car as a resut of a deiberate act by anybody insured by the poicy. 6 Your car being confiscated or destroyed by or under order of any government or pubic or oca authority. 6 Loss of or damage to your car caused by a member of your immediate famiy, or a person iving in your home taking your car without your permission, uness you report the person to the poice for taking your car without your permission and assist the poice in a prosecution. 6 Costs of importing parts or accessories or storage costs caused by deays, where the parts or accessories are not avaiabe from current stock in the UK. 6 Damage to your car if you or any person entited to drive as specified by your current Certificate of Motor Insurance is convicted of an offence invoving drink or drugs, or was driving when under the infuence of drink or drugs, when the accident happened. 6 This poicy does not provide cover for accidenta injury, oss or damage arising whist your vehice is being used in any raies. 6 Loss or damage to your car caused by an inappropriate type or grade of fue being used. Young and inexperienced driver excess You wi have to pay the first part of every caim for oss of or damage to your car. For each caim you wi have to pay the foowing: 6 The first 295 when your vehice is being driven by or is in the charge of any person who is under The first 195 when your vehice is being driven by or is in the charge of: - any person aged 21 to 24; or - any person aged 25 or over who hods a provisiona icence or who has not hed a fu UK or EU/EEC driving icence for at east one year. In either case the amount shown above wi appy on top of any other excess shown on your Schedue. You do not have to pay any excess when your car is with a member of the motor trade for servicing or repairs. 17
18 Section 1 Continued How your caims are setted For oss of or damage to your car your insurer wi either: 4 Pay for any necessary repairs; 4 repace your car; or 4 pay the market vaue of your car immediatey before the oss (this is not necessariy the vaue you decared when the insurance was taken out). Recyced parts or non origina parts and equipment may be used in repairs or taken into account in the caims settement. Your insurer wi not pay a cash sum for audio/visua equipment you are caiming for under this section. Your insurer wi sette a caim for audio/visua equipment by repairing it or repacing it with a simiar piece of equipment. The most your insurer wi pay is 300 for oss of or damage to in-car audio, teevision, DVD, phone, games-consoe, eectronic navigation or radar detection equipment permanenty fitted to your car. If the equipment is part of the car's origina specification, fitted by the manufacturer/deaer from first registration, cover wi be unimited. If your car is a tota oss, your insurer wi (if you and any other interested parties agree) repace it with a new car of the same make, mode and specification as ong as: 4 You have owned your car since it was first registered as new; and 4 within one year of it being registered as new, your car suffers damage where the cost of repair is estimated by your insurer to be more than 60% of the current ist price (incuding taxes) of your car at the time of the damage; and 4 your car s recorded mieage at the time of the oss is not more than 12,000 mies; and 4 your car is not an import and was sourced and suppied as new in the United Kingdom; and 4 the repacement car is avaiabe in the United Kingdom within 6 weeks from the time of the oss. If a car of the same make, mode and specification is not avaiabe, the most your insurer wi pay is the market vaue of your car at the time of oss or damage. If you are sti paying for your car under a hire purchase or easing agreement your insurer wi pay a caim for the tota oss of your car to the hire purchase or easing company. If your car is a tota oss, your insurer may put it in free and safe storage unti your caim is setted. Your insurer wi aso be entited to take possession of your car once they have setted your caim. If you are paying by instaments and your insurer settes a tota oss caim under this section a outstanding premium may be deducted from the caims settement. Except with the insurer s written consent, no admission, offer, promise, payment or indemnity sha be made by you or any person (or on behaf of any person) caiming indemnity under the Poicy. Your insurer sha be entited to conduct the defence or settement of any caim and to instruct the soicitors of their choice to act for you in any proceedings. In circumstances where it is considered appropriate your insurer wi be entited to admit iabiity on behaf of you or any person caiming indemnity under the Poicy. Such admissions may be made prior to or after the commencement of proceedings in reation to any event ikey to give rise to a caim under the Poicy. Your insurer wi aso pay the reasonabe cost of protection and taking your car to the nearest suitabe insurer nominated repairer or a pace of storage after such damage and where appropriate returning it after repair to your address as shown in the schedue. 18
