2 1 Introduction 1.1 definitions accident. An accident shall be defined to mean any sudden and unforeseen external event occurring during the journey which without any intent by the Insured causes him/her bodily injury. Drowning, gas poisoning, intoxication caused by a substance taken by mistake, sunstroke, heat-stroke, frostbite, assault and sudden injury caused by a considerable variation in air pressure shall also be considered to be accidents. Suicide or attempted suicide shall not be considered as an accident. Damage to teeth caused through biting shall not be considered as an accident. An infectious disease or a sickness and their consequences which are caused by the sting of an insect or the bite of a tick shall not be considered to be accidental bodily injury. baggage. Baggage shall be defined to mean personal property which the Insured has with him/her during the journey, including travel tickets. The following shall be considered as being comparable to the Insured s own personal baggage: a mobile phone or laptop computer used by the Insured which is owned by the Policyholder baggage type property which the Insured has borrowed or rented before the commencement of the journey. The following shall not be considered as baggage: installation, service or repair tools intended for professional use motor driven vehicles, caravans and other types of trailers, water vessels or aircraft, or parts or accessories belonging thereto commercial goods, trade samples, advertising material or gifts, demonstration or presentation equipment, commercial or educational films or tapes, photographs or drawings manuscripts, plans, collections or parts thereof, software or data stored in a data storage medium household goods in transit sports equipment household goods animals or plants securities, credit cards or money. Loss or losses sustained as the result of a robbery or burglary shall be indemnified in accordance with Clause 6 of the Terms and Conditions of this Insurance. being late for a journey. Being late for a journey shall be defined to mean that the Insured does not, in accordance with the original travel plan, arrive in time at the commencement place of a previously reserved flight, boat, train or coach journey s outward departure or homeward destination, including being late for any connecting flight. beneficiary. The beneficiaries are the Insured s family, unless any other beneficiaries have been notified to the Insurance Company in writing. Family is defined to mean the Insured s legal spouse or registered partner and his/her heirs. In the event of the death of the Insured, the legal spouse or the registered partner and the direct heirs shall be paid an amount of 50 % of the lump sum indemnity, respectively. If there are no direct heirs, the Insured s legal spouse or registered partner shall be paid the lump sum in its entirety. In the event that there is no legal spouse or registered partner, the lump sum shall be divided between the heirs in accordance with the provisions of the Finnish Inheritance Code ( /40 and subsequent amendments). burglary. Burglary shall be defined to mean an illegal forcible entry, with the intent to steal, of a building, apartment, vehicle or other similar locked area in such a way that evidence of such forcible entry remains, or the burglary can be shown to have occurred through some other indisputable way. cancellation of a journey. Cancellation of a journey shall be defined to mean that the departure of the journey is prevented altogether. close relatives. Close relatives shall be defined to mean the Insured s: legal spouse, common-law spouse or registered partner the Insured's own parents and children, and those of the spouse of the Insured the Insured's own grandparents, grandchildren and siblings. curtailment of a journey. Curtailment of a journey shall be defined to mean the changing of an already commenced journey, so that the Insured has to return to the place of departure in a manner differing from the original plan. customary and reasonable expenses. Expenses which are indemnified on the basis of this Insurance must be customary and reasonable. The concept customary and reasonable is always related to the local level in the country in which the expenses are incurred. 3 considered to be customary and reasonable. Examples of customary and reasonable expenses are flying economy class or 0.35 euros/km when using one s own private car. hi-jacking. Hi-jacking shall be defined to mean the illegal taking of possession or control of an aeroplane. illegal threat. Illegal threat shall be defined to mean a situation in which someone threatens the Insured with a weapon or threatens through some other criminal means so that the Insured has a justifiable reason to fear that his/her or somebody else s personal safety or property is in danger. insured event. An Insured Event is an event which is indemnifiable in accordance with the Insurance Contract. journey. A journey shall be defined to mean travelling to a destination which is located outside the Insured s principal employment municipality and which occurs under the orders of the employer and at the employer s expense. The journey shall begin when the Insured leaves his/her place of domicile or his/her place of work, and it shall end when he or she returns to his/her place of domicile or to his/her place of work. A journey between a temporary or permanent residence and a place of employment shall not be considered to be a journey which is included within the scope of cover provided by this Insurance. kidnapping. A kidnapping situation shall be deemed to exist when a person is illegally deprived of his/her freedom and his/her life or health is threatened for the purpose of obtaining a ransom or achieving some other objective. parties to the insurance contract. Robbery shall be defined to mean the stealing or the illegal taking into use of personal property under the custody or control of