4 1 Introduction Pursuant to Section 7.59 WHW the Executive Board is to adopt a Students Charter and disclose the basis of the statutory rights and obligations for the students. In the Regulations tuition fees Saxion (hereinafter referred to as the Regulations) the legal rights and obligations regarding the tuition fees and the examination fees for government-funded degree programmes at Saxion are specified in the rates at Saxion and in the procedural rules. The Students Charter contains, among other things, the present Regulations on government-funded degree programmes. In addition, the Regulations contain the rates and present procedural rules for the QAA accredited Master degree programme, the non-government-funded NVAO accredited Masters and the Saxion Next programmes. For enrolment as a student in a government funded degree programme, the student in accordance with the WHW (section 7.43 e.v.) is due a tuition fee to the University of applied sciences. In Section 7.43, paragraph 1, WHW the Act makes a distinction between the statutory tuition fee (section 3.1 and chapter 4 of the Regulations) and the institution tuition fee (Section 3.2 and chapter 5 of the Regulations). The extraneus is also due an examination fee (section 3.3 and chapter 6 of the Regulations). Persons enrolling in a non-government-funded QAA accredited Master degree programme, which Saxion offers together with the University of Greenwich, are due to pay a tuition fee in accordance with Section 3.4 and chapter 7 of the Regulations. Persons enrolling in a non-government-funded NVAO accredited Master degree programme, are due to pay a tuition fee in accordance with Section 3.5 and chapter 8 of the Regulations. Persons enrolling for a Saxion Next programme, are due to pay a tuition fee in accordance with Section 3.6 and chapter 9 of the Regulations. On 25 June 2014 the Staatsblad (the Dutch Official Journal) published the 6 June 2014 regulations of the minister of Education, Culture and Science Act, nr , amending the regulations of Higher education finance. This is partially due to the changes arising from first supplementary estimates of the minister of Education, Culture and Science for the budgetary year 2014 and for the determining of the rate of the academic year statutory tuition fees. This decision has been incorporated into the Regulations tuition fee Saxion Saxion is the government funded education of the Saxion Foundation. The government funding is to be put effectively and efficiently to use. This obligation does not extend to amounts used in any way to compensate students or extraneï for tuition fees, examination 4

5 or course fees, other than on the grounds of section 7.51 WHW (incentive funds). Repayment of statutory tuition fee may only be made according to cases recognised by law. These regulations are divided into government-funded and non-government-funded education. After the General Provisions in chapter 2, the diverse tuition- and examination fees adopted by the Saxion Foundation are enumerated in chapter 3. Hence, Section 3.1, 3.2 and 3.3 relate to government-funded education and Sections 3.4, 3.5 and 3.6 relate to non-government-funded education. The government-funded tuition and examination fees are detailed further in chapters 4, 5 and 6. The non-government-funded tuition and examination fees are detailed in chapters 7, 8 and 9. Chapters 10 and 11, with the exception of section 10.3, are related to government-funded education. Nongovernment-funded education must be paid in full before the starting date. Section 10.3 and chapter 12 apply to all forms of education. General provisions 2.1 Definitions In these Regulations the following is understood to mean: Tuition fee: Executive Board: CROHO: Examination fee: Extraneus: Authorised person University of applied sciences: University board: Institution tuition fee: International Office (IO): EU/EEA student: The contribution the student has to pay to be enrolled in a degree programme. The board of the Saxion Foundation, acting as university board as referred to in Section 1.1 WHW. Central Register Degree Programmes Higher Education of the Dienst Uitvoering Onderwijs (DUO). The examination fee to be determined by the university board, Examination fee (Section 7.44 WHW). Persons who sign in for examinations and who may not partake in classes or tuition (Section 7.36 WHW). Persons or legal entity other than Saxion who, with the consent of the student or extraneus, makes payment by Direct Debit. Saxion Hogeschool. The Executive Board. Students who do not meet the conditions for the statutory tuition fee are due the institution tuition fee determined by the Executive Board in accordance with Chapter 3, Section 2 of the Regulations. Note: Nationals of Switzerland are also considered as EU/EEA nationals. GBA Municipal Personal Records Database, this is a register of personal data of all inhabitants of a Dutch municipality who meet the conditions for registration with the municipality in question. NVAO: The Dutch-Flemish accredited organisation: the NVAO aims for an objective judgement on the quality of higher education in The Netherlands and Belgium Non-EU/EEA student: A student who does not fall under the scope of the abovementioned EU/EEA student. Degree programme(s): All Saxion bachelor degree programmes, Associate degree courses and master degree programmes. Debt arrears A debt to Saxion when the debtor fails to meet with payment obligations Other contribution: Monetary contribution towards the costs, other than the legal payment obligation (see Section 7.50 WHW) Package fee Additional costs to the tuition fee to be paid to Saxion by international students, excluding the cost of housing. QAA The Quality Assurance Agency for higher education: supervise the quality of higher education in The United Kingdom Regulations The present Regulations tuition fees Saxion Saxion Saxion Foundation. SEPA Single Euro Payments Area: to enable payment by Euro in the same manner all over Europe, new guidelines for bank account numbers, cashless payments and debt collecting. Student The person registered as a student or extraneaus for a degree programme. If the student is defined as a minor in the Civil Code, then this student should only act with the permission of a legal representative or should be represented by one. Academic year: The period commencing on 1 September and ending on 31 August of the next year (Section 1.1 sub k WHW). Interim enrolment An enrolment after 1 September for that academic year. WHW: The Higher Education and Research Act. Statutory tuition fee: The tuition fee established by ministerial regulations pursuant to the WHW section 7.45, as described in Chapter 3, Section 1 of these Regulations. 6

