2 Directions for Bid Submission 1. On envelope containing sealed bid: a. Print your company s name in upper left corner b. In lower left corner print Sealed Bid: June 8, 2016 Demolition of Three County Owned Structures 2. The successful bidder shall be required to submit a performance bond or certified check in the amount of 100% of the bid price. The performance bond is due in the office of the County Treasurer within 10 days of receipt of the award letter and will be returned upon completion and acceptance of the project. 3. Non-Collusive Bidding certificate shall accompany each bid. 4. The Allegany County Department of Public Works will receive sealed bids until 10:00 a.m., June 8, At that time bids will be opened in Room 210, County Office Building, Belmont, New York. 5. Specifications may be obtained online at or at the Allegany County Department of Public Works office, Room 210, County Office Building, Belmont, New York. 6. To be considered formal, bids must be submitted on enclosed bid submission sheets. 7. Bids received after the specified time opening will not be considered and will be returned unopened. 8. Allegany County Department of Public Works reserves the right to reject any or all bids and award the bid it determines to be in the best interest of the County. 05/23/2016 Page 2 of 12

3 Project Specifications A. Demolition of Structure 1. Allegany County is soliciting bids for the demolition of 3 structures located at 135 Howard Street, 213 East State Street and 249 East State Street all in the Village of Wellsville, New York. 2. Pre-demolition asbestos surveys were conducted in April, 2016 and it was determined that the 135 Howard Street location does not contain asbestos but both East State Street properties do contain asbestos. The surveys are available for inspection in the Department of Public Works office. 3. The County will require that the buildings be demolished pursuant to New York State Department of Labor Code Rule 56, Section The condemnation letter shall be forwarded to the successful bidder by Allegany County. 4. It is the responsibility of the bidder to inspect the site prior to submitting their bid. Arrangements for an accompanied site visit, if desired, can be made by calling the Allegany County DPW at B. Scope of Work 1. Successful bidder shall demolish all buildings (sheds, out buildings, foundations, etc.) at each location and remove all debris (including but not limited to tires, vehicles, concrete, etc. etc.) from the site using containers and vehicles suitable for each project. 2. All debris shall be delivered to a New York State permitted disposal facility that can accept such material. The Allegany County Landfill cannot accept any material and therefore an alternate facility must be located. 3. Successful bidder will be responsible for traffic control if necessary as well as any damage to adjacent structures or property. 4. Successful bidder shall leave site in a level, graded condition. Any gravel or topsoil that will be used must be included in the bid price. 5. The County will pay the successful bidder the bid price in one lump sum, per structure after project completion and acceptance by the County for the services contracted herein. 6. Successful bidder is responsible for obtaining all necessary permits, licenses, approvals etc, for carrying out the scope of work described herein including all utilities (private or public). 7. The County will obtain the permits from the Department of State for the demolition of each of the buildings. 05/23/2016 Page 3 of 12