the Insured, through the use of or the immediate threat of violence. salvage value. The salvage value shall be defined to mean the residual value of the property after damage has occurred. sickness during a journey. Sickness during a journey shall be defined to mean a sudden and unforeseen sickness which begins during the journey and which requires immediate medical treatment by a medical practitioner or which, according to medical experience, should be considered as having begun during the journey. This Insurance shall not indemnify a sickness considered to be a chronic disease which has begun prior to the commencement of the journey or a sickness in respect of which the Insured has visited a medical practitioner prior to the commencement of the journey. sum insured. The Sums Insured stated and entered in the Insurance Policy are the Insurance Company s maximum limits of liability for each and every loss. theft. Theft shall be defined to mean the stealing of the Insured s personal property whilst the said property is under his/her custody or control. 1.2 insured(s) The Insured(s) are the individual people or groups of people stated in the Insurance Policy. 1.3 validity of the insurance The Insurance is valid everywhere in the world. The Insurance is valid for a maximum continuous period of 90 days from the commencement of each business journey, unless otherwise agreed and unless such an agreement is stated in the Insurance Policy. If separately agreed, it is possible to extend the validity of the Insurance to also cover vacations which take place immediately before, or immediately after, are connected to the business journey, however, subject to a maximum period of 14 days. The Insurance shall not indemnify a loss or injury which is caused by war, rebellion or other similar event, unless otherwise agreed and unless this is stated in the Insurance Policy. This exclusion shall not be applied during the first 14 days of an armed operation if it concerns an event other than a major war and if the Insured has already commenced his/her journey before the event began and has not himself/herself participated Global Business Travel Insurance 3

4 in the above-mentioned operation. A major war refers to a war between two or several permanent members of the UN Security Council. 1.4 scope of cover The Insurance includes the following cover: cover for accident and sickness during a journey medical expenses expenses for emergency dental treatment one close relative s return journey to visit the Insured if he or she is seriously sick or injured cover for permanent disablement and death lump sum indemnity for permanent disablement caused by an accident lump sum indemnity for death caused by an accident cover for the curtailment or cancellation of a journey and being late for a journey repatriation of the deceased irrespective of the cause of death. The Insurance can also include the following additional covers if they are separately stated in the Insurance Policy: cover for permanent disablement and death lump sum indemnity for permanent disablement caused by sickness during a journey lump sum indemnity for death caused by sickness during a journey a second close relative s return journey to visit the Insured if he or she is seriously sick or injured therapy cover baggage cover sports equipment cover additional cover for employer s property taken on a journey cover against third party liability cover for legal expenses deductible cover cover for kidnapping and hi-jacking evacuation cover catastrophe cover. 2 Cover for Accident and Sickness during a Journey The Insurance shall indemnify medical expenses for an accident which has occurred during a journey and medical expenses for a sickness which has begun during a journey. 2.1 indemnifiable medical expenses The Insurance shall indemnify medical expenses or other comparable expenses directly arising from an accidental bodily injury or sickness during the journey if there is not or would not be any entitlement to receive indemnification under any law. The Insurance shall only indemnify such treatment expenses that the Insured himself/herself would have to pay for his/her treatment. If another sickness or injury which is not derived from the accident or sickness has essentially contributed to the sickness/injury or the protraction of the recovery from the sickness/injury, indemnification for expenses shall be paid only to the extent that they can be considered to have been caused by the indemnifiable accident or sickness. Customary and reasonable, medically necessary expenses which have been caused during a journey by an accidental bodily injury or a sickness shall be indemnified as follows: medical practitioner s fees hospital charges in a hospital or other similar establishment when the stay in such hospital or establishment is necessary for receiving medical treatment. However, additional expenses arising from the use of a private room shall not be indemnified. expenses for examinations, medical procedures, treatment and medicines prescribed by a medical practitioner expenses for a maximum of five visits without a medical practitioner s referral to a chiropractor, a naprapath, an osteopath or physiotherapist expenses which are caused by the first acquisition of a medical appliance which is necessary to treatment, prescribed by a medical practitioner and required as the result of an accidental bodily injury. Only one medical appliance shall be indemnified for one and the same injury. expenses for plastic surgical treatment or operation required as the result of an accidental bodily injury and approved by the Insurance Company in advance repair or purchase expenses arising from damage to eyeglasses, a hearing aid, dental prosthesis or protective helmet which has been sustained in an accident causing bodily injury necessitating a visit to a medical practitioner the fee for a medical practitioner s certificate which the Insurance Company requires for handling the claim for indemnification. Home or hotel visits by a medical practitioner shall be indemnified only in exceptional circumstances when it is medically necessary because of the state of the health of the Insured. The customary and reasonable, medically necessary expenses for damage to teeth which has been sustained 4 Global Business Travel Insurance

