Excused Absences for Personal Reasons Students excused from school for justifiable, personal reasons shall be allowed to complete all assignments and tests missed during the absence which can be reasonably provided. Verification of illness, quarantine absence or professional visit is to be made in accordance with California Code of Regulations, Title 5, Section 421. Release of Pupils for Medical Services Pupils must present a note from a parent/guardian or evidence of a medical appointment to be released from school for medical services. Students will be encouraged to make confidential medical appointments during non-school time. Because Education Code Section 49602 requires counselors to keep confidential any information of a personal nature disclosed by pupils twelve (12) years of age and older, in cases where students refuse to have parent(s) involved and where appointments during the day are unavoidable, students will be released without parental consent, pursuant to Education Code Section 49602. Every effort will be made to encourage students to inform parent(s)/guardian of their medical needs. Parent(s) and pupils will be notified annually of this policy in accordance with Education Code Section 46010.1. Residence of Pupil for Attendance Area Purposes The residence of a pupil is ordinarily that of his parent(s) or guardian, and a pupil may not establish a separate residence solely for the purpose of attending a particular school. Nonimmigrant "F" Students Nonimmigrant "F" students may be enrolled in the high schools of the District, in accordance with provisions of permit issued November 9, 1953, File No. LOS 214F0282, Immigration and Naturalization Service, the United States Department of Justice. Alien students may be accepted solely for the purpose of pursuing a full course of study. Proof of acceptable adult sponsorship must be provided. Nonresident alien students who are eighteen (18) years of age or older will not be considered for issuance of Certificates of Eligibility (for nonimmigrant "F-1" student status). The Board is to be notified of all approved nonimmigrant students. Peace Officer's Authority to Interview and Remove Pupil from School The peace officer may interview students on school grounds. The principal or designee is responsible for locating students and making them available to the peace officer.
Peace Officer's Authority to Interview and Remove Pupil from School In interviews involving suspected child abuse, the peace officer or any child protective agency representative must inform the student of his/her option to be interviewed in private or to select any school staff member to be present at the interview as stipulated in Penal Code 11174.3. In all other cases it is the practice of the District to have the principal or designee present during the interview; however, peace officers have the authority to interview students without a staff member present after students have been apprised of their rights. A student may be taken into custody under PC 836 and WIC 305 and 625 by a peace officer as provided in Education Code Section 48906. When a principal or other school official releases a minor pupil to a peace officer for the purpose of removing the minor from the school premises, the school official shall take immediate steps to notify the parent, guardian, or responsible relative of the minor regarding the release of the minor to the officer and regarding the place to which the minor is reportedly being taken. However, when a minor has been taken into custody as a victim of suspected child abuse, the school official shall provide the peace officer with the addresses and telephone number of the minor's parent or guardian. It is the responsibility of the peace officer to take immediate steps to notify the parent, guardian, or responsible relative of the minor that the minor is in custody and the place where he or she is being held. Pupils Not Living with Parent or Legal Guardian Pupils moving into the Whittier Union High School District boundaries but not residing with a parent or legal guardian will be accepted for enrollment provided that: A. The student is living with a relative as defined by California Code of Regulations, Title 22, Section 87005 and a responsibility statement has been submitted. B. The person, other than a relative (as stated in A.) with whom the student is living, has a foster home license and a responsibility statement has been submitted. C. The student has legally been declared an emancipated minor. Pupils wishing to remain in the District when the parent or legal guardian moves from the District may be continued in enrollment in order to complete the semester or attend the senior year, provided one of the above three criteria is met. A student whose parent/guardian lives within the Whittier Union High School District may establish a residence in a non-parent home in accordance with the district responsibility statement. In this case, the student is required to attend the school of residence of the parent/guardian unless an intradistrict permit is granted.
Truancy Resolution The District is committed to reducing day-long and selective-by-period truancies. All unresolved truancies will be dealt with in accordance with District Administrative Regulation 5113.1, Truancy Resolution Procedures. Juvenile court authorities will be notified of the truancy, habitual insubordination or disorderly behavior for students under the courts jurisdiction and attending school as a condition of probation pursuant to Education Code 48267. Reg. 7-1-59 Revised 5-12-2015 Renumbered 2-8-11 AR 5113 General The principal shall establish and maintain an office that will properly account for the attendance of all pupils in accordance with existing laws and regulations. Accounting procedures shall be established with individual records of pupil enrollment, absence and attendance maintained in a central location. The apportionment attendance record of each pupil shall show date of entry, date of withdrawal, entry code and attendance classification as prescribed by the California State Department of Education Bulletin ATTENDANCE ACCOUNTING IN CALIFORNIA PUBLIC SCHOOLS. Apportionment attendance records for individual pupils and for each school will be tabulated by the Data Processing Department. The teacher shall maintain a daily record of absence and tardiness for each pupil in the teacher's record book. The teacher shall provide a written report for each daily period denoting those pupils who are absent. Excused Absences for Personal Reasons A student shall be excused from school for justifiable personal reasons, including, but not limited to, an appearance in court, observance of a holiday or ceremony of his or her religion, attendance at religious retreats, or an employment conference, when the absence has been requested in writing by the parent or guardian and approved by the principal or a designated representative. A student shall also be excused from school when he or she is the custodial parent of a child who is ill or has a medical appointment during school hours. A student whose absence is excused, shall be allowed to complete all assignments and tests missed during the absence that can be reasonably provided and, upon satisfactory completion, shall be given full credit therefor. The teacher of any class from which a student is absent shall determine the assignments the pupil shall make up and in the period of time the pupil shall complete those assignments. The tests and assignments shall be reasonably equivalent to, but not necessarily identical to the tests and assignments that the pupil missed during the absence. Release of Pupils for Medical Services An off-campus permit will be issued to students presenting a note from parents or evidence of a medical appointment. Evidence of an appointment may consist of written evidence or a telephone confirmation.
