We have heard learned counsel for parties and gone through pleadings of writ petition. Learned counsel for respondents at the very outset submitted that petitioner-industry despite being an exempted industrial unit under Central Sales Tax and Meghalaya Value Added Tax and Rules, collected tax from customers but have not deposited the same with Taxation Authority. Therefore, industry has been subjected to assessment process under Section 9 of Central Sales Tax Act, 1956 read with Section 45 of Meghalaya Value Added Tax Act. As learned counsel for petitioner-industry is not able to make clear statement as to whether industry in question has collected the said tax or not, upon a request being made, he is granted time till after winter vacation to file affidavit.
