3 BWI CONNECT Migrant Workers Guide for Asia What is BWI? The Building and Wood Workers International (BWI) is a Global Union representing workers in the building, building materials, wood, furniture production, and forestry sectors. The BWI groups 328 trade unions representing 12 million members in 130 countries. What is BWI CONNECT? Following BWI s 2nd World Congress in 2009, the BWI launched a Global Campaign on Migrant Workers Rights where the crux of the campaign was to focus on recruiting and organizing migrant workers into trade unions and promoting their rights. BWI CONNECT is: CONNECTing Migrant workers with Trade Unions to Join Trade Unions. CONNECTing Unions from Countries of Origin with Unions from Countries of Destination to facilitate collaboration to organise migrant workers. CONNECTing Trade Unions with Governments to advocate for legislations and policies to ensure the rights of migrant workers. CONNECTing Trade Unions with Employers to negotiate agreements on the basis of equal work for equal pay. CONNECTing Trade Unions with Civil Society Organizations to build and strengthen alliances and networks for the promotion of migrant workers rights nationally, regionally, and globally. 3

4 What to Do Before You Leave Home: 1. Make enquiries about the employer that you will be working for while you are abroad (you can get some information through the internet, for instance on Google, typing the name of the company or the name of the person recruiting workers). 2. Make sure you have a written employment contract detailing your work hours, wages, living conditions, and other important details in your own language. 3. Seek advice: from the BWI affiliate or the national union (confederation) from the relevant government office dealing with work from construction companies that work in the country of your choice for sponsorship 4. Make copies of all of your documents such as: passport visa and work permit employment contract letters of introduction contact details of your potential employer in the country of destination 5. Leave copies of these documents with: your family BWI affiliate or the national union (confederation) keep a set yourself 6. Take a pre-orientation training operated by the union, government agency, employer, etc. What to Do Upon Arrival 1. Visit the local BWI affiliate (see enclosed list with contact details) to: seek information about your rights join the union leave copies of all documents and local details request them to send a copy of the local details to the BWI affiliate in your home country 2. Make a copy of all local details such as: the address of your employer information about your work site hostel or local address 3. Send a copy of the local details to your family. 4. Visit your embassy or consulate. 5. Keep your documents in a safe place. What Not To Do at All Times 1. Enter a country without proper documentation. 2. Use sponsors or recruiting agents that are not supported by your union or government. 3. Surrender any documentation, especially passport and work permit, to anyone. 4. Sign any documents without translation and advice. 5. Pay for a job. 4

5 BAHRAIN Your rights in Bahrain 1. You have the right to join a trade union. 2. Your employer or agent cannot withhold your passport against your will. 3. Discrimination between Bahraini and non-bahraini nationals is illegal. 4. You are free to change employers by issuing an end-of-contract notice through registered mail three months in advance. Your new employer will then have to re-register you with the LMRA after producing the end-of-contract notice you sent to your former employer. 5. You have the right to the following benefits: 1 rest day every week with full pay. Fridays are deemed to be the weekly day of rest. Leave for official public holidays. Where such public holidays occur on a Friday, your employer must compensate you with one further day of rest. You may be required to work on public holidays or on Fridays, subject to the provisions of the local law. A minimum of 21 days paid annual leave rising to 28 days after 5 years service. (The new legislation will guarantee 30 days of annual leave). Sick leave (illness has to be certified by doctor or hospital). Paid maternity leave of 45 days with full pay with possibility of another 15 days when necessary. (The new labour law will entitle female private sector workers are to 60 days of maternity leave with possibility of another 15 days when necessary.) What You Need to Know When You Arrive in Bahrain 1. Your employer must register you with the Labour Market Regulatory Authority (LMRA) and receive a valid residence permit and work permit. 2. Your employer should also register you with the Ministry of Labour and Social Affairs and receive a certificate of registration. 3. Without a valid work permit you are prohibited from engaging in any work in the Kingdom of Bahrain, and employers are prohibited from employing you without a valid work permit. 4. To work in Bahrain, you must be medically fit, have entered the country lawfully, possess a valid passport, and retain a residence permit and work permit. 5. Your employer must register you with the General Organization for Social Insurance (GOSI) and contributions must be paid monthly for compulsory insurances against work-related injuries, including death. 6. The leaving indemnity which is payable (by your employer) on termination of your employment is calculated by reference to a statutory formula which reflects your length of service and whether the employment has been terminated by your employer or by you. 7. Your employer must pay you for a return plane ticket to the place specified in the employment contract. If the contract does not specify such a place, then the employer must pay for a return plane ticket to the place of your country of nationality. 