4 NEWSBYTE: US CPSC Issues Position Letter on Children s Sleepwear On December 22, 2011, the US CPSC (Consumer Product Safety Commission) issued a letter to manufacturers, distributors, retailers and importers outlining and reminding them of the legal requirements for compliance of Children s Sleepwear in the US. This document serves as CPSC s position letter reiterating that all Children s Sleepwear and Loungewear sold in the US must comply with the flammability requirements of 16 CFR 1615/1616. It also underscored the fact that Children s Sleepwear and Loungewear must comply with requirements of the Consumer Product Safety Improvement Act (CPSIA), which include: testing by a third-party accredited approved lab; tracking labels and Children s Product Certificate (CPC) requirements; and complying with lead content, surface coatings and phthalate requirements. The letter also reminded the reader of the possible fines that could be levied for noncompliance. In addition to the letter, the CPSC also issued a public news release on December 23, 2011 announcing the letter and reinforcing the legal obligations required for Children s Sleepwear, including loungewear, as stated in the letter. 5 NEWSBYTE: CPSC Releases Ballot Vote Sheet Recommending NPR for Infant Swings On January 11, 2011, the US Consumer Product Safety Commission (CPSC) released the draft Notice of Proposed Rulemaking (NPR) for the Safety Standard for Infant Swings. The proposed rule would establish a safety standard for Infant Swings, pursuant to section 104 of the Consumer Product Safety Improvement Act of The CPSC staff presented the draft NPR to the Commissioners on January 18 th during a public briefing. Upon the review and approval of the draft by the Commissioners, the NPR will be published in the Federal Register at which time comments may be submitted on the NPR. 6 CPSC Issues Draft NPR for Safety Standard for Infant Swings The Consumer Product Safety Commission (CPSC) has issued a draft Notice of Proposed Rulemaking (NPR) for infant swings, released under Section 104(b) of the Consumer Product Safety Improvement Act (CPSIA). The draft proposed rule incorporates the applicable voluntary standard ASTM F b with certain modifications to strengthen the standard. Comments on the NPR may be submitted up to April 25, Background of CPSIA Requirements Section 104(b) of the Consumer Product Safety Improvement Act (CPSIA) of 2008 requires the CPSC to review current industry standards for durable nursery products and to implement mandatory requirements for such products. The CPSC must mandate safety standards for no fewer than two nursery products every six months. The current NPR addresses infant swings. An infant swing is defined as a stationary unit with a frame and powered mechanism that enables an infant to swing in a seated position. An infant swing is intended for use by infants from birth until a child is able to sit upright unassisted. The CPSC staff recommends adopting the requirements specified in ASTM F b Standard Consumer Safety Specification for Infant Swings as a mandatory standard for infant swings with the modifications specified below. Additionally, the CPSC staff recommends an effective date of six months after publication of a final rule in the Federal Register. Summary of Proposed Changes to ASTM F b Proposed clarification to the current seat back angle measurement method. Proposal to increase the frequency of the dynamic load test from 50 to 500 and a clarification to the test method for the dynamic load test. Proposal to include a new requirement restricting a swing seat from having a vertical deflection greater than 4 inches when tested accordingly. Proposal to require battery compartments to be subjected to an electrical overload test, an accessible component temperature evaluation, and if the swing can operate from a 120-V branch circuit, then the swing must comply with the applicable requirements of 16 CFR Proposed clarification to the current unintentional folding requirement and the stability in the direction of swing requirement. Proposed change to the mobile attachment strength requirement which will require the force on the mobile or mobile component to be applied in the most onerous direction at or below the horizontal. 