General Terms and Conditions and prices The General Terms and Conditions and the cell phone business price lists of Telekom Deutschland GmbH shall apply to the contract. These can be found online at Telekom Deutschland GmbH charges the future contract partner a one-time fee of 16,76 Euro plus value added tax per single contract. The contract can not be terminated before the expiry of the minimum contract period. If I cease to meet the conditions for the use of mobile services for business customers, I agree that the present mobile communications contract should be transferred into a valid cell phone private customer tariff, subject to the relevant General Terms and Conditions and price lists, that corresponds to the current tariff. Previous framework conditions shall no longer apply. Existing CombiCards to this contract are likewise taken over by me. The price list is valid also here for the existing CombiCards. 2. Credit rating IIn accordance with Items 1 through 3 in the Annex to the data protection notes, I hereby give my consent to Telekom Deutschland GmbH to pass on my personal data for the purpose of running a credit check to the following external credit reference agencies and to receive data from said institutions: from infoscore Consumer Data GmbH, Creditreform e. Annex: Take-over of a fixed-network number (exclusively in conjunction with the fixed network number/t-mobile@home option) Cell phone no. 0 1 Cell phone SIM REQUIREMENT ADDITIONAL COMPULSORY REQUIREMENT EXAMPLES - Take-over of a fixed-network number is only possible in connection with the change of an existing line s owner (e.g., request to take over a mobile fixed-term contract). - The fixed network number/t-mobile@home option shall be retained. - The fixed network operator shall be retained. - The fixed network number may only be taken over if the address data of the requested fixed- network number or T-Mobile@home area matches the existing area code. The principle of identification via the call number shall be used when deciding whether the transfer of the right to use a number (number transfer) is at all possible. This means that a person shall already be identified by an existing call number for an existing line. The previous line owner must have given up the right to use the number, and the network operator must have written evidence of this, and the person who would like to take over the right of use must be the owner or customer of a line to which the number can be transferred, and the number must be available at the network operator from which the person requesting the right of use obtains his/her line. - Married couples, individuals sharing a home and cohabitants, provided they inhabit a shared home with the previous line owner, may completely take over the line, including the number. - For changes between private and business lines at the same location (home): In the case of people who work at home (e.g., home-based teleworkers or field service employees), the line, at the same location and along with the number, may be taken over by the employer or business or vice versa. - In the event of a take-over of an existing commercial trade (business of a sole proprietor or trading company) due to a sale, inheritance, other legal succession or continuation of a company based on a beneficial interest or a lease agreement, the line and the numbers may be taken over by the new owner or lessee. There shall be no legal entitlement to take over the number(s). 6 LIFE IS FOR SHARING. Notes on data privacy for landline or mobile telephony contracts 1 General Deutsche Telekom attaches great importance to protecting your personal data. We inform you what personal data we collect, how your data is used and which options you can exercise. These notes on data privacy provide answers to the most important questions. 2 What data is collected and how is it used? We collect and use the following data, as necessary, in order to provide the agreed services and for billing purposes: - Contract data: The so-called contract data is data which you pass on to Telekom for provision of the agreed services. It includes data such as your name, address, date of birth, phone number and e- mail address. Information regarding the payment process, billing data (without individual traffic or usage data) and, for password-protected services, a user name and password also come under the heading of contract data. - Traffic data and content: This is the data and content that is produced when you use your Telekom line. This always includes the phone number or ID of the line calling and the line being called and the service/connection type used. If necessary, and depending on your chosen rate, we use the start and end time of a connection and also the data volume transferred. For mobile telephony, we also record the mobile card number and device number, and, if the Internet is used, the local dial-up node. Your traffic data is recorded in full. You may request that the numbers called be shortened by the last three digits after the bill is sent. Please note, however, that then your full connection data will no longer be available for use as evidence if you have objections against the costs shown in your bill. We collect data regarding incoming connection attempts and messages only as part of a relevant service, e.g. a mailbox application. We save message content itself only if you ask us to do so, for example, for SMS or MMS messages. We also use your data for legal purposes, in particular exposing misuse and identifying/rectifying faults in our network. We do not use your data for any other purpose, unless you have given express permission for us to do so. 3 What other data is used when I use Entertain and Entertain to go? In order to be able to provide and bill Entertain services, our servers and your Media Receiver need to exchange specific authorization and usage information. We store details about which Entertain services we may provide to you at a given point in time or which content you are still allowed to play. This storage covers the delivery of TV programs (Free TV/Pay TV), on-demand and premium content (Videoload, TV Archive) as