The following Online Agreement applies to Charter Oak Federal Credit Union account holders: ONLINE AGREEMENT & DISCLOSURE STATEMENT This agreement states the terms and conditions that apply when you use Charter Oak Federal Credit Union COFCU online services which include - Online Banking, Bill Pay, and/or Mobile Banking. These terms and conditions are in addition to those that apply to any accounts you have with us or any other services you obtain from us. In this agreement "you", "your", and "yours" refers to the person that has enrolled in and will be using the online banking services described in this agreement. "We", "us", "ours", COFCU and "credit union" refer to Charter Oak Federal Credit Union, and any agent, independent contractor, designee, or assignee the credit union may, in its sole discretion, involve in the provision of our online services. "Account" refers to the deposit and credit accounts you can access through the credit union online services. These include all accounts that have been opened showing your name and social security number. The credit union online service is an electronic banking and information service that permits you, through the use of your internet enabled devices, to access your deposit and credit (loan) accounts through the Internet using an Internet browser. This agreement contains the terms and conditions governing the credit union online services for which you have applied. USE OF ONLINE SERVICES To become eligible to use the credit union online services, you must open or obtain a deposit account at the credit union and become a member. Before you use the credit union online services you should read this agreement and the instructions which describe the credit union online services in greater detail. Your use of any the online services means that you agree to the terms and conditions stated in this agreement and our online services instructions. DEPOSIT AND CREDIT AGREEMENTS The terms and conditions in this Agreement are in addition to any deposit account, credit account or other agreement you have with us relating to your accounts, including any disclosures pursuant to such agreements. You must maintain your accounts in good standing with the credit union in order to perform transactions in those accounts through the use of the credit union online services. COMPUTER REQUIREMENTS, ELECTRONIC RECORDS, AND SIGNATURES By completing the enrollment request and using the credit union online services, you consent to electronic transmission and delivery of all information and records, including your financial information. The computer requirements to use the credit union online services are as follows: Your personal computer, laptop, portable computer, mobile device, internet service provider, WEB browser, and software telecommunication and any related equipment are referred to collectively as your computer. You are responsible for the installation, maintenance, operation, and costs of your computer. By enrolling in the credit union online services, you represent that your computer has the capability to receive electronic messages at the address you provided, that you are able to access and retrieve information in electronic form and that you can either print or store those messages and information.
2 You agree to notify us if your address changes. We are not responsible for any errors or failures from any malfunction of your computer and we are not responsible for any computer virus or related problems that may be associated with the use of the credit union online services. The credit union is not responsible for any electronic virus or viruses that you may encounter. In order to use the credit union online services, you must also have an internet service provider (ISP) and a WEB browser that supports the level of encryption we use. We may change our encryption requirements from time to time. If you cannot, or do not want to upgrade, your consent to and use of the credit union online services will be terminated. The credit union online services and related documentation are provided "as is" without any warranty of any kind. We disclaim all warranties regarding the use of the credit union online services, expressed or implied, including but not limited to, implied warranties or merchantability and fitness for a particular purpose. Your personal software may include other functions and features (such as online budgeting and mortgage comparisons) which are not associated with the credit union online services, and we are not responsible for them either. We are not responsible for damages arising from the use or maintenance of software that we did not provide to you that you use to access or communicate with the credit union online services. You agree that we are not responsible for any failure or loss caused if any personal financial software you use or any of your personal hardware or software is not compatible with our system.