5 1 Introduction The epsiplus National meeting 1 for Portugal was held on the 19 th September 2008 in Lisbon, Portugal. The agenda for the meeting appears within Annex 1 of this document. The PowerPoint presentations are available on the epsiplus website 2. All the materials from the meeting were posted to the epsiplus website by the 1 st October The language for the meeting was Portuguese and English. The meeting was sponsored and organised by. Arménio Castanheira, the Director-General of (IGP) opened the meeting, welcomed the delegates to the meeting and went on to describe the relevance and importance of the European Public Sector Information re-use Directive. Chris Corbin, epsiplus Analyst then outlined the economic objective of the Directive, reported on the current status across Europe with respect to the implementation of the Directive and the activities of the epsiplus Thematic Network. David Caldeira, Comissão de Acesso aos Documentos Administrativos (CADA) 4 outlined how the Directive has been transposed in Portuguese law. João Geirinhas, Secretary General of the European Umbrella Organisation for Geographic Information (EUROGI) presented EUROGI and outline the strategy and activities. Rui Pedro Julião, deputy Director of (IGP) António Arnaud, Universidade Nova de Lisboa provided an overview of the importance of Address registers and the associated quality measures. Anabela Pedroso, Agência para a Modernização Administrativa (AMA) was absent and as a consequence there was no presentation given. Each presentation was followed by a short question and answer session

6 1.3 Delegates The meeting was attended by 25 people, which included the organisers and speakers. The delegates represented 11 organisations. The attendance list appears within Annex 2 of this document. The delegates present were mainly from the public sector as shown in DIAGRAM 1. The meeting duration was 4.1 hours and DIAGRAM 2 shows the use of the time. I would first like to thank those colleagues that will make presentations: Dr Anabela Pedroso Prof. Dr. Anthony Arnaud Dr. David Caldeira Eng º João Geirinhas Prof. Dr. Rui Pedro Julião, and a special thanks to Chris Corbin, epsiplus participant in the project for taking the time to share with us the main project goals. 6

7 For all other guests the expression of our appreciation for having been with us in this workshop that has the modest aim of contributing a little to the disclosure of what is being done in Portugal and the European Union (EU) in promoting efficient reuse of public sector information. PSI Public Sector Information - PSI - are documents, databases and other information: weather, digital maps, traffic data, and other data, produced, collected and stored by public bodies and which are not constrained in its public dissemination by other specific regulations. The new information and communication technologies allow us to obtain, store, combine, analyze and disseminate information in a different way more efficiently, effective, economic and interactive than before. The combination of high quality public sector information with new information and communication technologies is creating a multitude of opportunities in their area of operation. Importance of PSI The importance of the PSI is thus in its economic value. The economic value of PSI is difficult to measure, however, a study of 2006 concluded that the overall size of this information in the EU amounts to 0.25% of total GDP of the EU (between 11 and 48 billion). A previous study done by the Commission in 2000, estimated the economic value of PSI in Europe, around 68 billion. The Directive Given the intrinsic value of the PSI Council and European Parliament adopted a Directive on the reuse of public sector information that sets out how the bodies should promote and increase the reuse of information (Directive 2003/98/EC of 17 November It was published in the Official Journal on 31 December 2003). The Directive is built around two key pillars of the internal market: transparency and fair competition. It sets minimum standards for the reuse of PSI across the European Union. In its preamble it encourages Member States to go beyond these minimum standards and policies of open data, to ensure a wider use of documents / information held by public bodies. The transposition of the Directive into Portuguese law is the publication of Law No. 46, on 24 August The project epsiplus The epsiplus project, funded by the econtentplus program, will promote the establishment of a thematic network to support the implementation of the European Directive on the reuse of public sector information (PSI) in the period preceding its revision in The epsiplus portal provides access to a wide range of knowledge emerging in this area for all EU member states and are of central importance for the officials of public and private sectors. While it promotes the public with the opportunity of any players can be involved in the debate on key issues related to the topic of reuse of public sector information. The epsiplus network has become a community sprouted among all European countries and that includes organizations and individuals who are stakeholders in PSI re-use public and private sectors. Thus the epsiplus is like a one stop shop for key information about the reuse of PSI throughout Europe. The IGP is, like most public bodies, a producer of information and then with clear responsibilities in compliance with existing rules regarding its reuse, not only in the aspect of producer, cited above, but with some frequency in the user. Moreover, the Institute is responsible for national implementation of the INSPIRE Directive (until May 2009) to the Portuguese law, a work that is at a crucial stage, and therefore it makes sense, in our view, for the promotion of this event now. 7

