Paid sick leave accrues at the rate of one hour per every 30 hours worked, paid at the employee s regular wage rate. ccrual shall begin on the first day of employment or July 1, 2015, whichever is later. ccrued paid sick leave shall carry over to the following year of employment and may be capped at 48 hours or 6 days. However, subject to specified conditions, if an employer has a paid sick leave, paid leave or paid time off policy (PTO) that provides no less than 24 hours or three days of paid leave or paid time off, no accrual or carry over is required if the full amount of leave is received at the beginning of each year in accordance with the policy. Usage: n employee may use accrued paid sick days beginning on the 90 th day of employment. n employer shall provide paid sick days upon the oral or written request of an employee for themselves or a family member for the diagnosis, care or treatment of an existing health condition or preventive care, or specified purposes for an employee who is a victim of domestic violence, sexual assault, or stalking. n employer may limit the use of paid sick days to 24 hours or three days in each year of employment. Retaliation or discrimination against an employee who requests paid sick days or uses paid sick days or both is prohibited. n employee can file a complaint with the Labor Commissioner against an employer who retaliates or discriminates against the employee. The first table outlines the functions which ental ssistants (), Registered ental ssistants (R), Registered ental ssistants in Extended Functions (REF), Orthodontic ssistants (O), and ental Sedation ssistants (S) are allowed to perform in California. The second table lists the duties Registered ental Hygienists (RH), Registered ental Hygienists in Extended Functions (RHEF), and Registered ental Hygienists in lternative Practice (RHP) are allowed to perform. These tables are intended to provide summary information to interested parties. It is not intended to cover all aspects of applicable laws or provide a substitute for reviewing the laws that are cross-referenced below. It is highly recommended that applicants and licensees review the actual text of the laws cited at the link provided below. If a duty is not listed in the sections of law cited below, the dental auxiliaries are NOT allowed to perform the duty. Under each category of dental auxiliary is one of the following notations: N means that the dental auxiliary is NOT permitted to perform the duty. means that the dental auxiliary may perform the duty under the irect supervision of a dentist, which means supervision of dental procedures based on instructions given by a licensed dentist who must be physically present in the treatment facility during the performance of those procedures. The duty must be performed pursuant to the order, control and full professional responsibility of the supervising dentist. Procedures performed by Registered ental ssistants in Extended Functions must be checked and approved by the supervising dentist prior to dismissal of the patient from the office of said dentist. C means that the dental auxiliary may perform the duty in the specified setting under the supervision of a dentist, Registered ental Hygienist, or Registered ental Hygienist in lternative Practice. G means that the dental auxiliary can perform the duty under the General supervision of a dentist, which means based on instructions given by a licensed dentist, but not requiring the physical presence of the supervising dentist during the performance of those procedures. This is not the same as the Without Supervision designation in the dental hygiene table. The supervising licensed dentist shall be responsible for determining whether each authorized procedure performed by a registered dental assistant should be performed under general or direct supervision, except as provided in Section 1777. The sections of law noted below are contained in the ental Practice ct located in Chapter 4, ivision 2 of the California Business and Professions Code (BPC) and in Title 16, Sections 1085-1089 of the California Code of Regulations (CCR). WS means the Registered ental Hygienist may perform this function without supervision of a dentist. Without supervision differs from general supervision in that the dentist has not examined the patient prior to the provision of the service.