7 2.2 Scope and validity 1) These Regulations concern the enrolment of extraneus or student at: a) Saxion University of applied sciences for an Associate-degree programme, Bachelor degree programme or a funded Master degree programme; b) a non-government-funded QAA accredited Master degree programme, offered jointly with the University of Greenwich. c) Non-government-funded NVAO accredited Master degree programmes d) Saxion Next Bachelor degree programme. 2) All sections in these Regulations relating to Bachelor degree programmes at Saxion University of applied sciences also apply to Associate degree courses and governmentfunded Master degree programmes. 3) These Regulations solely apply to the academic year The Regulations tuition fees Saxion are adjusted annually. Previous Regulations tuition fees of Saxion cannot be invoked. 4) Chapter 9 of these Regulations apply to students of the Saxion Next degree programmes. The other chapters in these Regulations do not apply to students of the Saxion Next degree programmes. 5) These Regulations are adopted under reserve of changes to the WHW and the related legislation and regulations. Changes in this apply by operation of law and are thus applicable to the present Regulations from the moment of introduction. 6) General Terms and Conditions of Saxion are applicable to non-government-funded Master degree programmes as referred to in paragraph 1b and 1c of this section. 7) The Regulations have 3 document supplements: a) General conditions Saxion Next , b) Complaint procedure Saxion Next, and c) General terms and conditions for courses, open enrolment Saxion Foundation: Saxion Knowledge Transfer July

8 3 Types of tuition fees and examination fees 3.1 Statutory tuition fee (Section 7.45 WHW) 1) The statutory tuition fee is due by a student who meets with at least one of the following requirements: a) the student has not previously obtained a bachelor degree for a Bachelor degree programme, nor a master degree for a Master degree programme. This concerns final certificates from government-funded Bachelor and Master degree programmes of Dutch universities and universities of applied sciences, from 1 September This condition does not apply to students who take a degree programme in education or healthcare for the first time (Section 7.45, paragraph 1 sub c WHW). b) the student belongs to one of the groups of persons referred to in Section 2.2 of the Student Finance Act 2000 (this concerns among others an EU/EEA student who qualifies for a tuition fee loan) or who has the Surinam nationality (the nationality requirement). c) Students with a non EU/EER nationality, with a residence permit for an indefinite period in an EU/EER country. d) A student who is taking more than one degree programme and graduates for the degree programme of the first enrolment, is due the statutory tuition fee for the remaining part of the second degree programme. Conform the Law of quality and diversity, from the academic year this regulation will be included in the Higher education law and scientific research (abbr. in Dutch: WHW) 2) Students who do not have the Dutch nationality but claim to belong to one of the groups of persons referred to in Section 2.2 of the Student Finance Act 2000, must demonstrate this upon enrolment. 3) By order in council the category of students referred to in the first paragraph of this section may be extended. 4) A student as referred to in the first paragraph who is enrolled in a part-time or dual degree programme, is due a part of the statutory tuition fee to be determined by the university board, the rates of which are set out in Section 4.2 of these Regulations. 5) Degrees obtained pursuant to Section 7.20 WHW are considered equivalent to the Bachelor degree and Master degree as referred to in the first paragraph. 6) Students engaged in a procedure for obtaining a residence permit for an EU/EEA country or Switzerland, have to pay an institutional fee. 7) Students who only meet the requirements as described in paragraph 1 of this section in the course of the academic year are to pay an institutional fee upon commencement of the academic year. Statutory tuition fees may be paid from the month following meeting these requirements. 8