<b> THE FOREGOING SHALL CONSTITUTE ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY. IN NO EVENT SHALL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS (EVEN IF ADVISED OF THE POSSIBILITY THEREOF) ARISING IN ANY WAY OUT OF THE USE OF THE CREDIT UNION ONLINE SERVICES, EXCEPT AS REQUIRED BY LAW. USER NAME ID AND PASSWORD When you enroll in the credit union online services you will be able to select a User Name ID and a Password. Together, the User Name ID and Password identify you as a credit union Online Banking member and the accounts or functions you are allowed to access. You agree to keep your User Name ID and Password confidential to prevent unauthorized access to your accounts and to prevent unauthorized use of Online Banking. If you permit other persons to access Online Banking using your Password or other means to access your account, you are responsible for any transactions they authorize. Your User Name ID and Password may be revoked or canceled at any time without giving you prior notice to assist us in maintaining the security of your accounts. The credit union User Name ID and Password are used to identify you as an authorized user of the credit union Online Banking. You therefore agree not to reveal your User Name ID and Password to any person or third party (such as a bill payment aggregator), without our prior specific authorization. The security of your accounts depends on you maintaining the secrecy of your User Name ID and Password. We recommend that you change your Password often. For security purposes, the system will prompt you to change your Password once a year. If you forget your Password or you have been locked out of your account and you have not set up your password reset question and answer, you must contact us to reset your Password for you. The credit union will then reset the Password and you will be prompted to select a new Password the next time you sign on. If you should forget your Password or if you are locked out of your account and you have pre-selected a password reset question and answer through the My Settings Personal Information menu in Online Banking, you may elect to re-set your Online Banking Password by clicking on the RESET Password link from the Login Page of Online Banking. You will be brought to a screen that will require you to enter your User Name ID and address. Once entered and you select submit you will receive an with instructions on how to reset your Online Banking Password. The will contain a link (valid for only two hours) that will bring you to a secure web page where you
3 will enter your Online Banking ID and the answer to the security question selected through the My Settings Personal Information menu mentioned above. If the answer entered matches the answer on file you will then be asked to select a new Password. If accepted, you will then be able to login with your User Name ID and new Password. Your new Password should not be the same as any previous Password you have selected. It is essential that the Online Banking users select the "Log Out" option located at the top right hand portion of the screen when terminating an active session of Online Banking. Any other means of signing out (i.e. powering down, clicking the "X" (close)) could lead to unauthorized access. CONTACT US IN THE EVENT OF A LOST OR STOLEN USER NAME ID OR PASSWORD, UNAUTHORIZED TRANSACTIONS OR STOP PAYMENT REQUEST If you believe that your User ID or Password has been lost or stolen or that someone may attempt to access your Online Banking account or transfer money from your account without your permission, call us immediately at: (Toll Free) or Or write us at: Charter Oak Federal Credit Union E-Banking Department 1055 Hartford Turnpike Waterford, CT Do NOT use service as a means of contact for the purpose of reporting this information. We will not immediately receive sent by you. transmissions through general or public are not secure. We, therefore, request that you do not send us or ask for sensitive information such as account numbers, user name and password, financial information, etc. via any general or public system. Additionally, under no circumstances will a credit union employee request your user ID name or password via the Internet or other contact. Do NOT respond to such requests even if the individual claims to represent the Credit Union or any subsidiary thereof. DESCRIPTION OF ONLINE BANKING SERVICES Depending on the services requested by you in your application, you could perform some or all of the following functions through the Online Banking: Obtain account balances and transaction information for your accounts. Transfer funds between your eligible Accounts and Loans (internal and external) Transfer funds from a deposit account to make a loan payment Make payments to any person or business from multiple accounts. Download statements and transactions. Create a budget and aggregate your account information from other financial institutions. Download account information into money management software (Microsoft Money / Quicken / Quickbooks).