8 2 Legal and regulatory progress and impact One the 22 nd December 2006 the European Commission announced 5 that Portugal along with four other countries had failed to inform the Commission on the measures taken to implement the PSI Directive 2003/98/EC and as such had referred Portugal to the European Court of Justice. 6 The Ministry of Justice is responsible for the Directive 2003/98/EC and attends the European Commission PSI Group meetings held in Luxembourg. 2.1 Transposition status The Portuguese Government chose to amend the law on the access to administrative documents (LADA) in order to transpose the Directive 2003/98/EC (DIRECTIVA 2003/98/CE DO PARLAMENTO EUROPEU E DO CONSELHO de 17 de Novembro de 2003 relativa à reutilização de informaço es do sector público). The new Law No. 46/2007 of August 2007 (Lei n.º 46/2007 de 24 de Agosto) repealed the early laws on access to administrative documents. The law was published in the Official gazette 7 on the 24 th August 2007 and came into force on 1 st September Portugal notified the European Commission that transposition was complete and this is reflected on the European Commission PSI portal dated 7 th September Other Portuguese laws associated with access and use of public sector information include: Law 19/2006 of 12 June 2006 (Lei n.º 19/2006, de 12 de Junho de 2006) transposes Directive 2003/4/EC on public access to environmental information. (Directiva 2003/4/CE do Parlamento Europeu e do Conselho, de 28 de Janeiro de 2003, relativa ao acesso do público às informações sobre ambiente) Law 67/98 of 26 October 1998 (Lei n. o 67/98 de 26 de Outubro 98) transposes Directive 95/48/EC on personal data. (DIRECTIVA 95/46/CE DO PARLAMENTO EUROPEU E DO CONSELHO de 24 de Outubro de 1995 relativa à protecção das pessoas singulares no que diz respeito ao tratamento de dados pessoais e à livre circulação desses dados). The National Commission for Data Protection is responsible for the regulation of the law. (Comissão Nacional de Protecção de Dado) Complaints procedure The potential PSI re-user must first submit a complaint to the public sector body concerned. If the re-user is not satisfied then they may apply to the Administrative Court. Appeals may be made to the Comissão de Acesso aos Documentos Administrativos (CADA) that has the responsibility to oversee the implementation of the law 46/2007. The CADA has no powers of enforcement of the decisions (opinions) that they reach following a referral from a re-user. The CADA produces an annual report on its activities. A PSI re-user may also refer a complaint to Portugal s Ombudsman. (Provedor de Justiça) Impact of the PSI Law The materials presented during the meeting did not provide enough evidence to indicate whether law 46/2007 has had an impact. At the time of the meeting the law had been in force for just over a year. There is little evidence that the lead bodies on the re-use of PSI have promoted the re-use of PSI opportunity Complaints The meetings heard about two complaints that the CADA had considered related to the re-use of public sector information. 5 IP/06/ Diário da República, 1.ª série N.º de Agosto de

The opinions have been published on CADA web site Scope to extend the coverage of the Directive The subject was not considered by the meeting or raised during the meeting. 2.4 Strengths-Weaknesses Analysis Strengths No strengths identified Weaknesses No apparent leadership to maximise the awareness of the PSI Directive within the public sector or else where in society. No dedicated online information service on the implementation of the re-use of public sector information. 2.5 Future developments No future developments were identified