5 as the result of an accident occurring during the journey or for toothache which began during the journey shall be indemnified as follows: expenses for treatment of teeth damaged in an accident necessary emergency dental treatment for a sudden toothache. Emergency dental treatment refers to procedures such as opening abscesses, commencing root canal treatment and the temporary filling or the extraction of a tooth. Such expenses shall be indemnified even when the toothache is caused by biting or sickness other than sickness arising during a journey. The repairing or fitting of bridges or crowns or other similar types of prosthetic treatment is never considered to be emergency treatment. In respect of a sickness which began before the commencement of the journey, the Insurance shall indemnify: the treatment expenses arising from the sudden and unforeseen deterioration of a sickness which deterioration starts during the journey if such deterioration was, according to general medical experience, improbable or unexpected and not typical of the normal progress of the sickness. In such cases, only acute emergency treatment which has been administered during the journey or at the journey s destination shall be indemnified. the necessary and imperative transportation based on medical grounds to the place of domicile. Travel and accommodation expenses shall be considered as being comparable to treatment expenses and shall be indemnified if they are medically necessary, customary and reasonable: travel expenses connected to the treatment extra travel expenses caused by the transfer of the Insured to his/her country of domicile or to the closest possible place for the continuation of treatment when, according to a medical evaluation, treatment is not possible at the journey s destination in addition to hospital charges, other accommodation expenses when it is medically necessary that the Insured receives treatment in a manner which unavoidably gives rise to accommodation expenses. However, these expenses shall only be indemnified for a maximum period of two weeks per Insured Event and per each Insured. If the Insured dies during the journey, the Insurance Company shall indemnify the reasonable expenses arising from the transportation to the Insured s place of domicile, irrespective of the cause of death. Alternatively, burial expenses at the journey s destination shall be indemnified, however, subject to a maximum amount of euros. 2.2 one close relative s journey to visit the insured The Insurance shall indemnify the direct, customary and reasonable travel and accommodation expenses of one close relative s visit to the Insured and his/her return journey if, according to the medical practitioner, the Insured s life is in danger. The indemnification shall be paid for a maximum period of 14 days. The Insurance can also be extended to include a second close relative s journey to visit the Insured. 2.3 indemnity period Expenses caused by the treatment of a sickness during a journey shall be indemnified for a maximum period of six months from the date the Insured first visited the medical practitioner because of such sickness. Expenses arising from the treatment of an accident shall be indemnified for a maximum period of three years from the date that the accident occurred. The Insurance must be valid when the Insured Event occurs and when the expenses arise. 2.4 general exclusions The Insurance shall not indemnify: rehabilitation expenses expenses for examinations or treatment for cosmetic reasons other than as stated in Clause 2.1 expenses arising from staying in a medical rehabilitation establishment, a health spa, a natural health clinic or similar establishment medical appliances other than as stated in Clause 2.1 of the Terms and Conditions of this Insurance expenses for the treatment of dental illnesses other than as stated in Clause 2.1 micronutrient examinations, nutritive substance products, vitamins, micronutrients, medical herbs, natural health care products, homeopathic or antroposofic products or similar examinations or products medicines which are primarily intended for preventive treatment or medicines which are used for relieving the adverse effects of ageing or other physiological changes treatment expenses or permanent disablement if the treatment expenses or the disablement are due to: pregnancy or childbirth the use of contraception or an abortion, an examination or treatment concerning infertility, artificial insemination, sterilisation or an examination to determine the condition of a foetus Global Business Travel Insurance 5

6 loss of earnings of a guardian, close relative or carer, expenses arising from day care, home care or household care or similar indirect expenses. The Insurance shall not cover treatment or other expenses caused by a sickness which has begun before the journey commenced or by an accident which has occurred before the journey commenced. The sudden deterioration of this type of sickness during the journey shall, however, be indemnified in accordance with Clause 2.1 of the Terms and Conditions of this Insurance. 