4 Place stop payment orders for checks you have drawn on your account Send/receive electronic mail message to/from us. These features of Online Banking are limited by and subject to the terms set forth below: (a) Your ability to transfer funds from your savings account is limited by federal law, as stated in the credit union Electronic Funds Transfer Agreement and Disclosures. By law, there may be a maximum of six transfers from these accounts per monthly statement cycle initiated on your computer (or by means of telephone, wire or preauthorized transfers), of which no more than three aggregate may be made by check or debit card (other than withdrawal from an automated teller machine ("ATM")). (b) If you overdraw your deposit account through an Online Banking transaction, and you have a Line of Credit with the bank that is attached to the account which is overdrawn, a loan advance will be made under the terms of that agreement. (c) Transaction information provided on any day will generally be current only as of the close of business on the preceding business day. Transaction information for your accounts will be available online for the preceding three month period, beginning from the date we authorize your use of the Credit Union Online Banking. (d) For security reasons, we may place limitations on the frequency and dollar amount of transfers from your accounts. (e) You agree that when you use the Online Banking to place a stop payment on a check you have drawn on your account, you will provide a written confirmation of the stop payment order within fourteen days of the date the stop payment order is submitted through the Online Banking. A stop payment order sent through the Online Banking is good for fourteen days; a written stop payment order is good for six months, but it may be renewed by written notice to us before it expires. We will have no liability for failing to act on a stop payment order if the stop payment order does not describe the check with reasonable certainty, or if the bank does not have a reasonable opportunity to honor the stop payment order, even if the failure to stop payment causes other checks to be returned. Prior to sending a stop payment order, you should first verify that the check has not already been posted to the account. SCHEDULING PAYMENTS You may choose to add Bill Payment and use your computer to schedule electronic payments with this service. Payments are posted against your balance available for withdrawal. The credit union s Funds Availability Policy Disclosure, Electronic Funds Transfer Agreement & Disclosure and Member and Account Agreement describe your ability to withdraw funds from your accounts at the Credit Union. PERIODIC STATEMENTS Your periodic statements for your accounts will include any transfers you authorize using the Credit Union Online Banking, as well as your other account activity. BUSINESS DAYS AND HOURS OF OPERATIONS For the purposes of this agreement, our business days are Monday through Friday. Holidays are not included. The credit union Online Banking can only make transfers on business days. However, you may
5 use your computer to access the credit union Online Banking 24 hours a day, seven days a week, except during any special maintenance period. YOUR LIABILITY You are responsible for all transfers you authorize using Online Banking. If you permit other persons to use Online Banking or your User Name ID and Password, despite our instructions not to do so, you are responsible for any transactions they authorize from your accounts. If you believe your User Name ID or Password has been lost or stolen call our Electronic Banking Department immediately at or If you contact us within two (2) business days after you discover your password has been lost or stolen, you can lose no more than $50.00 from each deposit account if someone used your User ID or Password to access your deposit account without your permission. If you do not tell us within two (2) business days after you learn the loss or theft of your User Name ID or Password, and we can prove that we could have prevented the unauthorized use of your User Name ID or Password if you had told us, you could lose as much as $ from each deposit account. Also, if your statement shows transfers from a deposit account that you did not make, tell us at once. If you do not tell us within sixty (60) days after the statement was mailed to you, you may not get back any money you lost after the sixty (60) days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or hospital stay) prevented you from telling us, we will extend the time periods. If we complete a payment or transfer that you make or authorize and we subsequently learn that you have insufficient funds for the transaction, you agree that we may reverse the transaction or offset the shortage with funds from any account you have with us. In any case, you are fully obligated to us to provide sufficient funds for any payments or transfers you make or authorize. OUR LIABILITY We will be responsible for your actual losses if they were directly caused by our failure to complete a transfer to or from your accounts on time or in the correct amount according to our agreements with you. However, there are some exceptions. We will not be liable, for instance: (a) If, through no fault of ours, you do not have available enough funds in your account to complete a transaction from that account, or if withdrawals from any of your accounts have been prohibited by a court order such as a garnishment or other legal process, or if that account has been closed. (b) If the transfer would go over the credit limit on your Line of Credit. (c) If the account has been closed. (d) If you have not properly followed our Online Banking instructions on how to make a transfer or if your electronic device or Internet service provider fails or malfunctions. (e) If you have not given us complete, correct and current instructions so that we can make a transfer. (f) If we have reason to believe that a transaction has not been properly authenticated or is fraudulent. (g) If the Online Banking system was not working properly and you knew or should have known about the breakdown when you attempted to authorize a transfer. (h) If circumstances beyond our control prevent the making of a transfer or payment, despite reasonable precautions that we have taken. Such circumstances include delays or losses of payments caused by equipment failure or breakdown, acts of God or other conditions beyond our control. We will be