well as the content you have recorded. To improve the Entertain offering for our customers, we employ usage data. Usage data includes information about the Entertain functions you use, e.g., content accessed (VoD, live TV, recordings), when you turn Entertain on and off and when you switch channels. This usage data is also pseudonymized and aggregated into statistics. Statistical analysis of usage data is carried out anonymously, meaning it is not possible to trace the data back to individual customers/set-top boxes/entertain to go applications on a smartphone, tablet, PC. You can object to the analysis of your usage data at any time. To do this, disable the collection of usage data under "Settings > User Account > Data Protection" in the menu of the Media Receiver. If you would like to use Sky offers via Entertain, you need to conclude a separate contract with Sky Deutschland GmbH & Co. KG in addition to your Entertain package. We then collect and use your data from the Sky contract on behalf of Sky, to give you access to the channels you have ordered. If your Entertain contract is terminated, we will inform Sky that your Sky activation with us will end. 4 What other data is used when I use joyn? Whenever you set up joyn, select a contact or use a joyn service, a check will be made to determine which joyn services are available at your location. Your particular location data will be used for this purpose. In order to protect your message content in the best way possible, we recommend that you use joyn via the mobile phone network as this ensures end-to-end encryption. If you use joyn via WLAN, your connection ID will be encrypted but not your message content. 5 How long will my data be stored? - Contract data: We will delete your contract data at the end of the calendar year following termination of the contract. If, for example, your contract ends this year, the data will be deleted at the end of the coming year. Contract data will only be stored for longer periods if there are outstanding obligations relating to the contract (debts, objections etc.). - Traffic data: Traffic data required for billing purposes will be deleted from our billing systems 80 days after a bill is sent out. If you use other providers' networks, for example, when making calls abroad, and we need to exchange data with these providers for billing purposes, this data will be deleted within the legal deadline of six months. Your traffic data will only be stored for longer periods if there are outstanding obligations relating to the contract (debts, objections etc.). Any data which is not relevant to billing will be deleted after seven days. - Message content: You yourself can delete SMS/MMS messages, s, buffered or saved voice messages and other message content which are saved on storage media provided by us, for example, in the Center or on your SIM card. Alternatively, the data will be deleted as agreed for the particular service. - Data for exposing misuse or identifying faults Data which we use for exposing misuse and identifying/rectifying faults will be deleted after a maximum of seven days. Further information on our maximum storage periods can be found at 6 Will my location data be stored? Your mobile phone location data will be stored for seven days in order for us to be able to expose misuse and identify/rectify faults. We will only store your location data for other purposes if this is necessary in order to provide an agreed service. 7 Does Telekom store my IP address and details of my use of the Internet? We will store your IP address for seven days after a connection ends in order for us to be able to expose misuse (spam, viruses, worms etc.) and identify/rectify faults in our network. We do not store details of your use of the Internet. 8 What data is used to measure the data volume I have used? Only information regarding the data volume you have used is stored. This is determined with the help of a totalizing counter. We need this data in order to determine when you have used up your contractually agreed inclusive data allowance. 9 Will my data be used for advertising or market research purposes? If you have given your consent, we will use your contract data for your individual customer consultation, for advertising and for market research purposes. If you have given your consent, this will apply to your current and future contracts. It will apply until the end of the calendar year following the termination of your contract with us. You may revoke this consent at any time. You may also limit withdrawal of your consent to individual methods of contact. 10 Where is my data processed? As a general rule, Telekom processes your data in Germany. Data will only be processed abroad in individual cases and in line with legal provisions. 11 Does Telekom pass on my data to third parties, e.g. the authorities? Certain data must be passed on in accordance with strict contractual and legal regulations: This translation is intended solely for informational purposes; the original German text shall be legally binding. 1 2

7 Notes on data privacy for landline or mobile telephony contracts - To partner companies: If partner companies come into contact with our customers' personal data, this occurs only as part of so-called commissioned data processing as set out explicitly in the relevant legislation ( 11 of the German Federal Data Protection Act (Bundesdatenschutzgesetz)). In such cases, Telekom will remain responsible for protecting your data. When working with your data, the partner must follow our instructions at all times. To ensure that this is the case, we have put in place strict contractual regulations, the partner has to ensure strict technical/organizational measures and we conduct corresponding checks. - Owing to legal requirements: In certain cases, we are legally obliged to pass on contract or traffic data if requested to do so by a state body. Upon presentation of a corresponding court order, we are obliged under 101 of the German Copyright Act (Urheberrechtsgesetz) to provide the owners of copyrights/ancillary copyrights with information about customers who have allegedly offered