3 Cover for Permanent Disablement and Death 3.1 cover for permanent disablement accident If an accident which is indemnifiable in accordance with the Terms and Conditions of this Insurance causes permanent disablement, the agreed Sum Insured shall be paid to the Insured as a lump sum indemnity if the disability category is 20. In all other cases, the amount of indemnity payable shall be as many twentieth parts of the Sum Insured as the disability category indicates. The disability category shall be determined by the Insurance Company in accordance with the decree (1649/2009) issued by the Finnish Ministry of Social Affairs and Health. Indemnification shall be payable if the disability category of the permanent disablement caused by an accident is at least disability category 2 (10 %). However, accidents causing injuries to fingers or eyes shall be paid indemnification concerning permanent disablement if the disablement is at least in disability category 1 (5 %). If sickness or injury which is independent of the accident has essentially contributed to the injury or the protraction of the recovery from the injury, indemnification for permanent disablement shall be paid only to the extent that it can be considered to have been caused by the indemnifiable accident. Indemnity for permanent disablement shall not be paid earlier than one year from the date of the accident. A prerequisite for receiving indemnification for permanent disablement is that the permanent disablement is medically confirmed to exist within three years from the occurrence of the accident. If the disablement caused by the accident deteriorates after the first decision concerning the lump sum indemnity has been made, an additional indemnity which corresponds to the deterioration of the disablement shall be paid. No additional indemnity shall be paid if the change in the disability category caused by the accident occurs later than three years after the first decision concerning the lump sum indemnity for the disablement was made sickness during a journey Permanent disablement caused by sickness during a journey can be included within the scope of cover provided by this Insurance. If a sickness during a journey which is indemnifiable in accordance with the Terms and Conditions of this Insurance causes permanent disablement, the agreed Sum Insured shall be paid to the Insured as a lump sum indemnity if the disability category is 20. If the disablement caused by the sickness deteriorates after the first decision concerning the lump sum indemnity has been made, and additional indemnity which corresponds to the deterioration of the disablement shall be paid. No additional indemnity shall be paid if the change in the disability category caused by the sickness occurs later than six months after the first decision concerning the lump sum indemnity for the disablement was made. 6 Global Business Travel Insurance

7 3.2 cover for death accident If an accident, indemnifiable according to the Terms and Conditions of this Insurance, results in the death of the Insured within a period of three years from the date of such accident, the Insurance Company shall pay a lump sum indemnity in an amount equivalent to the agreed Sum Insured. Any lump sum indemnity paid for the permanent disablement caused by the same accident shall be deducted from the amount mentioned above. The lump sum indemnity shall be paid to the Insured s beneficiaries sickness during a journey Death caused by sickness during a journey can be included within the scope of cover provided by this Insurance. The lump sum indemnity shall be paid to the Insured s beneficiaries. 4 Cover for Cancellation and Curtailment of a Journey 4.1 cancellation of a journey The cancellation of a journey shall be indemnified if it is due to the death of the Insured or a sudden and unforeseen sickness suffered by the Insured which imperatively prevents the Insured from commencing the journey. The imperative nature of the reasons for the cancellation shall be evaluated on medical grounds. The cancellation of a journey shall also be indemnified if the reason for the cancellation is due to: the death of or a serious accident to or serious, sudden and unforeseen sickness of a close relative of the Insured unforeseen, significant loss or damage to the Insured s property in his/her country of domicile which imperatively necessitates his/her presence at the place of the loss or damage the orders of a public authority issued as the result of insecurity at the journey s destination. Indemnification shall be payable only if the reason for cancellation arises after the Insurance has been taken out and the journey has been booked. The Insurance shall indemnify those cancellation expenses which the Insured or Policyholder is liable to pay to the tour operator or similar party according to the travel terms and conditions or according to law. 4.2 curtailment of a journey The curtailment of a journey shall be indemnified if it is due to a serious accident to or a serious, sudden and unforeseen sickness suffered by the Insured which is indemnifiable under this Insurance. The imperative nature of the reasons for the curtailment shall be evaluated on medical grounds. The curtailment of a journey shall also be indemnified if the reason for the curtailment is due to: the death of or a serious accident to or serious, sudden and unforeseen sickness of a close relative of the Insured unforeseen, significant loss or damage to the Insured s property in his/her country of domicile which imperatively necessitates his/her presence at the place of the loss or damage the orders of a public authority issued as the result of insecurity at the journey s destination. The Insurance shall indemnify expenses for the curtailment of a journey as follows: extra travel expenses and necessary accommodation expenses during a return journey caused by the return to the place of departure in a manner essentially differing from the original plan, this does not include accommodation or travel expenses at the place of destination, eating and food expenses or the expenses arising from transporting a vehicle to the place of domicile the necessary travelling and accommodation expenses of a companion whose presence is stipulated by a medical practitioner. 4.3 expenses for a new journey to resume work If the journey is curtailed for a reason which is indemnifiable in accordance with the Terms and Conditions of this Insurance and a new journey is necessary during the validity of the Insurance because of the continuation of the work, reasonable extra travelling and accommodation expenses which are caused by the Insured s or his/ her colleague s outward journey shall be indemnified. This type of expense shall only be indemnified if the new outward journey commences within 30 days of the curtailment of the journey. Global Business Travel Insurance 7

