1 STATE OF UTAH DEPARTMENT OF COMMERCE DIVISION OF OCCUPATIONAL AND PROFESSIONAL LICENSING NEWSLETTER April 1, 2007 The following actions have been taken by the Division following hearings conducted before an Administrative Law Judge and the respective Licensing Committees or Boards or have been entered by Stipulation or Memorandum of Understanding from January 1, March 31, PHYSICIANS/SURGEONS CARSON, Mia Elizabeth, MD Makawao, Hawaii Amended Date: February 22, 2007 The probationary condition requiring Respondent to meet with the Physicians Licensing Board on a quarterly basis was amended to require meetings with the Board every six (6) months during the probationary period. CODY, Heather Heim, MD Aurora, Colorado In March 2006 Respondent fraudulently issued prescription orders for Demerol, a Schedule II controlled substance, and she later used the controlled substance herself. Respondent voluntarily surrendered her license to administer and prescribe controlled substances. Respondent may not reapply for a controlled substance license for a period of at least two years from the Order date. Respondent's license to practice as a physician/surgeon was revoked with a stay of enforcement on the revocation. Said license is suspended until certain conditions have been completed by Respondent. Following the period of suspension, said physician/surgeon license will be placed on probation for five years with conditions and restrictions. Date: March 16, 2007 ELLSWORTH, Randal Nylan, MD Orem, Utah Amended Date: February 22, 2007 GOATES, Michael G., MD Provo, Utah Amended Date: March 19, 2007 The probationary condition requiring Respondent to attend a 12-step AA program was terminated. However, in lieu of the 12-step program meetings, Respondent is required to attend two (2) additional professional support group (PIR) meetings per month during the probationary period. The probationary condition requiring Respondent to have a reviewing physician monitor his controlled substance prescribing and submit quarterly reports regarding the appropriateness of his prescribing practices is terminated. HEAP, Alan F., MD Tooele, Utah Respondent engaged in unprofessional conduct in his practice of medicine with regards to prescribing controlled substances to several patients. Respondent's licenses to practice as a physician/surgeon and to administer and prescribe controlled substances were revoked with a stay of enforcement on the revocation. Said licenses were placed on probation for five years with conditions. Respondent was also ordered to pay a $1,000 fine within 90 days.

2 PHYSICIANS/SURGEONS - continued Date: January 11, 2007 HEWITT, Lance O., MD Respondent engaged in unprofessional conduct when he engaged in inappropriate drug use. Respondent's license to administer and prescribe controlled substances is suspended effective the date of the Order. Respondent's license to practice as a physician/surgeon is also suspended with conditions to be met during the period of suspension. Upon the successful completion of certain conditions, the Physicians Licensing Board/Division will determine if the suspension can be terminated. If the suspension is terminated, Respondent's license to practice as a physician/surgeon will be placed on probation for 5 years with conditions and restrictions. Date: February 8, 2007 LEWIS, Roger Belden, MD Orem, Utah Date: March 27,2007 PURSER, Danny C., MD Provo, Utah Amended Date: March 19, 2007 SELLERS, Terrell Lee, MD Orem, Utah Amended Date: January 16, 2007 THEODORE, Alexander, MD Sandy, Utah Amended Date: February 22, 2007 Allegations: Respondent engaged in unprofessional conduct in his practice of medicine with respect to a patient identified as "A.M.A." in the Division's Stipulation/Order. Respondent neither admits nor denies the Division's allegations, but agreed the following: Effective March 31, 2007, Respondent's licenses to practice as a physician/surgeon and to administer and prescribe controlled substances are revoked with a stay of enforcement on the revocation. Said licenses will be suspended until such time that Respondent successfully completes certain conditions. Following the period of suspension, said licenses will be placed on probation for five years with conditions and restrictions. The probationary condition requiring Respondent to meet with the Physicians Licensing Board on a quarterly basis was amended to require meetings with the Board every six months. The probationary condition requiring Respondent to complete a substance abuse treatment program at either the Rush Program or the Professional Renewal Center was terminated. In lieu of that probationary condition being terminated, Respondent is required to complete a local outpatient substance abuse program that is approved by