3 OVERVIEW IN TURKEY Only in 2012, children were pushed into crime in Turkey. Some children were sentenced to prison, some turned out to be a victim of crime or witnessed a crime. Thousands of children who have the same rights as all children met with courts for the first time. Prosecutors are to ensure that child friendly procedures are observed during the process of investigation in accordance with the Guidelines of the Council of Europe on Child-Friendly Justice. UN Committee on the Rights of the Child, General Comment number:10 requires the appointment of judges, prosecutors and lawyers specialized in juvenile justice. According to the Child Protection Law, it is required to carry out an investigation that reveals the individual characteristics and social environment of the child. According to the UN Guidelines on Justice in Mattters Involving Child Victims and Witnessess of Crime experts shall take necessary measures to facilitate the process for the child to give statement or evidence to ensure that the child could easily understand, to prevent their recurring victimization and to improve communication prior to and during the prosecution process and shall implement them.

4 IN TURKEY-5395 CHILD PROTECTION LAW Care Measure Health Measure Education Measure Consultacy Measure Accomodation Measure The purpose of this Law is to regulate procedures and principles with regard to protecting juveniles who are in need of protection or who are pushed to crime, and ensuring their rights and wellbeing. This Law covers the provisions related to the principles and procedures of the measures that will be taken with regard to juveniles who are in need of protection and the safety measures to be applied with regard to juveniles pushed to crime, along with the establishments, duties and capacities of juvenile courts.

5 WHAT IS DONE AFTER ACCEPTANCE OF A CHILD TO KEMERBURGAZ REHABILITATION CENTRE? ACCEPTANCE TO CENTER CHILD IS INFORMED ABOUT THE SERVICES, BUILDINGS AND DAILY LIFE PROGRAM OF THE CENTER BY A STAFF FIRST INTERVIEW IS CONDUCTED WITH CHILD A MENTOR IS APPOINTED TO CHILD CHILD IS REGISTERED TO A SCHOOL DEMAND FOR URGENT PROTECTİON DECISION URGENT PROTECTION DECISION IS MADE BY A JUDGE TO KEEP A CHILD IN SAFE. THEREFORE IT IS DEMANDED BY THE SOCIAL SERVICE WITHIN 5 DAYS THE DECISION IS MADE BY A JUDGE OF CHILD COURT WITHIN 3 DAYS FAMILY VISIT AND SOCIAL CASE REPORT AFTER ACCEPTANCE OF A CHILD WITHIN 30 DAYS FAMILY IS VISITED BY A SOCIAL WORKER AND SOCIAL CASE REPORT IS PREPARED. SOCIAL WORKER SHOULD DETERMINE THE NECESSARY MEASURES THAT SHOULD BE TAKEN FOR CHILD AND SEND THE REPORT TO THE COURT.

6 CASE MANAGEMENT Case Management is defined as: The process of assisting an individual child (and their family) through direct support and referral to other needed services, and the activities that case workers, social workers or other project staff carrry out in working with children and families in addressing their protection concerns. The primary goal of social work case management is to optimize child functioning and well-being by providing and coordinating high quality services, in the most effective and efficient manner possible. As a core function of any child protection system, case management can directly contribute to the overall protection goal of preventing and responding to abuse, neglect, exploitation and violence against children.

8 CASE MANAGEMENT PROCESS Identification: Child s situation is defined by a Social Worker/Psychologist after the interview conducted with a child. Pre-Assessment: Priorities, strengths and challenges of a child are assessed. Many of the risks to children stem from difficulties within the home or family environment. Therefore, it is paramount that the assessment of the child takes these issues into account. Case assessment meeting is held every week in our establishment. Individual Rehabilitation Planning: It should determine the type of support that is required. This plan must be based on the best interests of the child, and developed with the participation of the child. The plan should identify tasks and timescales for ensuring the plan is achieved. Implementation: Child is expected to go to school, join the social group studies, and attend the daily activities regularly. Monitoring:Child is monitored daily by Social Service and Education Service s staff. Report: All interviews and individual&group studies are reported by a Social Worker & Psychologist.

10 PERSONAL LESSONS LEARNED Each child is unique, and each one should be assessed by multiple professionals Children who have made progress in the rehabilitation process should be placed to a different establishment. Otherwise regression might be inevitable. The capacity of a Rehabilitation Center should be maximum 20. Parents (who can work with professionals in harmony) should be integrated into rehabilitation process of children. It shouldn t be optional, because they play crucial role. Getting detailed information about the criminal background of parents is important. It allows the professionals to make the most appropriate assessment. Social Rehabilitation process and Psychiatric/medical treatment process should go hand in hand. Rewards work much better than sanctions. There should be extra institutions which can monitor children after the age of 18. Children who commit crimes intentionally and regularly should be kept in a different establishment. Psychiatrist should visit the establishments at least once a week and should talk to children and observe them in the center. Talking to children 15 minutes in a hospital per week doesn t make a sense both for children and for us.