Absence for Apportionment Purposes No absence of a pupil enrolled for not less than the minimum school day shall be deemed to be an absence for apportionment purposes, except when such absence is equal to the total school day prescribed under Section 46141 of the Education Code. Classes for Adults and Continuation School Attendance shall be recorded in clock hours for each pupil enrolled and shall be reported to the principal at least once each week. No absence of a pupil enrolled in a class for adults, or in continuation school or class, shall be deemed to be an absence for apportionment purposes, except when such absence is equal to one clock hour. Special Education - Attendance Accounting Attendance accounting for pupils enrolled in special education classes shall be in the same manner as authorized for pupils enrolled in regular day classes of the same grade level. The apportionment record shall identify, by code number, the type of special education class in which the student is enrolled. Pupils Enrolled for Less Than the Minimum School Day Whenever a pupil is enrolled in a school or class for less than the minimum school day, attendance shall be on an hourly basis. Days of apportionment attendance for such pupils shall be computed by dividing the total hours of attendance by the hours equivalent to the minimum school day. No absence of such pupil shall be deemed to be an absence for apportionment purposes, except when such absence is equal to one full clock hour. Pupils Enrolled in Classes for Less Than One Full Clock Hour Whenever a regular day school pupil is enrolled in a class where the class period is less than one full clock hour, the class period shall be the period of attendance. No absence of such pupil shall be deemed to be an absence for apportionment purposes, except when such absence is equal to the full class period. The attendance accounting for such a class may be on either the positive or negative basis. Attendance Which May Not Be Credited No attendance for apportionment purposes may be counted, under Education Code Section 11251, for any period of time during a pupil's regularly programmed school day that the pupil attends a school-sponsored function or engages in a school-sponsored activity for which he/she pays an admission charge or participation charge, or because an admission or participation charge is paid. Only the actual attendance upon a school or class may be counted for apportionment purposes. Such apportionment attendance shall be computed on an hourly basis.
Attendance and Enrollment Report Procedure Annual and period reports of enrollment and attendance shall be prepared and filed in accordance with California State Department of Education Bulletin ATTENDANCE ACCOUNTING IN CALIFORNIA PUBLIC SCHOOLS. These reports are: 1. Monthly Attendance Summary 2. Report of Active Enrollment 3. First Period Report of Attendance for High Schools 4. Second Period Report of Attendance for High Schools 5. High School Principal's Annual Report 6. Composite Attendance Report for District Schedules for completion and filing attendance and enrollment reports shall be coordinated by a District staff member who shall be responsible for the accuracy and completeness of attendance reporting. No-Cost Interdistrict Agreements An interdistrict pupil transfer permit shall not be issued until after the required interdistrict agreements have been approved. A. Pupil Transfer Permits - Resident Pupils - Permits may be issued only to allow a pupil to complete the semester, to complete the senior year to graduate with his/her class or to provide for special adjustment cases where an intradistrict transfer is not feasible. When a pupil who resides in the high school attendance area requests a permit, the school concerned clears it with the school the pupil plans to attend. If the other school will accept him/her, the District administrator responsible for issuing permits is given the following information: Name of pupil Age Grade in school Present address Name of school and district he/she plans to attend Basis of request
The interdistrict permit shall be prepared in quadruplicate and distributed as follows: Receiving School two copies Sending School District Office Refer to the principal any questions as to whether or not the pupil's reason for wanting to attend another school is adequate. B. Acceptance of Nonresident Pupils - Nonresident pupils may be accepted to continue in attendance to allow a pupil to complete the semester; to complete the junior and senior years and graduate with his/her class; or to provide for special adjustment cases, requested by the district of residence. Permits shall be filed in the District Office by the school concerned. If the permit should come directly to the District Office, authenticity of the arrangements shall be verified with the school concerned. If the pupil is accepted, the high school concerned shall be notified in writing that a permit has been received and is on file. C. Pupils Not Living With Parent or Legal Guardian 1. Pupils moving into the Whittier Union High School District boundaries but not residing with a parent or legal guardian may be accepted for enrollment provided that: a. There is good cause for residence apart from a parent or legal guardian. b. Adult sponsorship and supervision are acceptable and a statement of responsibility from the adult is on file. c. An interdistrict permit is obtained for those whose parental or guardianship residence is in a district near enough to make it possible for the student to maintain a dual residence or live in the Whittier Union High School District for technical paper purposes only. 2. Pupils wishing to remain in the District when parents or legal guardian move from the District may be continued in enrollment in order to complete the semester or finish the senior year provided one of the above three criteria is met.