9 3.2 Institutional tuition fee (Section 7.46 WHW) 1 1) A student who does not meet the conditions as referred to in Chapter 3, Section 1, first, third or fifth paragraph, and does not fall under the scope of Chapter 3, Section 3 of these Regulations, is due the institution fee set by the Executive Board. 2) For rates and rules with regard to the institutional tuition fee, see Chapter 5 of these Regulations. 3.3 Examination fee 1) The person registering for examinations and does not take part in other educational activities is referred to as an extraneus (Section 7.36 WHW). 2) The extraneus is to pay an examination fee for the registration. 3) For rates and rules with regard to the examination fees, see Chapter 6 of these Regulations. 3.4 Tuition fee Greenwich Masters 1) For a non-government-funded QAA accredited Master degree programme, offered by Saxion in collaboration with the University of Greenwich, Saxion applies a fee or an extended fee, hereinafter referred to in the Regulations as Tuition Fee. A student may be eligible for an extended fee when, in addition to the nominal duration of the course, the student only requires a few months extra to complete the Master programme. 2) For rates and rules with regard to the Tuition Fee, see Chapter 7 of these Regulations. 3.5 Tuition fee non-government-funded NVAO accredited Master degree programme The regulations in the WHW with regard to tuition fees, does not apply to the nongovernment-funded NVAO accredited Master degree programmes. See Section 8 of these Regulations for the tuition fee and regulations for this Master. 3.6 Tuition fees Saxion Next Saxion Next is a private institution of the Saxion Foundation. The education provided by Saxion Next is non-government funded and the tuition fees are not statutory. The Bachelor degree programmes of Saxion Next must meet with the accreditation requirements as specified in the WHW. The WHW however does not apply to the education provided by Saxion Next. The general conditions of Saxion Next can be found in the supplements. Complaints regarding the application of these conditions can be put through the Complaints procedure of Saxion Next. 1 The institutional tuition fee is at least equal to the rate of the statutory full-time tuition fee (see Section 7.45 WHW and the Amended finances higher education regulations, Bulletin of Acts and Decrees 8 October 2008, no. 195). 9

10 See Section 9 of these Regulations for the tuition fees level of payment. 4 Statutory tuition fee The statutory tuition fee is subdivided into a full-time fee (Chapter 4 Section 1), a parttime and a dual fee (Chapter 4 Section 2). 4.1 Full-time degree programme (Section 7.45, paragraph 3 WHW) 2 A student as referred to in Chapter 3, Section 1, paragraph 1, paragraph 3 or paragraph 5 of these Regulations, who is enrolled in a full-time degree programme is due the full statutory tuition fee of 1, Part-time, dual and Ad-degree programme (Section 7.45, paragraph 4 WHW) 3 A student as referred to in Chapter 3: Section 1, paragraph 1, paragraph 3 or paragraph 5, of these Regulations, who is enrolled in a part-time programme, a dual programme or an Ad-programme is due the full statutory tuition fee of 1, An exception to this rate is the part-time degree programme for Teacher Education (Pabo, in Deventer, Enschede and Hengelo). The fee for this degree programme amounts to 1, Reduction, exemption and repayment statutory tuition fee (Section 7.48 WHW) 1) Costs of a second enrolment in addition to a first enrolment If a student has paid a statutory tuition fee for the first government-funded enrolment and the student wishes to enrol in a second degree programme in a governmentfunded higher education in the Netherlands for which a statutory tuition fee is due, the student must then submit a Proof of Tuition Fee Paid to the institute where he or she wishes to enrol in a second degree programme. The Proof of Tuition Fee Paid can be obtained at the institute of the first enrolment. After submission of Proof of Tuition Fee Paid of the first enrolment, the following rules apply: a) If an equal or lower statutory tuition fee is due for the second enrolment, then the student is exempted for the statutory tuition fee for the second enrolment; b) If a higher statutory tuition fee is due for the second enrolment, then the student must pay the difference between the tuition fee to be paid for the second enrolment and the tuition fee that has been paid for the first enrolment. 2) Interim enrolment 2 Pursuant to Section 18.77, paragraph 2 WHW this amount is indexed annually in accordance with the consumer index, in the way as set out by or pursuant to an order in council. 3 The tuition fee for part-time and dual degree programmes is a part of the statutory tuition fee to be determined by the Executive Board that lies between an amount to be determined by or pursuant to an order in council and the statutory tuition fee (7.45, paragraph 3 WHW). 10

