2 RIBA Agreements 2010 The full suite of electronic RIBA Agreements 2010 is as follows: Standard Conditions of Appointment for an Architect VAT Standard Conditions of Appointment for a Consultant VAT This is a much improved Form of Agreement and we are pleased to have been able to help the RIBA bring it about. Brian Waters, President of the Association of Consultant Architects (ACA). The new suite of RIBA Agreements 2010 is a versatile suite of contract documents for the appointment of architects and other consultants. Replacing the RIBA Agreements 2007, it is a flexible, user-friendly system which can be tailored easily to the needs of individual projects. The Conditions have been subjected to an extensive industry-wide review process led by the RIBA. Fair and balanced for both the architect/consultant and the client, they are formally endorsed by the Association of Consultant Architects (ACA), the Royal Incorporation of Architects in Scotland (RIAS), the Royal Society of Architects in Wales (RSAW), the Royal Society of Ulster Architects (RSUA) and the Chartered Institute of Architectural Technologists (CIAT). The RIBA Agreements 2007 and SFA 99 (and its suite of related documents) will be withdrawn from sale in December What s new? n The RIBA Agreements are now more user-friendly with a new simplified design n Recent legislative changes have been taken into account, including The Cancellation of Contracts made in a Consumer s Home or Place of Work Regulations 2008 and the Provision of Services Regulations 2009 n Revisions have been made to the provisions for termination, which give rights to the architect equal to those offered to the client n The option of an aggregate cap on liability has been introduced n The establishment of the right for the architect to have reasonable access to photograph a project and to publish images n Increased interest charges on the late payment of fees n Better clarification in relation to the architect s right to suspend the copyright licence in the event of non-payment of any amounts properly due n The printed versions have fewer separate components n There are now only five RIBA Agreement 2010 printed packs, reduced from nine in the 2007 edition. The RIBA Standard Agreement 2010 is the only agreement in the suite which has a separate consultant version For further information, go to n Memorandum of Agreement for the Appointment of an Architect/ a Consultant n Project Data 2010 n Services 2010 n Model Letter Concise Conditions of Appointment for an Architect VAT Concise Conditions of Appointment for a Consultant VAT n Small Project Services Schedule 2010 n Model Letter Conditions of Appointment for an Architect for a Domestic Project VAT Conditions of Appointment for a Consultant for a Domestic Project VAT n Small Project Services Schedule 2010 n Model Letter Conditions of Appointment for a Sub-consultant VAT n Sub-consultant Agreement 2010: Model Letter The electronic version also includes schedules which are not available in the printed version and allow for greater flexibility in the use of the Agreements: Access Consultancy Services Schedule Historic Building or Conservation Project Services Schedule Small Historic Building or Conservation Project Services Schedule Initial Occupation and Post-occupation Evaluation Services Schedule Master Planning Services Schedule Multi-disciplinary Design Services Schedule Draft Third Party Rights Schedule Draft Warranty by a Sub-consultant Public Authority Supplement Contractor s Design Services Schedule Contractor s Design Services Notes Parts 1-4 Extra Small Project Services Schedule 2010 Fees and Expenses Schedule 2010 Services 2010 Client Guides are also available to explain a particular service: A Guide to Access Consultancy Services A Guide to Working with an Architect: Repair and Alteration of Historic Buildings A Guide to Working with an Architect: Repair and Alteration of Places of Worship A Guide to Initial Occupation and Post-occupation Services
3 RIBA Agreements Electronic Electronic versions The whole suite of documents is available electronically, including much that is not available in print. The full versatility of the RIBA Agreements 2010 is best appreciated in the electronic version, where you are able to customise the components to suit your project. The electronic versions have been updated and rigorously checked for legal accuracy. They are available from Benefits of using the electronic versions n User-friendly n Cost-effective - significantly cheaper than printed versions n Re-usable - Conditions must be bought for each new project but you only need to buy the core components once n Easily amended you can edit or customise them to fit your house style (applies to all components other than Conditions) n Completed electronically no need to fill them in by hand n Convenient you can share them with others by 7 easy steps to creating a RIBA Agreement You are only 7 steps away from your customised Agreement - simply go to and follow the steps to tailor the contracts to your specific project. Creating your Agreement online is simple: This is a first class suite of documents which protects the interests of the architect while being fair so far as the client is concerned. It is a huge improvement on the 2007 documents and clearer than the 1999 suite which is now somewhat out of date. We shall be recommending them to our clients. Dr David Chappell BA(Hons Arch) MA(Arch) MA(Law) PhD RIBA. Director of David Chappell Consultancy Limited.
4 RIBA Agreements Printed The RIBA Agreements 2010 have been published in five print packs with corresponding bundles of core components. 5 RELATED READING A guide to letter contracts: for very small projects, surveys and reports Roland Phillips A guide to letter contracts presents, for the first time, a safe way to word a letter contract for very small projects. At its heart are two annotated model letters, one for a business client and the other for a domestic client. Expressed in plain English, the models include provisions that may be modified to suit project requirements. The whole is supported by four worked examples demonstrating how the models may be adapted in practice. A guide to letter contracts is an essential for architects and other consultants offering design services. Architect s Job Book Eighth Edition 3DReid Architect s Job Book is the Royal Institute of British Architects long-established and recognised standard reference work for running architectural jobs and administering construction contracts. Providing a systematic operational framework that can be applied to any building type or procurement method, its comprehensive scope is logically laid out along the RIBA s Outline Plan of Work In all, the Architect s Job Book s straightforward, no-nonsense coverage is invaluable and will form the cornerstone of an office quality management system, making it essential reading for anyone in architectural practice or, indeed, for students undertaking their Part 3 examinations. Plan of Work: Multi-Disciplinary Services Roland Phillips Plan of Work: Multi-Disciplinary Services is the new edition of the guide to the RIBA Outline Plan of Work 2007, the de facto standard project framework used by the construction industry. Now updated to reflect current procurement practice and the consequences of better risk management, this guide describes how the different parties in the contemporary multi-disciplinary team can work together effectively to complete work stages. In updating this new edition to suit contemporary building procurement routes, Plan of Work: Multi-Disciplinary Services provides a flexible model for preparing designs with a cost plan and is an invaluable roadmap for monitoring their construction.