8 4.4 being late for a journey Being late for a journey shall be deemed to have occurred when: public transportation has been delayed or a public transportation service is prevented from arriving at the departure point of an aircraft, a boat, a train or a coach or the departure point of a connection, due to weather conditions, a technical fault, a traffic accident, a criminal act or the orders of a public authority the private vehicle used for transporting the Insured is prevented from arriving at the departure point of an aircraft, a boat, a train or a coach or the departure point of a connection, due to weather conditions, a technical fault, a traffic accident, a criminal act or the orders of a public authority. The Insurance shall indemnify the extra reasonable and necessary travelling and accommodation expenses, however, subject to a maximum amount equivalent to the cost of the original journey. Eating and food expenses shall not be indemnified as delay expenses. 5 Therapy Cover The Insurance can be extended to include cover for therapy expenses. Therapy expenses shall be indemnified if the Insured suffers from acute psychiatric trauma during a business journey. Incidences which give rise to an entitlement to indem-nification for psychological therapy are: robbery, unlawful threat or assault a serious accident or a serious, life threatening sickness fire, explosion, traffic accident, natural catastrophe, kidnapping, hi-jacking, terrorist attack or similar traumatic incident. The therapy expenses of the Insured s legal spouse, common-law spouse, registered partner and children shall be indemnified in accordance with this Insurance if the Insured dies during a business journey as the result of any of the above-mentioned incidents. The Insurance shall provide indemnification for a maximum of 10 therapy sessions per each Insured Event for each person entitled to indemnification. The Insurance shall only indemnify therapy given by a qualified psychologist or psychiatrist, and the psychological therapy must be given during a period of 12 months from the date of the incident. 6 Baggage Cover The Insurance can be extended to include baggage cover. The Insurance shall indemnify direct, sudden and unforeseen property damage to baggage. Money lost in connection with a robbery or burglary or losses sustained by the Insured because of the misuse of securities, cheque forms, bank or credit cards shall be indemnified up to the amount stated in the Insurance Policy. Indemnification concerning a loss caused by misuse shall be paid only if the reporting of the loss is carried out without delay immediately after it is noticed that the securities, cheques, bank or credit cards have been stolen. Compensation for loss caused by misuse must always be applied for in the first instance from the credit card company or the bank. 6.1 sports equipment cover The Insurance can be extended to include sports equipment cover. If the Insurance is extended, ordinary sports equipment taken by the Insured on a business journey shall be considered to be baggage. Loss or damage to the sports equipment shall be indemnified in accordance with the Terms and Conditions of this Insurance up to the maximum amount stated in the Insurance Policy. Ordinary sports equipment does not include, e.g. water scooters, motor boats, dinghies, canoes and kayaks go-carts and motorbikes para-gliders and gliders. 6.2 additional cover for employer s property taken on a journey The Insurance can be extended to include additional cover for employer s property taken on a journey. Such property can include, e.g. demonstration and presentation equipment sound and picture recording equipment for professional use measurement equipment installation, service or repair tools intended for professional use. This additional cover shall not, however, provide indemnity for: motor driven vehicles, caravans and other types of trailers, water vessels or aircraft, or parts or accessories belonging thereto 8 Global Business Travel Insurance

9 commercial goods, trade samples, advertising material or gifts, photographs or drawings manuscripts, plans, collections or parts thereof, software or data stored in a data storage medium household goods in transit household goods animals or plants securities, credit cards or money. Additional cover shall indemnify loss or damage up to the maximum amount stated in the Insurance Policy. 6.3 basis of indemnification The Insurance Company shall be entitled to fulfil its obligation to indemnify: by paying the repair costs of the damaged property, by having the damaged property repaired, through the acquisition of similar property as a replacement, or by paying the indemnification in cash. When a loss or damage occurs, the amount of the loss or damage and the value of the property shall be determined in accordance with the price level prevailing at the time of the said loss or damage. Depreciation of the property due to age, use or a reduction in usability or for any similar reason shall be taken into consideration in the determination. If the damaged property can be repaired, the amount of loss or damage shall be the repair costs. If the repair of the property is not possible or expedient due to economic reasons, the amount of the loss is the monetary amount which is equivalent to the actual repair costs or the value of the property less the salvage value. The Insurance Company s maximum limit of indemnity is the Sum Insured for baggage stated in the Insurance Policy. The deductible stated in the Insurance Policy shall be deducted from the amount of indemnity to be paid. Irrespective of the Sum Insured, the Insurance shall indemnify reasonable expenses which have been caused by measures taken to save the baggage and limit the damage to the baggage. 