7 US Toy Standard ASTM F to Become Mandatory ASTM F Standard Consumer Safety Specification for Toy Safety becomes a mandatory standard on June 12, The 2011 version of the standard was published on December 15, 2011, and as defined under the Consumer Product Safety Improvement Act (CPSIA) it becomes mandatory within 180 days of publication, unless rejected by the US CPSC (Consumer Product Safety Commission) within 90 days of publication. On February 15, 2012, the US CPSC Commissioners unanimously voted to accept the proposed revisions to ASTM F and the CPSC issued a notice in the Federal Register on February 22 nd announcing their decision to accept the 2011 version of the standard as mandatory. It should be noted that ASTM F does not incorporate the provisions for toy chests from ASTM F963-07e1, section 4.27, therefore, the requirements from ASTM F963-07e1 regarding toy chests remain in effect. \ Summary of Final Revisions to ASTM F The requirements and test methods for the Overload and Stability Sections have been clarified. A definition for toy seat has been added. Flammability: changed the word should to shall to eliminate the non-mandatory language. Packaging film changed to plastic film to be more inclusive and duplicate information deleted in the Test Method Section. Resistivity changed to resistance for strings and flying devices. Jaw entrapment test gauge was modified to add a third dimension; also added a requirement that the gauge has to completely pass through the opening. Exclusion added for soft filled rattles and teethers. Exclusions added for constant air inflatable products and juvenile products from the scope of the standard. Heavy metal requirements have been revised as follows: o total lead in surface coating limit has been reduced from 600 ppm to 90 ppm to be aligned with 16 CFR 1303; o new heavy metal in substrate requirement, equivalent to the European Toy Standard EN71:3, has been added; o new cadmium requirement added for metal components that fit within the small parts cylinder; o total digestion screening is allowed to determine compliance to the soluble requirement and the special soluble extraction requirement for metal small parts; o compositing is allowed when conducting the total digestion test only; and o alternative tests are allowed as long as specific conditions are met (i.e., XRF testing). 8 NEWSBYTE: FTC Seeks Public Comments Regarding Rules under the Wool Products Labeling Act On January 30, 2012, the Federal Trade Commission (FTC) announced an Advance Notice of Proposed Rulemaking and Request for Public Comments in regard to 16 CFR Part 300, Rules and Regulations Under the Wool Products Labeling Act of The FTC is seeking comments from the public on the following: Definitions in the Rules: Whether there is a need for modification to some of the definitions. If the disclosure of fiber content percentages in multiple languages may present a need for modification of the Rules. Recommendations on how the FTC can clarify or improve its consumer and business education materials to make them more useful, in an effort to ensure compliance with the Wool Act and Rules. The benefits and costs to companies of using identifiers other than company name or RN # (Registered Number). For example, numbers issued by other countries, such as Canada's CA Identification Number. The extent to which US retailers are obtaining guaranties and continuing guaranties under the Rules. Currently, the Wool Act provides that no one shall be guilty of misbranding a wool product if he or she obtains a guaranty in good faith that a wool product is not mislabeled and signed by the manufacturer or supplier residing in the United States. 9 NEWSBYTE: Final Rules for US Safety Standard for Portable Bed Rails Published in Federal Register On February 29, 2012, the Final Rule for the Safety Standard for Portable Bed Rails was published in the Federal Register by the US Consumer Product Safety Commission (CPSC). The final rule adopts the ASTM F as mandatory with no changes. The final rule also establishes an effective date of August 29, 2012 and will apply to product manufactured or imported on or after this date. 10 ASTM International Publishes New Standard for Sling Carriers In February 2012, ASTM International, formerly known as the American Society for Testing and Materials (ASTM), announced the publication of a new standard for Sling Carriers. The new standard, designated as ASTM F , provides safety and labeling requirements for Infant Slings. An Infant Sling is a product of fabric or sewn fabric construction which is designed to contain a child from birth (full term infant weighing 8 lbs. or more) through 35 lbs., in an upright or reclined position, while being supported by the caregivers torso. Introduction This safety specification was developed in response to data collected by the CPSC and it attempts to minimize hazards associated with Sling Carriers from occupant retention and a lack of