the Division and one that Respondent has had no previous affiliation. The probationary condition requiring Respondent to meet with the Physicians Licensing Board on a quarterly basis was amended to require meetings with the Board once a year unless Respondent intends to return to the practice of medicine in Utah. 3 DENTISTS/DENTAL HYGIENISTS MYERS, John W. Draper, Utah Respondent has previously been disciplined due to his drug and alcohol abuse. Memorandum of Understanding and A license to practice as a dentist was issued to Respondent and placed on probation for five years with conditions and restrictions. A license to administer and prescribe controlled substances will not be issued to Respondent during the probationary period that exists on his dental license. Date: February 15, 2007 OWENS, C. Dean Layton, Utah Respondent failed to comply with probationary conditions that existed on his licenses. Respondent voluntarily surrendered his licenses to practice as a dentist and to administer and prescribe controlled substances. Respondent may not reapply for licensure for a period of five years. Date: January 12, 2007 SLATER, Rodney John Highland, Utah Date: February 2, 2007 Amended Date: March 8, 2007 REGISTERED NURSES/ADVANCED PRACTICE NURSES Newsletter - April 1, Page 3 of 21 Respondent failed to comply with probationary conditions that existed on his license. Respondent has a substance abuse problem that, if left untreated, could render him unsafe to practice dentistry. Respondent's license to practice as a dentist was revoked with a stay of enforcement on the revocation. Said license is suspended until such time as certain conditions have been successfully completed by Respondent. Following the period of suspension, said license will be placed on probation for three years with conditions and restrictions. The suspension on Respondent's license to practice as a dentist was terminated and said license was placed on probation for three years with conditions and restrictions. BARNETT, Adrienne S. Respondent failed to comply with probationary conditions that existed on her license. Respondent voluntarily surrendered her license to practice as a registered nurse. Respondent may not reapply for licensure for a period of three years. Date: February 22, 2007 CAMPBELL, Blaine G. APRN Midvale, Utah Amended Date: January 22, 2007 The probationary condition requiring on-site supervision was amended to allow Respondent to practice as a registered nurse under the on-site supervision of either an APRN in good standing with the Division, a registered nurse in good standing with the Division or a licensed physician in good standing with the Division.. The probationary condition requiring on-site supervision if Respondent is practicing as an APRN remains his practice shall be supervised by either an APRN in good standing with the Board or a licensed physician in good standing with the Board.

4 REGISTERED NURSES/ADVANCED PRACTICE NURSES - continued Amended The probationary condition restricting Respondent to practicing only with patients over the age of 18 years was terminated. The probationary condition restricting Respondent's practice to duties and surroundings that do not allow him access to minors and children, including telephone access, was also terminated. Date: February 8, 2007 CORMIER, Sarah Jane APRN Grantsville, Utah Date: March 26, 2007 Between March 2006 and October 2006 Respondent issued prescriptions for a Schedule III controlled substance to a patient. The prescriptions and the refills for them were issued at a frequency that provided grossly excessive amounts to the patient given Respondent's directions for use. Respondent failed to document many of the prescriptions she issued in the patient's chart and lost track of the quantities she prescribed to the patient. Respondent was ordered to pay a $1,000 fine within 90 days. Respondent's licenses to practice as an advanced practice registered nurse and to administer and prescribe controlled substances were revoked with a stay of enforcement on the revocation. Said licenses were placed on probation for three years with conditions and restrictions. GOMES, Michael A. Tooele, Utah In December 2006 Respondent exceeded the scope of his license as a registered nurse. Respondent was given a public reprimand for administering controlled substances without a license in Utah. Respondent was also ordered to pay a $500 fine within 90 days. Respondent was also required to meet with the Nursing Board within 30 days and complete two nursing education courses within six months of the Order date. Date: January 19, 2007 HAYWARD, Nikki K. Castledale, Utah Respondent engaged in unprofessional conduct in her practice of nursing with respect to two patients under in her care. Respondent