4 Course: BUS 250 (Contemporary Legal Issues for Business) Distribution Area: Social Sciences Rationale for Distribution Designation and Alignment of Outcomes with Distribution Designation: Contemporary Legal Issues for Business (Business Law) focuses on judicial and non-judicial dispute resolution processes and institutions in the business arena. Many of the concepts also apply to nonbusiness settings. The formal and social structure of dispute resolution techniques, including the court system on the federal and state level, as well as alternate dispute resolution, address individual and collective human interactions in various situations. From resolving simple disagreements to very complex issues, such as privacy rights under the constitution and labor collective bargaining agreements, the course provides a solid background in dealing with fundamental legal and ethical issues. In addition to dealing with dispute resolution, the course stresses appropriate legal and ethical considerations to help avoid dysfunctional illegal behavior which can result in invoking criminal processes and civil dispute resolution. Learning Outcome: Participate in dialogue that involves respectful and careful listening Narrative: The course involves several negotiation exercises through the term. These facilitate respecting the views of others so that the class overall arrives at a common ground. Further, the course has several cases, and the analysis of these involves a back-and-forth discussion of the two or more sides of issues in these cases. Assessment tools: Negotiations exercises, case analyses Learning Outcome: Demonstrate knowledge of culture and the arts, social structure and process, and the physical and natural world Narrative: Law is a social contract between citizens and the application of law are the very processes of functioning in society to the benefit of the greater good. Every class discussion and assignment addresses the social contract in one way of the other. Assessment tools: Class discussions Learning Outcome: Apply knowledge complex issues such as social justice, globalization, economic growth and distribution, environmental sustainability, public health, etc., in increasingly broad spheres of influence Narrative: Students cover state, federal and global issues, from local zoning ordinances, to World Trade Organization decisions. One example is outsourcing and foreign direct investment abroad and their impact not only on domestic workers but also on foreign labor, child labor, and the companies and economies of both the home and foreign countries, applying concepts of the law to the differing treatments of workers and investors. Assessment tools: In a negotiation exercise, students acting as employer and employees must reach consensus on a collective bargaining agreement with many real life issues "on the table". They are assessed on their ability to reach mutually-acceptable contract terms while addressing each area of multi-faceted concerns, using give-and-take techniques. Learning Outcome: Use of multiple perspectives and methodologies to analyze real or hypothetical problems. Narrative: Real and hypothetical problems are addressed from multiple economic, social, and cultural perspectives, from comparing legal systems globally to discussing whether corporations should continue to exist to contemporary issues, such as unions versus right to work laws. Assessment tools: On the macroscopic level, students compare various legal systems on various topics. On the microscopic level, they present and evaluate different points of view that can be brought to bear on particular legal problems, such as whether a contract exists based upon a specified set of facts. The facts are varied to explore changing possibilities of interpretation. Student assessment includes brief

5 essays and class discussion on various fact patterns, to determine if theories are properly being applied to facts. Written examinations similarly measure the application of theory to facts, the identification of the operative issue(s), and the rationale for applying a specific theory to a scenario. Learning Outcome: Investigate the nature of citizenship Narrative: The very basis of democracy is its laws, starting with constitutions. Students in this course learn about the US constitution and the competing forces at work when a law, including constitutional amendments, is proposed, and the drawing of a balance between the forces. Assessment tools: Students are assessed using class interaction and testing on their understanding of the goals and operative systems of a democracy. They compare democratic methods and institutions with those of non-democratic nations in general and in particular areas of the democratic societal contract between the people and the government, such as the taking of private property for public use.