19 Section 2 Damage or oss by fire or theft What is covered Loss of or damage to your car (and its accessories whie in or on your vehice or in your private garage) by: 4 Theft; 4 attempted theft; or 4 fire and ightning. If the keys to your car or the ock transmitter are stoen your insurer wi pay up to a maximum of 500, after deducting any excess under this section, towards the cost of repacing: - the door ocks and/or boot ock; - ignition/steering ock; - the ock transmitter and centra ocking interface; providing it can be estabished that the identity of the garaging address of your car is known to any person in receipt of such keys or transmitters. Except with the insurer s written consent, no admission, offer, promise, payment or indemnity sha be made by you or any person (or on behaf of any person) caiming indemnity under the Poicy. The insurer sha be entited to conduct the defence or settement of any caim and to instruct the soicitors of their choice to act for you in any proceedings. In circumstances where it is considered appropriate your insurer wi be entited to admit iabiity on behaf of you or any person caiming indemnity under the Poicy. Such admissions may be made prior to or after the commencement of proceedings in reation to any event ikey to give rise to a caim under the Poicy. 21 Section 3 Liabiity to third parties What is covered 4 Your insurer wi cover ega iabiity for the death of or injury to any person, and damage to property, caused by: - You using or being in charge of your car; - a traier, broken-down vehice or caravan whie attached to your car; - any person driving your car with your permission (as ong as your Certificate of Motor Insurance shows that he or she is entited to drive your car); - any person using (but not driving) your car, with your permission, for socia, domestic and peasure purposes; or - any person getting into or getting out of your car. 4 Your insurer wi aso cover the foowing: - Any costs and expenses your empoyer or business partner is egay iabe for as a resut of you using your car for their business, providing your Certificate of Motor Insurance shows you have the appropriate business use cover. - The cost of emergency treatment under the Road Traffic Act. 4 And, if your insurer first agrees in writing: - Fees for any soicitor appointed by your insurer for representation at any coroner s inquest, fata accident inquiry or court of summary jurisdiction. - Costs of ega services arranged by your insurer for defending a charge of mansaughter or causing death by dangerous, careess or inconsiderate driving. - Any other costs and expenses your insurer has agreed to in writing. If anyone covered by this section dies as a resut of an event covered by this section, their ega representative wi have the benefit of the cover provided under this section. Where cover is provided by the effective Certificate of Motor Insurance, your insurer wi indemnify you whie personay driving, with the permission of the owner, any car not owned by you or hired to you under a hire purchase agreement or eased to you under a easing agreement or provided to you as a courtesy car and not owned or hired or ent to you by your empoyer or partner. Your insurer wi not indemnify you where the insured vehice specified in the current Schedue, which forms part of the Poicy, has been disposed of or has become the subject of a tota oss. Note: Cover is not provided: a) For oss or damage to the car you are driving. b) If you are covered by any other poicy of insurance to drive the car. c) If the vehice is being used outside the territoria imits of this Poicy. d) Uness a current and vaid poicy of insurance is in force for the vehice being driven under this section of this Poicy. e) For recovery of any vehice which has been impounded by any poice or oca authority. Except with the insurer s written consent, no admission, offer, promise, payment or indemnity sha be made by you or any person (or on behaf of any person) caiming indemnity under the Poicy. The insurer sha be entited to conduct the defence or settement of any caim and to instruct the soicitors of their choice to act for you in any proceedings. In circumstances where it is considered appropriate your insurer wi be entited to admit iabiity on behaf of you or any person caiming indemnity under the Poicy. Such admissions may be made prior to or after the commencement of proceedings in reation to any event ikey to give rise to a caim under the Poicy. 21