6.4 delay of baggage If personal baggage which has been properly left for transportation is delayed from reaching the Insured s travel destination during the outward journey, necessary articles, such as clothing, medicines and toiletries, shall be indemnified. Indemnification shall be paid provided that a written report (Property Irregularity Report) has been acquired from the company which was responsible for the transportation of the baggage and that the report has been submitted to the Insurance Company. After the destination and delay have been confirmed by the company responsible for the transportation, 70 % of the documented reasonable additional expenses arising from the purchase of necessary articles, taking into consideration the circumstances and the purpose of the journey, shall be indemnified. However, the Insurance shall indemnify a delay of baggage when the delay of baggage is connected to a return journey if the Insured leaves for a new business or leisure-time journey within 48 hours of returning. The maximum amount of indemnity that the Insurance shall pay for expenses is the Sum Insured stated in the Insurance Policy. For the purposes of the Insurance, baggage shall be considered to be lost if the delay lasts longer than 30 days. 6.5 loss prevention and minimisation instructions The Insured must comply with the given loss prevention and minimisation instructions. Non-compliance with the given loss prevention and minimisation instructions could result in a reduction in the amount of indemnification paid or the refusal to pay any indemnification. Attendance in the loss prevention and minimisation instructions shall mean continuous supervision. Theft and Malicious Damage In baggage storage areas, for example, windows, latches, doors and similar entrances must be locked. Property which the Insured has with him/her must be attended to avoid theft. Valuable equipment and property, such as jewellery, optical equipment, cash or securities, must not be left unattended by the Insured even if in a locked vehicle, caravan or boat. If the above-mentioned valuable property and equipment are to be kept in a hotel room or in any other similar place, they must be in a properly locked and secure place, if possible taking into consideration the use and size of the property and the circumstances. When the Insured is away from the hotel, securities, cash, bank and credit cards must be kept either in a safe or in a safety deposit box which has been reserved for storing of valuables. 10 The disappearance of cheques, bank or credit cards must be immediately notified to the banks or credit card companies to avoid possible misuse. Transportation of Baggage Property to be transported must be packed in such a way that it is able to withstand the ordinary effects of weather and transportation. Corrosive and staining property as well as bottles containing liquids must be securely packed and separated from the other baggage. The Insured must carry all valuable objects in his/her own hand luggage. If the property is lost or damaged during transportation, the loss or damage must be reported to the representative of the transport company or operating agent. 6.6 other provisions concerning indemnification If the lost property or some part of it is returned after indemnification has been paid, the owner of the insured property must, without delay, give the property to the Insurance Company or return to the Insurance Company that part of the indemnification which relates to the said property. 7 Cover against Third Party Liability The Insurance can be extended to include cover for third party liability. The Insurance shall indemnify sudden and unexpected bodily injury or property damage caused to a third party during the journey if the Insured as a private person is legally liable for damages for such injury or damage according to the legislation in force at the time and place of the incident. The Insurance shall not indemnify a pure economic loss if such loss does not arise as the result of or is not connected or attributable to personal injury or property damage. The Insurance shall not indemnify loss, damage or injury: which has been caused to the Policyholder or other Insured(s) under this Policy which the Insured causes by his/her activities to earn income or profit or which is caused to property which is connected with the Insured s gainful employment which the Insured has caused intentionally or through gross negligence or carelessness which is caused by the participation of the Insured in a game or other such kind of activity which requires physical contact, or which, according to general experience, otherwise might cause injury or damage to the participating person or his/her property which is caused in connection with a fight, assault or other crime for which the Insured is liable solely on the basis of a contract, commitment or promise, but for which the Insured would not be liable for damages except for the existence of such contract, commitment or promise which is caused by: the use of a sailing boat, or boats or vessels subject to registration the use of an aircraft the use of a motor vehicle or motor-propelled vehicle in traffic in accordance with the Finnish Motor Liability Insurance Act or any other such corresponding foreign law. The Insurance shall not indemnify damage to the abovementioned vehicles in the above-mentioned circumstances: which is caused to property which the Insured has taken into custody or control for the purpose of manufacturing, installing, repairing, transporting or storing which is caused to property which the Insured