11 A student only has to pay part of the statutory tuition fee that is due if the student enrols in the course of the academic year. In that case the amount due is calculated pro rata the number of remaining months of the academic year in question. Students who enrol on 1 February pay 7/12 of the tuition fee. 3) Repayment upon termination of enrolment Information on terminating an enrolment can be found in Section Payment of part of the statutory tuition fee is only applicable to the statutory tuition fee that has been paid to Saxion. a) A student who wishes to terminate his/her enrolment must put in a request to terminate the enrolment via Studielink. b) A request for deregistration will only be accepted when: i. The student is not enrolled in a second government-funded degree programme in the Netherlands ii. The student, who is enrolled for a second government-funded degree programme, submits the original Proof of Tuition Fee Paid c) A request for deregistration in connection with graduation, to be effective from the month following the result of the final exam, will only be granted after the examination board determines that the student has been successful in attaining the degree for the programme in which the student is enrolled. If the request is granted then repayment will enter into effect on the first of the month following the month in which the final examination results have been acquired. This date depends on the moment that the examination board establishes the results. Payment will be made 56 days after the last payment. This is in view of the legal period for reversal of payment. d) In all other cases a request for deregistration will be granted and repayment will be made on the first of the month following the date of the request, or, provided this date is after the request: on the first of the month requested by the student. Payment will be made 56 days after the last payment. This is in view of the legal period for reversal of payment. e) Tuition fee is only paid back into the account of the person to whom the tuition fee has debited. An exception from this can only be made on the decision of the head of the Financial Administration and Financial Student Registration of Saxion. f) Following deregistration of the degree programme(s) at Saxion the student is entitled to repayment of the statutory tuition fee paid pro rata the remaining months during which the student is not enrolled in that academic year. Upon termination of the enrolment effective from July or August, the student is not entitled to repayment of the tuition fee paid for these months. This means, a student who deregisters in June, is not entitled to repayment as the termination of enrolment is not effective until 1 July. g) The student is responsible for the cancellation of his/her student financial aid and student travel pass. 4) Students who, on the grounds of the advice given at the study choice check in September, decide to terminate their enrolment for a degree programme per 1 October, are entitled to full repayment including possible administration costs. This however, only applies to students who are not enrolled for a second degree 11

12 programmes or to students who do not enrol in that month or in the following month for another degree programme at the Saxion foundation. 5) A student who has lodged an appeal against a negative and binding study advice (BSA) in the previous academic year, may re-enrol for this programme if the appeal is pending. If the appeal is rejected then repayment will be made of the tuition fee for the academic year following the BSA, including possible administration costs, provided the student is not enrolled for another higher education programme. N.B. A student does not have the right to student financial aid from the moment of deregistration. The student decides whether or not to request student financial aid while the appeal is pending. 5 Institution tuition fee (Section 7.46 WHW) 5.1 Rates institution tuition fee (Section 7.46 WHW) 4 1) Pursuant to Section 7.46 paragraph 3 WHW the Executive Board has set the following institution tuition fees: a) Students who enrol via the foundation for refugee students UAF (University Assistance Fund) and who pursuant to Chapter 3, Section 1 of these Regulations do not (yet) qualify for the statutory tuition fee, are due a tuition fee of 1, (equal to the statutory tuition fee); b) Students who already have a Bachelor degree certificate in Dutch higher education from 1991, but who meet the nationality requirement (Chapter 3.1.1b), pay an institution tuition fee of 5, An exception to this fee is the degree programme BK5. The fee for this degree programme amounts to 2,150.00; c) All students who are to pay an institution tuition fee and who do not fall under sub a or sub b of paragraph 1 of this section, pay an institution tuition fee of 7,800 ( tuition fee ); 2) The provisions laid down in this section under paragraph 1 are not applicable to the institution tuition fees agreed in a separate agreement between the Saxion Executive Board and a third external party. 3) Students who in the course of the year meet the requirements necessary to qualify for a statutory tuition fee (see Section 3.1) upon request can pay a statutory tuition fee for the remaining part of the academic year. The request is granted at the moment the student has submitted evidence to the Saxion Student Registration Office that the conditions for payment of a statutory tuition fee have been met. The statutory tuition fee commences in the month following the month in which the request was granted. The institution tuition fee paid over the months over which the student is to pay a statutory tuition fee is repaid after deduction of the statutory tuition fee. 4 The institution tuition fee is at least equal to the rate of the statutory full-time tuition fee (see Section 7.45 WHW and the Amended finances higher education regulations, Bulletin of Act and Decrees 8 October 2008, no. 195). 12