22 Section 3 Continued What is not covered 6 Death of or injury to, any of your empoyees during the course of their work except where your insurer needs to provide cover as required by aw. 6 Loss of or damage to, property owned by or in the care of the person caiming under this section. 6 Loss of or damage to your car or any attached traier, broken-down vehice or caravan. 6 This poicy does not provide cover for accidenta injury,oss or damage arising whist your vehice is being used in any raies. 6 Caims arising from the foowing: - Your car being driven with your permission, by someone who you know does not hod a icence to drive the vehice. (This exception does not appy if the driver has hed a icence and is not disquaified from hoding or getting one). - Your car being driven by or in the charge of any person who is not named as entited to drive on your Certificate of Motor Insurance. - Your car being driven by any person who is insured under another motor poicy. 6 Any amount exceeding: - 20 miion for oss of or damage to other peope s property incuding any reated indirect oss or damage; and - 5 miion for ega costs and expenses arising from oss of or damage to other peope s property; arising out of any caim or series of caims caused by one event. Section 4 Persona accident What is covered 4 If you or your spouse or civi partner are accidentay kied or injured whie getting into, traveing in or getting out of your car (or any other car you do not own), your insurer wi pay a benefit if the accident resuts in death, tota and permanent oss of sight in an eye or tota physica oss of a imb at or above the anke or wrist. The death or oss must occur within 90 days and be a direct resut of the accident. What is not covered 6 Benefit for death of or injury to a person under 16 or over More than 5000 in any one period of insurance. 6 If you or your spouse or civi partner have more than one poicy with the insurer, your insurer wi ony pay out under one poicy. 6 Benefit for death or injury occurring whie the driver is under the infuence of acoho or drugs. How your caims are setted For caims under this section your insurer wi pay the foowing: For death For tota and permanent oss of sight in an eye For tota physica oss of a imb at or above the wrist or anke If your insurer pays a caim for death, they wi make this payment to the appropriate persona representative. 22
23 Section 5 Territoria imits and using your car abroad The Territoria Limits of this poicy are Great Britain, Northern Ireand, the Ise of Man and the Channe Isands, incuding transit by sea, air or and within and between these paces. 4 Compusory Cover outside the Territoria Limits This poicy aso provides the minimum cover required by the reevant aw to enabe you or any person named on the Certificate of Motor Insurance to drive or use your car in any country which is a member of the European Union and to any other country which agrees to foow European Union directives on motor insurance and is approved by the commission of the European Union. 4 Fu Poicy cover outside the Territoria Limits The Territoria Limits are automaticay extended for 90 days for any one trip to incude - any country that is a member of the European Union; and - Croatia, Iceand, Norway, Switzerand and Liechtenstein. This cover ony appies if your permanent home is in the United Kingdom; and your visit to such countries is temporary. If you intend to use your car in excess of 90 days for any one trip in these territories, you must first contact our Customer Service Department to obtain agreement and pay any additiona premium requested. Ony the minimum cover required by the reevant aw wi appy uness this condition is met. Fu cover appies whie your car is being transported by air, sea or rai between any of these countries, incuding oading and unoading, subject to the imitations detaied above. This poicy does not cover events occurring in a country that is not incuded in this section uness this is agreed and you receive an Internationa Motor Insurance Certificate. How your caims are setted Your insurer wi sette caims as set out in sections 1 and 2. If they have to pay for the car to be deivered to you after repairs, they wi ony pay for it to be deivered to you whie you are in the country where the oss or damage occurred. Section 6 Medica expenses What is covered 4 if you or anyone in your car is injured in an accident invoving your car, your insurer wi pay medica expenses of up to 500 for each injured person. 23
24 Section 7 Persona beongings What is covered 4 Your insurer wi cover persona beongings which are in your car and are ost or damaged by accident, fire or theft. The most that wi be paid is 300 for any one caim. What is not covered 6 Money, stamps, jeweery, tickets, documents or securities. 6 Goods, sampes or toos carried in connection with any trade or business. 6 Wear and tear. 6 Property insured under any other poicy. 6 Loss of or damage to mobie phone or eectronic navigationa equipment. 6 Theft or attempted theft of persona beongings if your car has been eft unocked, eft with the keys in it or eft with a window or roof open. 6 Theft of persona beongings uness kept out of sight in the ocked boot or gove compartment of your car. How your caims are setted Your insurer wi pay the cost of the item ess an amount for wear and tear, to you or the owner of the property. Section 8 Gass damage What is covered 4 Broken gass in the windscreens or windows of your car and any scratching to your car s bodywork as a resut of the broken gass. What is not covered 6 The excess shown for this section on your Schedue. 6 Sunroofs or any other gass forming part of your car. How your caims are setted Your insurer wi either: Pay for the gass to be repaired; or pay for the gass to be repaced. Additiona charges or imited cover may appy if you do not use your insurers nominated windscreen repairer. You wi be required to pay the excess shown on your schedue for each gass caim made. Your insurer wi aso pay to repair any scratching to the bodywork of the vehice. Any payment made under this section aone wi not affect your no-caim discount. 24
