DECISION. Single Registry of Legal Entities Transaction Accounts in. Bosnia and Herzegovina. Article 1

1 Herein we put out of force the revised text of the Decision on the Single Registry of Transaction Accounts in Bosnia and Herzegovina, /10 as of May 27, 2010 (published in Offical Gazette of BH, 48/10) On the basis of Article 58 and Article 70 of Law on the Central Bank of Bosnia and Herzegovina (Official Gazette of BH ", No. 1/97, 29/02, 13/03, 14/03, 9/05, 76/06 and 32/07) and the Article 52 of the Central Bank of Bosnia and Herzegovina By-Law, GB, No:120/05 dated June 29, 2005, 100-GB No: 66/10 dated 29 April, 2010 and 100-GB No: 130/11 dated 30 March, 2011, the Governing Board of the Central Bank of Bosnia and Herzegovina on its ninth session as of 31 October 2011, passed the DECISION on Single Registry of Legal Entities Transaction Accounts in Bosnia and Herzegovina Article 1 By this Decision, the Central Bank of Bosnia and Herzegovina (hereinafter: the Central Bank), in order to improve the payments systems and settlement system, establishes a Single Registry of Transaction Accounts of the legal entities that carry out the payments in Bosnia and Herzegovina through the transaction accounts in commercial banks (hereinafter referred to as the Single Registry of Accounts in BH). In order to establish the Single Registry of Accounts in BH, this Decision shall regulate the running and contents of the Single Registry of Accounts in BH, and the users and the way of using the data from the Single Registry of Accounts in BH. Article 2 Legal Entities performing the payments systems operations in Bosnia and Herzegovina through the commercial banks transaction accounts (hereinafter: bank) in terms of this decision are legal persons, authorities, judiciary and administration bodies at the state level of Bosnia and Herzegovina, bodies of entities authorities, judicial system

2 and administration bodies, authorities, judiciary and administration bodies of Brčko District, the cantonal authorities, the judiciary and administration bodies of these, the city authorities and municipal authorities, judiciary and administration bodies of these and other entities subject to the granting of Unique identification number. Transactions Account in terms of this Decision is each account opened by a legal entity with a commercial bank and the Central Bank, which serves to carry out payment transactions in Convertible Marks (hereinafter referred to as KM). Transaction accounts in terms of this Decision and pursuant to the positive legislation, is not the account open for special purposes. Article 3 The Single Registry of Accounts in BH is established and run by the Central Bank. The Central Bank runs the Single Registry of Accounts in Bosnia and Herzegovina as the data file on accounts of legal entities from the Article 2, Paragraph 1 of this Decision, subject to the granting of Unique identification number. Along with the data for the data file of the accounts of legal entities from the paragraph 2 of this Article, banks deliver to the Central Bank also the data in the short format on UINC (Unique Identification Number of Citizen), number and the activity of the account for the entities for which they open the transaction accounts, and which are not the legal subjects in terms of this Decision, without the possibility of the identification of the name of the account holder. These data are necessary to the Central Bank in order to have functional the program solution of the Single Registry of Accounts in BH, without the possibility of creating the report and the data distribution. Article 4 Bank and Central Bank deliver the following information into the Single Registry of Accounts in BH, for each transaction account of legal entity that they run: 1. Unique identification number of an entity (13 characters) The unique identification number of the subject-holder is entered in the sequence and without the space. 2. Account Number (16 characters)

3 The account number of a legal entity is entered. The account number is entered in the sequence, without spaces and special characters such as hyphens, slashes, full stop, etc. 3. A bank name (64 characters) Name of the bank where an account is opened. 4. IBAN code (4 characters) IBAN account extension. While the IBAN is not implemented, it is filled with blanks. 5. Tax number (8 characters) Tax number of the account holder. 6. Name of a legal entity company (up to 100 characters) We enter the name of the company referred to in the Official Decision on entry in the Registry or referred to in some other relevant document. 7. Organizing form of a legal entity (2 characters) We enter the numerical mark from the Information on Classification according to the Standard Classification of Economic Activities from the Bureau of Statistics of the Federation of Bosnia and Herzegovina, Republika Srpska and Brčko District of Bosnia and Herzegovina (FBH, RS and BDBH): The organizing form of legal entity, subject to the granting of the Unique identification number, is entered according to the Book of Codes provided by the Central Bank. 8. Activity of the legal entity (6 characters) We enter the numerical mark of the activity- activity code according to the Standard Classification of Activities under the relevant document. For the individual entrepreneur we enter the activity on the basis of the Official Decision of the competent authority. 9. Ownership type of a legal entity (1character)

4 The mark is entered according to the Book of Codes provided by the Central Bank. 10. Mark of territorial-political unit (1character) We enter a numerical mark for the territorial-political unit: Bosnia and Herzegovina, Republika Srpska, Federation of Bosnia and Herzegovina and Brčko District of Bosnia and Herzegovina, according to the Book of Codes, which is provided by the Central Bank. 11. Canton (3 characters) We enter the numerical mark of the canton in which the headquarters of a legal entity is placed, according to the Book of Codes, which is provided by the Central Bank. 12. City or Municipality (5 characters) We enter the numerical mark of the city or municipality where the headquarters / residence of the legal entity is placed, or numerical mark of cities and municipalities, which is prescribed by the competent authority, according to Book of Codes, provided by the Central Bank. 13. Postal Code (5 characters) Postal Code of the legal entity headquarters according to the Book of Codes which is provided by the Central Bank. 14. Headquarters of a legal entity/address of the account holder (64 characters) Address of the legal entity headquarters. We shall specially record the address of the owner when it comes to other entities subject to the granting of Unique identification number, as well as postal number of such entity. 15. Date of recording (8 characters) The date of the contract on the account opening is entered. 16. Date of activation (8 characters) Date of the first transaction in that account is entered. 17. Account status (1 character) We enter the code according to the pre-defined values provided by the Central Bank.

