1 Western Governor s Wildlife Council Fall Business Meeting Long term CHAT Maintenance & Data Integration Discussion The Montana Natural Heritage Program and Montana Fish, Wildlife & Parks Experience

2 Established by Legislature in 1983 Part of the Montana State Library s Natural Resource Information System Operated a partnership with the University of Montana Part of the Nature Heritage Network -- NatureServe

3 MTNHP Statutes (Excerpts) DEFINITIONS. (3) "Natural heritage program" means a program of information acquisition, storage, and retrieval for data relating to the flora, fauna, and biological community types of Montana NATURAL HERITAGE PROGRAM. (1) There is a Montana natural heritage program to be operated by the library. (2) The Montana natural heritage program shall be designed to be compatible with similar programs in other states.

4 MTNHP Statutes (Excerpts) INTERAGENCY COOPERATION. (2) Within the limits of available resources, state agencies shall provide data requested by the library for purposes of the natural resource information system and the Montana natural heritage program NONDISCLOSURE OF LIBRARY RECORDS. (1) No person may release or disclose a library record or portion of a library record to any person except in response to: (a) a written request of the person identified in that record, according to procedures and forms giving written consent as determined by the library; or (b) an order issued by a court of competent jurisdiction, upon a finding that the disclosure of such record is necessary because the merits of public disclosure clearly exceed the demand for individual privacy.

12 Challenges Lengthy process to negotiate MOU and to obtain all signatures Had to acknowledge turf issues and arrive at compromise Needed to develop creative solutions - for example, some data are fuzzed before coming to MTNHP

13 Benefits Ready access to each agency s data so that both use the same data More efficient use of limited resources Improved ability to quickly take advantage of opportunities Defined roles allow each to fill different purposes FWP can regulate; MTNHP can disseminate Better information is being managed and disseminated Less competition more partnerships ship helps FWP implement wildlife management mandates Empowers projects like the Regional CHAT
