California Association of School Business Officials, CASBO, prides itself on providing the best resources to all of its members. This year, for the first time, we will provide FREE Professional Liability Excess Insurance to all CASBO Distinguished Access and Executive Access members. License #0451271

FAQs about CASBO s Professional Liability Excess Insurance Who is an insured by the policy? All Distinguished Access and Executive Access members of CASBO are covered while they are employed by a California public school or community college district, state college or university, or county office of education. What kinds of claims are covered by this policy? Claims or lawsuits arising out of your school business activities performed in the course of your professional duties as a full or part-time employee of a California public school or community college district, state college or university, or county office of education, but only if you also are a member of CASBO at the Distinguished Access or Executive Access level. What types of claims are typically not covered? The policy provides broad coverage, subject to certain exclusions, such as intentional acts, sexual abuse and misconduct, prior acts, medical malpractice and a few others. I m retired. Does this policy protect me? Yes, but only if you are providing school business-related consulting or short-term assistance services to a district that is covered by its own professional liability insurance policy; and you are a retired employee of a California public school or community college district, state college or university, or county office of education; and you are a member of CASBO at the Distinguished Access or Executive Access level. What insurer provides this coverage? Hiscox Insurance Company, Hiscox, provides coverage for this policy. Hiscox is domiciled and licensed in New York and conducts its business in California on a nonadmitted basis and has an A.M. Best rating of AXI. What should I do if I am sued or a claim is made against me? Immediately report the suit or claim to your district and/or CASBO.

If I m already covered by my district s liability program, what is the value of CASBO s program? This policy is in excess of all indemnification and insurance which is available to you through your district. In addition, there are several personal coverages available as detailed in the policy coverage section that are not normally provided by your district s program, such as ID theft legal services and a free confidential risk management and loss prevention consultation. Whom do I contact if I believe I may have a claim under this policy? You must cooperate with the insurance carrier in the defense, investigation and settlement of any claim, potential claim, breach, occurrence or other matter notified to the carrier, including but not limited to: 1. Notifying the insurance carrier immediately if you receive any settlement demands or offers; and sending the carrier copies of any demands, notices, summonses or legal papers; 2. Submitting to examination and interrogation under oath by the insurance carrier s representative, and providing a signed statement of your answers; 3. Attending hearings, depositions and trials; 4. Assisting in securing and giving evidence and procuring witnesses; 5. Providing written statements to the insurance carrier s representative, and meeting with such representative for the purpose of investigation and/or defense; 6. Providing all documents and information the insurance carrier may reasonably request, including authorizing the carrier to obtain records; and 7. Pursuing your right of recovery from others.

Policy COVERAGES Below is an overview of the policy highlights: Claims-made policy excess of your district s coverage subject to policy terms and conditions Program Limits $1,000,000 per occurrence limit with a $3,000,000 policy/program aggregate limit Criminal Actions Defense $5,000 per occurrence limit with a $25,000 aggregate Legal Services Due to Identity Theft $3,000 per occurrence limit with a $15,000 aggregate Defense of Licensing Proceedings $10,000 aggregate limit Bail Bonds $3,000 limit for each bond with a $15,000 aggregate Sexual Abuse and Molestation $50,000 per occurrence limit with a $250,000 aggregate Subpoena Assistance $10,000 aggregate limit Supplemental Payments Reasonable expenses, including loss of wages and a $250 travel per diem, if required to attend defense proceedings of a covered claim Policy is excess of $10,000,000 for actives and $50,000 for retirees. EXCLUSIONS The program provides excess coverage over your district s coverage. While there is broad coverage, the following exclusions are included in the program: Sexual misconduct Intentional acts Medical malpractice Misappropriation of funds Bodily injury / property damage Prior acts / notice / knowledge Antitrust / deceptive trade practices Breach of contract Breach of warranty / guarantee Criminal proceedings Employment-related liability Failure to maintain insurance or bonds Insured vs. insured Intellectual property Mold Pollution / environmental Privacy Subsidiary outside control of named insured Third-party discrimination All coverage is subject to policy terms and conditions on file with CASBO.