25 Section 9 No-caim discount If you do not make a caim during the current period of insurance, when you renew the poicy a discount wi be incuded in your premium. You may not transfer this discount to another person. Any payment your insurer makes under section 8 (Gass damage), or for emergency treatment under section 3 (Liabiity to third parties) wi not affect your no-caim discount. If you have protected no-caims discount, there is no guarantee that your premium wi not increase. Section 10 Chid seat cover What is covered 4 If you have a chid s car seat or booster seat fitted in your car and your car is invoved in an accident, fire, theft or attempted theft, provided you are making a caim under Sections 1 or 2 of this poicy, your insurer wi pay for the cost of a repacement of a simiar mode and standard even if there is no apparent damage, subject to the provision of the purchase receipt for the origina item. Uness stoen, the chid's car seat or booster seat shoud be made avaiabe for inspection. Section 11 Overnight accommodation or onward transport If you are unabe to continue your journey as a resut of oss of or damage to the insured car under Sections 1 & 2 of this poicy, the insurer wi pay you up to 50 per person ( 250 maximum for a occupants of the car) in respect of one of the foowing: Traveing expenses for occupants of the insured car towards reaching your destination; or One nights hote accommodation on the day of the accident or oss for the occupants of the insured car where the oss of use necessitates an unpanned overnight stop. You must pay for the accommodation or traveing expenses yoursef and submit receipts for the insurer to reimburse you. There wi be no cover for newspapers, drinks, teephone cas and meas. This cover wi not appy outside the Territoria Limits of the poicy. 25
26 Genera exceptions This poicy does not cover the foowing: 1. Any injury, oss or damage occurring whie your car is being: Driven by or is in the charge of any person not shown on your Certificate of Motor Insurance; or used for any purpose not shown on your Certificate of Motor Insurance; or used on any race track or circuit other than accidents to which the Road Traffic Act appies. However, your car is covered whie with a member of the motor trade for the purpose of maintenance or repair. 2. Any injury, oss or damage occurring whie your car is being: Driven or in the charge of anyone who does not have a vaid driving icence, is disquaified from driving, has not hed a driving icence, is prevented by aw from hoding one and who does not meet the terms and conditions of their driving icence as required by DVLA/DVANI rues and reguations and any reevant aw. 3. Liabiity you have under an agreement, uness you woud have had the iabiity if the agreement did not exist. 4. Loss, damage, injury or ega iabiity directy or indirecty caused by, resuting from or in connection with invasion, war, revoution or any act of terrorism regardess of any other cause or event contributing concurrenty or in any other sequence to the oss, except where such iabiity is required to be covered by the Road Traffic Act. The definition of terrorism sha foow the interpretation as set out in the Terrorism Act 2000 or subsequent amendments thereto or be any act deemed by the Government or a UK Court of Law to be an act of terrorism. 5. Any injury, oss or damage (except under section 3 - Liabiity to third parties) caused by or arising from: Earthquake; or riot or civi disturbance outside Great Britain, the Ise of Man or the Channe Isands. 6. Loss, damage, injury or ega iabiity caused directy or indirecty by: Pressure waves caused by aircraft and other fying objects; or Ionising radiation or radioactive contamination from any nucear fue or from any nucear waste arising from burning nucear fue; or the radioactive, poisonous, exposive or other dangerous properties of any exposive nucear equipment or part of that equipment. 7. Any accident, injury, oss, damage or iabiity arising whie your car is in a pace used for the take off, anding, parking or movement of aircraft, incuding the associated service roads, refueing areas and ground equipment parking areas. 