6 KUWAIT Your Rights in Kuwait 1. You have the right to join a trade union if you are at least 18 years old, have a valid work permit and certificate of good conduct from a complete authority and have been in Kuwait for 5 consecutive years. 2. Your employer or agent cannot withhold your passport against your will. 3. You have the right to the following benefits: Rest break of at least 1 hour after 5 consecutive hours of work. 1 day off without payment per week, Paid leave on all the 13 public holidays, and 30 days of annual leave. Paid sick leave at: 15 days full pay, 10 days three quarters pay, 10 days half pay, 10 days quarter pay, and 30 days without pay. Compensation for overtime. Compensation for work-related injuries without having to prove that it was your fault. Medical treatment at your employer s expense if you are injured. Your employer must also report the accident to the local police station and the Ministry of Social Affairs and Labour. During treatment you have the right to full pay for the first six months and half pay until you recover. What You Need to Know When You Arrive in Kuwait 1. Before arriving in Kuwait someone must have applied for a work permit for you. You should get a copy of the work permit approval. A work permit is valid for a maximum of 5 years. 2. When your permit is approved you will need to visit a Kuwaiti Consulate to apply for your work visa, this will allow you to enter Kuwait to work. 3. An employment contract may be verbal or written but must show at least the salary payable, a description of the job, the date of appointment and the duration of the contract (if fixed). If written the contract must be in Arabic but a translated version can be attached. 4. What is included in your total remuneration is important, as this is the figure that must be used when calculating terminal indemnity or compensation on account of injury. 5. You can seek assistance from the Labour Department of the Ministry of Social Affairs and Labour for legal and other disputes. 7 HONG KONG Your Rights in Hong Kong 1. You have the right to join a trade union. You cannot be dismissed for being a trade union member. 2. Your employer or agent cannot withhold your passport against your will. 3. You have the right to the following benefits: Minimum wage of HK$30 per hour. Overtime pay for hours worked outside of the working hours in your contract. 1 rest day per 7 day week, 12 public holidays per year, and at least 7 days paid annual leave for every period of 12 months following the completion of the first and of the second year of service. Free medical care which must be provided by your employer during your employment. Furnished accommodation which your employer must provide, but not necessarily free. Compensation for occupational illnesses or injuries and paid sick leave. Your employer should pay expenses for passage to and from Hong Kong on commencement and on termination or expiry of the contract, visa fees, subsequent visa extension fees and medical examination fees. What You Need to Know When You Arrive in Hong Kong 1. A working visa must have been applied for and approved before your arrival in Hong Kong 2. Upon arrival, the Department of Immigration can only approve your employment in the occupation and location stipulated in your employment contract. If you work outside of that occupation and area you may be liable for action by the government 3. To register for a Hong Kong Identity Card you must bring a copy of your employment contract to the Immigration Department. 4. 8 MALAYSIA Your Rights in Malaysia 1. You have the right to join a trade union. 2. Your employer or agent cannot withhold your passport against your will. 3. You have the right to not be sexually harassed at your work place. 4. You have the right to the following benefits: To be included in collective bargaining agreements. 1 full rest day per week and if your employer requires you to work on a rest day you have the right to double payment and 10 public holidays per year. Overtime pay when you work more than 8 hours in one day. Paid annual leave and paid sick leave. Workers compensation after accidents and health insurance 5. Your employer is legally required to pay for levy charges. If your employer has deducted levy charges from your salary you are entitled to a full refund of those deductions. What You Need to Know When You Arrive in Malaysia 1. When you arrive in Malaysia you will either receive a visa on arrival using the calling visa letter issued by Malaysian Immigration (it should be provided to you by your agent or employer before departure) or you will enter with a single entry visa which has previously been applied for and granted before your arrival in Malaysia. 2. Work permits are issued by the Immigration Department. Your employer must apply for your permit within 30 days of your arrival in Malaysia for employment. To do this they require your passport. You have the right to request for it to be returned by the agent/employer. 3. You must be covered by insurance. It is compulsory for your employer to provide you with insurance in order for you to be issued with a work permit or to have a work permit renewed. 4. You are required to undergo a health check before being issued with a new or renewed work permit. The FOMEMA health check s results are sent direct to the Department of Immigration and the Ministry of Health. 8