6 responsible for acting only on those instructions sent through the Credit Union Online Banking which we actually receive. (i) For other exceptions to our liability as stated in our Electronic Fund Transfer Agreement. (j) For any indirect, incidental, special or consequential damages if our failure was not intentional and resulted from a bona fide error, notwithstanding our procedures to avoid such error. Provided none of the foregoing reasons that we will not be liable are applicable, if the Credit Union Online Banking fails to process a transaction, causes an incorrect amount of funds to be removed from your account, or causes funds from your account to be directed to a person or entity which does not comply with your payment instructions, we will be responsible for returning any improperly transferred funds to your account and for directing to the proper recipient any payments or transfers that were previously misdirected or not completed. ERROR RESOLUTION In case of errors or questions about your Credit Union Online Banking transactions, contact us immediately. Telephone our E-Banking Department during normal Member service hours at: (Toll Free) or Or write us at: Charter Oak Federal Credit Union E-Banking Department 1055 Hartford Turnpike Waterford, CT For credit account transactions: Telephone us during our regular business hours or write us at the address set forth in your Membership Agreement or periodic statement. For credit account transactions, if you telephoned us instead of writing you may lose certain rights the law gives you to dispute billing errors. If you think your statement is wrong or if you need more information about a transaction listed on the statement, we must hear from you no later than sixty (60) days after we sent the first statement on which the problem or error appeared. You must: Tell us your name and account number(s). Describe the error or the transaction you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information. Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days: (A) Deposit Accounts: We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. (We may extend this time period to twenty (20)
7 business days if the error occurred within 30 days of the first deposit to your account). If we need more time, however, we may take up to 45 days to investigate your complaint or question. (If the complaint or question concerned a transaction that occurred within 30 days of the first transaction to your account, we may take up to 90 days to complete the investigation). If we decide to do this, we may provisionally credit your deposit account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your deposit account. We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation. We may revoke any provisional credit provided to you if we find that an error did not occur. You may ask for copies of the documents we used in our investigation. (B) Line of Credit Accounts: You do not have to pay any amount in question while we are investigating, but you are still obligated to pay the parts of your credit account bill that are not in question. While we investigate your question, we cannot report the amount in question as delinquent or take any action to collect the amount you question. DISPUTES In the event of a dispute regarding Online Banking, you and the credit union agree to resolve the dispute by looking to this Agreement. You agree that this Agreement, together with the applicable deposit or credit Account agreement and the Electronic Fund Transfer agreement, is the complete and exclusive agreement between you and the credit union Online Banking, which supersedes any proposal or prior agreement, oral or written, and any other communications between you and the Credit Union Online Banking relating to the subject matter of this Agreement. If there is a conflict between what an employee of the Credit Union says and the terms of this Agreement, the terms of this Agreement will prevail. DISCLOSURE OF ACCOUNT INFORMATION TO OTHERS It is our general policy to treat your account information as confidential. However, we will disclose information to third parties about you, your accounts or the transfers you make under the following circumstances: (a) We have entered into an agreement to have another party assist us in providing the Credit Union Online Banking services. In order to carry out your instructions we will provide this party with, or it will receive from you, information about your designated accounts, your Online Banking transactions and your electronic mail messages. (b) Where it is necessary for completing transfers. (c) In order to verify the existence and condition of your accounts for a third party, such as a credit bureau. (d) In order to report our experience regarding your accounts or the Credit Union Online Banking transactions to financial institutions and credit reporting agencies.
8 (e) To collect any debt that you may owe to us. (f) We may collect Member account data for the purpose of learning about aggregate Member usage patterns, Member telephone inquiries, and the effectiveness of the Credit Union Online Banking, but shall not disclose individual identifiable information except as provided in this Section. (g) In order to comply with laws, government agency rules or orders, court orders, subpoenas or other legal processes in order to give information to any government agency or official having legal authority to request such information. (h) If you give us your written permission. (i) For any of the reasons listed in your Electronic Fund Transfer Agreement. DATA RECORDING The information and electronic mail messages you enter on the Credit Union Online Banking may be recorded. By using Online Banking, you consent to such recording. We request that you do not send us or ask for sensitive information such as account numbers, user name and password, financial information, etc. via any general or public system. NO WAIVER The Credit Union Online Banking shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by the Credit Union Online Banking. No delay or omission on the part of the Credit Union Online Banking in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions. CAPTIONS The captions of sections hereof are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this Agreement. AMENDMENT TO THIS AGREEMENT This Agreement, applicable fees and service charges may be altered or amended by the Credit Union from time to time. In such event, we send notice to you at your address as it appears in our records, prior to the effective date of the amendment, as required by law. Any use of the Credit Union Online Banking after we have sent notice of change will constitute your agreement to such change(s). Further, the Credit Union Online Banking may, from time to time, revise or update the programs, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Credit Union Online Banking reserves the right to terminate this agreement as to all such prior versions of the programs, services, and/or related material and limit access to the Credit Union Online Banking s more recent revisions and updates. The Credit Union Online Banking and your accounts will be governed by this agreement as amended.