Intradistrict Permits Intradistrict Permits may be issued when in the best interests of the school and the pupil in accordance with Board Policy 3151, Superintendent's Authority. Requests that do not meet the exact authority as outlined in Board Policy 3151, Superintendent's Authority, must be referred to the Superintendent for Board approval. Procedure for intradistrict attendance transfers: 1. Ordinarily the parent of the pupil will initiate a request for intradistrict pupil transfer permit. However, the principal may initiate the request. The application for an intradistrict transfer permit is to be presented to the school of residence. 2. When the principals of the two schools concerned mutually agree that the request for intradistrict pupil transfer is in compliance with Board Policy 3151, Superintendent's Authority, each approves the application form which converts the application to a valid intradistrict pupil transfer permit. 3. When the application is not in compliance with Board Policy 3151, Superintendent's Authority, or when a principal deems the transfer to be other than in the best interest of the pupil, the application is referred, if this is the wish of the parent, to the Superintendent. 4. Unless the intradistrict transfer permit specifies a definite time limit, the transferred pupil becomes, in effect, a resident of the new school. It is anticipated that he/she will remain at the new school until the completion of his/her high school education. 5. The intradistrict pupil transfer permit is to be distributed as follows: School of Residence Receiving School Pupil's Folder Work Permits The issuing authority for work permits to pupils of the District is the Director of Categorical Programs. Transfer to Continuation School A pupil under 18 years of age who drops school to work full time must be transferred to a continuation class for four hours per week. The pupil involved is to be notified of his/her responsibility to attend continuation classes and is not to be issued a work permit until properly enrolled. The school involved is to notify the continuation school in writing of the pupil's transfer and forward the pupil's record to the continuation school.
Pupils under 18 years of age who are not working full-time and who are not in attendance on a regular day school program are to be enrolled in continuation classes for three hours per day. Exceptions to attendance in continuation classes may be made in strict accordance with the provisions of the Education Code Sections and Title 5. (See Education Code Sections 48400, 48410.) Requests for such exceptions are to be forwarded by the school concerned with proper documentation to the Assistant Superintendent, Educational Services, for approval prior to the granting of the exception. Non-Immigrant Student Attendance Policy Following is the procedure by which a non-immigrant student is to be approved for attendance: 1. The sponsor of the non-immigrant pupil is to submit a written request for admission of the pupil to the principal of the school. The request must contain the following information: Full name of applicant student Applicant's country of citizenship Applicant's date of birth Applicant's place of birth Applicant's address at time of application Sponsor's address Sponsor's telephone number, if any Applicant's educational goal Visa classification Admission number 2. The principal must be assured that the non-immigrant student is entering this country for educational purposes and is interested in educational achievement. 3. Information necessary to complete Certificate of Eligibility (I-20A-B/I-20ID) is forwarded to the Educational Services Division for processing on District form supplied for this purpose. 4. With the Superintendent or his designee's approval, a Certificate of Eligibility (for Non- Immigrant "F" Student Status), Form I-20A-B/I-201D United States Department of Justice, Immigration and Naturalization Service, will be issued. The Certificate of Eligibility may be presented to the sponsor, the applicant or the parent of the applicant. Upon presentation at the border, Form I-20A-B is processed by the Department of Immigration and mailed directly to the receiving school and form I-201D is given to the student.
5. With the Superintendent or his designee's approval, students eligible for and enrolled in the District's English as a Second Language (ESL) program may be issued a Certificate of Eligibility (I-20) based upon the following criteria: A. The student has demonstrated: Academic success in the ESL program Acceptable attendance Acceptable citizenship Positive attitude toward school B. The Director of the ESL program predicts: The student's probable success in the program The student may ultimately be mainstreamed 6. A Certificate of Eligibility (I-20) will not be issued: A. For the purpose of entering this country if placement in the ESL program is necessary. B. When an original I-20 is requested for a student 18 years of age, or older. 7. Transfer Student In order for an I-20 student to transfer from one authorized school to another the student must: A. Be attending a full course of study B. Notify school they are attending that they want to transfer It is the responsibility of the new school to: A. Verify the student was in a full course of study B. Determine student has notified the prior school they want to transfer C. Issue a new I-20 8. Upon receipt of the I-721 (Student Status Form), it is the responsibility of the school concerned to complete the form and verify the status of students enrolled on I-20's with the Immigration and Naturalization Services.
