2 VILLAGE OF FLORIDA RESOLUTION Termination of Hometown Online, Inc.'s Authority to Provide Cable Television Services on June 28, 2012 INTRODUCED BY: Trustee \SLa I-k n1 SECONDED BY: Trustee 0,~ l:> f,; " DATED: 0~t\tb.z." ~,201l At a meeting of the Village Board of Trustees of the Village of Florida, State of New York ("Board") held on the '1f\-day ofl\k.~h~,2011: WHEREAS, by agreement dated January 14,2002 (the "Agreement") the Village of Florida, New York ("Village") agreed to grant a cable television franchise within the Village to Hometown Online, Inc. ("Hometown"), a subsidiary of Warwick Valley Telephone Company, which agreement was approved and made effective by order of the New York Public Service Commission dated November 19, 2002; and WHEREAS, the franchise granted pursuant to the above agreement was for a period of ten (10) years from the effective date; and WHEREAS, Hometown has submitted a request to the Village of Florida for consent to terminate its cable franchise effective June 28, 2012; and WHEREAS, the Board has the requisite authority to agree to such tennination; and WHEREAS, the Board has considered the request of Hometown in this matter NOW, THREFORE, BE IT RESOLVED, that the Village of Florida consents to the termination of the Agreement and the franchise granted thereunder effective as of June 28, 2012 contingent upon Hometown providing notice of said termination that provides information on other subscription television providers available to its customers, with a copy to the Village Clerk no later than thirty (30) days from the date of this resolution, which notice shall be deemed complete upon sending such notice via first class mail to each customer billing address.