10 3 Public sector organization and culture change 3.1 General information Public Sector Number of Government Ministries (Refer Annex 4 of this report) 14 Administrative Districts within Portugal (Refer Section 7 of this report) Support and compliance Support for the Directive Compliance with the Directive The evidence presented and discussed during the meeting was not sufficient to ascertain how compliant public sector bodies within Portugal are at the current time with respect to the implementation of the PSI re-use framework. 3.3 Value chain Modernising government (egovernment) Portugal is actively involved in European Union egovernment initiatives, which includes the European Commission, Directorate General Enterprise and Industry led initiative IADBC 13 (Interoperable and Delivery of pan-european egovernment services to public Administrations, Business and Citizens) programme. The IDABC egovernment Observatory provides news and status reports on Portugal within the egovernment context. The IDABC has now merged into the epractice.eu portal 14 and the latest Country Report for Portugal was published in March The European Commission i2010 commissioned benchmark report published in June 2006 provides an indication of how Portugal compares with other Member States. 12 Portugal is actively involved in the European Environmental Spatial Data Infrastructure initiative (INSPIRE) with the (IGP) acting as the primary interface within Portugal. A report on the state of play as of December 2007 on the spatial data infrastructure initiatives within Portugal is available on the European Commission Joint Research Centre INSPIRE portal 17. Agência para a Sociedade do Conhecimento (UMIC) 18 The Knowledge Society Agency reports to the Ministry of Science, Technology and Higher Education. It is a public agency with a mission to coordinate the policies for the Information Society and mobilizing it through dissemination, qualification and research activities. It was created in January 2005, as a public institute with administrative and financial autonomy UMIC succeeded the Mission Unit for Innovation and Knowledge formerly operating, that was created in November 2002, within the Ministers Council Presidency. The Knowledge Society Agency mission has presently a reinforced relevance since the Portuguese Government Program for established a Technological Plan as the keystone of the Government s economic policy. This plan consists on a set of related policies and transversal measures guided by a vision of transforming Portugal into a modern knowledge society. The intentions of this plan are: * To mobilize Portugal for the information society; * To provide a new stimulus to entrepreneurial innovation; * To promote scientific and technological development; * To qualify human resources Public Sector Information Holders (IGP) The presentation tilted: Contributions to the re-use of geographic information in Portugal described IGP as a public sector information holder. IGP reports to the Secretary of State for Spatial Planning and Towns within the Ministry of Environment, Spatial Planning and Regional Development. IGP is governed by Law No. 133/2007 of the 27 th April National Authority for Geodesy, Cartography and Cadastre Implementation of national policy for spatial information. IGP besides its own projects and activities is also in external projects such as RENEP, SiNErGIC and SNIG. In response to the INSPIRE Directive IGP has brought online a service to view and down load maps titled: m@pas on-line. 19 SiNErGIC is the National System for the Management of Cadastral Information. The system ensures unambiguous identification of buildings and provides for the input and retrieval of standardised cadastral parcels and the associated information. The system is available for use by public sector bodies as well as enabling access to citizens and companies. The SNIG was established in the early 90 s and as part of implementing the INSPIRE Directive operates the Portuguese nation geoportal. 20 The portal states: The National Geographic Information System (SNIG) is the national infrastructure of spatial data and is intended to provide, from several points of access, the ability to search, view and explore geographic information on the national territory. It is also an area of contact that allows dynamic, articulate and organize activities related to this subject in Portugal and in the European directive INSPIRE (Infrastructure for Spatial Information in Europe). Catalog: Search the catalog of national geographic information. Viewer: View and combin maps of Portugal and the world from different servers. Applications: Directory of Internet issues for applications that allow view and analyze maps and applications of GIS, editors, etc.. Geocomunidade: Information and projects related to the activities of IG. INSPIRE Network. Be a partner in projects SNIG. Join the Forum SNIG. Channels of SNIG

13 Instituto de Meteorologia The Instituto de Meteorologia 21 reports to the Minister for Science, Technology and Higher Education. The Institutes web site makes no reference to the re-use Directive or the Portuguese transposition. The Institute provides two forms for use when ordering data (download). Statistics Portugal Statistics Portugal 22 statistical activity is governed by Law No 22/2008, 13 th May The lad (approves the general basis of the National Statistical System (NSS). The National Forest Authority (AFN) The National Forest Authority was referenced during the meeting discussions as a good example of a public body moving towards complying the PSI re-use Directive and the national transposition within Portugal. The AFN reports to the Ministry for Agriculture, Rural Development and Fisheries (MADRP) Public Private Partnerships No public private partnerships were identified during the meeting National Innovation Strategy The Agência de Inovação, SA 23 (Adi) supports an innovation network that promotes innovative companies and organizations. Adi is a state-owned agency funded by the Ministry of Science, Technology and Higher Education and the Ministry of the Economy and Innovation. 3.4 Impact of relevant initiatives No specific initiatives related to the re-use of public sector information were identify during the meeting. 3.5 Strengths-Weaknesses Analysis Strengths Portugal s history of working on and implementing spatial data infra-structures that has placed Portugal in a strong position when transposing and implementing the INSPIRE Directive Weaknesses The meeting did not identify any weaknesses. 3.6 Future developments None identified. 4 Encouraging the PSI re-use business 4.1 General Information Private Sector Number of SMEs (Approximate) (EUROSTAT 2005) 847,152 Number of employees within SMEs (EUROSTAT 2005) 2,268,940 Percentage of Enterprises using the Internet 90% Percentage of Enterprises using the Internet 76%