voluntarily surrendered her license to practice as a registered nurse. Respondent may not reapply for licensure for a period of five years. Date: January 31, 2007 HUNTER, Deneice Marie Clinton, Utah Date: March 5, 2007 In February 2007 Respondent took a controlled substance from her employer without a physician's order and administered the drug to herself. Respondent has a drug abuse problem that represents a threat to the public if she continues to practice nursing without treatment. Respondent voluntarily surrendered her license to practice as a registered nurse. Respondent may not reapply for licensure for a period of five years from the completion of related criminal sanctions. LYMAN, Luisa A. Moab, Utah Interim Respondent's license to practice as a registered nurse is suspended for no more than four months to thus permit the resolution of the related criminal proceeding and then the issuance of a final Order in the Division proceeding. 5 REGISTERED NURSES/ADVANCED PRACTICE NURSES - continued Date: March 5, 2007 MACK, Sherry Kaye Sandy, Utah Date: March 15, 2007 MANGELSON, Angie Nephi, Utah Amended Date: March 1, 2007 MCCARTY, Karen J. Pleasant Grove, Utah Date: March 15, 2007 MCCLAIN, Kiley M. South Jordan, Utah Amended Date: March 1, 2007 OLSEN, Jean Ellen Taylorsville, Utah Date: January 18, 2007 In August 2006 Respondent was receiving pain medications from both her physician and dentist without neither the dentist nor the physician knowing Respondent was receiving pain medications from other prescribing practitioners. In September/October 2006 Respondent stole controlled substances from her employer. She also failed to chart she had administered various medications to patients in their records. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. The probationary condition requiring Respondent to participate in a professional support group (PIR) was amended to allow Respondent to attend AA/NA meetings in lieu of the PIR meetings; but she must attend at least one meeting per week. In December 2006 Respondent took, without authorization or a valid prescription, a Schedule II controlled substance from her employer's drug inventory. Respondent told a Division investigator she self-administered some of the controlled substance to treat a migraine headache and then discarded the remaining amount. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. Respondent was also ordered to pay a $500 fine within 90 days. The probationary condition requiring Respondent to participate in a professional support group (PIR) was amended to allow Respondent to attend either PIR, AA/NA or aftercare meetings in lieu of the PIR meetings; but she must attend at least one meeting per week. The probationary condition requiring Respondent to receive prescriptions from only on prescribing practitioner was amended to allow Respondent to also receive prescriptions from four additional physicians. Respondent took a controlled substance from her employer without authorization and used the controlled substance herself. Respondent's nursing license in New Mexico was revoked in October 2006 due a disciplinary proceeding. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. 6 REGISTERED NURSES/ADVANCED PRACTICE NURSES - continued ROONEY, Ann Date: March 1, 2007 Respondent violated a probationary condition/restriction that exists on her license when in January and February 2007 she administered controlled substances to patients in her care. Respondent was given a public reprimand for violating a probationary condition when she administered controlled substances to patients under her care. Respondent was also ordered to pay a $500 fine within 90 days. The probation on Respondent's license to practice as a RN is to begin a new 5 year term from the date of this Order subject to the conditions and restrictions identified in the Division's November 3, 2005 Order in Case No. DOPL SALAS, Glenda J. North Ogden, Utah Respondent failed to comply with probationary conditions that existed on her license. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Said license is placed on probation for another five year period, to commence on October 17, 2007, subject to the conditions and restrictions identified in the Division's October 17, 2002 Order in Case No. DOPL Date: February 8, 2007 SAYAH, Lynne Elizabeth Order Terminating Probation: Date: March 28, 2007 The probation on Respondent's license to practice as a registered nurse was terminated. However, it should be noted that Respondent's license to practice as a registered nurse expired on January 31, 2007when it was not renewed. STEWART, Stephen S. CRNA West Jordan, Utah Respondent viewed pornography on the Internet on several occasions while at work. As a result, his hospital privileges were suspended in August Respondent's license to practice as a certified registered nurse anesthetist was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. Date: February 22, 2007 STONE, Nancy M. Harrisville, Utah Amended Date: March 1, 2007 The probationary condition restricting Respondent's access to controlled substances was terminated. TEERLINK, Judy Lynn Fruit Heights, Utah In 2006 Respondent asked a patient who was under her care for two loans of money thus engaging in unprofessional conduct and violating the Code of Ethics of the American Nursing Association. Respondent was ordered to pay a $1,000 fine within 90 days. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Date: March 28, 2007 THOMPSON, Ellen Provo, Utah Respondent practiced as a nurse in January 2007 when she was not licensed to do so. Respondent was ordered to cease and desist from the practice of nursing until such time as she is licensed to do so. Respondent was given a public reprimand for practicing as a nurse without a valid license in Utah. Respondent was also ordered to pay a $500 fine within 90 days. Date: February 22, 2007 TIPPETTS, Diane B. Santa Clara, Utah Respondent continued to practice as a registered nurse after her license expired on December 31, Respondent was ordered to cease and desist from the practice of nursing in Utah until such time as she is currently licensed to do so. Respondent was given a public reprimand for practicing as a nurse without a valid license in Utah. Date: February 12, 2007 WOOD, Stacie Date: March 7, 2007 LICENSED PRACTICAL NURSES FRANCOM, Mason C. Genola, Utah Amended Date: March 1, 2007 In November 2006 Respondent's nursing license was disciplined by the Arizona Nursing Board. In January 2007 on her license renewal application, Respondent answered "no" to the question if any disciplinary action had been taken since the last renewal. Res pondent was ordered to pay a $500 fine within 90 days. Respondent's license to practice as a registered nurse was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. The probationary condition requiring Respondent to participate in therapy and aftercare was terminated. The probationary condition restricting Respondent's access to controlled substances was terminated. The probationary condition requiring Respondent to practice under on-site supervision was amended to require Respondent to practice under general supervision of a registered nurse in good standing with the Division or a licensed physician in good standing with the Division. The probationary condition restricting Respondent from contacting a pharmacy or drug supplier for the purposes of filling a prescription order was terminated. The probationary condition requiring Respondent to submit updated probation reports from a criminal probation officer was also terminated. MAYO, Jully Ann Wellsville, Utah Respondent continued to practice as a licensed practical nurse after her license expired on January 31, Respondent was given a public reprimand for practicing as a LPN without a current valid license. Respondent was also ordered to cease and desist from the practice of nursing until such time as she is licensed to do so. Respondent was also ordered to Newsletter - April 1, Page 7 of 21

8 LICENSED PRACTICAL NURSES - continued pay a $500 fine within one year. Date: January 29, 2007 VEATCH, Lorie Lee Layton, Utah Respondent took various controlled substances from her employers' stock without authorization or a valid prescription. Respondent was ordered to pay a $500 fine within 90 days. Respondent's license to practice as a licensed practical nurse was revoked with a stay of enforcement on the revocation. Said license was placed on probation for five years with conditions and restrictions. Date: January 30, 2007 PHARMACISTS/PHARMACY TECHNICIANS/PHARMACIES BOYER, Stephanie Jean Pharmacy Technician Ogden, Utah In July 2006 Respondent surrendered her nursing license and failed to notify the Division investigator she was also licensed as a pharmacy technician. Respondent's license to practice as a pharmacy technician was revoked effective the date of the Order. Date: March 6, 2007 CATES, Mary Jo Centerville, Utah Date: March 30, 2007 CHRISTIANSEN, Clair John South Jordan, Utah Date: January 18, 2007 Reinstatement Date: February 13, 2007 In September 2006 Respondent took a Schedule III controlled substance from her employer's pharmacy stock without authorization or a valid prescription for her own use. Respondent's licenses to practice as a pharmacist and to dispense controlled substances were revoked with a stay of enforcement on the revocation. Said licenses were placed on probation for five years with conditions and restrictions. Respondent was also ordered to pay a $1,000 fine within 90 days. From June 