9 ADDRESS OR BANKING CHANGES You agree to promptly notify in writing the Member Service Department of any address change. Additionally, you agree to notify the Member Service Department in writing at least ten (10) business days in advance of any change in your payment account or your banking status. Such notice must be sent to: Charter Oak Federal Credit Union E-Banking Department 1055 Hartford Turnpike Waterford, CT NOTICES AND COMMUNICATIONS Except as otherwise provided in this agreement, all notices required to be sent to you will be effective when we mail or deliver them to the last known address that we have for you in our records or when we make such notices available to you through Online Banking or at the last known address that we have for you in our records. Notice to one joint owner or the Online Banking Member will be effective for all of you. You agree that we may send or provide certain documents to you through electronic communication. Certain restrictions may apply. ASSIGNMENT You may not assign this Agreement to any other party. We may assign this Agreement to any future, directly or indirectly, affiliated company. We may also assign our rights and delegate our duties under this agreement to independent contractors or other third parties. INFORMATION AUTHORIZATION Your enrollment in Online Banking may not be fulfilled if the credit union cannot verify your identity or other necessary information. Through your enrollment in the credit union Online Banking, you agree that we reserve the right to request a review of your credit rating at our own expense through an authorized bureau. TERMINATION In the event you wish to discontinue your ability to use the Credit Union Online Banking, you must contact the Electronic Banking Department in writing. Such notice must be supplied ten (10) days prior to the actual discontinuance date and must be sent to: Charter Oak Federal Credit Union E-Banking Department 1055 Hartford Turnpike Waterford, CT This agreement and your ability to use any or all of the Credit Union Online Banking may be terminated at any time by you or us upon giving notice of the termination to the other party. Neither termination nor discontinuation shall affect your liability or obligations under this Agreement. If you terminate the
10 Online Banking, you authorize us to continue making transfers and bill payments you have previously authorized until such time as we have had a reasonable opportunity to act upon your termination notice. Once we have acted upon your termination notice, we will make no further transfers or payments from your accounts, including any transfer or payments you have previously authorized. If we terminate your use of the Credit Union Online Banking, we reserve the right to make no further transfers or payments from your accounts, including any transactions you have previously authorized. SEVERABILITY If any provision of this agreement is held invalid, illegal, void or unenforceable by any rule or law, administrative order or judicial decision, all other provisions of the agreement shall remain in full force. ATTORNEY FEES If you bring legal action against us or if we bring a legal action against you and the legal action involves electronic funds transfers or matters discussed in this agreement, you agree to pay all of our attorney fees if we win. GOVERNING LAW This agreement is governed by and shall be construed in accordance with the laws of the State of Connecticut and applicable federal law. If any terms of this agreement cannot be legally enforced, they will be considered changed to the extent necessary to comply with the applicable law. E-ALERTS By subscribing to ealerts, you will receive a set of credit union defined, un-editable ealerts that will replace any paper notices you currently may receive. You will also be able to set up self-defined ealerts. You are solely responsible for the setup and maintenance of your own self-defined individual ealerts, and may discontinue and edit your self-defined ealerts as you see fit. Your Internet access and/or SMS (text) messaging carrier fees may apply. ealerts will be sent to the address you have provided as your primary address for Online Banking. You can choose to have ealerts sent to other addresses including a mobile device that accepts SMS (text) messages. ealerts may be delayed or prevented by a variety of factors. We neither guarantee the delivery nor the accuracy of the contents of any ealerts. We will not be liable for any delays, failure to deliver, or misdirected delivery of any ealert; for any errors in the content of an ealert; or for any actions taken or not taken by you or any third party in reliance on an alert. ealerts are unencrypted. We will never include your password or full account number. However, ealerts may include your name and some information about your accounts. Depending upon which ealerts you select, information such as your account balance or the due date for your credit card payment may be included. Anyone with access to your will be able to view the contents of these ealerts. Therefore, you are responsible for the security of your telecommunications