or someone else acting on behalf of the Insured has rented or borrowed. However, the Insurance shall indemnify damage suddenly caused to a hotel room or rented apartment or to their furnishings, structures or equipment, excluding damage caused through wear and tear due to the normal use of the property or by the improper care of the property. which is caused by war or other similar military operation, strike or work stoppage. The Insurance shall indemnify necessary expenses which are caused through the prevention of an immediately threatening damage indemnifiable under the cover against third party liability and the necessary expenses caused by the settling of liability for damages. The Insurance shall not indemnify fines, contractual penalties or similar sanctions. In each Insured Event, the Insurance Company s maximum limit of indemnity is the Sum Insured stated in the Insurance Policy. Loss, damage or injury resulting from one and the same act or omission is considered one Insured Event. The deductible stated in the Insurance Policy is deducted from the amount of loss covered by the Insurance for each Insured Event. 10 Global Business Travel Insurance

11 The Insured must inform the Insurance Company without delay if the Insured Event leads to a trial. The indemnification of an injury or damage, the agreeing to or the approving of a claim for damages by the Insured or the Policyholder is not binding on the Insurance Company, unless the basis and the amount is obviously correct. If the Insurance Company has notified the Insured or the Policyholder about its intention to conclude an agreement, within the limits of the Sum Insured, with the injured party, concerning indemnification of the injury or damage, which the Insured does not accept, the Insurance Company is not obliged to indemnify costs which arise afterwards or make any further settlement concerning the matter. 8 Cover for Legal Expenses The Insurance can be extended to include cover for legal expenses. The Insurance shall cover the Insured s necessary and reasonable legal and litigation expenses arising from the use of an attorney or other lawyer as counsel in civil or criminal cases which can be submitted to an ordinary court for review. The Insurance covers the Insured only in matters involving the Insured as a private individual, and in matters which have occurred during the journey and which are directly connected to the journey and the travelling. The Insurance shall only indemnify an Insured Event which has occurred during the validity of the Insurance. The Insured Event has occurred during the validity of the Insurance if the dispute, claim or charge is based on an event, circumstance, judicial act or infringement of rights occurring or caused during the validity of the Insurance. The Insurance shall not indemnify expenses sustained by the Insured concerning a matter: which is of minor significance to the Insured where the claim cannot be shown to have been specifically contested which concerns a claim for damages against the Insured if the cover against third party liability covers the risk of payment of damages in which it is a question of whether or not the costs caused by the Insured Event which the Insured has provided notification of are either completely or partially indemnifiable under the cover for legal expenses. 8.1 indemnification provisions The Insurance shall indemnify reasonable fees for an attorney s work and necessary expenses. The person who is acting as the Insured s counsel must be an attorney or other lawyer. In determining whether the fee or expenses are reasonable, the value of the disputed interest shall be taken into account, as well as the difficulty and extent of the case and the amount and nature of the work performed. The Insurance shall not indemnify: expenses for the defence of the Insured if the prosecution concerns a deliberate act, gross negligence or gross recklessness. The Insurance shall also not indemnify expenses caused by the handling of a claim for damages arising from, connected with or attributable to such kinds of acts. expenses arising from the enforcement of a judgment or a decision or expenses arising from precautionary measures the Insured s loss of time, own work or expenses arising therefrom, loss of income or earnings, travel or accommodation expenses or extra expenses caused by the changing of an attorney or other lawyer, or increased expenses or unnecessary expenses caused by the Insured s own acts expenses arising from the acquisition of a statement from a legal expert expenses arising from the notification of a crime or preliminary investigation of a criminal case. The Insured or the Policyholder are not entitled to accept or reach an agreement which binds the Insurance Company concerning the amount of any expenses arising from the handling of the case or the amount of the adversary party s legal expenses that the Insured must pay. Any amounts paid by the Insured or the Policyholder to the Insured s attorney or lawyer as attorney s or lawyer s fees or expenses shall not be binding upon the Insurance Company when it evaluates the reasonableness of the legal expenses, but the attorney s or lawyer s invoice shall be sent to the Insurance Company for determination of the amount of the indemnification. 9 Deductible Cover The Insurance can be extended to include deductible cover. 12 9.1 damage occurring in the insured s permanent, temporarily unoccupied place of residence If a loss or damage, indemnifiable under the Insured s household insurance, occurs in the Insured s permanent place of residence which is temporarily unoccupied during a journey and the amount of loss or damage exceeds the deductible under the insurance contract, indemnification equivalent in amount to the deductible shall be paid by this Insurance, however, subject to a maximum amount of euros. Before the indemnification is paid, the Insured must have claimed indemnification from his/her own household insurance and a decision in writing concerning the claims settlement must have been received by the Insured. 