copyrighted works via Internet file sharing services. In these cases, our information contains the user ID of an IP address assigned on the requested date/time as well as the customer s name and address. We do not pass on your data to third parties for any other purpose, unless you have given express permission for us to do so or as provided by law. 12 Does Telekom cooperate with credit reference agencies, e.g. Schufa? Yes, Telekom works with established credit reference agencies for the following purposes: - Telekom carries out a creditworthiness check if it provides services which are not billed until later on. To check your creditworthiness, we use your address data and payment history from existing contracts. With your consent, we also obtain information from credit reference agencies if necessary. - If you fail to meet your contractual obligations adequately, we will pass on corresponding information to credit reference agencies. We will, of course, observe the strict legal requirements when doing so ( 28a of the German Federal Data Protection Act (Bundesdatenschutzgesetz), Weighing of Interests). You will find details of the credit reference agencies we work with in the appendix to these notes on data privacy. 13 How does the calling line identification presentation work? If you have requested that you be entered in a telephone directory (e.g. phone book), your line will be configured to display your number to the called party. If you have chosen not to be entered, your number will be displayed only if you have specifically requested this. Should you wish to suppress line identification on a permanent or temporary basis, you will find information on the relevant settings in the operating manual for your phone. With a mobile phone, you can withhold your number for an individual call by entering #31# prior to dialing. With SMS messages or joyn chat messages, the calling line identification always appears within the text message or the joyn chat message for technical reasons. 14 Can I receive itemized bills? Yes, if you request itemized billing, you will in future receive an overview of the chargeable calls you have made. This overview enables you to check your bill. Itemized billing for flat rates is not possible. 15 Will my data be used for communication directories (e.g. phone books) and directory assistance? We will use your data for printed and/or electronic directories and for directory inquiry services if you instruct us to do so. You yourself can determine what data is published. If you do not object to the data published being used for so-called reverse lookup purposes, directory inquiry services can give your name and address to anyone who gives your phone number when making an inquiry. We are required to pass on the permitted data to other companies which publish publicly accessible directories or provide directory inquiry services. You can object at any time to your data being used for the purposes described above in the future. 16 What data is used for anonymized data analysis? In line with legal requirements, Deutsche Telekom only uses your data for analysis either if you have given your consent to this, or if the data is in anonymized form, which means that it would be impossible to identify you from the data. Deutsche Telekom anonymizes mobile communications data that is aggregated and provided to Motionlogic GmbH, a Deutsche Telekom subsidiary. Motionlogic GmbH uses the anonymous data to create projections of traffic flows, for example. This analysis of anonymized data involves methods and technology that are often summarized under the blanket term "big data." Three contract attributes are used for the data analyses: - Age group (in ten-year bands) - Gender - Zip code (the first four digits) In line with statutory data protection and data security requirements, Deutsche Telekom is also offering you an additional, voluntary option: You can object to the anonymization of the contract attributes. This data will then not be passed on to Motionlogic GmbH, including obviously not in the form of plain text. You will find the process for objecting here. or you can obtain it from our hotline: (from within Germany) 17 Can I receive information on my stored data? Can I have incorrect data corrected? You may request, free of charge, information on the scope, origin and recipient(s) of the stored data as well as the purpose of storage. You may also demand at any time that incorrect data be corrected. 18 Where can I find further information regarding data protection at Telekom? 8 LIFE IS FOR SHARING. Annex to the notes on data privacy (credit reference agencies) 1 SCHUFA clause relating to Telecommunications Agreements. I/we hereby consent to the Telekom forwarding to SCHUFA Holding AG, Kormoranweg 5, Wiesbaden, Germany, data about the application, start and end of this telecommunications contract, and further consent to it receiving information about me/us from SCHUFA. Irrespective thereof, the Company may also forward to SCHUFA information about its claims against me/us for outstanding invoices (claim amount according to name). This is permissible in accordance with the German Data Protection Act (section 28a, subsection 1, sentence 1) if I/we have not paid the due amount irrespective of the fact that it has fallen due for payment, if the forwarding is necessary to safeguard justified interests of the Company or third parties, and if - the claim is enforceable or I/we have expressly acknowledged the claim, or - after the claim fell due for payment, I/we received at least two written reminders, and the Company has informed me/us in good time, at the earliest, however, by way of the first reminder, of the pending forwarding after four weeks at least, and I/we did not dispute the claim, or - the contractual relationship that forms the basis of the claim may be terminated without notice by the Company on the basis of payment arrears, and if the Company has informed me/us of the pending forwarding. Furthermore, the Company shall also forward to SCHUFA data about other conduct that is not as per agreement (e.g. account or credit card misuse or other fraudulent acts).
