YA The undersigned is informed and believes that: COUNT 1 On or about November 24, 2012, in the County of Los Angeles, the crime of MURDER, in violation of PENAL CODE SECTION 187(a), a Felony, was committed by SHERRI LYNN WILKINS, who did unlawfully, and with malice aforethought murder PHILLIP MORENO, a human being. "NOTICE: The above offense is a serious felony within the meaning of Penal Code Section (c) and a violent felony within the meaning of Penal Code Section 667.5(c)." COUNT 2 On or about November 24, 2012, in the County of Los Angeles, the crime of GROSS VEHICULAR MANSLAUGHTER WHILE INTOXICATED, in violation of PENAL CODE SECTION 191.5(a), a Felony, was committed by SHERRI LYNN WILKINS, who did unlawfully, and without malice, kill PHILLIP MORENO, a human being, while driving a vehicle in violation of Vehicle Code sections 23140, and and said killing was the proximate result of the commission of an unlawful act, not amounting to a felony, and with gross negligence; and the proximate result of the commission of a lawful act which might have produced death, in an unlawful manner, and with gross negligence. 2 It is further alleged pursuant to Vehicle Code section 20001(c), that, after committing the above offense, the defendant fled the scene of the crime. COUNT 3 On or about November 24, 2012, in the County of Los Angeles, the crime of D.U.I. CAUSING INJURY, in violation of VEHICLE CODE SECTION 23153(a), a Felony, was committed by SHERRI LYNN WILKINS, who did unlawfully, while under the influence of an alcoholic beverage and a drug and under their combined influence, drive a vehicle and in so driving, concurrently did an act forbidden by law and neglected a duty imposed by law which proximately caused bodily injury to PHILLIP MORENO. COUNT 4 On or about November 24, 2012, in the County of Los Angeles, the crime of DRIVING WITH A.08% BLOOD ALCOHOL CAUSING INJURY, in violation of VEHICLE CODE SECTION 23153(b), a Felony, was committed by SHERRI LYNN WILKINS, who did unlawfully while having.08 percent and more, by weight, of alcohol in his/her blood, drive a vehicle and in so driving did an act forbidden by law and neglected a duty imposed by law which proximately caused bodily injury to PHILLIP MORENO. 3 COUNT 5 On or about November 24, 2012, in the County of Los Angeles, the crime of LEAVING THE SCENE OF AN ACCIDENT, in violation of VEHICLE CODE SECTION 20001(a), a Felony, was committed by SHERRI LYNN WILKINS, who did unlawfully, and knowingly, being a driver of a vehicle involved in an accident resulting in death to a person other than himself/herself, fail, refuse, and neglect to give to the injured person and to a traffic and police officer at the scene of the accident his/her name and address, the registration number of his/her vehicle, and the name of the owner of said vehicle; to exhibit his/her operator's license; to render reasonable assistance to the injured person; and perform the duties specified in Vehicle Code sections and It is further alleged pursuant to Penal Code sections (a) through (d) and 667(b) through (i) as to count(s) 1, 2, 3, 4 and 5 that said defendant(s), SHERRI LYNN WILKINS, has suffered the following prior convictions of a serious or violent felony or juvenile adjudication: Case No. Charge Code/Statute Conv.
