1 QUEENSTOWN LAKES DISTRICT COUNCIL COMMUNITY SERVICES COMMITTEE FOR MEETING OF 7 JULY 2009 REPORT FOR AGENDA ITEM: 5 SUBMITTED BY: Amanda Colmore-Williams Lakes Property Services REPORT DATED: 11 May 2009 PROPOSED TABLE AND CHAIR LICENCE THE BATHHOUSE RESTAURANT PURPOSE To consider approval for a table and chair licence on the Marine Parade lakefront reserve. BACKGROUND The Bathhouse Restaurant has applied to place four tables and sixteen chairs on the lakefront in front of their restaurant legally described as Section 6 Blk LI Town of Queenstown and also falling into Pt Section 74 Blk XX Shotover SD. This area will cover 12m2 and will be opposite the front facing verandah on the lakefront. This area of the foreshore is on Marine Parade and is predominantly used for passive recreation, with a playground and the Horne Creek mouth adjacent to the restaurant. The Sunshine Bay Kelvin Heights Foreshore Management plan notes that Reserve management attempts to find an acceptable balance between conserving the quality of the natural environment and beauty of the area and encouraging commercial enterprise and public use and enjoyment. The Property Subcommittee approved this application in November 2008 and therefore a temporary permit was granted and is in effect. The Reserves Act requires that the intention to grant this license be publicly notified calling for submissions, a hearing held if necessary, resolution of QLDC and approval of the Minister of Conservation. We suggest that the tenure be by way of a licence with the following key terms: Term: One year Right of Renewal: Nine x one year renewals at Council s absolute discretion Rent: $80p/m 2 for the licence area per annum Use: To service patrons frequenting The Bathhouse Restaurant. Limitations: Operation of the Table and Chair area is the responsibility of the permit holder and in accordance with the Table and Chair Policy. Insurance: The permit holder is required to hold valid public liability insurance to the satisfaction of the council as outlined in the Table and Chair Policy. ATTACHMENTS 1. 3 CONSULTATION AFFECTED OR INTERESTED PARTIES The intention to grant a licence will be publicly notified calling for submissions. RELEVANT COUNCIL POLICIES Reserves Act 1977 Table and Chair Policy 2006 Sunshine Bay to Kelvin Heights Reserve Management Plan DISCUSSION It was discussed with the applicant the potential for these tables and chairs to obstruct public use of Queenstown Beach, especially in the summer months where this area has a high concentration of pedestrians. The applicants noted that this area of the beach is wide and can accommodate many people. They also note that the public mainly use the beach area closer to Central Queenstown, nearer the Main Town Pier. It has deemed the impact of the tables and chairs will be minimal, and upkeep of the tables and chairs will be the sole responsibility of the applicant. OPTIONS 1. Decline this application for tables and chairs on the lakefront opposite The Bathhouse.; or 2. Accept this application to place 4 tables and 16 chairs on the lakefront opposite The Bathhouse. FINANCIAL IMPACT There is no cost in granting this licence, as the applicant must pay for all costs incurred as per the Tables and Chair Policy. The applicant must also pay an annual licence fee to Council, under the Table and Chair Policy; this fee will be based on $80p/m 2 for the licence area. DELEGATIONS REGISTER REFERENCE This matter does not require any changes to delegations RECOMMENDATION 1. That the Community Services Committee receive this report; 2. That the Community Services Committee approves in principle this application for tables and chairs subject to the following terms and conditions: Term: One year Right of Renewal: Nine x one year renewals at Council s absolute discretion Rent: $80p/m2 per annum Reviews: Pursuant to the Table and Chair Policy Use: To service patrons frequenting The Bathhouse Restaurant.
4 Limitations: Operation of the Table and Chair area is the responsibility of the permit holder and in accordance with the Table and Chair Policy. Insurance: The permit holder is required to hold valid public liability insurance to the satisfaction of the council as outlined in the Table and Chair Policy. 3. That the Community Services Committee gives approval to Lakes Property Services to notify Council s intention to grant this licence and call for submissions; 4. That the Community Services Committee nominate a hearing panel to hear any submissions (if necessary) and make a recommendation to Queenstown Lakes District Council; and 5. That if no submissions are received, the Community Services Committee recommend to Queenstown Lakes District Council that a licence be granted to The Bathhouse subject to the above terms and conditions and the consent of the Minister of Conservation.