consumer education on the proper use of sling carriers. The safety standard for sling carriers sets forth the following requirements: General Requirements Shrinkage requirements from laundering No hazardous sharp points or edges No small parts as received or after testing Any paint or surface coating must comply with 16 CFR 1303 Any exposed wood part shall be smooth and free from splinters Requirements for locking/latching mechanisms Requirements for finger entrapment hazards associated with circular holes in rigid materials Requirements for scissoring, shearing, or pinching hazards Monofilament threads shall not be used No flammable solids as defined within 16 CFR (c)(6)(vi) Performance Requirements Structural integrity requirements Static load test Dynamic load test Restraint system test Occupant retention test Marking and Labeling Requirements All Sling Carriers shall comply with the specified requirements for warning statements on the product, packaging, and within the instructional literature. 11 NEWSBYTE: CPSC issues revised Final Rule for 16 CFR 1130, Requirements for Consumer Registration of Durable Infant or Toddler Products On February 17, 2012, the revised Final Rule for 16 CFR 1130, Requirements for Consumer Registration of Durable Infant or Toddler Products was published in the Federal Register. The amendment addresses interpretation issues with the original Final Rule that became effective in The changes were reported in a Bureau Veritas Bulletin released in August Not previously included in the Bulletin was the acceptance of a bar code on the registration code at a manufacturer s discretion. 12 NEWSBYTE: AAFA Updates Restricted Substances List (RSL) The 10 th version of The American Apparel and Footwear Association (AAFA) restricted substances list (RSL) has been published. Updates in this version include the addition of 18 chemicals to appendix I, which lists chemicals that are associated with reporting laws, as well as other minor administrative changes. The practical quantification limits (PQL) defined in a guidance document issued by Washington State for their Children s Safe Product Act reporting law have also been added to appendix I. 13 The US State of South Carolina recently amended the existing ban on phosphates in cleaning agents On 6 March 2012, the State of South Carolina enacted ACT 120, which amended the existing laws (Section , Code of Laws of South Carolina, 1976) governing phosphates in cleaning agents. This amended law now includes certain household cleaners, which includes dish detergents as well as commercial laundry. 16 Environmental Protection Agency Proposes New Toxic Substances Control Act (TSCA) Rules The Environmental Protection Agency (EPA) has proposed changes to Toxic Substances Control Act (TSCA) regulations. The proposed changes are related to the significant new use reporting requirements for five chemicals. These chemicals include polybrominated diphenylethers (PBDEs), benzidine dyes, short chain chlorinated paraffins (SCCP), hexabromocyclododecane (HBCD), and phthalate di-n-pentyl phthalate (DnPP). The EPA will accept comments on these proposed rules until June 1, Proposed Rules Would require manufacturers, importers, and processors of these chemicals to report any new uses to the EPA 90 days prior to manufacturing, importing, or processing them. Would require manufacturers and importers of products that contain PBDEs, benzidine dyes, and HBCD to report any new uses to the EPA 90 days prior to manufacturing or importing them. Important note: any product containing benzidine dyes would be considered a new use and any consumer textiles, other than motor vehicle upholstery, containing HBCD would be considered a new use. On April 27, ANMAT issued a new order (2268/2012) that allows companies 180 days to make necessary adjustments to meet the requirements of the ban. During this period companies may sell baby bottles containing bisphenol A that have a label with the following warning statement: Atención: No caliente alimentos dentro de este biberón. Deje entibiar los alimentos calientes previo a su llenado. Reemplace este biberón cuando presente desgaste (rayones, grietas, pérdida de color). 