5 18. Date of an account status change (27 characters) We enter the date of the last change in the status of the account. The time of status change is entered only when an account blocking is in question. 19. Account type (2 characters) We enter it according to the Book of Codes which is provided by the Central Bank (legal person; budget beneficiaries; administrative body, a physical person - an independent businessman, etc.). 20. Type of a change (1 character) Mark of change type (N = opening, C = closing; U = change of status or of other account information). 21. Date of the account opening (8 characters) The date of an account opening is entered. In the first four spaces we enter a year, in the next two we enter a month and in the last two we enter a day (GGGGMMDD). 22. Account closing date (8 characters) We enter the date of an account closing. In the first four spaces we enter a year, in the next two we enter a month and in the last two we enter a day (GGGGMMDD). 23. Transferred from the account (16 characters) Number of old account, if the transfer was done from that account. 24. Transferred at the account (16 characters) Number of new account if the transfer is done at that account. 25. The Main Unit of the Central Bank (1 character) Mark for the Main Unit of the Central Bank (1 = Sarajevo, 2 = Mostar, 3 = Banja Luka, etc.) is entered by Book of Codes which is provided by the Central Bank.

6 Article 5 The data are delivered via telecommunications into the Single Registry of Accounts in BH. Article 6 A bank transmits the data from Article 4 of this Decision in the Single Registry of Accounts in BH every day from hours to hours. A business day is considered to be the business day specified by the Gyro Clearing Operational Rules of the Central Bank. A bank is responsible for the accuracy of submitted data and for the promptness in delivery of information in the Registry of Accounts in BH. The data in the Single Registry of Accounts in BH are updated with the data submitted by banks in the time defined in Paragraph 1 of this Article and they are available during the next working day. The Central Bank ensures and it is responsible for the identical information in the Single Registry of Accounts in BH as those which are submitted by the banks. Article 7 Data from the Single Registry of Accounts in BH can be used by the direct insight in the data via internet or in form of the individual reports. Direct insight in the data of the Single Registry of Account in BH is provided to the banks, the Central Bank, Banking Agencies and the users to whom the Central Bank issued the authorisation at the written request. The Distribution of data from the Single Registry of Accounts in BH, in form of the individual reports, is performed via the written requests sent to one of Central Bank Main Units or the banks to which the Central Bank of Bosnia and Herzegovina, at the submitted written request, issued the authorisation for data distribution, by the enactment of the Central Bank of Bosnia and Herzegovina Governor. In case the distribution of data from the Single Registry of Accounts in BH from the previous Paragraph is done by the Main Units of the Central Bank, the submission of the request and recuperation of data are done in person, by fax or . The Central Bank Main Unit, noticing the irregularities, i.e. data mistakes during the distribution of data from the Single Registry of Accounts of BH, shall initiate the

7 correction of these with the bank which delivered the data in the Single Registry of Accounts in BH. Article 8 For the services of using the data from the Single Registry of Accounts in BH, defined by this Decision, provided by the Central Bank, the users of data pay the fee in the amount defined by the Central Bank s enactment regulating the fee lists of the Central Bank. Article 9 The Central Bank can deny the right to users of the BH Single Registry of Accounts, as defined by this Decision, to use the data and to exclude each user, temporarily or permanently, in case the one is not adhering to the terms and conditions on use of the data regulated by this Decision, i.e. if it estimates that his/her continued use of data from the Single Registry of Accounts in BH could affect the operations of the Single Registry of Accounts in BH as a whole. The Central Bank can deny the right from the Paragraph 1 of this Article to the banks in case that banks do not update the data in time and accurately, i.e. they use the data contrary to the issued authorisation for the distribution of data from the Single Registry of Accounts in BH. Upon temporary exclusion of an user and the denial of data using rights from the Single Registry of Accounts in BH, from reasons mentioned in Paragraphs 1 and 2 of this Article, the Central Bank shall charge the user from this Article with the fee in the amount defined by the enactment of Central Bank, regulating the Central Bank fees list, when including the user again. Herein we authorise the Governor of the Central Bank to deliver the appropriate measure, upon the offense identification, with the special enactment in each individual case, for the data user who uses the data from the Single Registry of Accounts in BH contrary to the provisions of this Decision. The Central Bank delivers to the competent Banking Agency the enactment from the previous Paragraph on the measure of temporary. i.e. permanent exclusion issued to a bank. Article 10 Here in we authorize the Governor of the Central Bank to pass the regulations necessary for the functioning of the Single Registry of Accounts in BH, and those which specially

8 apply on the regulation process for data submission, data availability, setting the deadline for entry obligation to enter certain data types, way of the data usage, etc. Article 11 This Decision shall enter into force by the day of its publishing in Official Gazette of BH and shall be applied since 1 December Article 12 This Decision shall be published in «Official Gazette of FBH», «Official Gazette of Republika Srpska«and in «Official Gazette of Brčko District of BH«.