13 5.2 Reduction, exemption and repayment institution tuition fee 1) The student who is due an institution tuition fee, in the event of a second enrolment is not entitled to reduction or exemption of this institution tuition fee. A student who changes to a different degree programme during the academic year at the Saxion foundation is exempt from paying a second institution fee if the second institution fee is equal or less than the first institution fee. If the second institution fee is more than the first institution fee then the student must pay the difference. 2) Students who begin their degree programme later than the starting date of the academic year are entitled to a reduction of the institution tuition fee. In that case the amount due is calculated pro rata the month of enrolment and the number of remaining months of that academic year. Students with an nationality other than the E.U. who enrol on 1 February pay 6/12 of the institution tuition fee in accordance with 5.1 sub c. 3) A student who pays the institution tuition fee (that falls under Chapter 5 of the Regulation) is not entitled to repayment of part of his/her institution tuition fee in the event of termination of enrolment unless involving graduation. 4) A student who has lodged an appeal against a negative and binding study advice (BSA) in the previous academic year, may re-enrol for this programme if the appeal is pending. If the appeal is rejected then repayment will be made of the tuition fee for the academic year following the BSA, including possible administration costs, provided the student is not enrolled for another higher education programme or does not enrol in that month or the following month for a degree programme at Saxion. 5) The enrolment of a student will be revoked when this student (re)enrols for a degree programme at Saxion and, on admittance, turns out to have booked insufficient study progress during the previous academic year for a residence permit based on study. Repayment will be made of the institution tuition fee, including possible administration costs, for the new academic year. 6) Repayment of the institution tuition fee in the event of graduation a) A student who deregisters from July or August, is not entitled to repayment. This means that a student who submits a request for deregistration in the month of June, is no longer eligible for reimbursement. b) A student who is subject to the provisions in Chapter 5 Section 1 sub b and c and has obtained the Bachelor degree certificate or Master degree certificate, is upon termination of the enrolment entitled to repayment of part of the institution tuition fee paid. Upon termination of enrolment in connection with graduation for the course programme(s) at Saxion, the student is entitled to repayment of the amount paid, i.e. the institution tuition fee minus any scholarship granted, pro rata the remaining months that the student is not enrolled during the academic year. 5) Repayment before commencement of the degree programme A potential student who has enrolled in a degree programme in the academic year and who revokes this enrolment before commencement of the degree programme, will be paid back the institution tuition fees paid for that academic year less 250 for administrative costs. A condition for repayment is that the potential 13

14 student can show that the country of residence at the moment of application is the same as the country of residence at the moment of cancellation of the enrolment. An exception to the rule are students who enrolled in the academic year for the same degree programme for which they had enrolled in the academic year (re-enrolment). In the case of deregistration before the start of the academic year, the student is repaid the institution tuition fee without having to pay 250 administrative costs. Examples of how Chapter 5 Section 3 paragraph 5 works out in practice: A student from China who applies for a degree programme at Saxion in the Netherlands and who has paid the institution tuition fee in advance and who upon arrival in the Netherlands signs out of the degree programme will not receive any restitution. A student from China who applies for a degree programme at Saxion in the Netherlands and has paid the institution tuition fee in advance and signs out in China for the degree programme, will be repaid the institution tuition fee minus administrative costs. 6) Repayment based on negative study advice in the month September A student who decides to terminate an enrolment in the month of September (before 1 October) based on negative study advice from the degree programme, will be repaid the tuition fee, including possible administration costs, provided the student is not enrolled for another higher education programme or does not enrol in that month or the following month for a degree programme at Saxion Foundation. 14