10 SINGAPORE Your Rights in Singapore 1. You have the right to join a trade union and you are protected against anti-union discrimination by the law. 2. Your employer can not withhold your passport or other documents against your will. 3. You are, regardless of nationality, covered by the Singapore Employment Act (excluding seamen, domestic workers or statutory board and government employees). 4. You have the right to lodge any complaints or labour disputes with your trade union, if you are not a member of the trade union you can go to the Ministry of Manpower. 5. You have the right to not work more than 8 hours in one day and 44 hours in a one week. 6. You have the right to 1 rest day per week. 7. You have the right to annual leave and sick leave, if you have worked for the employer for at least three months. What You Need to Know When You Arrive in Singapore 1. You should have some information on your employment arrangements before arriving, especially a contract of offer and a security bond issued by the employer. 2. Your work permit must have been applied for before you arrive in Singapore. 3. After your arrival you will be required to undertake medical examinations, as specified by the Controller of Work Passes. The number and frequency of these examinations may vary. 4. If your rights are violated you can lodge complaints with the Ministry of Manpower. Your employer is responsible for: 1. Paying the foreign Workers Levy. The employer cannot deduct the levy from your salary. 2. Coordinating medical examinations as required by the Controller of Work Passes. 3. Sending you for the Safety Orientation Course (construction industry only). 4. Providing acceptable housing and updating of your address within five days of commencement of employment and subsequent changes in your address. 5. Paying the $5,000 security bond in the form of an insurance/banker s guarantee prior to your arrival in Singapore. Without this you will not be allowed into Singapore. You should not pay the security deposit yourself. 6. Paying your medical consultations if you have worked for your employer for at least three months and purchasing medical insurance for you. 10

12 South Korea Your Rights in South Korea 1. You have the right to join a trade union. 2. Your employer or agent cannot withhold your passport against your will. 3. You have the right to be covered in a Collective Bargaining Agreement if there is one at your work site. 4. You have the right to be paid a salary according to the national minimum wage or higher. 5. You have access to the following benefits: Standard working hours are 8 hours per day and 40 hours per week. Overtime pay for extra work or night shift work (22:00-06:00) or if you work on holidays. Recess time of 30 minutes or longer for every 4 working hours, and 1 hour or longer for 8 working hours. At least 1 paid day leave per week, 15 days annual leave per year (for a full year s employment), and 13 public holidays per year. Health insurance, industrial accident compensation insurance, national pension and employment insurance which should all be provided by your employer. What You Need to Know When You Arrive in South Korea 1. The process for approval of your work visa, before you leave your home country is: Application by employer for approval of foreign employment Issuance by government of the employment permit Signing of the employment contract between employer and employee Issuance of the written confirmation on visa issuance Arrival of foreign workers and their pre-work education in Korea Workplace assignment and assistance for their stay in Korea 2. You need to have an employment contract and a medical check-up certificate when entering South Korea. 3. After entry into South Korea you need to go through Employment Training at an Employment Training Centre. 13 THAILAND Your Rights in Thailand 1. You have the right to join a trade union 2. Your employer does not have the right to withhold your personal documents (ID-card, work permit, passport). 3. You are covered in a Collective Bargaining Agreement, if there is one at your workplace. 4. Your employer does not have the right to make deductions from your wages. 5. The Labour Protection Act covers all workers regardless of their immigration status. But some work is excluded from this protection: domestic work, agriculture work, informal sector. 6. You have the rights to the following benefits: 8 hour work day and overtime pay for each hour thereafter. Overtime pay to be calculated at rate of between times your normal hourly wage. At least 1 rest day per week and at least one hour rest after working 5 consecutive hours, 13 paid public holidays, 6 days annual leave and 30 days sick leave per year. Work injury compensation if your employer is paying into the Workman s Compensation fund or if you are part of the social security system. What You Need to Know When You Arrive in Thailand 1. Your employer should apply for your non-immigrant visa for you. Once it is approved, you should apply to the nearest Thai consulate for your visa, and work permit before arrival. 2. Work permits can be applied for within Thailand if you have the correct type of visa to enter and subsequently work in Thailand. 3. The Department of Labour Protection and Welfare is the agency in charge of labour protection issues. The Department of Employment is in charge of your work permit. 4. Depending on the nature of your employment contract, visa and work permit, you may not be allowed to travel outside of the area listed in your contract. You may also be restricted in finding work other than stated in your visa and work permit. 5. You should keep note of the number of hours you worked each day and how much you were paid. These records are important should you need to file a complaint. 6. Burmese, Cambodian and Laotian workers are required to pay a monthly fee through payroll deductions to cover the government s expenses in the event a migrant worker is deported. 7. You can make complaints at the Department of Labour Protection and Welfare who will contact NGOs to assist in interpretation.