21 ASTM International Publishes New Standard for Baby Monitors In May 2012, ASTM International, formerly known as the American Society for Testing and Materials (ASTM), announced the publication of a new safety standard for Baby Monitors. The new standard, designated as ASTM F , provides safety and labeling requirements for Baby Monitors. Introduction This safety specification was developed in response to data collected by the CPSC and it attempts to minimize hazards associated with Baby Monitors including strangulation to children as a result of entanglement within the monitor cord. The safety specification requirements are amenable to corded audio and video monitors as well as motion sensor baby monitors. The safety standard for Baby Monitors sets forth the following requirements: General Requirements No hazardous sharp points or edges Appropriate warning labels dependent on the monitor type o Corded monitors intended to be attached to a crib o Corded monitors not intended to be attached to a crib Any paint or surface coating must comply with 16 CFR 1303 No flammable solids as defined within 16 CFR (c)(6)(vi) Warning label permanency requirements Toy accessories shall meet ASTM F963 Marking and Labeling Requirements All Baby Monitors shall comply with the specified requirements for warning statements on the product, packaging, and within the instructional literature. 22 Mexico Finalizes New Heavy Metals Requirements for Children s Items In 2010 the Mexican government proposed more stringent heavy metals requirements for toys for children under 12 years old and preschool materials for children 6 years of age and younger. These requirements have been finalized and are scheduled to become effective as of August 13, Definitions Preschool materials - Materials used as an aid in teaching with the aim of developing certain skills and abilities specific to preschool age children (no older than six years of age), which have a colored component or material, such as graphite and color pencils, erasers, crayons, glue, blunt scissors, clay, watercolors, markers, chalk, abacus, pencil sharpeners, etc. Toy - A product or material designed, intended and manufactured for use in a game or for entertainment, which may be used or enjoyed actively or passively. Lead Requirement Scope - Toys for children under 12 years old and preschool materials that pose a risk of being sucked, licked or swallowed. Limit - 90 mg/kg soluble lead. Other Heavy Metals Requirements Scope - Toys for children under 3 years old and preschool materials that pose a risk of being sucked, licked, or swallowed. 23 CPSC Issued a New FAQ Regarding Drawstrings in Children s Upper Outerwear On July 19, the Consumer Product Safety Commission (CPSC) posted a new FAQ on their website which provides some clarifications to the current drawstring requirements of ASTM F and 16 CFR Background: Last year, on July 19, 2011, the CPSC published a final rule, stating that children s upper outerwear garments which have neck or hood drawstrings (in sizes 2T to 12), and those which have waist or bottom drawstrings (in sizes 2T to 16) that do not meet the criteria of the previously voluntary standard, ASTM F , Standard Safety Specifications for Drawstrings on Children s Upper Outerwear, present a substantial product hazard. The new rule, 16 CFR 1120, became effective on August 18, CFR 1120 included some points in addition to that included in ASTM F , such as: The definition of a drawstring is a non-retractable cord, ribbon, or tape of any material to pull together parts of outerwear to provide for closure. This definition considers ties to be drawstrings, as well as traditional tunneled drawstrings. Size equivalents for garments that are sized under S, M, L sizing system are as follows: Girls and Boys sizes Large (L) are equivalent to size 12. Girls and Boys sizes Extra-large (XL) are equivalent to size 16. The apparel industry raised questions with the CPSC following finalization of the rule. The FAQ clarified several other points as well. The most noteworthy are as follows: Definition of upper outerwear: In addition to clothing, such as jackets and sweatshirts, generally intended to be worn on the exterior of other garments, the CPSC clarified that lightweight outerwear that is appropriated for use in warmer climates is also included. Underwear, inner layers, pants, shorts and skirts are excluded from the definition. The CPSC reiterated that ties are included in their definition of drawstrings. It was clarified that belts are not included in the scope of the drawstring rule. Definitions of "non-retractable" and "fully retractable" were addressed. The CPSC listed additional requirements for children s upper outerwear which are required by the Consumer Product Safety Improvement Act of 2008, as follows: o Lead in surface coatings o Total lead content o Testing and Certification o Tracking Labels The CPSC also provided the legal rationale behind creating a list of substantial product hazards, as permitted under section 15(j) of the CPSA.