8. Any decision or action of a court outside Great Britain, Northern Ireand, the Ise of Man or the Channe Isands, uness the decision is made or action is taken in a foreign court because your car was used in that country and that country is in the European Union or is mentioned by name in Section Any iabiity for death, injury, iness, or oss of or damage to property, arising directy or indirecty from poution or contamination, uness it is directy caused by an event which is sudden, identifiabe, unintended and unexpected. The whoe event must happen at a specific time and pace during the period of insurance. We wi treat a poution or contamination arising from one incident as having happened at the time of the incident. This poicy does not cover caims arising from poution or contamination which happen as a resut of deiberatey reeasing substances or as a resut of eaks from your car caused by faiure to propery maintain it. This exception does not appy where your insurer needs to provide the minimum eve of cover required by aw. 10. Any oss or damage resuting from the impoundment or confiscation of your vehice by Customs and Excise, Poice or any other Government Authority. 11. Any accident, injury, oss, damage or iabiity whie your car is: Towing a traier which is unsafe or has an insecure oad. Being driven with a oad or a number of passengers which is unsafe or greater than the manufacturer s specifications. 12. Any accident, injury, oss, damage or iabiity whie your car is outside the Territoria Limits uness aowed by Section Loss or damage or iabiity which is the responsibiity of the person driving or steering any vehice being towed by your vehice or being towed by a vehice being driven by you. 14. Lega iabiity when a traier or broken-down vehice is being towed for profit. 26
27 Genera conditions You must compy with the foowing conditions to have the fu protection of your poicy. If you do not compy with them, your insurer may at their option cance the poicy or refuse to dea with your caim or reduce the amount of any caim payment. 1. Making Caims In the event of any caim under this poicy, you or any insured driver or your ega representative must phone our caims hepine with information as soon as is reasonaby possibe. If your caim is for gass damage ony, phone your insurer s gassine. The teephone numbers are shown on your Certificate of Motor Insurance and your Schedue. You or any insured driver must immediatey send to your insurer any writ, summons, etter, caim or other document, unanswered. You or any insured driver must immediatey te your insurer about any impending prosecution, inquest or fata accident inquiry. You or any insured driver must not admit iabiity for or negotiate the settement of any caim uness you have your insurer s written permission. You or any insured driver must give your insurer a the information and hep requested, and a information provided must be true and correct to the best of your knowedge. Your insurer can, for their own benefit: Take over and conduct the defence or settement of any caim; and Take ega action over any caim. These actions may be taken in your name or the name of any insured person. 2. Care of your vehice You or any insured driver must take a reasonabe steps to: Protect your car from oss or damage; and Maintain your car in an efficient and roadworthy condition and we may examine your car at any time. Ensure you have a vaid Department for Transport Test Certificate (MOT) for your car if one is needed by aw. 3. Canceing this poicy You have the right to cance this poicy within 14 days of taking it out or renewing it (or within 14 days of receiving the poicy documents or renewa schedue, if ater), without giving a reason. Uness you have made a tota oss caim under the poicy, you wi receive a refund of premium paid, subject to your insurer s minimum premium for any period of cover provided. In these circumstances, the effective date of canceation wi be the date that you serve notice of your wish to cance. If you serve notice of canceation prior to commencement of cover, you wi be entited to a fu refund of the premium you have paid. We or your insurer may aso cance this poicy by sending you 7 days' notice, in writing, to your ast known address. A refund of premium for the remaining period of your poicy wi be aowed as ong as no caim has arisen in the current period, subject to your insurers minimum premium. You may aso cance the poicy at any time after the initia 14-day period detaied above by returning the Certificate of Motor Insurance to us. In this event a refund of premium, subject to your insurers minimum premium,wi be cacuated with effect from the date that the Certificate of Motor Insurance s received at the offices of Hastings. If any caims have been submitted during the current annua period of insurance, no refund wi be due and if you are paying the annua premium by instaments, then the outstanding oan wi become payabe in fu. 4. Right of recovery If your insurer is required under aw to pay a caim which they woud not otherwise pay, they can recover the amount of the caim from you or the person responsibe. 5. 