For vehicles being transferred to Commerce, a completed new business application, providing the information necessary for Commerce to transmit data to the Registry of Motor Vehicles for each vehicle insured is required. 2. It is the responsibility of the producer of record to notify the former producer of the transfer of insurance. A. The notice must be signed by the producer of record for the new policy or the notice must be on the company s letterhead, if it is issued by the new insurer;
6 and B. The notice must bear the registry stamp of the new insurer. The stamp may be in electronic format. 3. When Commerce receives a Notice of Transfer of Insurer, Commerce will: A. discontinue coverage as of the date shown on a Notice of Transfer of Insurer; B. Compute the return premium, if any, as of the date shown on a Notice of Transfer of Insurer; and C. Notify the former producer, if any, of the transfer of coverage. No notice of cancellation is required. Rule 6. Out-of-State Garaging Added language: Any motor vehicle, whether owned by a resident or non-resident of Massachusetts for which Massachusetts registration is required, principally garaged outside of Massachusetts, will be written at limits of liability at least equal to the financial responsibility limits of the state of principal garaging and will be charged the rates for vehicles garaged in Connecticut, Maine, New Hampshire, New York, Rhode Island, Vermont and other. The Loyalty Plus Factor (LPF) will be applied on a vehicle level basis to Coverage Parts 1, 2, 3, 4, 5, 6, 7, 8, 9. 10, 11 and 12. This factor will apply to all vehicle types. The LPF will be updated (1) upon renewal and (2) with any endorsement activity that impacts SDIP and/or Years Licensed. The LPF will apply to a vehicle given the specific combination of the following risk characteristics of the vehicle being rated: A. The applicable Years licensed group for the assigned driver
7 B. The applicable SDIP Group as determined by the SDIP Points reported by the Merit Rating Board for the assigned driver C. The applicable Loyalty group which is determined by the number of consecutive years the policy has maintained uninterrupted Personal Automobile Coverage with Commerce. D. Presences of AAA Membership, including the number of years the insured has been a AAA Member. 2. Apply the appropriate Loyalty Plus Factor (LPF) shown below in accordance to Rule 11. Anti-Theft Device Standards and Discounts. Category III Added Chip Key (k) Chip Key This device allows only the correct ignition key(s) to start the engine. The system prevents the motor vehicle from being started unless the key to the ignition system enables the correct signal. The three types of systems that qualify are: 1. Transponder immobilizer system: system must detect the proper transponder value form the chip in the key in order to star the engine. 2. VATS/PASS-Key system: system must detect the proper resistance value in the key in order to start the engine. 3. Passlock system: system must detect the proper R-code within the ignition lock or ignition switch to start the engine. This system does not have a chip in the key. The key turns the Passlock cylinder which provides the R-Code.

Assignment of Operators to Automobiles iii added language: A Deferred Operator is defined as a listed, non-rated operator who is a member of the named insured s household whose rate classification and Merit Rating is applied to an automobile covered by another active Massachusetts Private Passenger Automobile policy. In addition, an insured must provide a copy of the most recent declarations page for the alternate policy as documentation to support the deferral status. 2. Excluded Operator added language: If any operator excluded as a result of such signed statement operates the automobile, the appropriate operator classification premium for the full policy period may be charged unless a collision or limited collision claim has been denied in accordance with the provisions of the policy because the excluded operator was driving the automobile at the time of the accident. 3. Driving Experience (formerly in Rule 56) All new: An operator new to Massachusetts must provide evidence of licensure from the state or country where the operator was previously licensed in order to assign the correct operator classification under this rule. If electronically available, Commerce will be responsible for obtaining the motor vehicle operator report from the other state or country. If necessary, a certified English translation maybe required. No operator will be assigned to Class 10 unless the operator has six or more years of driving experience. The classification assigned to the operator is based on the number of years licensed in the other state or country and the completion of driving training, as established by the evidence of licensure. If no evidence of prior licensure is available, the operator may be assigned to Class 20 (inexperienced principal operator, licensed less than three years, no driver training) or Class 21 (inexperienced occasional operator, licensed less than three years, no driver training). The Massachusetts driving experience will be used thereafter to assign the operator classification.