4 8. All work must be completed by Friday, September 2, Bids must be all inclusive (i.e. labor, materials, disposal, transportation, permits, etc.). C. Special Conditions 1. Bidders must be a New York State Licensed Asbestos Contractor and all employees used during the actual demolition must be appropriately certified. Proof of such must be submitted with bid proposal. 2. The successful bidder shall perform in accordance with all applicable Federal, State and Local Laws, rules and regulations. All statutory provisions applicable to this project are hereby incorporated by reference. Successful bidder is also responsible for obtaining all applicable permits and licenses and shall be solely responsible for paying any fines or penalties incurred during the performance of this project. 3. The following condition applies to the two properties on East State Street: Allegany County is required by law to obtain a 3 rd party firm for air quality monitoring (AQM). a. Once the successful demolition contractor is notified, the contractor will call the AQM to coordinate and submit all information and documentation paperwork to the NYSDOL. b. There will be a 10-day waiting period before demolition can begin. During that 10 day period, the AQM will perform pre-demolition background air quality monitoring at the properties. Also, during that time the demolition contractor will let the AQM know when the start date of the demolition will be. c. The AQM will perform monitoring services every day during demolition. d. The County is requesting that each bidder, as closely as possible, list the maximum number of days anticipated to complete the demolition job, including all debris removal. D. General Conditions 1. Insurance: The Successful bidder shall secure and maintain at his own expense, insurance coverage as specified in Allegany County Standard Insurance Requirements, contained herein. The County shall be provided a certificate of insurance naming Allegany County as an additional insured as well as stating that Allegany County be given thirty (30) days notice prior to non-renewal or cancellation of policies. 2. Assignment: The successful bidder shall not assign, transfer, sublet or otherwise dispose of the contract, or of its right, title or interest, or its power to execute the same, to any other person or corporation without the previous consent, in writing, of Allegany County. An assignment of the contract shall not relieve the assignor of his obligations hereunder. In the event of assignments, all the provisions herein shall be binding upon and inure 05/23/2016 Page 4 of 12

5 to the benefit of the respective successors and assignees to the same extent as if each such successor or assignee were named as a party to the original contract. 3. Hold Harmless: Successful bidder agrees to the fullest extent permitted by law, to indemnify, hold harmless and defend the County of Allegany, its agents, employees or any other person against loss or expense, including attorney s fees, by reason of liability imposed by law upon the County, except in cases of the County s negligence, for damage because of bodily injury, including death at any time resulting therefrom sustained by any person or persons, or on account of damage to property arising out of or in consequence of, the performance of this contract. 4. Governing Law The terms of the contract shall be governed pursuant to the laws of the State of New York. 5. Performance Bond The successful bidder shall be required to submit a performance bond or certified check in the amount of 100% of the bid price. The performance bond is due in the office of the County Treasurer within 10 days of receipt of the award letter and will be returned upon completion and acceptance of the project. 05/23/2016 Page 5 of 12

8 HOLD HARMLESS CLAUSE The agent shall at all times defend, indemnify and hold harmless the County of Allegany and its employees from any and all claims, damages or judgments or for the defense or payment thereof, based on any claim, action or cause of action whatsoever, including any action for libel, slander or personal injury, or any affiliated claims, by reason of any act or failure to properly act on the part of Agent and in particular as may arise from the performance under this contract. Such obligation to the County shall not be construed to negate, abridge or reduce other rights of indemnity which would otherwise exist. This provision shall supersede any other provision in this Agreement deemed to be in conflict, unless specifically stated otherwise. In the event of an injury by the subcontractor or its employees, they shall cause notice to be served upon the County within twenty-four (24) hours of any such injury. 9 ALLEGANY COUNTY STANDARD INSURANCE REQUIREMENTS Insurance shall be procured and certificates of Insurance delivered to the County Attorney s Office, the County department responsible for the agreement, and the Clerk of the County Board of Legislators prior to commencement of work or delivery of merchandise or equipment. The Certificates of Insurance shall be made to the County of Allegany, County Office Building, Belmont, New York must comply with all coverage specifications of the contract; and must be executed by an insurance company and/or agency or broker licensed by the Insurance Department of the State of New York. The ACCORD form certificate may be used, provided the following two additions are added to the form verbatim: Policy A. ACKNOWLEDGMENT: The insurance companies providing these coverages acknowledge that the named insured is entering into a contract with Allegany County in which the named insured agrees to defend, hold harmless, and indemnify the County, its officials, employees and agents against all claims resulting from work performed, material handled and services rendered. The contractual liability coverage evidenced above covers the liability assumed under the County-Contractor agreement. B. Prior to non-renewal or cancellation of these policies, at least thirty (30) days advance written notice shall be given to Allegany County Attorney s Office and the County Department requesting this certificate before such change shall be effective, except that five (5) days advance written notice shall be sufficient for Certificates from the State Worker s Compensation Fund.