28 Genera conditions Continued 6. Keeping to this poicy Your insurer wi ony provide the cover described in this poicy if: Anyone caiming cover has kept to a its terms, conditions and endorsements; and The information you gave on your Proposa/Statement of Fact/Statement of Insurance and decarations is correct and compete as far as you know. 7. Non-payment of premiums If you are paying in instaments by Direct Debit, you must make sure your instaments are kept up to date. If an instament is not received on or before the date it is due, we wi give you 7 days notice of canceation in writing. This notice wi be sent to your ast known address by first cass post. The poicy wi end after the 7 days notice runs out. If a caim has arisen during the current period, the fu annua premium wi be required. If a tota oss caim is setted under section 1 or 2, a outstanding premium may be deducted from the caims settement. 8. Car sharing The receipt of financia contributions as part of a vehice- sharing arrangement for socia or simiar purposes in respect of the carriage of passengers wi not be regarded as the carriage of passengers for hire or reward (or the use of the vehice for hiring) provided that: a) The vehice is not constructed or adapted to carry more than seven passengers (excuding the driver). b) The passengers are not being carried in the course of a business of carrying passengers. c) The tota contributions received for the journey do not invove an eement of profit. 9. Fraud You must not act in a frauduent manner. If you or anyone acting for you: Misead us in any way, incuding who is the main user of the car, in order to get insurance from us, to obtain more favourabe terms or reduce your premium; or Make a caim under the poicy knowing the caim to be fase or frauduenty exaggerated in any respect; or Submit a document in support of a poicy or caim knowing the document to be forged or fase in any respect; or Make a caim in respect of any oss or damage caused by your wifu act or with your connivance. Then: Your insurer sha not pay the caim. Your insurer sha not pay any other caim which has been or wi be made under the poicy. Your insurer may cance or at their option decare the poicy void. Your insurer sha be entited to recover from you the amount of any caim aready paid under the poicy. Your insurer sha not make any return of premium. Your insurer may inform the poice of the circumstances. 10. Victim of Crime The circumstances of any caim which arises as a resut of you being a victim of crime must be reported to poice as soon as practicabe. You must fuy cooperate with a resuting poice enquiries and any resuting prosecution of offenders. 11. Proof of No Caims Discount We have given a discount on your poicy dependent on the number of years no caims you state you have. Proof of this no caims period must be provided, when you are asked to do so, in writing from the immediate ast insurer or your poicy may be invaid. Your period of no caims must have been earned within the United Kingdom within the previous two years and earned on a private car poicy. 28
29 Endorsements An endorsement ony appies if its number is shown on your current Schedue. 02 Excuding drivers under 25 years of age The cover described in the poicy wi not appy whie your vehice is being driven by or is in the charge of any person under Protected no-caim discount (Two caims in 3 years). Section 9 of your poicy is repaced with the foowing: You wi keep your no-caim discount if you make no more than 2 caims in any 3 year period. If you make more than 2 caims, at the next renewa date your no-caim discount wi be reduced to: 2 years no-caim discount (if you have made 3 caims); or No no-caim discount (if you have made more than 3 caims). Depending on the circumstances of your caim, we may increase your premium. 07 Excuding drivers under 25 years of age uness specified The cover described in the poicy wi not appy whie your vehice is being driven by or is in the charge of any person under 25 years of age uness that person s name is shown on your Schedue against this endorsement number. 09 Owner s interest noted The person named against this endorsement number on your Schedue has an interest in your poicy as owner of the vehice. 10 Excuding a specific driver The cover described in the poicy wi not appy whie your car is being driven by or is in the charge of the person named against this endorsement number on your Schedue. 13 Traier cover (accidenta damage, fire and theft) Any traier attached to your car wi have cover under sections 1 and 2 as ong as: You have given us fu detais of the traier; and You own the traier or it is hired to you under a hire purchase agreement. Loss or damage to any property being carried in the traier is not covered by this poicy. 16 Revised imit for audio/visua equipment The most we wi pay under sections 1 and 2 of this poicy for a fitted radio, cassette payer, car phone or any other audio/visua equipment is the amount shown against this endorsement number on your Schedue. 19 Immobiiser warranty For a caim of theft or attempted theft of your car, section 2 of this poicy wi ony appy if: The car is fitted with an eectronic immobiiser; The immobiiser was on and working efficienty at the time of the theft or attempted theft; and You send us a the keys and remote contro units used to turn the immobiiser off. 29