11 equipment and must take all reasonable precautions to prevent anyone else from accessing any confidential information. Mobile Deposit Capture Description: The Mobile deposit capture services ("Mobile Deposit" or "Services") are designed to allow you to make deposits to your checking, money market checking or savings accounts from your camera-enabled mobile device capable of capturing check images and information and electronically delivering the items and associated deposit information to the Charter Oak Federal Credit Union or Charter Oak Federal Credit Union's designated processor. The device must capture an image of the front and back of each check to be deposited in accordance with the Procedures; must read and capture the magnetic ink character recognition ("MICR") line on each check; and must read and capture all such other data and information as is required by this Agreement or Federal Reserve regulations for the processing of these checks for payment. Charter Oak Federal Credit Union offers the benefits and convenience of the Services to you free. Charter Oak Federal Credit Union reserves the right to charge fees for the Services in the future. Hardware and Software requirements: You must have a Mobile Device that is acceptable to us and a wireless plan from a compatible mobile wireless provider. You must also use the operating system(s) and software that satisfies all technical specifications and other requirements that we and/or our service provider(s) establish and specify. We and/or our service provider(s) may change these specifications and/or requirements from time to time. Charter Oak Federal Credit Union is not responsible for any third party software you may need to use the Services. You agree that you will perform, or cause to be performed by properly trained personnel, all vendor recommended maintenance, repairs, upgrades and replacements. Unless otherwise provided in this Agreement, you are solely responsible, at your own expense, for purchasing, installing, operating, testing and maintaining all hardware and software necessary to use the Service. You must install and test your Mobile Device, your system, and any other required hardware and software before you make your first deposit through the Service. You accept any such software as is and subject to the terms and conditions of the software agreement that you enter into directly with the third party software provider at the time of download and installation. We are not responsible for, and you release us from, any and all claims or damages resulting from, or related to, any computer virus or related problems that may be associated with using the Service, or the Internet. You agree that all images and files transmitted to us through the Service will contain no viruses or any other disabling features that may have an adverse impact on our network, data, or related systems. <br><br> Receipt of Items: We reserve the right to reject any item transmitted through the Services, at our discretion, without liability to you. We are not responsible for items we do not receive or for images that are dropped during transmission. An image of an item shall be deemed received when you receive a confirmation from Charter Oak Federal Credit Union that we have received the image. Receipt of such confirmation does not mean that the transmission was error free or complete. Availability of Funds: You agree that items transmitted using the Services are not subject to the funds availability requirements of Federal Reserve Board Regulation CC. Funds deposited using the Services will be available after Charter Oak Federal Credit Union receives payment for the funds submitted. Charter Oak Federal Credit Union may make such funds available sooner based on such factors as credit worthiness, the length and extent of your relationship with us, transaction and experience information, and such other factors as Charter Oak Federal Credit Union, in its sole discretion, deems relevant. Deposit Limits: Charter Oak Federal Credit Union reserves the right to establish and assign to you deposit limits for the Service (including limits on the dollar amount and/or number of Checks that you may transmit through the Service each day) and to modify such limits from time to time in the
12 Charter Oak Federal Credit Union s sole discretion, and you agree to comply with all such limits. Our current daily deposit limit is 10 checks/$3,000 per day or 20 checks/$10,000 per month. Fees and Charges: Charter Oak Federal Credit Union offers the benefits and convenience of the Services to you free. Charter Oak Federal Credit Union reserves the right to charge fees for the Services in the future. Endorsements and Procedures: You agree to restrictively endorse any item transmitted through the Services as "FOR MOBILE DEPOSIT ONLY" or as otherwise instructed by Charter Oak Federal Credit Union. You agree to follow any and all other procedures and instructions for use of the Services as Charter Oak Federal Credit Union may establish from time to time. Endorsements must be made on the back of the share draft or check within 1½ inches from the top edge, although we may accept endorsements outside this space. Any loss we incur from a delay or processing error resulting from an irregular endorsement or other markings by you will be your responsibility. For a check payable to you and any joint owner(s) of your account, the check must be endorsed by all such payees and you may only use