As on after revising the seniority of police personnel as per GO(P)33/1989/Home Dated 10/03/1989 has been published vide this office proceedings read on 5 th paper above. The concerned unit/sub unit authorities where the police personnel are working have also been requested to circulate the list to all concerned and got acknowledgement. The time allowed for the said process has been elapsed. Now we have received the representation against the seniority list from the following police personnel. In the representations, they have stated that their names in the seniority list are seen very junior than previous seniority list of SCPOs of Thrissur Dist. and requested to re-fix their seniority as per GO (P)125/80 Dated , and also stated that, there is a Hon'ble Supreme Court judgment, that, a seniority list exists without no change for 4 years, that should not be altered in any case. 1. State Police Chief, Kerala has stated in the letter cited 4 th above that the recruitment rules to the post of PCs in the Kerala Police Subordinate Service, 1980 have come into force wef 17/07/1980 as per SRO 82/80 published vide GO(MS) 16/80/Home Dtd 17/01/1980. As per rule 3 of this Special rule, the Dist. AR and AP Battalion shall be separate units for the purpose of Recruitment. The rule 3 of the Special rule was amended wef 26/12/1980 by adding two provisions as per the SRO 1289/80 published vide GO(MS) No.125/80/Home Dtd 26/12/1980. As per this amendment, the seniority of a PC appointed to a Dist. AR from an AP Battalion should be determined by the date of the order of his first appointment of date of first effective advice of the PSC for his appointment, as the case may be, to the post of PC in the AP Battalion. GO(MS) No.2014/86/Home Dtd 17/07/1986, ordered to stop the direct recruitment of Police Constables in districts and that, future vacancies in the district ARs will be filled up only by transfer from AP Battalions. To give statutory validity to the above orders, the special rules were amended wef 17/07/1986 vide GO(P)33/1989/Home dated 10/03/1989. With the recruitment Rules of Police Constables, 1980 amended vide GO(P) 33/89/Home dated 10/03/1989, the executive order issued vide GO(MS) 125/80/Home dated 16/12/1980 turned null and void. Over and above, the Hon ble Division Bench of Hon ble High Court vide Judgement dtd 12/03/2010 in WP 17133/07 delivered that the entire old rule 3 was substituted by the newly introduced Rule- Provisos to the old rule was not in force. Hence, as per existing rule, ie, GO(P) 33/1989/Home Dated 10/03/1989 the Police constables who joined at District AR on or after 17/07/1986 from AP Battalion are entitled to get seniority in the Dist. AR concerned with effect from the date of order of transfer of Deputy Inspector General of Police, AP Battalion, transferring them from Battalion to AR, Inter district transferees are entitled to get seniority with effect from the date of joining duty in the respective AR and the PCs directly recruited in AR are entitled to get seniority with effect from the date of advice by KPSC. In the above circumstances, the arguments of the petitioners cannot be considered and hence are rejected. Another representation received from Sri. Jayakumar K, ASI (R 3493). In his representation, he has stated that his date of birth is mentioned in the seniority list shown as instead of The above complaint has been examined with his service book and found that his complaint is seen to be genuine, and corrected the date of birth as Another representation has been received from Sri. Jose P P, SI. In his representation, he has stated that his qualification and date of enlistment is not correct in the seniority list. His complaint has been verified with his service book and found that the complaint is genuine and made necessary corrections in the seniority list. Sri. Joy, R 3840 (SL No. 446) had availed LWA for taking up employment abroad from to (13 years) and lost his seniority. Inspector General of Police, Thrissur Range has instructed to re-fix the seniority in Local HC(GE) cadre considering LWA period vide letter No. A1/528/2013/TSR Dated addressed to District Police Chief, Thrissur Rural. As such, District Police Chief, Thrissur Rural re-fixed the seniority of Sri. Joy, R 3840 vide Order No.A3/20886/13/R Dated Accordingly seniority in respect of Sri. Joy, R 3840 is re-fixed and assigned as Sl. No. 544 in the seniority list in the place between Sri. Muraleedharan, SCPO 4274 and Sri. Krishnan, SCPO 3992.

5 No representations have been received in this office other than those mentioned above. As such the provisional revised seniority list of SCPOs(GE) as on issued vide this office proceedings cited 5 th above is finalised with the above mentioned modifications and annexed herewith for information to all the concerned.