30 Endorsements Continued 24 Garaging Warranty We have accepted your insurance on condition that your car is kept overnight in a ocked and secured garage. Faiure to compy with this condition may mean we wi refuse to dea with any caim arising from your car being maiciousy damaged, ost or stoen. 26 Tracking Device Warranty We have accepted your insurance on condition that your car is fitted with a tracking device and that the device wi be fuy operationa at a times when your car is parked and eft unattended. Faiure to compy with this condition may mean we wi refuse to dea with any caim from your car being ost or stoen. 27 Guaranteed Bonus Section 9 of your poicy is repaced with the foowing: You wi be aowed a no-caim bonus according to the guaranteed bonus rate in force even if you make caims. 32 Theft Endorsement It is a condition of this insurance that any manufacturer's standard security device fitted to your vehice is operationa and is used whenever you eave the vehice. If the device is not operationa or is not used, any caim for theft or attempted theft wi not be covered by this poicy 33 Limited Mieage Your premium refects the tota annua mieage you have decared as shown on your Proposa/Statement of Fact /Statement of Insurance for this insurance. If you exceed this, within a tweve month period, you wi be responsibe for the first 500 of any caim(s) under sections 1 and 2 of this Poicy. This is in addition to any other excess(es) appicabe. 34 Vehice Security Endorsement It is a condition of this insurance that an approved security device is fitted to your vehice and that it is operative when your vehice is eft unattended. In the absence of such, any caim for theft or attempted theft wi not be covered by this poicy. 38 Uninsured Driver Promise In the event that you are invoved in an accident that is not deemed to be your faut and the driver of the vehice that hits you is not insured, we wi not prejudice your no caim discount in any way. This is subject to the foowing conditions being met: You providing us with the vehice make, mode and registration of the third party car that caused the damage to your car Where possibe, the other drivers name and address. 39 Vandaism Promise If you make a caim for your car as a resut of vandaism which is a maicious and deiberate act, you wi not ose your no caims discount. This is subject to the foowing conditions being met: 1. The excess is paid. 2. You report the incident to the poice and provide us with your crime reference number. 3. Maicious damage is specificay excuded to your car as a resut of a deiberate act by anybody insured by the poicy. Your no caims discount wi be prejudiced unti such time as you provide your crime reference number. 30
31 Traveing abroad Important guideines when traveing abroad Pease see section 5 for detais of where this poicy covers you and fu detais of foreign use. You do not need a green card to trave in the EU and the countries specified in section 5 but you must first contact our Customer Service Department to obtain agreement if you intend to use your vehice in excess of 90 days for any one trip or you intend to visit countries not specified. Uness this condition is met ony the minimum cover required by the reevant aw wi appy. Take the foowing insurance documents when you trave abroad: Your Certificate of Motor Insurance and this Poicy Booket. If you have an accident abroad, foow the procedure beow 1. Immediatey report the accident to the poice if anybody invoved in the incident is injured or if there is a disagreement with the other driver. Get detais of the poice team that attended the scene or who the accident was reported to. 2. Give your name and address, and our name and address to the other party and produce your Certificate of Motor Insurance. 3. Get the name and address of the other driver, detais of their motor insurer (incuding poicy number) and information about the registration and ownership of the other vehices invoved. In some countries (such as Greece, Portuga, Itay and France) the identity of the insurer of the vehice is dispayed on the windscreen disc. 4. Ca the Caims Hepine number shown on your certificate as soon as possibe, particuary if anybody is injured. 5. Never make any statement or sign any document without the advice of a awyer or competent officia. 6. If you have a camera, take photographs showing the ayout of the scene and positions of the vehices from various anges. 7. Ensure you obtain the foowing detais: The make, registration number and coour of the other vehice and whether it is right or eft-hand drive. The fu names, addresses and occupations of independent witnesses. The date, time and exact pace of the accident. The speeds of your own and the other vehice. Signas given by you and the other driver.