Mobile Deposit to deposit such check into an account jointly owned by all such payees. If the check is payable to you or your joint owner, either of you can endorse it. If the check is made payable to you and any non-joint owner, you may not deposit the check into your account using the Services. And, you agree never to represent the item. You will promptly provide any retained item, or a sufficient copy of the front and back of the item, to Charter Oak Federal Credit Union as requested to aid in the clearing and collection process, to resolve claims by third parties with respect to any item, or for Charter Oak Federal Credit Union audit purposes. Check requirements (including image quality): The image of an item transmitted to the Charter Oak Federal Credit Union using the Services must be legible and contain images of the front and back of the Check. The image quality of the items must comply with the requirements established from time to time by the American National Standards Institute ("ANSI"), the Board of Governors of the Federal Reserve Board, or any other regulatory agency, clearing house or association. These requirements include, but are not limited to, ensuring the following information can clearly be read and understood by sight review of the Check image: the amount of the Check (both written and numeric); the payee; the signature of the drawer (maker); the date; the Check number; the information identifying the drawer and the paying Charter Oak Federal Credit Union that is preprinted on the Check including the MICR line; and all other information placed on the Check prior to the time of an image of the Check is captured (such as any required identification written on the front of the Check and any endorsements applied to the back of the Check). Storage, security and destruction/disposal of the checks: After you receive confirmation that we have received an image, you must securely store the original Check for 90 days after transmission to us and make the original Check accessible to us at our request. Upon our request from time to time, you will deliver to us within two Business Days, at your expense, the requested original Check in your possession. If not provided in a timely manner, such amount will be reversed from your account. Promptly after the 90-day retention period expires, you must destroy the original Check by first marking it "VOID" and then destroying it by cross-cut shredding or another commercially acceptable means of destruction. After destruction of the original Check, the image will be the sole evidence of the original Check. You agree that you will never re-present the original Check. You understand that you are responsible if anyone is asked to make a payment based on an original check that has already been paid. Presenting checks more than once: Once you have used the Service to deposit a Check you agree not to present, or allow anyone else to present, that original Check or a substitute check of that original Check again for deposit through the Service or by any other means. If you or anyone else present a Check or substitute check for deposit more than once, in violation of this Agreement, you agree to indemnify, defend and hold Charter Oak Federal Credit Union harmless from and against all liability and damages that may result from any claims, suits or demands from third parties with
13 respect to such Check or substitute check. You agree that we may debit from your account the aggregate amount of any Checks that that are deposited more than once. To the extent that funds in your account are insufficient to cover such amount, we shall debit the deficiency amount from any other of your account(s) with the Charter Oak Federal Credit Union in our sole discretion. Rejection of deposits: After we receive Check images and all other required deposit information from you through the Service, we shall provisionally credit your designated account for the total amount of such Checks. The provisional credit is subject to final payment of the Checks and is also subject to your Charter Oak Federal Credit Union Account Agreement. You agree that all deposits received by us are subject to verification and final inspection and may be rejected by us in our sole discretion, and you shall be liable to Charter Oak Federal Credit Union for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against the Charter Oak Federal Credit Union relating to such deposits. Charter Oak Federal Credit Union is not liable for any service or late charges that may be imposed against you due to Charter Oak Federal Credit Union s rejection of any Check that you transmit for deposit through the Service. In all cases, you are responsible for any loss or overdraft plus any applicable fees to your account due to a Check being returned. You acknowledge and agree that, while we normally provide notice of rejected deposits, we may reject any Check transmitted through the Service in our sole discretion without notice to you, and we will not be liable for any such rejection or failure to notify you of such rejection. If we reject a Check for Mobile deposit, you must physically deposit the original Check. Unpaid checks: Should you fail to produce the original check, you authorize us to deduct that amount from your account. You are solely responsible for