LANDON: 5 Q And I believe the Judge indicated accurately that 6 at some point that action was stayed? 7 A Yes. 8 Q And it ultimately went into arbitration? 9 A Yes. 10 Q Why did it go into arbitration? 11 A We received two sets of death threats. I received 12 one at a face to face meeting prior to that point, and we 13 had a hearing on the arbitration issue just like this one, 14 and the evening prior to the hearing I was preparing with my 15 attorney in a hotel room at a local hotel, and Patti called 16 me in a panick because her and my youngest son, Adam, 17 received a death threat. And subsequent to that the FBI put 18 a tap and trace on our phone and the state police responded 19 as well, but FBI had been working with me already because 20 there was a previous threat. 21 MS. MILLER: Your Honor, I'd move to 22 strike that as non-responsive. 23 THE COURT: What are you trying to 24 establish -- why it's stayed? 25 MR. LANDON: The circumstances under Page 59 1 which Mr. Scheibeler had agreed to refer the prior case to 2 arbitration. 3 THE COURT: Okay, he can explain why he 4 did that. I think he said he received threats and his 5 family received treats. 6 MR. LANDON: Yes. 7 THE COURT: I would let it stand for 8 that purpose. 9 BY MR. LANDON: 10 Q And just to clarify, were those threats received 11 from Amway Corporation or Quixtar to your knowledge? 12 A No, as a matter of fact I'm certain they were not 13 from Amway directly. It's was unanimous. 14 Q Okay, and I think you previously testified about 15 the first threat A Yes. 17 Q -- that you received face to face? 18 A Right. That was not an Amway employee either. 19 That was a kingpin Amway distributor, and that was face to 20 face. 21 MR. LANDON: For the purposes of brief 22 housekeeping matter, there are some issues related to 23 argument on that particular point and some other issues that 24 I would prefer to reserve until after testimony is over, if 25 that is acceptable? Page 60 1 THE COURT: Okay, I'm not sure what 2 you're referring to, but typically we're not going to have 3 argument until we finish testimony. 4 MR. LANDON: Yes, that's my -- I guess 5 that's my question. Are we going to have argument after the 6 testimony is finished? 7 THE COURT: Yes. 8 MR. LANDON: Okay. 9 THE COURT: And that normally is the 10 procedure. We hear testimony then we let counsel summarize 11 with their argument. 12 MR. LANDON: Very good. Thank you. I 13 believe that's all I want to ask Mr. Scheibeler, but let me 14 look just to make sure. 15 BY MR. LANDON: 16 Q And just to summarize, Mr. Scheibeler, what is it 17 exactly that you're asking the Court to do today? 18 A To allow me to have the case before a judge or a 19 jury so I retain my right to free speech and to continue 20 consumer advocacy work. 21 Q And it's your desire to prevent the arbitration? 22 A Yes, and to prevent the fraud from continuing so 23 what happened to Patti and I don't happen to other people. 24 MR. LANDON: That's all I have for Mr. 25 Scheibeler. Page 61 1 THE COURT: You may cross-examine. 2 MS. MILLER: Thank you, your Honor. 3 Your Honor, we have a set of exhibits, Defendant's Exhibits 4 1 through 35, and I don't expect that we'll -- actually 1 5 through 36. I'm not sure that we'll need them all but we do 6 have a set, and Mr. Carlucci will help me get those 7 organized. 8 THE COURT: Okay, that's fine. 9 MS. MILLER: We've already given counsel 10 a set. 11 MR. LANDON: We have not reviewed these 12 ahead of time and there may be objections to specific 13 documents. 14 THE COURT: We'll go through them as 15 they're offered. 16 MR. LANDON: Yes, I'd prefer if we just 17 went through them as they're offered. 18 MS. MILLER: I'll certainly give them to 19 the witness one at a time. I just wanted to give them to 20 you in advance. 21 MR. LANDON: I understand. 22 MS. MILLER: Your Honor, if I could 23 approach the witness. 24 THE COURT: You may. 25 MS. What's amazing is how accurately it captures the deceptive world of the MLM industry and yet handles it in comedic and sometimes poignant fashion. Every victim of an MLM will see a character they know in this film. I give "Believe" a whole hearted two thumbs up! Don't miss it! See the movie if you can. Download a ticket to the screenings at Big News in the UK - Double Diamonds Fred and Linda Harteis are coming from America to speak to trusting UK distributors. They will be at the Telford International Centre October I have received trestimonials from a good number of former Harteis downline (UK & US), some of whom claim to have lost tens of thousands of dollars in the Harteis' "success system" and are willing to testify. A reliable source advised that public discolsure of the losses of many of his downline forced Amway/Quixtar to sanction Harteis and not allow him to sell millions of dollars of books, tapes, CDs, videos to his downline, most all of whom seem to be losing money. Another source advised that his son Fred Jr. set up shop to buy and sell tools to the group from Diamond Orrin Woodward's TEAM tool system. What is different? The strange thing is that a good number of TEAM victims are coming forward (also willing to testify)and providing me with testimonials showing significant Quixtar losses and the TEAM CD's provided to me promote the same "business model" that Harteis' did - which results in overwhelming losses for near all of the consumer investors induced to participate. The appropriate authorities have been notified in the UK as they may want to come hear Mr. and Mrs. Harteis speak on their "Amway" success. Quixtar hired the law firm Brinks Hofer to file a legal action against me to prevent me from speaking to the media and to eventually pull down

32 the we site and not have contact with you. We have a court hearing this coming Thursday. Me making the fact public that almost 100% of all of the millions of consumers recruited into the Amway/Quixtar motivational groups LOSE money is not good for recruitment. It is ironic that I am paying money in legal fees to defend my free speech to protect their loyal distributor force from being defrauded.