14 4.1.1 Private Sector Re-use examples No examples were referred to during the meeting. Publishing sector: Impresa 24, Portugal (The Chief Executive Officer of Impresa is the Chair of the European Publishers Council) 4.2 Potential for pan-european products The potential for pan European products was not discussed during the meeting. 4.3 Knowledge transfer between sectors - Associations Professional and Trade European Umbrella Organisation for Geographic Information (EUROGI) EUROGI is an epsiplus European Association Representative 25. The (IGP) sponsor the EUROGI Secretariat and provide the accommodation within the IGP offices in Lisbon. The EUROGI Secretary General outlined the EUROGI vision, mission, membership and the current activities with respect to the INSPIRE and PSI re-use Directives. EUROGI has since its inception focussed on policy related to geographic information much of which is held by the public sector. EUROGI is a network of network and one of the keys strengths is knowledge exchange and sharing. EUROGI has a written and published policy on public sector information that states: EUROGI supports the goal of ensuring that citizens and organizations must be able to access and re-use public sector information more easily and at a fair price, to allow the development of products and services which may stimulate the Knowledge Economy. EUROGI as been involved in the European Union agenda on the re-use of public sector information since the publication of the Green Paper on Public Sector Information (PSI): a key resource for Europe, back in The EUROGI perspective on the implementation of the PSI Directive across Europe was summarized as: Although INSPIRE was strongly related to the PSI there is a clear knowledge gap within the GI community of this relationship. The involvement of the GI community with the PSI Directive varies greatly between EU countries, from actively involved in the process where as in others there is no awareness or involvement. Differences in understanding of the PSI Directive have led to large discrepancies in the transposition into national laws. To address the above issues EUROGI as taken a number of actions, which include amongst others: PSI information dissemination particularly at the level of regional and local government. Production of case studies that re-use public sector information. Highlight the synergies between the INSPIRE and PSI re-use Directives. Inform other sectors and networks about PSI. Universidade Nova de Lisboa (UNL) Faculty of Computing Technology (FCT The Universidade Nova de Lisboa presentation titled: Building a National Address Infrastructure first outlined the importance of the Address Register within the context public sector information re-use. The real world Address commences life at the local level within the public sector but many of the related datasets and attributes originate from elsewhere in the public sector and civil society. A national Address Register Infrastructure policy needs to comply with the principle of collect once from the local level but to allow everyone in society to use the register as this improved the quality. That is the greater the use the more likely errors are spotted and corrected. Due to the ability to use the address to join data sets a national address register forms one of the base registers within the electronic infrastructures. The INSPIRE Directive recognizes this as the Address appears in Annex 1 the first set of data sets that will be brought into compliance with the INSPIRE data rules. In order to support cross-border solutions interoperability of national (Member State) address registers is seen as key and Portugal is participating in

15 the EC econtentplus funded project EURADIN European Address Infrastructure. EURADIN involves 30 partners from 16 countries, which again endorses the importance of the Address register. The presentation stressed the need for quality assurance processes to be followed during the construction, maintenance and archiving of an address. A number of examples were included within the presentation that described the poor quality of address data currently within Portugal. Reference was made to the ISO 9000 Quality standard and also the Information Quality Methodology (Dvir 1998) that is structure into three levels User satisfaction, User needs and metrics. One of the key messages from the presentation was the need to for cooperation especially amongst the public sector bodies and collaboration with society and others to share knowledge and best practice not just within Portugal but also across Europe and that the Universities have a key role in supporting the knowledge transfer processes. 4.4 Strengths-Weaknesses Analysis Strengths None identified during the meeting Weaknesses The presentations highlighted the low awareness of the economic benefit of re-using public sector information. The lack of a national Address register within Portugal. 4.5 Future developments Apart from the work underway on implementing the INSPIRE Directive within Portugal and the ongoing work towards a national address register no other developments were identified during the meeting. 5 The financial impact: pricing and charging 5.1 Impact on the PSI value chain Not discussed during the meeting. 5.2 Pricing and charging policies The meeting did not consider pricing and charging policies directly within the meeting Public Sector bodies The Instituto de Meteorologia web site refers the re-user to ECOMET 26 with respect to prices. The Statistics Portugal web site publishes a downloadable publication (available in Portuguese and English) titled: DISSEMINATION POLICY The 24-page document states on page 17 at bullet point 20: Further dissemination of statistical data produced by Statistics Portugal is free of charge, provided that information be accessed free of charge, the source identified and no restrictions imposed on its access. 5.3 Outstanding national policies No outstanding policies have been identified within the meeting. 5.4 Strengths-Weaknesses Analysis Strengths None identified during the meeting