verifying that Checks that you deposit by using the Service have been received and accepted for deposit by Charter Oak Federal Credit Union. Charter Oak Federal Credit Union will provide you with notice of any deposits that it is unable to process because Checks were returned unpaid by the payor. You agree to accept such notices at your address on file with us, but we may choose any reasonable method for providing such notices to you. In the event that Charter Oak Federal Credit Union credits your account for a Check that is subsequently dishonored and returned, you authorize Charter Oak Federal Credit Union to debit the amount of such Check plus any associated fees from the account. To the extent that funds in your account are insufficient to cover such amount, we shall debit the deficiency amount from any of your other account(s) with Charter Oak Federal Credit Union in our sole discretion. Our right to charge your account(s) will apply without regard to whether the Check was timely returned or whether there is any other claim or defense that the Check was improperly returned. You understand and agree, that since the original Check is your property, it will not be returned and Charter Oak Federal Credit Union may charge back an image of the Check, an ACH debit, or other electronic or paper debit, as applicable, to your account. You further agree that any image that we charge back may be in the form of an electronic or paper reproduction of the original Check or a substitute check. You may not use the Service to deposit a substitute check and you may not deposit the original Check through the Service or in any other manner if you receive a dishonored Check. You agree to comply with any additional instructions we may provide to you in connection with returned Checks. Duty to report errors: Charter Oak Federal Credit Union will provide you with periodic statements that will identify the deposits that you make through the Service. In addition, you may access Charter Oak Federal Credit Union s OnlineBanking service for information about your deposits, return items, deposit adjustments, Checks and other transactions on your accounts. You agree that it is your responsibility to review all such information that Charter Oak Federal Credit Union makes available to you in a timely manner to verify that deposits made through the Service have been received and accepted by Charter Oak Federal Credit Union and are accurate. Receipt of a Check by Charter Oak Federal Credit Union through the Service does not constitute an acknowledgement by the Charter Oak Federal Credit Union that the Check is error-free or that we will be liable for the Check. You agree to notify us promptly of any errors, omissions, or discrepancies in a deposit within the time periods established in your Account Agreement. You may notify us by ing us at ebanking@cofcu.com, or writing to Charter Oak Federal Credit Union Attn: ebanking Dept, 1055 Hartford Turnpike, Waterford, CT or telephoning us at or toll free. You agree to cooperate in any investigation by Charter Oak Federal Credit Union of any unsuccessful or lost

Subject to applicable law, any failure by you to notify the Charter Oak Federal Credit Union of any error, omission or other discrepancy in accordance with this Agreement and your Account Agreement shall relieve Charter Oak Federal Credit Union of any liability for such error, omission or discrepancy. Availability of service/contingency: In the event you are unable to capture, balance, process, produce or transmit a file to Charter Oak Federal Credit Union, or otherwise comply with the terms or the Procedures for any reason, including but not limited to, communications, equipment or software outages, interruptions or failures, you will transport or mail the originals of all checks to the closest Charter Oak Federal Credit Union location. The deposit of original checks at an office of Charter Oak Federal Credit Union shall be governed by the terms and conditions of the Deposit Account Agreement and not by the terms of this Agreement. Cooperation with Investigations: You agree to cooperate with us in the investigation of unusual transactions, poor quality transmissions, and resolution of member claims, including by providing, upon request and without further cost, any originals or copies of items deposited through the Service in your possession and your records relating to such items and transmissions. Availability of Funds: You agree that items transmitted using the Services are not subject to the funds availability requirements of Federal Reserve Board Regulation CC. In general, if an image of an item you transmit through the Service is received and accepted before 4:00pm EST on a business day that we are open, we consider that day to be the day of your deposit. Otherwise, we will consider that the deposit was made on the next business day we are open. Funds deposited using the Service will generally be made available in two business days from the day of deposit. (Charter Oak Federal Credit Union) may make such funds available sooner based on such factors as credit worthiness, the length and extent of your relationship with us, transaction and experience information, and such other factors as (Charter Oak Federal Credit Union), in its sole discretion, deems relevant.