1, 2005 until January 2007 Respondent continued to practice as a pharmacist and dispense controlled substances when his licenses had expired on May 31, Respondent was publically reprimanded for continuing to practice as a pharmacist and to dispense controlled substances without a current/valid license. Respondent was ordered to pay a $500 fine within 30 days. Respondent is also required to meet with the Pharmacy Board within 30 days and also complete four additional hours of continuing professional education within one year. Respondent successfully completed all terms and conditions required in the January 18, 2007 Order and his licenses to practice as a pharmacist and to dispense controlled substances were reinstated with full privileges. FRANK, Terrance E. South Ogden, Utah Reinstatement The probation on Respondent's licenses to practice as a pharmacist and to dispense controlled substances was terminated and said licenses were reinstated with full privileges. 9 PHARMACISTS/PHARMACY TECHNICIAN/PHARMACIES - continued Date: March 30, 2007 HARMON'S APOTHECARY SHOP West Valley City, Utah Date: March 15, 2007 HILL, Orlando Pharmacy Technician Amended Date: February 20, 2007 KILPATRICK, Layne Ronald Draper, Utah Amended Date: January 29, 2007 STEWART, Scott Edward Draper, Utah Reinstatement Date: March 30, 2007 STREBEL, Thomas Evan Park City, Utah Date: January 4, 2007 Respondent has previously been disciplined in 2003 and 2004 for employing unlicensed pharmacy technicians. From May 2006 to February 2007 Respondent employed an unlicensed pharmacy technician. Respondent was ordered to pay a $5,000 fine within 30 days. Respondent was also publicly reprimanded for employing an unlicensed technician for a third time. Respondent's pharmacist-in-charge and district pharmacy manager are to meet with the Pharmacy Board within 30 days. The probationary condition requiring Respondent to meet with the Pharmacy Board on a quarterly basis was changed to require meetings every six months. The probationary conditions requiring Respondent to submit to random drug testing and to submit quarterly employer reports were terminated. The probation on Respondent's licenses to practice as a pharmacist and to dispense controlled substances was terminated and said licenses were reinstated with full privileges. Respondent engaged in unprofessional conduct in his practice as a pharmacist by filing a false/fraudulent insurance claim. Respondent denies engaging in unprofessional conduct, but agreed to the following: Respondent voluntarily surrendered his licenses to practice as a pharmacist and to dispense controlled substances. Respondent may not reapply for licensure as a pharmacist until the successful completion and expiration of his two-year criminal probation which is scheduled to end in February CONTRACTORS/UNLICENSED CONTRACTORS BENEDICTO, Francis Vernal, Utah Respondent practiced as a contractor when he did not have a current license to do so. Respondent also performed plumbing and electrical work when he is not licensed as either. Respondent was ordered to pay a $3,000 fine of which $2,000 is suspended upon compliance with conditions. The remaining $1,000 is due within 30 days of the Order date. Respondent's license to practice as a contractor is placed on probation until November 30, 2009 with conditions. 10 CONTRACTORS/UNLICENSED CONTRACTORS - continued acting as a plumber or as an electrician until such time as he obtains the required licenses to do so in Utah. Date: February 28, 2007 CASE, Gary Edward dba: Gary Case Roofing Herriman, Utah Date: January 31, 2007 In July 2005 Respondent misrepresented on a contractor renewal application that he maintained continuous general liability insurance coverage and workers' compensation insurance coverage as required by law; when in fact he had not maintained the insurance coverage since September Respondent has also hired unlicensed contractors to perform roofing services. Respondent's license to practice as a contractor was revoked with a stay of enforcement on the revocation. Said license was placed on probation with conditions until November 30, Respondent was also fined $10,000 of which $7,000 is suspended upon compliance with conditions. The remaining $3,000 was to be paid within 30 days. Respondent shall also cease and desist from acting as a contractor until such time as he obtains the required liability insurance coverage, workers' compensation insurance coverage and unemployment insurance coverage in Utah. Respondent was also ordered to cease and desist from hiring unlicensed contractors. CUSTOM CREATIONS LANDSCAPE SEMICK, Daniel S. St. George, Utah Respondent Semick misrepresented his qualifying experience with respect to the B100 general building classification in an