Washington Enacts Social Media Privacy Law Became effective on July 28, 2013 Law covers public employers (state, state agencies, and political subdivisions) Employers prohibited from asking for login information for applicant/employee s social media account Engaging in shoulder-surfing Compelling applicant/employee from adding an employer to social media account Require applicant/employee to change privacy settings 11
12 Washington Enacts Social Media Privacy Law Law does not apply to employersponsored social media accounts Employers that inadvertently receive an employee s login information may not use it Remedy for violation of law: Civil action Statutory damages of $500 Injunctive or other equitable relief Reasonable attorneys fees and costs Employee Recommendations Reference check policy should limit online posts (e.g., LinkedIn recommendations) Consider prohibiting social media recommendations without prior approval from HR Should be consistent with existing Company reference check policy Communicate with managers 12

21 Off-Duty Social Media Basic Rules Employees may use social media during non-work hours using personal resources Employer s interests arise when employee s association with the employer is identified, known, or presumed. Remember This Bottom line: employer has a duty to respond when knows or should have known about harassment or other risks Employer should investigate and possibly discipline for off-duty conduct that violates workplace policies But beware of protected concerted activity Follow the policy 21
22 PART 4: Public Employer Concerns Are Social Media Posts Public Records? Jerry Handfield WA State Archivist "If the posts are made or received in connection with the transaction of the agency s public business (such as providing advice or receiving comments about the agency, its programs, core business, etc.), then they are public records for the purposes of records retention and need to be retained for their minimum retention periods." 22

Vague rules or stipulations, without clarification or examples.
