1 Personal Auto Supplement California Supplement To The Personal Auto Program Program Eligibility All portions of the California ValuePlus Auto Product Guide and Premium Determination Section apply to the Personal Auto Supplement Program, except as outlined below. The Unigard Personal Auto Supplement Program is limited to offering coverage to non-good drivers except as defined below. For definitions of violations and accidents, refer to the ValuePlus Auto Product Guide. Refer to Rule 6. Driver Safety Record Plan in the ValuePlus Auto Product Guide for a definition of Principally At-Fault Accident. Refer to Rule 5. Classification for a definition of experienced and inexperienced driver. 1. Any experienced driver who has had four or more Driver Safety Record points, during the experience period, as described under the Conviction and Accident Points, Rule 6. Driver Safety Record Plan in the ValuePlus Auto Product Guide. 2. Any inexperienced driver who has had three or more Driver Safety Record points, during the experience period, as described under the Conviction and Accident Points, Rule 6. Driver Safety Record Plan in the ValuePlus Auto Product Guide. 3. Any driver who has had more than one dismissal (pursuant to the Vehicle Code) in the three years immediately preceding the effective date of the policy of a violation that would have resulted in the imposition of more than two violation points as described under Convictions and Accident Points, Rule 6. Driver Safety Record Plan in the ValuePlus Auto Product Guide. 4. Any driver who is principally at-fault in more than one accident, during the experience period, which resulted in bodily injury or death or bodily injury and property damage of $750 or more. 5. Any driver with an unverifiable driving record. 6. Any experienced driver who has been convicted of: a. more than one violation of Vehicle Code Cal. Veh. Code in the previous ten years, pertaining to certain violations of driving under the influence of any alcoholic beverage and/or drug; or b. one violation of Vehicle Code Cal. Veh. Code in the previous 36 months and has a total of three or more driver safety record points during the 36 month experience period. c. one violation of Vehicle Code Cal. Veh. Code within the period more than 36 months and up to ten years, and has a total of two or more driver safety record points during the most recent 36 month experience period. 2 Program Eligibility (Cont d) 7. Any inexperienced driver who has been convicted of any violation of the following Vehicle Code or Penal Code section in the previous ten years: Cal. Veh. Code 23152, pertaining to certain violations of driving under the influence of any alcoholic beverage and/or drug. 8. Any driver who has been convicted of a violation of any of the following Vehicle Code or Penal Code sections during the period beginning on January 1, 1999, or the date 10 years prior to the date of application for the issuance or renewal of the Supplement Auto policy, whichever is later, and ending on the date of application for the issuance or renewal of the Supplement Auto policy. a. Cal. Veh. Code 23140, pertaining to violations of driving under the influence of an alcoholic beverage by persons under 21 years of age. b. Cal. Veh. Code 23153, pertaining to certain violations of driving under the influence of any alcoholic beverage and/or drug resulting in bodily injury to any other person. c. Cal. Veh. Code 23550, pertaining to conviction of Section within ten years of three or more separate violations of Sections or , or Sections or 23153, or any combination thereof. d. Cal. Veh. Code 23566, pertaining to (1) conviction of Section within ten years of two or more separate violations of Section 23103, as specified in , or Sections or 23153, or any combination thereof; or (2) conviction of Section and the act or neglect proximately caused great bodily harm. e. Cal. Penal Code 191.5, pertaining to gross vehicular manslaughter in the driving of a vehicle where the driving was in violation of Section 23140, 23152, or of the Vehicle Code. f. Cal. Penal Code 192, pertaining to vehicular manslaughter involving driving a vehicle: (1) in violation of Section 23140, 23152, of the Vehicle Code and in the commission of an unlawful act, not amounting to felony, but without gross negligence; or (2) in violation of Section 23140, 23152, or of the Vehicle Code and in the commission of a lawful act which might product death, in an unlawful manner, but without gross negligence. 3 Driver Safety Record Plan The following is added to Rule 6.B.1. Driver Points: d. Driver Frequency Two additional points shall be assigned for any combination of three or more convictions and/or accidents which develop points in accordance with the above when the same person is operating the automobile in all three instances and they occur during the experience period. Certified Risks Financial Responsibility Laws Risks requiring Financial responsibility Filings may not be bound. Refer to Unigard. Premium Calculation Single Limit Liability, or Bodily Injury Liability and Property Damage Liability, Uninsured Motorist Bodily Injury, Uninsured Motorist Property Damage, Medical Payments, Comprehensive, and Collision premiums are determined as follows: 1. Refer to the Supplement Program eligibility rules to determine program placement. The premiums displayed in the Premium Determination Section are the base rates and are displayed on an annual premium basis. A six-month policy term deviation is applied to determine final six-month policy premium. All programs are based on these rates. 2. Determine the appropriate Base Premium for each coverage refer to the Base Premium Table. 3. Determine and apply Increased Limit Factor, if applicable refer to the Increased Limit Factor Table. Note: Refer to Increased Limit Factor Table for premium calculation steps for Combined Single Limit. 4. Determine the appropriate Driver Safety Record Points for each driver; refer to the Driver Safety Record rule in the ValuePlus Auto Product Guide or the Personal Auto Supplement Section. Refer to the Driver Safety Record Factors Table in the Premium Determination Section of the manual for the safety record factors based on total number of points assigned. 4 Premium Calculation (Cont d) 5. Determine estimated annual mileage and apply the appropriate annual mileage rating factor for each coverage. (Refer to the Annual Mileage Rating Factor Table in the Premium Determination Section for rating factors.) 6. Determine years of driving experience and other driver characteristics, such as gender, marital status, and principal driver status. Apply the appropriate driver characteristic factor for each coverage; refer to Years of Driving Experience, Gender, Marital Status Tables in the Premium Determination Section. 7. Determine and apply the appropriate vehicle usage factor for each coverage. (Refer to the Usage Rating Factor Table in the Premium Determination Section for rating factors.) 8. Determine the model year of the auto and refer to the Symbol Section for the appropriate symbol for each coverage based on the year, make and model of the auto. When an auto is not displayed on the symbol pages, a temporary symbol will be assigned based on the symbols shown for the latest model year that most closely matches the make, model, body style, engine size, engine type and number of wheel drive. Refer to the Model Year Factor and Symbol Factor Tables to determine appropriate factors and apply for each coverage. 9. Refer to the Frequency and Severity Band Descriptions to determine the appropriate frequency and severity bands to use and apply the appropriate: a. Frequency Band factor for each coverage b. Severity Band factor for each coverage 10. Determine whether the Multi-Car discount applies; refer to the ValuePlus Auto Product Guide, Rule 5.C.7.d. The factors are found in the Miscellaneous Discount Factor Table. Apply the appropriate factors for each coverage. 11. Apply the deductible factors to the comprehensive and collision premiums, if applicable. 12. Apply the Cross Sold Credit, if applicable. 13. Apply the Anti-Theft Credit to the comprehensive premium, if applicable. 14. Apply the Passive Restraint Credit to the medical payment premium, if applicable. 15. Apply the Renewal Credit, if applicable. 19. Apply the Accident Free Credit, if applicable. 20. Add expense fees, if applicable. 21. Apply the 6-month policy term deviation for each coverage.