9.2 damage to the insured s private automobile If a loss or damage which is indemnifiable under a motor vehicle insurance occurs during the time the Insured is on a business trip to an automobile owned by the Insured for his/her private use, indemnification equivalent in amount to the deductible under the motor vehicle insurance shall be paid by this Insurance, however, subject to a maximum amount of euros. A prerequisite for the payment of the indemnification is that the privately used automobile has not been used and is located at the Insured s place of residence, or e.g. in the parking area of an airport or harbour, during the entire business journey. Before the indemnification is paid, the Insured must have claimed indemnification from his/her own motor vehicle insurance and a decision in writing concerning the claims settlement must have been received by the Insured. The motor vehicle insurance deductible shall not be indemnified with respect to: an Insured Event which is indemnifiable under the legal expenses insurance included in the motor vehicle insurance loss of profits loss of bonus loss of the possible use of a rental car or the rent of a rental car. 10 Cover for Kidnapping and Hi-jacking The Insurance can be extended to include cover for kidnapping and hi-jacking. If the Insured is kidnapped or the aeroplane in which the Insured is flying is hi-jacked during a business trip, indemnification concerning physical and mental suffering shall be paid to the Insured for the period in which the Insured s illegal deprivation of freedom took place. Indemnification for each day of the deprivation of freedom shall be paid for a maximum period of 90 days, however, only up to the Sum Insured stated in the Insurance Policy. 11 Evacuation Cover The Insurance can be extended to include cover for evacuation. The Insurance shall provide indemnification for the evacuation of the Insured from an area considered dangerous during the journey if the Insurance Company considers the evacuation necessary. When making such a decision, the Insurance Company shall comply with the general and specific instructions concerning the special circumstances in question which are given by the embassies, ministries or other public authorities in the countries concerned. The countries concerned shall be defined to mean the Insured s country of domicile and the country in which the circumstances necessitating evacuation appear. Evacuation cover shall indemnify the travel expenses which are caused by the leaving of an area considered by the Insurance Company as dangerous for the nearest safe location or the Insured s country of domicile. 12 Catastrophe Cover The Insurance can be extended to include cover for catastrophe. The Insurance shall indemnify extra accommodation and transport expenses if the Insured has to imperatively move from a previously reserved place of 12 Global Business Travel Insurance

13 accommodation to another place of accommodation due to fire, storm, explosion, earthquake, volcanic eruption, avalanche, tornado, tsunami or flood. The maximum amount of indemnity payable for catastrophe cover shall be that which is stated in the Insurance Policy. 13 General Exclusions 13.1 alcohol, medicines and intoxicating substances Indemnification shall not be paid if a sickness has been caused by the use of alcohol, medicine or an intoxicating substance. However, in the event of the death of the Insured, a lump sum indemnity shall be paid to the Insured s legal spouse or registered partner and the Insured s child or children under 18 years of age causing of the insured event Non-Life Insurance The Insurance Company is released from all liability if the Insured has intentionally caused the Insured Event. If the Insured has caused the Insured Event due to gross negligence or if the Insured s use of alcohol or other intoxicant has contributed to the Insured Event, the amount of indemnification payable to the Insured can be reduced or indemnification can be refused entirely. If the Insured has caused the Insured Event due to gross negligence or if the Insured s use of alcohol or other intoxicant has contributed to the Insured Event, the Insurance Company shall, however, under the liability insurance pay the natural person suffering loss or damage that part of the indemnification that the party suffering loss or damage has not been able to collect due to the Insured s insolvency confirmed through execution or bankruptcy. Personal Insurance The Insurance Company is released from all liability if the Insured has intentionally caused the Insured Event. If the Insured has caused the Insured Event through gross negligence or through aggravated endangering of traffic safety, the liability of the Insurance Company can be reduced insofar it is deemed reasonable, taking the circumstances into consideration. Indemnification can also be reduced if the Insured has, during the occurrence of the Insured Event, been under the influence of alcohol, medical substances or other intoxicating substances and this has essentially been a contributing factor in the creation or amount of the loss or damage and that the Insured can be considered to have acted with gross negligence. However, in the event of the death of the Insured, a lump sum indemnity shall be paid to the Insured s legal spouse or registered partner and the Insured s child or children under 18 years of age. 14 Claiming Indemnification The indemnity must be claimed from the Insurance Company within one year from the date on which the claimant became aware of his/her eligibility to receive indemnification. 15 Applicable Terms and Conditions In addition to the Global Business Travel Insurance Terms and Conditions, the General Terms and Conditions shall also apply to the Insurance /2010 If P&C Insurance Company Ltd.
