1 Nutrition s for Foods and Beverages Sold During the Regular School Day throughout the School Campus THIS RULE PERTAINS TO ALL SCHOOLS THAT PARTICIPATE IN THE NATIONAL SCHOOL LUNCH PROGRAM (NSLP) In June 2013, the US Department of Agriculture released the Interim Final Rule Smart Snacks in Schools. 1 The rule is intended to bring a nationwide focus to the types of foods and beverages that may be sold throughout the school campus during the defined regular school day. Ohio Revised Code sections , and (formerly called Senate Bill 210/ SB 210 defines food and beverage standards for the regular school day in public and non-public chartered schools in Ohio regardless of NSLP participation. All schools on the NSLP will follow the standards that are considered more restrictive when comparing the USDA and the / SB 210 legislation. Note: the following nutrition standards are subject to change based on the USDA Interim final rule becoming a Final rule (projected to occur for the school year) and any related future changes to Ohio nutrition standards. DEFINITIONS Regular school day "Regular school day" The period from the means the period each midnight before, to 30 school day between minutes after the end the designated arrival of the official school time for students and day. the end of the final instructional period. 2 DEFINITIONS School campus Defined as premises of schools School campus means, for the purpose of competitive food standards implementation, all areas of the property under the jurisdiction of the school that is accessible to students during the school day. Schools will follow the detailed definition under the Smart Snacks rule. Note: Both USDA Smart Snacks and are intended to address foods and beverages sold to students only. Any food and beverage sales that are strictly for adults or accessible only to adults (such as teachers lounges) are exempt from the nutrition standards

3 DEFINITIONS Fundraisers during the regular school day The only exemption defined is interscholastic sporting events that occurred during the school day The State of Ohio may set a number of exempt fundraiser that may happen during the regular school day. Exempt fundraisers must be infrequent in nature Ohio has not yet determined if any exempt fundraisers will be allowed during the regular school day. Note: Food and beverages sold outside of the defined regular school day and/or any food and beverages given to students at no cost/or no medium of exchange are exempt from the nutrition standards Accompaniments (condiments) such as cream cheese, salad dressing and butter Accompaniments were not addressed Accompaniments must be included in the nutrient profile as part of the food item sold Accompaniments must be included in the nutrient profile as part of the food item sold

4 DEFINITIONS Entrée and corresponding entrée exemption No specific definition of entrée Entrees are defined as an item that is either: (i) A combination food of meat or meat alternate and whole grain rich food; or (ii) A combination food of vegetable or fruit and meat or meat alternate; or (iii) A meat or meat alternate alone with the exception of yogurt, low-fat or reduced fat cheese, nuts, seeds and nut or seed butters, and meat snacks (such as dried beef jerky). A school food authority (SFA) is permitted to determine which item(s) are the entrée items for breakfasts offered as part of the SBP. Foods meeting the definition of entrée are exempt from the nutrition standards on the day of and the day after they are offered on the NSLP or School Breakfast Program (SBP) menu. Exempt entree items offered as a competitive food must be offered in the same or smaller portion sizes as in the NSLP or SBP. Side items sold a la carte must meet the Smart Snacks nutrition standards.

5 DEFINITIONS Exempt food items not defined as entrees All food items that can be considered components are exempt if sold in the same serving size as the item would appear on a reimbursable meal tray Fruits and vegetables as described in the column to the right are exempt from all nutrition standards Exempt foods from all nutrition standards: Fresh fruits and vegetables with no added ingredients except water are exempt from all nutrient standards. Canned and frozen fruits with no added ingredients except water, or are packed in 100% juice, extra light syrup, or light syrup are exempt from all nutrient standards. Canned vegetables with no added ingredients except water or that contain a small amount of sugar for processing purposes to maintain the quality and structure of the vegetable are exempt from all nutrient standards.

6 NUTRITION STANDARDS FOR ALL FOODS SOLD IN SCHOOLS Nutrition Standards for Foods: First Assessment (Step 1) No pre-assessment rules exist All foods (not meeting the definition of exempt entrée or food items as specified in the definition section of this document) must meet at least one global nutrition standard before continuing to the specific nutrition standards Any food sold in schools must: Be a whole grainrich grain product; or Have as the first ingredient a fruit, a vegetable, a dairy product, or a protein food (meat, beans, poultry, seafood, eggs, nuts, seeds, etc.); or Be a combination food that contains at least ¼ cup of fruit and/or vegetable; or Contain 10% of the Daily Value (DV) of one of the nutrients of public health concern in the 2010 Dietary Guidelines for Americans (calcium, potassium, vitamin D, or dietary fiber).* *This option only valid through June 30, 2016