15 6 Examination fee extraneus 6.1 Level of examination fee extraneus The extraneus is due an examination fee determined by the Executive Board for each academic year that the extraneus is enrolled as such in a degree programme. The Executive Board has set the examination fee at an amount equal to the amount that applies to enrolment as a full-time student in accordance with these Regulations. In accordance with Section 4.1, Section 5.1 sub c or d, this amount is equal to 1,951, 5,300 or 7,800, respectively. 6.2 Reduction, exemption and repayment examination fee 1) The regulations concerning reduction of, exemption from and repayment of the tuition fee are not applicable to the examination fee. 2) Section 5.2 is applicable to the examination fee of extraneï. 7 Tuition fee Greenwich Masters The General Terms and Conditions of courses, open enrolment Saxion Foundation, Saxion Knowledge Transfer July 2015 (see attachment) apply to the terms and conditions of the articles that are included, but not described, in (chapter 7) the Greenwich Masters. 7.1 Level of tuition fee Greenwich Masters A student who attends a non-government-funded QAA accredited Master degree programme offered by Saxion in collaboration with Greenwich University, is to pay a tuition fee or an extension fee as shown in the following table. The tuition fee or the extension fee is to be paid in full prior to enrolment. Master Fee Extension fee Master in Management 12 months , ,- Master of Business Administration 12 months , ,- 7.2 Reduction, exemption and repayment tuition fee Greenwich Masters The tuition fee or the extension fee for a non-government-funded QAA accredited Master degree programme, which Saxion offers in collaboration with the University of Greenwich, will be referred to in this section as Tuition Fee. 1) A student who enrols for a non-government-funded QAA accredited Master degree programme offered by Saxion, is to pay a Tuition Fee. The student is not entitled to a 15

16 reduction or exemption of the Tuition Fee unless contractually laid down by the Executive Board. 2) In the event of a second enrolment: the student who has to pay a Tuition Fee is not entitled to a reduction or exemption of the tuition fee. 3) The student who has to pay a Tuition Fee is not entitled to repayment of part of the Tuition Fee upon termination of the enrolment. 4) Repayment before commencement of the degree programme A potential student who has enrolled in the academic year in a nongovernment-funded Master degree programme, which Saxion offers in collaboration with the University of Greenwich, and who revokes this enrolment before commencement of the degree programme, will be repaid the Tuition Fee paid for that academic year minus 250 for administrative costs. A condition for repayment is that the potential student can show that the country of residence at the moment of application is the same as the country of residence at the moment of cancellation of the enrolment. Other students for the fulltime or the part-time programme Master Facility and Real Estate Management, are due a lump sum payment or, upon request, payment in instalments. 3) Payment by, or on behalf of, the student is in accordance with a payment schedule (the debt collection agreement) concluded between the Executive Board and the person who has committed himself to payment. Saxion makes use of a continuous debt collection agreement. 4) Administrative costs will be charged each academic year for debt collection in instalments via an automatic debt collection agreement. 5) Administrative costs, set by the Executive Board, will be charged each academic year for debt collection in instalments in a manner in which this is carried out for the statutory tuition fees. 6) The Executive Board has set the administrative costs for the academic year at an amount of

18 7) See Chapter 10.1, with the exception of section 1, section 3 and 9 and chapter 10.2, for the terms of payment in instalment. 8) In the event of deregistration during the academic year other than in connection with graduation, the student has no further payment obligations for the following academic years unless the student re-enrols at Saxion. 8.4 Reduction, exemption and repayment tuition fee/extension fee The following regulations apply to students who do not come under section 8.2: 1) In the event of a second enrolment: the student who has to pay Tuition Fee for a nongovernment-funded NVAO-accredited Master degree programmes is not entitled to a reduction or exemption of the tuition fee. 2) A student who pays the institution tuition fee (that falls under Chapter 8 of the Regulation) is not entitled to repayment of part of his/her institution tuition fee in the event of termination of enrolment unless involving graduation. 3) Repayment of tuition fee upon graduating a) A student who comes under the scope of chapter 8 and has paid an extension fee, is not entitled to reimbursement. b) A student, who comes under the scope of Section 8 and has attained the Master degree, has the right to part reimbursement of the tuition fee on termination of the enrolment when this is not an extension fee. Upon graduation the student will be reimbursed for the months that were paid after deregistration. 4) Repayment before the starting date of the degree programme A prospective student who terminates his/her enrolment for a non-government-funded NVAO-accredited Master degree programme before the starting date of the programme will be repaid the Tuition Fee paid for that academic year less 250 for administrative costs. The student is exempted from paying this deduction when it concerns a termination of re-enrolment for a non-government-funded NVAO-accredited Master degree programme. 18

