3 virginia law 2012 Old Dominion has seen several new cases and laws that lead the nation and help define the commonwealth s social and political future. Here are some of the year s most notable stories. Virginia lawmakers passed a strict new drunk driving law this year in an effort to reduce the number of repeat offenders caught while driving under the influence. The new law requires all first-time offenders to install in their car a blood-alcohol testing device that would lock the ignition if the driver were found to be over the legal limit. The apparatus, called an ignition interlock device, requires the driver to blow into a tube before it allows the car to turn on. Prior to the new law, the device was only required for repeat offenders or for first time offenders whose blood-alcohol level measured.15 or above (nearly twice the legal limit of.08). Now, all first time offenders will be required to use the ignition interlock every time they drive, for a period of six months. Users must also cover the $480 cost for the device s six-month installation. According to some critics, including Fairfax County Public Defender Todd Petit, the hefty fee could make it difficult for some offenders to comply. It s going to unfairly impact clients who can t afford interlock, as opposed to a more wealthy person who can pay for it and continue to drive to work, Petit told The Washington Post. That said, substantial evidence suggests that the devices are highly effective at combating drunk driving, which is why groups such as Mothers Against Drunk Driving and the Washington Regional Alcohol Program support the new law. Federal data shows that drunk drivers involved in fatal crashes were four times more likely to have a prior DUI conviction than were sober drivers. According to analysis by the Centers for Disease Control and Prevention, ignition interlock devices reduce recidivism by 67%. When you still have over 29,000 people arrested for DUI, what we have out there isn t working, Washington Area Regional Alcohol Program President Kurt Erickson told The Washington Post. The technology is proven effective and safe. It allows the offender to drive, earn a living, and go to his or her son s baseball game. Virginia is one of 17 states that require firsttime drunk drivers to equip their cars with interlock devices. They re a model for other states nationwide: A federal program would provide more than $20 million for highway and safety improvements from the National Highway Traffic Safety Administration to entice more states to add laws that target firsttime offenders. To See A Directory of All AV Preeminent Rated Attorneys visit Hope for the Wrongfully Convicted In April, Richmond resident Thomas Haynesworth was awarded over $1 million after serving 27 years in prison after being wrongfully convicted in a series of rapes that took place during the 1980s. Haynesworth s victory came after years of legal battles, following the discovery of new evidence after Haynesworth had already been convicted. Virginia Attorney General Ken Cuccinelli was among the attorneys who argued for Haynesworth s full exoneration. The Virginia Court of Appeals granted it in December. Haynesworth s exoneration proved that the laws that permit courts to overturn convictions work, Cuccinelli said in an interview with the Richmond Times-Dispatch. Current Virginia laws regarding wrongful conviction remain some of the toughest in the nation. After an individual is convicted of a crime, the defendant has 21 days to file new evidence of innocence. Since 2004, the only exception to this rule was in the case of DNA evidence. Cuccinelli, a state senator at the time, wrote and sponsored the law that added another exception for non-biological evidence. Still, Cuccinelli believes the law should be altered even more to make it less onerous to overturn wrongful convictions. What does this mean for their child, now and in the future? A person too young to be prosecuted for a crime is usually considered a juvenile offender. Each state has established a juvenile court system to handle youthful offenders. The goal of juvenile court is to rehabilitate rather than punish. For serious crimes, however, a juvenile can be prosecuted as an adult. Age Varies by State Most states define a juvenile offender as any person under age 18 who commits an act that would be considered a crime if the act was PAGE PROOF -- FOR APPROVAL ONLY kyle g. manikas CRIMINAL LAW Kyle G. Some states set the juvenile offender age at 16 and younger, while New York and North Carolina set the age at 15 and under. Juvenile Court Oversees Youthful Offenders A juvenile charged with committing a crime is sent to the state s juvenile court. Although each state has enacted its own rules, juvenile courts in general have wide discretion in handling cases involving youthful offenders. For example, the judge can evaluate whether the juvenile could benefit from a counseling program without the need for a formal court proceeding. Even after a formal proceeding, the juvenile court has various sentencing options, such as placing the offender in a group home or foster care, or ordering counseling, home detention or electronic monitoring. Because of the age of the accused, proceedings in juvenile court are not open to the public. Juvenile Offenders Can Be Transferred to Adult Court All states have laws that permit juvenile offenders to be tried as adults. This may be done in exceptional cases that usually involve a serious crime such as murder or in situations where the juvenile is a repeat offender. Twenty-two states and the District of Columbia have no age restrictions for transferring a juvenile offender to adult court. The remaining states set a minimum age for transferring a juvenile offender that varies from age 10 to age 15. Once a juvenile offender is tried as an adult, it s likely that the individual will be tried as an adult for any future offenses. Juvenile Records Can Be Sealed Records in juvenile court are not open to the public. After a youthful offender has become an adult, most states will allow juvenile records to be sealed or expunged in certain circumstances. This is not automatic. A written request must be made to the court. The court can order any government agency to seal or expunge juvenile court records. Non-government sources of the records, such as media reports, will not be sealed or expunged. 