7 NUTRITION STANDARDS FOR ALL FOODS SOLD IN SCHOOLS Entrée items: Second Assessment (Step 2) All other foods not meeting the definition of entrée: Second Assessment (Step 2) Entrees are exempt if sold in the same serving size as the entrée would appear as part of the reimbursable meal Schools either followed the Snackwise program or the Alliance for a Healthier Generation Foods meeting the definition of entrée are exempt the day of and the day after the entrée is served as part of the NSLP or SBP. All other days, entrees must first meet one of the preassessment criteria. If the entree meets a pre-assessment criteria, the entrée must then meet specific calorie, fat and sodium standards Very specific nutrition standards for calories, sodium, fat and sugar are set, similar to the Alliance for a Healthier generation requirements For each nutrient, specific foods are defined as exempt. The exemptions are noted in the below rows of this table. Non-exempt entrée items must meet the following criteria as packaged or served (including any added accompaniments): 350 calories 480 mg sodium Total fat: 35% of calories Saturated fat: < 10% of calories Trans fat: zero grams 35% of weight from total sugars in foods Foods not meeting the definition of entrée must meet the following criteria as packages or served (including any added accompaniments): 200 calories 230 mg sodium (will change to 200 July 1, 2016) Total fat: 35% of calories Saturated fat: < 10% of calories Trans fat: zero grams 35% of weight from total sugars in foods *see below specific exemptions to the secondary assessment nutrition standards

8 NUTRITION STANDARDS FOR ALL FOODS SOLD IN SCHOOLS Foods exempt from the total fats standard Rule/SB 210 Not defined Acceptable food items must have 35% calories from total fat as served. Reduced fat cheese (including part-skim mozzarella) is exempt from the total fat standard. Nuts and seeds and nut/seed butters are exempt from the total fat standard. Products consisting of only dried fruit with nuts and/or seeds with no added nutritive sweeteners or fats are exempt from the total fat standard. Seafood with no added fat is exempt from the total fat standard.

9 NUTRITION STANDARDS FOR ALL FOODS SOLD IN SCHOOLS Foods exempt from the saturated fat standard Not defined Acceptable food items must have <10% calories from saturated fat as served. Reduced fat cheese (including partskim mozzarella) is exempt from the saturated fat standard. Nuts and seeds and nut/seed butters are exempt from the saturated fat standard. Products consisting of only dried fruit with nuts and/or seeds with no added nutritive sweeteners or fats are exempt from the saturated fat standard. General Exemption Sugar Free Chewing Gum Sugar Free Chewing Gum is exempt from the Smart Snacks standards

10 NUTRITION STANDARDS FOR ALL FOODS SOLD IN SCHOOLS Foods exempt from the sugar standard Not defined Acceptable food items must have 35% of weight from total sugar as served. Dried whole fruits or vegetables; dried whole fruit or vegetable pieces; and dehydrated fruits or vegetables with no added nutritive sweeteners are exempt from the sugar standard. Dried whole fruits, or pieces, with nutritive sweeteners that are required for processing and/or palatability purposes (i.e., cranberries, tart cherries, or blueberries) are exempt from the sugar standard. Products consisting of only exempt dried fruit with nuts and/or seeds with no added nutritive sweeteners or fats are exempt from the sugar standard.

11 NUTRITION STANDARDS FOR ALL BEVERAGES SOLD IN SCHOOLS The beverage standards as specified in the / SB 210 and interim rule are similar in scope. The below table denotes the requirements for beverages starting. The bold and italicized font below indicates the changes in standards as compared to the previous requirements under / Senate Bill 210. *Note for Milk: If a school is offering Non-dairy beverages in lieu of milk the Nondairy beverages must meet USDA Fluid Milk Substitution Rule nutrition requirements and milk portion size limit Grades Beverages allowed Elementary Schools Water Plain water only (no flavors) unlimited container size Milk* up to an 8 ounce container size. Milk must be low fat (1%) or fat free unflavored or fat free flavored Juice - 8 ounces or less of 100% fruit juice, or a 100% fruit juice and water blend with no added sweeteners, that contains no more than 160 calories per 8 ounces No other beverage Middle Schools Water Plain water only (no flavors) unlimited container size Milk* - up to a 12 ounce container size. Milk must be low fat (1%) or fat free unflavored or fat free flavored Juice - 10 ounces or less of 100% fruit juice, or a 100% fruit juice and water blend with no added sweeteners, that contains no more than 160 calories per 8 ounces No other beverage

12 Grades High Schools Water - unlimited container size Beverages allowed Milk* - up to a 12 ounce container size. Milk must be low fat (1%) or fat free unflavored or fat free flavored Juice - 12 ounces or less of 100% fruit juice, or a 100% fruit juice and water blend with no added sweeteners, that contains no more than 160 calories per 8 ounces 12 ounces or less of any beverage that contains no more than 40 calories per 8 ounces (60 calories per 12 ounces; 20 ounces or less of calorie-free, flavored water (with or without carbonation); 20 ounces or less of a beverage that contains no more than 5 calories per 8 ounces (or 10 calories per 20 ounces) The latter may include caffeinated beverages and beverages with added sweeteners, carbonation, or artificial flavoring. NOTE: Schools with a blend of grade groups (e.g. K-8) must follow the stricter rule for the entire grade group.