The other chapters, with the exception of chapter 12, do not apply to Saxion Next students. 10 Collection, compensation and punitive measures The examination fee (see chapter 6) must be paid prior to the examination. The tuition fee for the Greenwich Masters (see Chapter 7) and the tuition fee for non-government-funded NVAO accredited masters (see Chapter 8) must have been paid to Saxion University of Applied Sciences prior to participating in education, in the manner set out by Saxion. Section 10.1, 10.2 and 10.3 apply only to statutory tuition fees (see chapter 4) and the institution tuition fees (see chapter 5). 19

20 10.1Payment tuition fee (Section 7.47 WHW) and reversal of payment 1) The statutory tuition fee and institution tuition fee is paid by or on behalf of the student in accordance with a payment schedule (the debt collection agreement) concluded between the Executive Board and the person who has committed himself to payment. This can take place by authorising automatic debt collection, either for a single payment or for payment in instalments. Saxion makes use of a continuous debt collection agreement or an acknowledgement of debt. Administrative costs will be charged each academic year for debt collection in instalments via an automatic debt collection agreement or for an acknowledgement of debt. The Executive Board has set the administrative costs for the academic year at an amount of The payment regulations in chapter 9 and 10 of this article apply to non-eu/eea student for whom the tuitions fee is part of a package fee. Likewise, chapter 9 and 10 apply to non-eu/eea students with a Saxion scholarship who opt for this form of payment. 2)The instalment payments will be collected approximately on: 25 September 2015, 26 October 2015, 25 November 2015, 24 December 2015, 25 January 2016, 25 February 2016, 29 March 2016, 25 April 2016, 25 May 2016 and 27 June The collection date may deviate in the event of force majeure, provided this is not to the detriment the debtor. 3)The tuition fee or examination fee for full-time, dual and part-time degree programmes is due before commencement of the degree programme: upon enrolment as a student at the start of the academic year this means that the tuition fee is due before 1 September. In case of enrolment in the course of the academic year, with the exception of the month of September, this means that the tuition fee is due before the first day of the month of the interim enrolment. The single payment tuition fee of students who enrol during the month of September is due immediately and the enrolment date is 1 September. The instalment payments will be collected 9 times instead of 10. 4) Tuition Fee payments have been met, when: The total sum has been paid; An acknowledgment of debt or a debt collection agreement has been submitted, stating the dates of the installment payments. 5) Debt collection is only possible by paying the tuition fee from a SEPA bank account number provided the bank allows this. 6) The student is responsible for the correctness of the IBAN-bank account number and the BIC code to ensure that Saxion can collect the instalments. The student and the authorised person are both responsible for the correctness of the bank account number. This co-responsibility of the authorised person ceases to apply when Saxion is informed of this in writing. 7) The student is responsible for payment, also in the event that there is a reversal of payment of the authorised person. 8) Saxion will only send an invoice to students or third parties when the tuition fee is part of a package fee. In all other cases Saxion does not send an invoice for payment of the tuition fee to students or third parties. 20

21 9) For non-eu/eea students who are eligible for a scholarship the institution tuition fee is settled with the scholarship. 10) Students who have to pay a package deal (excluding the cost of housing), are to pay this in full prior to the enrolment of that academic year. If the student can show proof, before the start of the academic year, of needing only 30 ECTS or less to graduate, then the student may pay in instalments. 11) Each student is responsible for sufficient balance on the designated account to collect an instalment. For the academic year a minimum amount of 300 is required for the statutory tuition fee. For the institution tuition fee this minimum amount is ) A reversal of payment is when an instalment cannot be collected or has been reversed. In the event of a reversal of payment the student will be sent a reminder and a request for payment at the address which was provided in Studielink. In the month following the reversal of payment, the student will receive a second reminder requesting payment within 10 days (hereafter the fortnight letter ) at the address which was provided in Studielink. The fortnight letter informs the student of additional costs, the possible closing of the Saxion login account and further consequences when payment is not met. When the student does not meet with the payment date referred to in the fortnight letter, then the following will be enforced on the first of the month following the fortnight letter: It will no longer be possible to make payment of the outstanding amount to Saxion (financial hold) The Saxion login account of the student will be closed The claim will be transferred to a debt-collection agency The head of the degree programme will be informed The debt-collection agency is authorised by Saxion to apply the following procedures for the outstanding payment: The costs of debt collections are calculated as announced in the fortnight letter The student must pay the debt-collection agency within 10 days. When the outstanding payment and the costs of debt collection have been paid within 10 days, the service of the debt-collection agency will no longer be required. Within five working days of the payment, the students Saxion account will be reactivated and Saxion will resume the automatic debt collection. When the aforementioned payment is not met, the student will be served a last notice. The student must them pay the outstanding tuition fee payment and the costs of debt collection at the debt collection agency within 5 days. Within five working days of the payment, the students Saxion account will be reactivated. The student is deregistered when payment of the full outstanding tuition fee payment, including the costs of debt collection, is still not met. The debt collection agency will then be authorised for the collection of the debt and the costs of the debt collection. 21