5 the process by which it s handled and the hoops you have to get through, I think, are worthy of reconsideration, he told the Richmond Times- Dispatch. Haynesworth s case demonstrated that the system is far from perfect, and Cuccinelli said he would continue to advocate for further improvements to the law. Legal Recourse for Wrongful Death of Unborn In April, Gov. Bob McDonnell approved a landmark bill that permits compensation for family members when an unborn child dies as the result of medical malpractice, domestic abuse, or negligence. Earlier law had allowed an expectant mother to recover damages for emotional distress after the loss of a fetus, but it contained no clause of action for wrongful death. The issue of how to apply the new law to an unborn fetus raises the legal question of when life begins. It has been particularly sensitive and contentious in Virginia, where a large number of the state s population historically has been pro-life; many believe that personhood begins at conception. Despite this popular sentiment, Virginia civil law has PAGE PROOF -- FOR APPROVAL ONLY not recognized wrongful death suits when the death occurs to a fetus. The new law has erased this discrepancy. Yet it doesn t specify the age at which a fetus will qualify for protection. With that omission, the Virginia legislature has signaled that any fetus would be considered a person and therefore subject to the new wrongful death clause from conception. The new law s lack of specificity stands apart from other jurisdictions, including Maryland and Washington, D.C., where the law states that the protected fetus must be viable to be considered a person. Virginia s new law gives expectant parents the right to sue for the wrongful death of a fetus, but it doesn t allow for a wrongful death suit to be brought against the mother. The bill passed easily by a margin of 33-6, after a personhood bill failed to become law a month earlier. That bill would have given a fetus the full rights of a person from the moment of conception. Taking on Intellectual Property Theft In October, Virginia received a grant worth nearly $215,000 from the U.S. Department of Justice to combat the purchase and sale of counterfeit and pirated products. The money is earmarked for specific programs and initiatives that protect copyrights, patents, trademarks, and other forms of intellectual property and trade secrets. This funding will help expand our partnership with Virginia State Police and other law enforcement in Virginia to combat criminal organizations who use IP theft to threaten our security, Virginia s Eastern District United States Attorney, Neil MacBride, said in a press release from the US Department of Justice. Faulty products, which can include improperly prepared counterfeit drugs, risk causing harm to consumers. In some cases, criminals use revenues from these activities to fund criminal enterprises and organized crime networks. According to the U.S. Department of Justice, IP crimes pose a threat to the financial stability of the country and can even threaten our national security. Authorities from the Virginia State Police will use the grant funds to train agents in the area of IP theft investigation and to fund overtime work for agents collecting evidence of IP theft. For example, could you benefit from an attorney who speaks a language other than English? There are two types of business lawyers: those who handle lawsuits (called business litigators) and those who primarily handle corporate and contract matters (called transactional lawyers). Some lawyers do both, but most of them tend to specialize in one area or the other. If you are forming a new business, a lawyer who handles business transactions may be your best bet. If you are starting up a small business where the ownership will be closely held, the organizational issues may not be too complicated and a sole practitioner or a lawyer in general practice may do a good job in representing your interests. Look at a full service firm that does both transactions and litigation to keep on retainer to anticipate your needs as your business grows. It may also be to your benefit to have access to lawyers with expertise in other areas affecting your business (for example labor or employment law, tax law, real estate law, banking and finance or intellectual property). Look to see if a lawyer is affiliated with associations that cater to legal issues affecting businesses. Having a lawyer who is involved in a chamber of commerce or other local organizations may also be a good sign, depending on your legal needs. Unless there are special circumstances, you ll want to hire a lawyer who is licensed to practice law in your state and has an office located near your principal place of business. Before you hire a lawyer: Ask for references you want to talk to people who can comment on the lawyer s skills and trustworthiness, such as other lawyers and banks. A business lawyer should also be able to give you the names of several CPAs as references. Find out if he or she has previously worked with venture capitalists or other financing sources. A great reference source for a good lawyer is word of mouth from satisfied clients. After getting appropriate consents, lawyers will sometimes develop a list of representative clients that they ll use for marketing and promotional purposes, and you might ask if it would be okay to contact some of them. You shouldn t be surprised, however, if the lawyer declines attorney/client privilege binds lawyers to strict rules. It may even cause you to question whether the lawyer would keep your legal matters confidential if he or she volunteers too much information about other clients. Ask about conflicts of interest. Does the lawyer represent any opposing parties or potential competitors? 7 CHALLENGING A WILL MAY LEAVE YOU WITH NOTHING challenging A WILL IS difficult, but it can be done. You can challenge a will if facts indicate that the will was not properly made or was the result of fraud, mistake, or improper influence on the person who made the will referred to as the decedent after death. A valid will requires that the decedent possessed testamentary capacity, sometimes referred to as having a sound mind, at the time the will was made. The decedent must also have met the state s minimum age requirement. Challenging a will on the basis of capacity typically requires showing that the decedent did not understand the nature and extent of the property or the identity of natural heirs. Typically, such a challenge requires medical evidence showing mental impairment. A challenge of undue influence means the decedent did not make the will of free choice, but solely due to the improper influence of another person. A common situation that leads to such a challenge is where a lone sibling cares for an infirm parent, and the caregiver sibling receives a greater portion of the parent s estate than other siblings. This is particularly true if the parent has changed his will while under the care of the sibling and if this fact was kept secret from the other siblings. Fraud, Mistake, or Other Factors A will can be challenged for fraud, such as when pages have been inserted after the decedent signed the will or the decedent s signature is forged. If the will was not executed properly, with only one witness signature when two are required, for example, the will can be challenged as invalid. Sometimes a will that has been previously revoked is mistakenly (or purposefully) submitted for probate. This version will be rejected when the superseding will is provided. You challenge a will by filing an appropriate petition in the state probate court that has control over the decedent s estate. The type of petition, the basis for the challenge, and the likely results depend on the state law where the court is located. Each state s law has its own rules, which can differ. Challenging a will because you believe your inheritance should be greater involves a risk of violating the no-contest clause. If you fail, the will is valid and the no-contest clause will prevent you from receiving the inheritance left to you. State law varies regarding the conditions under which a no-contest clause is valid.