application for licensure as a contractor. Respondent's license classification B100-general building to practice as a contractor was revoked. Respondent shall cease and desist from acting as a B100 general building contractor until such time as it becomes licensed to do so. Respondent's license to practice as a contractor with classification S330-landscape was revoked with a stay of enforcement on the revocation. Said license with S330 classification was placed on probation with conditions until November 30, Respondent was ordered to pay a $2,000 fine of which $1,000 was suspended. The remaining $1,000 fine is to be paid within 30 days. Date: March 28,2007 FORD, Paul James Contractor qualifier St. George, Utah Respondent admitted to providing false information with respect to verifying qualifying experience in an application for licensure as a contractor. Respondent was ordered to pay a $500 fine within 30 days. Respondent was also ordered to cease and desist from violating all applicable federal and state laws, regulations, rules and orders relating to his practice as a contractor. Date: March 28, 2007 LANDSCAPE PLUS Sandy, Utah Reinstatement Date: January 31, 2007 The probation on Respondent's license to practice as a contractor was terminated and said license was reinstated with full privileges. SANDIA BUILDERS, INC. Murray, Utah Respondent failed to timely provide evidence of current liability insurance to the Division. Newsletter - April 1, Page 10 of 21

11 CONTRACTORS/UNLICENSED CONTRACTORS - continued Respondent voluntarily surrendered its license to practice as a contractor since it has ceased operation as a contractor. Date: February 28, 2007 SYNERGISM, INC. Pleasant Grove, Utah Respondent failed to replace its qualifier. Respondent voluntarily surrendered its license to practice as a contractor based on the fact that it is no longer doing business as a contractor in Utah. Date: March 28, 2007 TRIAD ELECTRIC & CONTROLS, INC. Baton Rouge, LA Date: March 28, 2007 OTHER REGULATED PROFESSIONS Respondent's previous qualifier had let his Utah master electrician license expire as of July 31, Respondent has since replaced its qualifier with a currently licensed electrician. Respondent was ordered to pay a $500 fine within 30 days. BARKER, Art F. Professional Land Surveyor Wellington, Utah Respondent engaged in unprofessional conduct in his practice as a professional land surveyor by failing to timely submit a complete survey map. Respondent's license to practice as a professional land surveyor was placed on probation for one year with conditions. Date: March 9, 2007 BECKSTEAD, Lucas R. Apprentice Plumber West Point, Utah Reinstatement Date: January 31, 2007 The probation on Respondent's license to practice as an apprentice plumber was terminated and said license was reinstated with full privileges. BILLINGS, Jason D. Unarmed Private Security Officer Saratoga Springs, Utah In December 2006 Respondent was convicted of a crime that relates to his ability to safely act as an unarmed private security officer. Respondent voluntarily surrendered his license to practice as an unarmed private security officer and any residual rights he has to that license. Respondent may not reapply for licensure as a private security officer for a period of one year. Date: February 22, 2007 BIRCH, Derek Wayne, DC Chiropractic Physician Lehi, Utah Respondent aided and abetted a person not licensed to practice medicine in Utah. Respondent's license to practice as a chiropractic physician was revoked with a stay of enforcement on the revocation. Said license is placed on probation for three years with conditions. Respondent shall also cease and desist from referring patients to unlicensed practitioners for medical testing or treatment. Respondent shall also not employ or contract with assistants to provide services that Respondent or the assistant is not trained, qualified, or licensed to perform. 12 OTHER REGULATED PROFESSIONS - continued Date: March 19, 2007 BROWN, Benjamin J. Certified Public Accountant Bountiful, Utah Respondent engaged in unprofessional conduct in 2004 prior to submitting a renewal application for licensure in September Memorandum of Understanding and Respondent's license to practice as a certified public accountant was renewed and said license was placed on probation for three years with conditions. Date: January 30, 2007 CALL, Amanda Cosmetologist/Barber Price, Utah Memorandum of Understanding and Date: January 18, 2007 Respondent had previously been on probation under a Memorandum of Understanding in 2004 when her license to practice as a cosmetologist/barber expired in Respondent's license to practice as a cosmetologist/barber was reinstated and said license was placed on probation for two years with conditions.