22 13) A student who has paid the statutory tuition fee to Saxion, can on request receive a "Proof of Statutory Tuition Fee Paid" for a second enrolment at another institution. If the Proof of Statutory Tuition Fee Paid is submitted to another institution of higher education in the Netherlands for a government-funded degree programme, the student has met his payment obligations at that institution (Section 7.48, paragraph 1 WHW). If a higher statutory tuition fee is due for the second enrolment, then the student must pay the difference for the second enrolment. 14) Saxion ensures that no later than in the month of June preceding a new academic year the level of the tuition fee and of the administrative costs for the next academic year are made known to (prospective) students. The number of instalments and the moments of debt collection will also be announced for the continuous authorisation. 15) Students who fail to meet their payment obligations before commencement of the degree programme, on 1 September or the first of the month of an interim enrolment, are deregistered and can no longer make use of the facilities of Saxion Continuous authorisation and debt acknowledgement 1) A student's continuous authorisation is applicable to an enrolment at Saxion that has not been terminated or that has been reactivated within 2 days of deregistration. In the event of several enrolments at Saxion for degree programmes for which a statutory tuition fee is due, the continuous authorisation is only applicable to the degree programme for which the highest statutory tuition fee is due 5. 2) The tuition fee for the academic year is collected in ten consecutive monthly instalments, see Chapter 10.1 par 2. It is possible to deviate from this if a student, with the permission of the Head of the school, starts with the degree programme later on in the academic year or when circumstances necessitate instalment payment on more occasions during the academic year. 3) A continuous debt collection agreement of an authorised person is terminated on the date that Saxion receives this written request from the authorised person. The debt collection obligations which are not, or will no longer be, met by the authorised person become the responsibility of the student (see section 10.1 par 7). A continuous debt collection agreement is terminated from the month in which the enrolment lapses. The enrolment before or in an academic year can only be terminated in accordance with the rules as described in the Regulations tuition fees Saxion for the academic year in question. For termination of the enrolment in the academic year see Chapter 11, Section 2 of these Regulations. 4) Payment of the tuition fee by means of a continuous debt collection agreement is only possible if there are no outstanding debts from a previous academic year at Saxion and the student ensures that Saxion can collect the instalments. 5) A student who makes payment in full of the tuition fee before the first instalment collection, is exempt from administration costs and the continuous debt collection 5 Saxion is currently researching if the digital continuous authorisation can also be used for tuition fee payments. As soon as this research is completed it will be submitted to the Executive Board. 22

23 agreement is discarded. The student must sign a new continuous debt collection agreement on re-enrolment Unauthorised participation in education (Section 15.2 and 15.3 WHW) 1) Anyone who is not enrolled but who (undesirable) participates in tuition and examination facilities for initial education of the university of applied sciences, will be due to pay the university of applied sciences damages on this ground (in addition to a possible penal penalty based on Section 15.3 WHW), to be determined by the Executive Board. The Executive Board will determine the amount of the damages at a sum equal to the tuition fee, which should have been paid if the person in question had been enrolled in the degree programme in question. 2) Anyone who is not enrolled but participates in tuition and examination facilities for initial education of the university of applied sciences, will be punished by a fine of the second category. The fine is imposed by the Public Prosecution Service, if Saxion reports the offence. 3) The payment of the damages and/or fine as referred to in paragraph 1 and 2 of this section, does not imply the enrolment ipso jure as yet. Enrolment is only possible at the next date of enrolment after payment of the tuition fee Refusal of registration With the exception of students who have arranged a payment schedule approved by Saxion, a student who still has an outstanding (tuition fee) debt from previous academic years cannot enrol or re-enrol at Saxion. 23
